A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO AIRSEP
SYSTEMS, INC. FOR THE OPERATION OF A
RECYCLED MATERIALS PROCESSING
FACILITY AT 4405 FRUITLAND AVENUE IN
THE CITY OF VERNON
WHEREAS, AirSep Systems, Inc. has applied for a
conditional use permit to operate a recycled materials
processing facility at 4405 Fruitland Avenue; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on September 22, 1998; and
WHEREAS, the proposed site is in the General
Industry M Zone and Section 26.3.5-3 of the Comprehensive
Zoning Ordinance requires a recycled materials processing
facility obtain a conditional use permit; and
WHEREAS, the proposed site is adequate in size,
shape and topography for the proposed operation, has
adequate drainage, and landscaping, if required, will be
installed pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and by
residents to the south in the City of Maywood, and adverse
effects anticipated from the proposed operation have been
addressed in the mitigation monitoring program; and

WHEREAS, the existing site provides parking on -
site on Everett Court and additional parking on Fruitland
Avenue in the City of Maywood, and meets the minimum
required off-street parking and loading facilities for the
proposed project as required by the Vernon City Code; and
WHEREAS, the site has access to Everett Court and
the auxiliary parking lot has access to Fruitland Avenue and
traffic will generally travel either south from the site on
to Everett Court then to Fruitland Avenue or east from the
auxiliary parking lot on Fruitland Avenue and out of Vernon
to a landfill, and Everett Court and Fruitland Avenue are of
adequate size and pavement -type to handle the traffic
generated from the proposed operation.
WHEREAS, the Community Services Department has
performed an Initial Study to determine any potential
adverse impacts to the environment that the proposed project
may cause and has determined that the proposed project will
not have significant effect on the environment in this case
because of the mitigation monitoring program, and the
Director of Community Services & Water has recommended that
a Negative Declaration be adopted in compliance with the
California Environmental Quality Act; and
WHEREAS, the conditions and the mitigation
monitoring program imposed on the conditional use permit
will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the city of Vernon; and

WHEREAS, the proposed use, as to location,
operation and design is consistent with the General Plan and
Zoning Ordinance of the City of Vernon; and
WHEREAS, the City Council has received a Staff
Report dated September 17, 1998 upon which it has relied in
making the foregoing recitals; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
herein -above are true and correct.
SECTION 2: The City Council hereby finds on the
basis of the whole record before it (including the initial
study and any comments received) that there is no
substantial evidence that the project will have a
significant effect on the environment individually or
cumulatively, and that the mitigated Negative Declaration
reflects the City of Vernon's independent judgment and
analysis, and on the basis of said findings the City Council
hereby approves and adopts the Negative Declaration for the
project.
SECTION 3. Pursuant to Section 711.4(c) of the
Fish and Game Code, the City has found no evidence that the
proposed project will have the potential for adverse effects
on wildlife resources and the project is therefore exempt
from the fees otherwise payable under Section 711.4.

SECTION 4: Subject to the conditions and the
mitigation monitoring program set forth below, the
conditional use permit is hereby granted to AirSep Systems,
Inc. for the operation of a recycled materials processing
facility at 4405 Fruitland Avenue.
SECTION 5: In order to adequately protect the
public health and general welfare the following conditions
are required:
a. The facility shall be operated in accordance
with, and made to conform with all current codes, rules,
regulations and subject to permit fees as adopted by the
City of Vernon.
b. All required federal, state, local and
regulatory agency permits shall be obtained prior to
operation. Prior to occupancy a business license and
occupancy permit shall be obtained.
C. All required frontage improvements in the City
of Vernon shall be constructed and all existing cracked
sidewalk, curb and gutter adjacent to the site on Fruitland
Avenue and Everett Court, in the City of Vernon shall be
repaired and maintained to meet City Standards.
d. The facility shall be operated in a manner
which will not impede traffic on Everett Court or Fruitland
Avenue. Truck parking and loading shall only occur in the
lot located at 4405 Fruitland Avenue/5050 Everett Court
while automobile parking may occur in either the said lot or
the lot located on Fruitland Avenue in the City of Maywood.
No on -street parking or loading shall occur.

e. The proponent shall submit quarterly reports
to the Environmental Health Department on diversion and
disposal tonages.
f. All recyclable product waste containers which
are used to transport product to or from the facility shall
be water tight.
g. All transport vehicles used to deliver
recycled product to the facility shall be permitted by the
City of Vernon.
h. There shall be no storage of materials outside
of the AirSep Systems, Inc. building at 4405 Fruitland
Avenue
i. The authorized use shall be conducted at all
times with due regard for the character of the surrounding
area and shall not cause a nuisance to the neighboring
residences or businesses.
j. The facility shall be operated in compliance
with the "Mitigation Monitoring Program for AirSep Systems,
Inc., Recycled Material Processing Facility Located at 4405
Fruitland Avenue, Vernon, California" dated September 17,
1998

SECTION 6: The City Council hereby approves (1)
Mitigation Monitoring Program for AirSep Systems, Inc.
Recycled Materials Processing Facility Located at 4405
Fruitland Avenue Vernon, California, dated September 17,
1998, (2) City of Vernon Community Services Department Staff
Report on AirSep Systems, Inc. Conditional Use Permit to
Operate a Recycled Materials Processing Facility at 4405
Fruitland Avenue dated September 17, 1998, and (3) the
Environmental Checklist Form and Initial Study for the
project dated September 17, 1998. Copies of said documents
have been submitted to the City Council concurrently
herewith, and the City Clerk is directed to receive and file
them. Such documents and other materials which constitute
the record of proceedings in this matter shall be maintained
in the office of the City Clerk, who is and shall be the
custodian thereof.
SECTION 7: Noncompliance with the conditions set
forth in the conditional use permit shall be grounds for
voiding the permit pursuant to Section 26.5.2-10 of the
Comprehensive Zoning Ordinance.

