RESOLUTION NO. 7209
A ESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON AWARDING A CONTRACT TO UTILITY
BO ING FOR VERNON GAS DISTRIBUTION SYSTEM
PHASE III IN ACCORDANCE WITH CONTRACT NO. 540
OF'THE CITY OF VERNON AND APPROVING THE
EXtCUTION OF SAID CONTRACT
WHMREAS, the Department of Community Services and Water
has developed bid specifications for Vernon Gas Distribution
System Phase'III, which are contained in Contract No. 540; and
WH�EREAS, the Phase III project is a continuation of the
Phase II project, involving the same construction techniques, some
of which arehighly technical and specialized; and
WH�EREAS, Contract No. 540 was originally awarded to De
La Cruz Construction on April 27, 1998, but said award was
subsequently rescinded pursuant to Resolution No. 7199 due to De
La Cruz inability to perform the work; and
WHEREAS, the plans and specifications for Contract No.
540 have since been revised, and said contract, as revised, has
been presented to the City Council; and
WHEREAS, Utility Boring, Inc. has provided the City with
a bid dated July 28, 1998 (the "Bid"), indicating it is willing to
perform the Work required by Contract No. 540, as revised, for the
total sum ofl',Three Million Twelve Thousand Nine Hundred One
Dollars and Torty Cents ($3,012,901.40); and
WHEREAS, Samuel Kevin Wilson, Director of Community
Services & W ter, has recommended that the City Council award
Contract No. 540, as revised, to Utility Boring, Inc., in the
amount quote in the Bid; and

WHEREAS, it is in the public interest and necessity
that Contract No. 540 for Vernon Gas Distribution System Phase
III, as revised, be awarded to Utility Boring, Inc., without
necessity of formal bids, as provided in Section 2.27(a) of the
Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City Council hereby approves and accepts
Contract No. 540, as revised.
SECTION 3: The City Council of the City of Vernon
hereby awards Contract No. 540, as revised, to Utility Boring,
Inc., in the total sum of Three Million Twelve Thousand Nine
Hundred One Dollars and Forty Cents ($3,012,901.40), in accordance
with the recommendation of Samuel Kevin Wilson, Director of
Community Services & Water and the Bid submitted by Utility
Boring, Inc., dated July 28, 1998, a copy of which has been
presented to the City Council concurrently with this resolution,
and the City Council hereby orders the Bid and Contract to be
received and filed by the City Clerk.
SECTION 4: The City Council of the City of Vernon
hereby authorizes the Mayor and the City Clerk to execute said
Contract for, and on behalf of, the City of Vernon.

SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 18th day of August, 1998.
