INVESTMENTS, LLC. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2425 30TH STREET IN THE CITY OF VERNON WHEREAS, B. H. Investments, LLC. owns the property located at 2425 30th Street in the City of Vernon and is requesting,a variance from Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, the property is unique in that the existing building measures approximately 76,163 square feet, was built with 10 truck loading spaces and the building currently is used to manufacture yarn; and WHEREAS, Zoning Ordinance Section 26.4.2-7(b) requires 4 truck loading spaces for buildings with a gross floor area between 50,001 and 100,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8(c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long; and WHEREAS, Zoning Ordinance Section 26.4.E-4(c) of the Comprehensive Zoning Ordinance provides that a non- conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19' 21 22 23 24 25 26 27 28 WHEREAS, The applicant has permanently sealed 6 of the 10 truck loading spaces, leaving 4 open truck docks on the building; and WHEREAS, three of the four remaining truck loading spaces located on the north east section of the building are legally non -conforming and measure 10 feet in width, 65 feet in length, and have approximately 23 feet of maneuvering area; and WHEREAS, the remaining truck loading space, located on the south east section of the building, measures 50 feet in length and 12 feet in width which does not conform with the 65 foot minimum length requirement as stated in Section 26.4.2-8 of the Comprehensive Zoning Ordinance; and WHEREAS, 2425 30th Street is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, strict application of the loading space requirements of Section 26.4.2-8(c) of the Vernon City Code would create an unreasonable hardship, the existing use does not and will not adversely affect the surrounding area, and the use does not require the loading area specified by Section 26.4.2-8(c); and WHEREAS, the City Council has received a Staff Report dated September 8, 1998, upon which it has relied in making the foregoing recitals; and 1 2 3 4 5 6 7 8 9 1OI' 11 12 13 14 15 16 17 18 19 21 22 23 24 25 26 27 28 WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on September 22, 1998. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein -above are true and correct. SECTION 2: A variance from Section 26.4.2-8 of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long, is hereby granted for the parcel of property at 2425 30th Street. SECTION 3: The variance granted is subject to the following conditions: a) The ,applicant shall maintain a minimum of four recessed truck loading spaces on the property. b) The usage of all non -conforming truck loading spaces shall be limited so that no trucks parked at or using the loading space shall extend into the existing street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992. c) All existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases. -3- 27 28 d) This variance shall automatically expire at the time of any expansion or structural alteration of the building, or on August 19, 2009, whichever occurs first. At which time the use of the parking, access or loading area(s) allowed by this variance shall be discontinued unless brought into compliance with all applicable standards for parking, access and loading areas set forth in the Comprehensive Zoning Ordinance. It is the intent of the City Council that said parking, access or loading area(s) be treated in the same manner as a legal nonconforming use subject to section 26.4.E-4(b). SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of Zoning Ordinance Section 26.4.2-8 and the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. SKW:pp Attachments STAFF REPORT B. H. INVESTMENTS, LLC. 2425 30th STREET VARIANCE APPLICATION (September 8, 1998) B. H. Investments, LLC. has requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2-8, Development Standards for the property located at 2425 30th Street in the City of Vernon. The property had 10 non -conforming truck loading spaces. The two loading docks on the north west section of the building have been permanently blocked. On the west end of the property one truck loading dock has been permanently blocked. On the southern section of the building there are three permanently blocked loading doors. There are four open truck loading spaces remaining on the building. Three of these four spaces are legally non -conforming, dock high spaces, located on the north east section of the building. They measure 65 feet in length and 10 feet in width, and have approximately 23 feet of maneuvering area. The only other open loading door is located on the south east end of the property and fronts 30th Street. The space is recessed approximately 50 feet from the property line and measures 12 feet in width. Currently it is being used for storage and not as an active truck loading space. However, to remain open it requires a variance from dimensional requirements stated in section 26.4.2-8(c). The previous occupants, U.S. Building and Development occupied 200 square feet of the building for office use in 1994. A second occupant, Cafe Society, Inc. occupied 73,000 square feet of the building for office and distribution uses in 1993. The building has never been issued a variance in the past. The current occupant, Premiere Textiles (previously known as Millinneer Fibers, Inc.) was issued a temporary certificate of occupancy on February 17, 1998 to operate a yarn manufacturing company at 2425 30th Street, pending the approval of this variance. Premiere Textiles currently occupies the entire 76,163 square foot industrial building. The owners of the property, B. H. Investments, LLC., are requesting a variance from Section 26.4.2-8, Development Standards, pursuant to section 26.4.E-4(d) of the Comprehensive Zoning Ordinance. Currently, Premiere Textiles is only loading their trucks from the three truck loading spaces in the north east section of the building. The recessed truck loading space on the south east section of the building is currently being used for storage. However, the occupant is proposing to utilize the loading space in the future as needed. The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared and filed with the County Clerk. The facility complies with section 26.4.2-7(b) of the -2- i Comprehensive Zoning Ordinance requiring four truck loading spaces for buildings with a gross floor area between 50,001 and 100,000 square feet. The remaining truck loading doors have been permanently blocked and are not permitted to be utilized in the future. Staff proposes the following findings: a) As previously mentioned the building has one non- conforming truck loading space. Recessing the non -conforming truck loading space to meet dimensional requirements would cause a significant financial hardship to the applicant. b) This variance will not adversely affect the interest of the public or the interests of other residents and property owners within the vicinity of the premises because the applicant has agreed to use shorter trucks at the recessed truck loading space fronting 30th Street to ensure that vehicles will not extend into the street right-of-way while in the loading space. c) With the approval of this variance the facility meets the minimum number of truck loading spaces as required by section 26.4.2-7(b) of the Comprehensive Zoning Ordinance. The recessed truck loading space on the south east section of the building will require a variance to comply with minimum dimensional requirements set forth in section 26.4.2-8(c). The operation is in conformance with the Comprehensive Zoning Ordinance and General Plan.