SECTION 8: AirSep Systems, Inc. and any successors
in interest shall indemnify, hold harmless, and defend the
City of Vernon, its officers, agents, and employees from and
against any and all claims, complaints, or petitions for:
(1) damages, losses, expanses resulting from bodily injury,
sickness, disease, disability or death arising from the
operation of the facility excluding therefrom any such claim
resulting from the sole negligence or intentional wrongdoing
of the City of Vernon, its officers, agents or employees;
(2) a peremptory writ or other relief by way of injunction,
mandamus, or administrative mandamus; or (3) legal expenses
and attorney's fees incurred by the City of Vernon on behalf
of any party in such actions or proceedings. The City of
Vernon does not waive its right to participate in the
defense of any such action
SECTION 9: Not later than sixty (60) days from the
date of this Resolution, AirSep Systems, Inc., shall
indicate, in writing, its acceptance of and agreement with
the conditions contained in Section 5 of this Resolution and
the indemnification provision contained in Section 8 of the
Resolution.

SECTION 10: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

NOTICE OF INTENT
The City of Vernon has received an application for a
conditional use permit to allow AirSep Systems, Inc. to operate a
recycled materials processing facility located at 4405 Fruitland
Avenue. The applicant, AirSep Systems, Inc., is proposing to
accept a slurry of wet cardboard and plastic scraps which will be
sort into its primary materials, plastic and recyclable container
board. The manufacturers that delivers the slurry for recycling,
will pick up the separated material, including both the usable and
unusable portions of the slurry.
Please take notice that a recommendation from the Director of
Community Services will be made to the City Council of the City of
Vernon during the regular adjourned meeting on September 22, 1998
to adopt a Mitigated Negative Declaration in accordance with the
California Environmental Quality Act, since the issuance of the
conditional use permit will not have a significant effect on the
environment because of the mitigation monitoring program and the
conditions placed on the project.
A copy of the application and supporting evidence is available
for public review at my office between the hours of 7:15 a.m. and
5:15 p.m. Monday through Thursday.
You must submit written comments on these documents which will

permit) as well as with the General Plan, local codes and ordinances as they now exist. Building standards will, at a minimum,
conform to the building requirements of applicable codes and ordinances. The project is not in conflict with any environmental
plans or policies.
c) Affect agricultural resources or operations
(e.g. impacts to soils or farmlands, or impacts

c. The City of Vernon is an industrial city with no agricultural land use within its boundaries. Therefore, the project, as
proposed, will not affect agricultural resources or operations.
d) Disrupt or divide the physical arrangement of

d. The previous use of the building was industrial as is the surrounding uses in the area. The nearest residential unit is
approximately 500 feet south from the project's boundary. The site is surrounded by compatible uses and will not disrupt or
divide the physical arrangement of an established community.
H. POPULATION AND HOUSING. Would the proposal:
a) Cumulatively exceed official regional or local

site is currently vacant. The proponent is expecting to accommodate 2 employees at the new site to run the proposed facility.
No change in population or housing will occur as a result of the project. The project will not induce substantial growth directly
or indirectly.
c) Displace existing housing, especially affordable

c. The project will not displace housing, therefore there will clearly be no significant impact.
III. GEOPHYSICAL. Would the proposal result in or
expose people to potential impacts involving:

Special Studies Zones are known to traverse the City or the project area. The existing building was constructed in compliance

b. According to the California Division of Mines and Geology, the proposed project area is subject to liquefaction during
an earthquake. However, the proposed project is in an existing building that complies with 1990 seismic standards. No impact

c and d. The project is located in a densely developed central section of Los Angeles County. The project is at a
considerable distance from the ocean and any large bodies of open water, and is not subject to seiches or tsunamis. The project
area is flat, located away from hillsides, and is not affected by landslides or mudflows.
e) Erosion, changes in topography or unstable soil

as part of the proposed project. Therefore, this impact is considered less than significant.
Vernon is a fully urbanized industrial city. No geologic features exist within the project area. The channelized Los
Angeles River runs through the City, but the project will not affect the river.
IV. WATER Would the proposal result in:
a) Changes in absorption rates, drainage patterns,
or the rate and amount of surface runoff. ❑ ❑ X ❑
a. The project is located in a highly urbanized area and is served by the existing drainage system. The existing building
currently diverts rainwater to a culvert located in the shared parking lot between the two buildings on the lot. The culvert
connects to the storm drain on Everett Court. Since the site has historically been paved and developed, the possibility of an
impact associated with the change in the amount of surface water in any water body is negligible. The proponent shall be
required to construct all necessary drainage improvements in accordance with City standards and National Pollutant Discharge
Elimination System (NPDES) requirements if applicable. Therefore, no impact is predicted.
b) Exposure of people or property to water related
hazards such as flooding? ❑ ❑ ❑ X
b. According to the MEA`, the Los Angeles River flows through the City in a concrete channel. The river channel, in
conjunction with other major improvements in the region, has greatly reduced the probability of a major flood occurring in the
City of Vernon. However, intense thunderstorms of short duration have been known to occur and result in localized flooding
and ponding in areas extensively covered by buildings or paving. The project will include all necessary drainage
improvements to provide for adequate site drainage, in compliance with existing City Standards. Therefore, the proposed
project will cause no impact.
c) Discharge into surface waters or other alteration of
surface water quality (e.g. temperature, dissolved
oxygen or turbidity)? ❑ ❑ ❑ X
c. No surface water bodies are located near the project and the project is not expected to directly discharge into such
water or change the amount of any water bodies located in the vicinity.
The material to be received and processed by the applicant is non -hazardous. The building at 4405 Fruitland has no floor

drains. The sanitary drains at the restrooms and drinking fountain are the only connections to the sewer. No other waste shall
be discharged into the sewer system, therefore there will be no impact to surface water quality.
d) Changes in the amount of surface water
in any water body? ❑ ❑
e) Changes in currents, or the course or direction
of water movements? ❑ ❑
d and e. No surface water bodies are located near the project and the project is not expected to directly discharge into
such water or change the amount of any water bodies located in the vicinity. All construction will proceed in compliance with
NPDES requirements. Therefore, the proposed project will cause no impact.
f) Change in the quantity of ground waters, either
through direct additions or withdrawals, or through
interception of an aquifer by cuts or excavations? ❑ ❑ ❑
g) Altered direction or rate of flow of groundwater? ❑ ❑ ❑
f and g. The project is an existing industrial building with support structures above ground. No excavation or other
below -grade work will take place to affect quantity, direction, or flow of groundwater.
h) Impacts to groundwater quality? ❑ ❑ ❑
h. Typically, industrial activity involves the use, generation, storage, and regional transport of hazardous materials and
waste. The proposed project will be required to comply with the NPDES permit requirements and any conditions issued by the
Regional Water Quality Control Board. These requirements are designed to prevent groundwater pollution during both the
construction and operation of such development. The entire site will be paved, and there will be little percolation occurring.
Therefore, no impact is expected to occur from the proposed project.
V AIR QUALITY: Would the proposal:
a) Violate any air quality standard or contribute to
an existing or projected air quality violation? ❑ ❑ X ❑
a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600-square mile
area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air
quality in the basin is monitored by the South Coast Air Quality Management District (SCAQMD) at 35 monitoring stations
throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station
are used to characterize air quality in the City of Vernon.
The AirSep System includes a series of mechanical system which will separate a mixture of wet cardboard and plastic
packaging material. The process will involve a series of screw conveyors, industrial blowers, propeller fans, air separators, a
gas burner, and a baghouse. The SCAQMD has reviewed the proposed project and has separated the system into two sections,
each of which will require a separate permit. The applicant shall obtain all required air quality permits from the SCAQMD
District. The SCAQMD has advised the applicant that they may operate their equipment at the Fruitland location during the
time the Agency is reviewing the applicant's submittal data.
The applicant will generate a total of 8 - 10 truck trips per day at full capacity. This will not constitute a significant
impact nor cause an impact to air quality standards. Mobile sources of air pollution are negligible therefore there will be no
impact.
b) Expose sensitive receptors to pollutants? ❑ X ❑ ❑
b. The existing building at 4405 Fruitland has predominantly been used for industrial activity. The surrounding uses are
predominantly industrial with sensitive receptors (i.e. residential units) south of the proposed site. The residents are located
within one quarter mile of the project area (distance threshold established by the South Coast Air Quality Management
Districtf. . It is not expected that the proposed project will generate air toxic contaminants which could result in a health risk
for pollutants identified in District Rule 1401. An SCAQMD approved baghouse shall be installed as part of the AirSep
System to prevent pollutants from escaping into the environment. The baghouse filters shall be periodically tested by the
AQMD to insure compliance with air quality standards.
Although the AirSep System of separating plastics from cardboard is a prototype, it is not expected that any SCAQMD air

quality standards be violated. A Mitigation Monitoring Program shall be implemented to insure compliance with local, state
and federal air quality standards. All air quality complaints from local residents shall be routed to the City of Vernon
Department of Community Services and dealt with appropriately.
c) Alter air movement, moisture, or temperature, or
cause any change in climate? ❑ ❑ ❑ X
c. The proposed project will create no unusual conditions which could alter air movement, moisture, temperature, or
climate.
d) Create objectionable odors? ❑ ❑ X ❑
d. Incoming raw materials is essentially odorless unless it is allowed to sit stagnant or accumulate on -site for long periods
of time. The applicant has indicated that material will not be left on -site. It will either be processed or rejected upon arrival
and sent to its original destination, the landfill. In the event that objectionable odors are generated by the facility the applicant
has proposed using a citrus spray to avoid any possible impacts. Therefore, there will cause clearly be no significant impact.
VI. TRANSPORTATION/CIRCULATION.
Would the proposal result in:
a) Increased vehicle trips or traffic congestion? ❑ ❑ X ❑
a. The applicant hopes to negotiate one or more agreements with large recycled paper container board manufacturers
upon approval of their conditional use permit. The manufacturers would deliver the raw material to the proposed site and
pickup an equal amount of processed material. Each manufacturer may deliver 4-5 trucks to the site per day (4-5 inbound and
4-5 outbound trips per day). At full capacity, estimated to take 5 years, a maximum of two manufacturers are predicted to
generate a total of 8-10 truck trips per day (8-10 inbound and 8-10 outbound trips per day.)
The manufacturers that deliver the raw material to the project site are expected to be in the local area. The increase in
traffic trips is not significant and therefore will cause clearly be no significant impact.
b) Hazards to safety from design features (e.g. sharp
curves or dangerous intersections) or incompatible
uses (e.g. farm equipment)?. ❑ ❑ ❑ X
b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. No
safety hazard resulting from incompatible uses are expected.
c) Inadequate emergency access or access
to nearby uses? ❑ ❑ ❑ X
c. The proposed site includes an emergency access and access to nearby uses, as required by the City and the Uniform
Fire Code.
d) Insufficient parking capacity on -site or
off -site? ❑ X ❑ ❑
d. The building located at 4405 Fruitland Avenue is one of two building in a parcel. The two buildings are separated
between a single parking lot. The proposed use for the building requires 21 automobile parking spaces, 2 truck parking spaces,
and 2 truck loading spaces according to the City of Vernon Comprehensive Zoning Ordinance'. There are a total of 46
existing automobile parking spaces and 7 existing truck parking/loading spaces provided for both buildings. A portion of the
automobile parking spaces and all the truck loading/parking spaces are provided in the parking lot between the two buildings.
The remaining automobile parking is provided on a second parking lot, neighboring the subject parcel, located in the City of
Maywood. Both buildings comply with required truck parking/loading and automobile parking as stated by the Vernon City
Code.
The occupants of the second building located at 5050 Everett Court employ over 100 people. They utilize a majority of
the parking in the said lot, all the parking on Fruitland Avenue, and park along the public right-of-way. A Mitigation

Monitoring Program has been proposed to ensure that the applicant for 4405 Fruitland Avenue will not further impact the
parking or loading situation by requiring that all paring, loading and maneuvering be done on -site. Therefore, upon mitigation
the proposed use will cause a less than significant impact to required parking and loading.
e) Hazards or barriers for pedestrians
or bicyclists? ❑ ❑ ❑ X
f) Conflicts with adopted policies supporting
alternative transportation (e.g. bus turnouts,
bicycle racks)? ❑ ❑ ❑ X
g) Rail, waterborne or air traffic impacts? ❑ ❑ ❑ X
e through g. The proposed project area is surrounded by industrial uses with virtually no pedestrian traffic. The activity
at the site does not involve direct waterborne or air traffic. The project does propose some rail traffic in the future. However,
the project shall have no more than three rail cars exiting the site per week.
VII. BIOLOGICAL RESOURCES.
Would the proposal result in impacts to:
a) Endangered, threatened or rare species or their
habitats (including but not limited to plants, fish,
insects, animals, and bids)? ❑ ❑ ❑ X
b) Locally designated species

a. The existing building shall comply with all appropriate local and state energy conservation regulations.
b) Use non-renewable resources in a wasteful and

b. The proposed energy to be used by this operation is consistent with typical energy consumption rates of businesses in
Vernon. The facility will not use energy in a wasteful manner and there will be no impact to the City of Vernon Utilities
Department. Therefore, the impact will be less than significant.
IX. HAZARDS. Would the proposal involve:
a) A risk of accidental explosion or release of
hazardous substances (including, but not limited to
oil, Pesticides, chemicals or radiation)? ❑ ❑ X ❑
b) Possible interference with an emergency response
plan or emergency evacuation plan? ❑ ❑ ❑ X
c) The creation of any health hazard or
potential health hazard? ❑ ❑ X ❑
d) Exposure of people to existing sources

a, b, c, and d. Use and storage of hazardous materials at any facility within the City of Vernon is regulated by the local
Certified Unified Program Agency (CUPA) which is the City of Vernon Environmental Health Department. Existing
regulations and permitting requirements will be adhered to by the facility and this compliance will reduce potential hazards to
less than significant levels. A Hazardous Materials Establishment Permit, as required of all facilities within the City, shall be
submitted to and approved by the City of Vernon Environmental Health and Fire Departments. A Hazardous Materials
Establishment Permit shall include, but not be limited to, instruction and on-the-job training of employees to identify and
handle hazardous materials and shall be conducted by an individual knowledgeable in hazardous materials management. As
required by the Hazardous Materials Establishment Permit, a detailed log shall be maintained to account for and monitor all
hazardous material that is brought into, stored and leaves the site. All employees shall be trained by an individual
knowledgeable in hazardous materials management on how to properly maintain and clean accidental spillage both on and off -
site. The material shall be contained and removed as required by State Law and local ordinances. Therefore, this impact will
be less than significant. These requirements are standard requirements of facilities located within the City of Vernon to
regulate the handling and storage of hazardous materials involved in the everyday function of "non -hazardous" businesses.
This facility will not receive any hazardous waste as part of its processing.
All facilities within the City are regularly inspected by the Vernon Fire and Health Departments for code violations. The
inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully
manned hazardous materials unit. All personnel are trained in hazardous material response.
All flammable and hazardous materials including fuels, propane, lubricants, coolant, and solvents shall be stored,
contained, and monitored according to the 1994 Fire Code to reduce the risk of any exposure to hazardous materials.
To avoid any impacts to emergency response plans, the facility shall provide fire access as required by the 1994 Uniform
Fire Code. All queuing of vehicles shall be conducted on -site so as not to interfere with any emergency response traffic.
Therefore, there will be no impact.
e) Increased fire hazard in areas with flammable
brush; grass, or tees?

e. The existing building is located in a completely built -out urbanized area that does not contain flammable grass, brush,
or trees.
X. NOISE. Would the proposal result in:
a) Increases in existing noise levels?
b) Exposure of people to severe noise levels?

a and b. The project is within an industrial area and the majority of the surrounding uses are manufacturing and
warehousing which are not noise sensitive. However, there are sensitive receptors, i.e. residences, within one quarter mile (a
distance threshold established by the South Coast Air Quality Management District)^. It has also been indicated by the
applicant that they plan on operating 24 hours per day. This may increase ambient noise levels from existing conditions.
To mitigate the possibility of there being a noise impact a Mitigation Monitoring Program has been proposed. As part of
the Mitigation Monitoring Program all machines shall be located within the existing building at 4405 Fruitland Avenue. The
facility shall not exceed 65 dBA at the property line. The applicant has agreed to further reduce the impact of its operation on
the neighboring residential units by restricting the shipments and deliveries to the hours of 6 a..m. to 10 p.m.. An additional
mitigation proposed by the applicant is to inclose the machines, already inside the building, in a noise buffering casing. Upon
implementation of the Mitigation Monitoring Program the impact to existing noise levels will be clearly less than significant.
The machinery used to process the raw material inside the building may cause noise impacts on site personnel. To avoid
any hearing impacts an occupational noise study shall be conducted and a hearing conservation program shall be implemented
according to appropriate state and local agencies. Therefore, this impact will be less than significant.
XI. PUBLIC SERVICES. Would the proposal have an
effect upon, or result in a need for new or altered
government services in any of the following areas:
a) Fire protection?
b) Police protection?
c) Schools?

a through c. The existing building is located in a highly industrialized and developed area. The proposed project will
not pose a need for new or altered fire, police or school services within the City of Vernon.

d. The raw material delivered and picked up from the faculty shall be inclosed and covered with minimal risk of any
material spilling onto public roads. The applicant shall maintain all materials on -site and inside the inclosed building. No
material shall be allowed to migrate off site and onto public roads. The proposed operation will not pose any impact to public
facilities.

e. No impact on governmental services will result.
XII. UTILITIES AND SERVICE SYSTEMS. Would the
proposal result in a need for new systems, or
substantial alterations to the following utilities:

a. The existing facility is located in an area that is fully urbanized and served by an existing extensive electricity and gas
infrastructure. Implementation of the project is not expected to result in the need for new power lines or natural gas systems.

b. The proposed site will be served by existing communication systems. The telephone, cable, and other communication
systems are adequate and available to serve the proposed site. No need for new communication systems are required to serve
the proposed site.
c) Local or regional water treatment or

continue with the proposed site. All main lines are in place and the proposed operation will not require any additional services
beyond those presently offered. The proponent is responsible to contract for refuse disposal and will be served as needed.
Therefore, there will be no impact.
XIII. AESTHETICS. Would the proposal:
a) Affect a scenic vista or scenic highway?
b) Have a demonstrable negative aesthetic effect?

structures, and does not provide any scenic vista open to the public. The entire site is enclosed by a gate on the west side, a

any aesthetic impacts. Therefore, the proposed project will create no impact.
c) Create light or glare?

c. The site is located in an industrial area and lighting of facilities is common, therefore no impacts from light are

XIV. CULTURAL RESOURCES. Would the proposal:

a and b. The project will not result in an increase in residential population in Vernon. No impact on the demand for
recreation opportunities is anticipated. No parks or recreation facilities exist on the project site nor is one planed on the site.
XVI. MANDATORY FINDINGS OF SIGNIFICANCE.
a) Does the project have the potential to degrade the
quality of the environment, substantially reduce the
habitat of a fish or wildlife species, cause a fish or
wildlife population to drop below self-sustaining
levels, threaten to eliminate a plant or animal
community, reduce the number or restrict the range
of a rare or endangered plant or animal or eliminate
important examples of the major periods of
California history or prehistory? ❑ ❑ ❑ X
a. The City of Vernon is primarily made up of industrial and distribution type facilities with limited plant life. Plant life is
limited to non-native and ornamental species which are used for landscaping. Animal life in Vernon and nearby urban communities
consists of bird, reptile and mammal species that live in close proximity to man. There are no endangered species in Vernon. There
are no important examples of major periods of California history. Therefore, the proposed project will create no impact.
b) Does the project have the potential to achieve
short-term, to the disadvantage of long-term,
environmental goals? ❑ ❑ ❑ X
b. The proposed project is in conformance with the City of Vernon General Plan. The zoning of the site is M, which allows
a recycled materials processing facility with a conditional use permit. By properly implementing the mitigation measures
prescribed herein and in the mitigation monitoring program, the impacts associated with air quality, transportation, and noise can
be reduced to a level of clearly no significance. There will not be an impact on long-term environmental goals.
c) Does the project have impacts that are individually
limited, but cumulatively considerable?

incremental effects of a project are considerable
when viewed in connection with the effects of past
projects, the effects of other current projects, and

c. Cumulative impacts from this project are negligible. There are no other projects within the surrounding area that may result
in a cumulative impact. Traffic generated by the facility is minimal and will not overlap with other projects. The applicant shall
not impact parking and loading by following the conditions set forth in the proposed Mitigation Monitoring Program. By
implementing the mitigation measures as prescribed herein and in the mitigation monitoring program the cumulative impacts
associated with the project are clearly less then significant.
d) Does the project have environmental effects which
will cause substantial adverse effects on human
beings, either directly or indirectly? ❑ ❑ ❑ X
d. There are no environmental impacts caused by the project that will cause adverse effects on human beings.

NOTICE OF INTENT
The City of Vernon has received an application for a
conditional use permit to allow AirSep Systems, Inc. to operate a
recycled materials processing facility located at 4405 Fruitland
Avenue. The applicant, AirSep Systems, Inc., is proposing to
accept a slurry of wet cardboard and plastic scraps which will be
sort into its primary materials, plastic and recyclable container
board. The manufacturers that delivers the slurry for recycling,
will pick up the separated material, including both the usable and
unusable portions of the slurry.
Please take notice that a recommendation from the Director of
Community Services will be made to the City Council of the City of
Vernon during the regular adjourned meeting on September 22, 1998
to adopt a Mitigated Negative Declaration in accordance with the
California Environmental Quality Act, since the issuance of the
conditional use permit will not have a significant effect on the

PROJECT DESCRIPTION:
The applicant, AirSep Systems, Inc., has applied for a
conditional use permit to operate a recycled materials processing
facility at 4405 Fruitland Avenue in the City of Vernon. The
facility is subject to the California Environmental Quality Act.
An Initial Study, Negative Declaration and Mitigation Monitoring
Program have been prepared. The applicant is proposing to
negotiate contracts with a maximum of two large manufacturers of
recycled paper container board. The manufacturers will deliver a
slurry of wet cardboard and plastic scraps which will be sort into
its primary materials, plastic and recyclable container board.
Upon delivery of the slurry the manufacturers will pick up a like
amount of separated material, including both the usable and
unusable portions of the slurry. At full capacity the facility
will generate a total of 10 truck trips and have two employees
stationed at the site 24 hours per day, seven days per week.
FINDINGS:
The City Council of the City of Vernon has determined that
this project will not have a significant effect on the
environment. These mitigation measures and conditions are
designated to ensure protection of public health and the

An initial study has been conducted for the project in
compliance with the California Environmental Quality Act (CEQA)
which identifies potentially significant impacts on the

has been proposed to mitigate any potentially significant
effects. The project is consistent with the General Plan as
adopted by the City of Vernon.
Therefore, it is recommended that the City Council
determine:
1. That the project is consistent with the General Plan as
adopted by the City of Vernon.
2. That the project will not have a significant effect on
the environment.
3. That the project will not individually or cumulatively
have an adverse effect on wildlife resources.
Further, it is recommended that the conditional use permit
be granted subject to the following conditions:
a. The facility shall be operated in accordance with, and made
to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon.
b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to
occupancy a business license and occupancy permit shall be
obtained.
C. All required frontage improvements in the City of Vernon
shall be constructed and all existing cracked sidewalk, curb
and gutter adjacent to the site on Fruitland Avenue and
Everett Court, in the City of Vernon shall be repaired and
maintained to meet City Standards.
d. The facility shall be operated in a manner which will not
impede traffic on Everett Court or Fruitland Avenue and
parking and loading shall occur in either the lot located at
4405 Fruitland Avenue/5050 Everett Court or the additional
parking lot located on Fruitland Avenue in the City of
Maywood. No on -street parking or loading shall occur.
e. The proponent shall submit quarterly reports to the
Environmental Health Department on diversion and disposal
tonages.
f. All recyclable product waste containers which are used to
transport product to or from the facility shall be water
tight.
g. All transport vehicles used to deliver recycled product to
the facility shall be permitted by the City of Vernon.
h. There shall be no storage of materials outside of the AirSep

(September 17, 1998)
AirSep Systems, Inc. has submitted an application for a
conditional use permit to operate a recycled materials processing
facility at 4405,Fruitland Avenue. The building is currently
vacant. The previous occupant of the site was Fools In Love
Production, Inc. They used the building for film set
construction. The proposed applicant will use the facility to
separate a mixture of wet cardboard and plastic packaging
material into its primary constituents of usable paper fibers and
unusable plastics. The facility is proposing to eventually
operate 24 hours per day, seven days per week.
1. GENERAL PLAN The proposed use conforms to the
Zoning Ordinance and the General Plan. The site is located in
the M zone, General Industrial. A recycled materials processing
facility is allowed in this zone with a conditional use permit.
2. SITE The existing 20,893 square foot building in
question, is located on a 1.30 acre parcel. The parcel is shared
by two buildings of similar size that share a common parking lot.
A second parcel in the City of Maywood is used exclusively for
automobile parking. Both parcels together meet the minimum
required parking for both buildings. However, the second
building in the parcel, located at 5050 Everett Court, requires
more parking than provided and subsequently the employees park
along Everett Court and Fruitland Avenue. The applicant is aware
that a condition has been placed in the CUP that restricts
parking and loading to the two parking lots and no on -street
parking shall occur. The site in Vernon is of adequate size,
shape, topography and drainage for the facility located at 4405
Fruitland Avenue.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use. There are some
residential units approximately 500 feet south of the facility in
the City of Maywood. An initial study has been conducted for the
project in compliance with the California Environmental Quality
Act (CEQA) which identifies potentially significant impacts on
the environment from the project. A mitigation monitoring
program has been proposed to mitigate any potentially significant
effects to air quality, noise, and transportation/circulation.
With proper implementation of the Mitigation Monitoring Program
the impacts identified will have clearly no significant impact to
the environment.
4. ACCESS The site in Vernon has two driveways located on
Everett Court which access a parking lot located between 4405
Fruitland Avenue and 5050 Everett Court. They are both 27 feet
in width and will accommodate both automobiles and trucks. An
additional parking lot located on Fruitland Avenue in the City of
Maywood has one driveway located on Fruitland Avenue and will

only accommodate automobiles. Everett Court and Fruitland Avenue
are 60 and 50 feet wide respectively, and are of adequate size to
handle the traffic generated from the proposed operation.
5. VEHICLE MOVEMENTS The applicant is proposing to
negotiate a contract with Jefferson Smurfit Corporation, located
at 2001 57th Street, in the City of Vernon. Currently, the non-
recoverable material generated at Jefferson Smurfit Corporation
is collected into roll -off containers and shipped to a land fill.
AirSep Systems, Inc. is proposing to recycle this material and in
the process reduce the number of traffic trips to the landfill.
Currently, the trucks that deliver the non -recoverable material,
travel from Jefferson Smurfit Corporation to 55th Street to Santa
Fe Avenue to Fruitland Avenue and to the landfill site. AirSep
System, Inc. is proposing to occupy the existing building at 4405
Fruitland, located in the line of travel to the landfill.
Therefore, no excess truck traffic trips will be generated by the
proposed operation.
AirSep Systems, Inc. is also proposing to negotiate another
contract with a second manufacturer. This manufacturer has not
been determined but is expected to be in the local area, possibly
in the City of Vernon. The traffic trips generated by this
contract has not been determined. However, the combined total of
traffic trips generated by both manufacturers will not exceed 10
trips per day. This is not a significant number of traffic trips
and therefore no impact is expected to occur from traffic.
AirSep Systems, Inc. is proposing to have two employees

stationed at the site at any one time during operating hours, 24
hours per day, seven day per week. The number of traffic trips
generated by employee vehicles is negligible and no impact is
predicted.
6. OPERATIONS The applicant is proposing to negotiate
contracts with approximately two large manufacturers of recycled
paper container board. The manufacturers will deliver a slurry
of wet cardboard and plastic scraps which will be sorted into its
primary materials, plastic and recyclable container board. Upon
delivery of the slurry the manufacturers will pick up a like
amount of separated material, including both the usable and
unusable portions of the slurry.
After receiving the raw material from the manufacturers, it
is fed into a network of screw conveyors, industrial blowers,
propeller fans, air cyclones, a gas burner, a final separator and
a "baghouse" approved by the South Coast Air Quality Management
District. The entire system includes a series of high -velocity,
heated air streams, which are generated within each of the
cyclonic cones. The system then separates the feedstock into
separate containers of usable paper fibers and unusable plastics.
The facility is proposing to process between 2 and 4 tons
per hour of incoming material, 24 hours per day, 7 days per week.
The majority of the incoming material is water and may generate
liquid waste. The facility currently does not have any floor
drains and the applicant has indicated that waste water will not
migrate off -site. The AirSep System is designed to evaporate the

excess water in the slurry. The applicant is aware that they
must obtain a NPDES permit if required and that no waste water is
to migrate off -site and into the storm drain.
The AirSep System consists of air drying the slurry to
separate the plastic from the paper fiber. This may create a
noise impact to the employees on -site, business in the Cities of
Vernon and Maywood and the surrounding residences in the City of
Maywood, if not mitigated. AirSep Systems, Inc. performed a
preliminary noise study outside without any obstructions between
the noise source and receptor. It was determined that the system
generates approximately 65 dBA at 90 feet. The applicant has
been informed that they shall be limited to generating no more
than 60 dBA, measured from the property line. AirSep Systems,
Inc. shall submit a noise study at plan check and at 6 months to
insure compliance. If required, a hearing conservation program,
approved by the appropriate agency(s), shall be implemented and
noise buffers shall be installed to prevent any noise impacts to
neighboring properties.
As previously described, the AirSep System is designed to
separate the usable paper fiber from the un-usable plastics using
a series of high pressured heated air. A continuous forced
mechanical ventilation/exhaust system is proposed to be
installed. The air may include fine particles that may impact
air quality or create objectionable odors. A Mitigation
Monitoring program has been proposed to mitigate these potential
impacts. The AirSep System will include a South Coast Air

Quality Management District approved Baghouse to insure
compliance with air quality standards. The applicant has
indicated that a citrus spray may be used as needed to control
any objectionable odors. However, because the incoming product
will not sit stagnant or be stored at the facility, the applicant
does not predict any objectionable odors from their proposed use.
7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.

A. APPLICANT'S NAME AND PROPERTY DESCRIPTION:
The Applicant, AIRSEP Systems, Inc., is the lessee of an
existing industrial building of 20,893 SF, located at the
northeast corner of Everett Court and Fruitland Avenue,
whose address is 4405 Fruitland Avenue, Vernon, CA 90058.
The leased premises occupy the southerly portion of a lot
of 56,700 SF, "Parcel 1", which is legally described as
follows: That portion of lot 2 of Tract 5974, in the city
of Vernon, county of Los Angeles, state of California, as
per map recorded in book 69, page 67 of Maps, in the office
of the county recorder of said county. The above -described
property is also shown as a portion of Parcel 93 on map of
Region 48, Division 106, filed in book 3, page 29 of
Official Maps in the office of said county recorder. The
property upon which the leased premises are located also
includes "Parcel 2", which is joined to "Parcel 1",
pursuant to a Covenant and Agreement to Hold Property as
One Parcel, recorded in the official records of the county
of Los Angeles on May 31, 1990 as document 90-974502.
"Parcel 2" is described as follows: The east 60 feet of lot
1138, Tract 3607, in the city of Maywood, county of Los
Angeles, state of California, as per map recorded in book
38, page 86 of Maps, in the office of the county recorder
of said county.
B. APPLICANT'S REQUEST - USE OF PROPERTY:
The applicant requests a CONDITIONAL USE PERMIT to use the
above -described property for the following purpose: To
install and operate a highly cost-effective, energy -
efficient mechanical system which will separate a mixture
of wet cardboard and plastic packaging material into its
primary constituents of usable paper fibers and unusable
plastics. Using this installation as a "pilot plant", the
applicant hopes to negotiate one or more service agreements
with one or more of a number of large Southern California
manufacturers of recycled paper containerboard. The
applicant hopes to provide significant savings to its
potential clients by reclaiming and reusing the
approximately thirteen (13) to fifteen (15) percent of
their primary paper feedstock which is now being hauled to,

and disposed of, in local or regional landfills as
unusable, non -hazardous waste.
C. BURDEN OF PROOF:
The applicant shall indicate the following facts (attach
additional sheets if necessary):
(1) Adequate size and shape
That the site for the proposed use is adequate in size and
shape:
As attached hereto in Section 6. DEVELOPMENT/PLOT PLANS,
the applicant's leased building includes three truck access
doors and a parking/maneuvering area which will accommodate
the anticipated truck traffic onto and away from the site.
(2) Sufficient Street and Highway Access:
The applicant believes and states affirmatively that the
site has sufficient access to streets and highways and is
adequate in width and pavement type to carry the quantity
and quality of vehicles which will be required to support
the proposed use. Further, the applicant's use of the
property does not differ materially from similar uses and
operations now being conducted at neighboring properties.
(3) No adverse effect upon adjacent or abutting properties:
The applicant believes and states affirmatively that its
proposed use will not have an adverse effect upon adjacent
or abutting properties. The area is primarily industrial,
and the applicant's proposed use does not differ materially
from the current uses of adjacent or abutting properties.

capacity the facility will generate a total of 8 to 10 truck trips and have a total of two employees stationed at the site 24
hours per day, seven days per week.
This is to advise that the City of Vernon has approved the above described project on September 22, 1998 and has made
the following determinations regarding the above described project:

The city of Vernon has determined that the applicant's
proposed use of the premises is that of a "Recycled
Materials Processing Facility". The premises lie within
the city of Vernon's "M", General Industrial, Zone.
Section 26.3.5-3 of the Comprehensive Zoning Ordinance of
the City of Vernon provides that a "recycled materials
processing facility" may be permitted in the M Zone subject
to the approval of a conditional use permit as provided in
Section 26.5.2 of the above -referenced zoning ordinance.

D. ENVIRONMENTAL SETTING (Items 33. and 34.)
33. Description of project site:
As described above, the project site is an existing single -
story, concrete -masonry -unit industrial building with a
concrete slab floor. A slightly smaller, "mirror -image"
building (5050 Everett Court) faces the applicant's leased
building across a shared, gated, off-street parking area
whose dimensions are approximately 95' X 1471. Both
buildings and the common parking area were constructed in
1990. The site is flat and well -drained. The underlying
soil, paving and floor slab are solid and stable.
34. Description of surrounding properties:
The area surrounding the site is primarily urban industrial
and includes some commercial and residential occupancies,
as more specifically described on the radius map and
property owners' and tenants' lists included in Sections 2.
and 3. of this application. No rare or endangered plant or
animal species, cultural, historical or scenic aspects of
the neighborhood will be adversely affected by the
applicant's operations.

8. OPERATIONS REPORT
A. SYSTEM OVERVIEW
After approval of this conditional use permit, the
applicant plans to operate its "AIRSEP" mechanical materials
separation system at the subject site. The system is
designed to separate a mixture of wet cardboard and plastic
packaging material into its primary constituents of usable
paper fibers and unusable plastics. The system is highly
cost-effective and energy -efficient. The applicant hopes
to negotiate one or more service agreements with one or
more of a number of large Southern California manufacturers
of recycled paper containerboard. The applicant hopes to
demonstrate significant cost -savings to its potential
clients by reclaiming and reusing the approximately ten per
cent of their primary paper feedstock which is now being
hauled to, and disposed of, in local or regional landfills
as unusable waste.
After processing by the applicant, each client's trucker
would pick up the separated materials and return them to
the client's facilities. Upon its return from processing
by the applicant, the client would re -introduce the fiber -
containing portion of the separated materials into its
basic paper manufacturing apparatus, thus creating an
essentially closed -loop process.
The separating system includes a network of screw
conveyors, industrial blowers, propeller fans, air
cyclones, a gas burner, the final separator and a
"baghouse" final air filtration device. The system passes
the material through a series of high -velocity, heated air
streams, which are generated within each of the cyclonic
cones. The system then separates the feedstock into fiber -
containing and non -fiber -containing components, which are
deposited into separate containers, picked up and returned
by the client's hauler to its facilities.

input feeder by means of a Melroe "Bobcat" or similar
materials -handling device. After processing, the materials
are deposited by the final separation system into
individual containers. Containers of separated materials
are then picked up and returned to the client's plant by
its contracted hauler.
The applicant's materials separation system is highly
automated and computer -controlled. Moisture content and
density of the input material are carefully monitored by
the system's controls. The controls, in turn, vary the
system's feed rate, heat and airflow to precisely control
the moisture content of the materials to assure their
maximum separability.
After initial start-up and testing, the applicant
anticipates that two (2) full-time employees will feed,
operate and monitor the system during any one eight -hour
shift.
C. MECHANICAL OPERATION —CONVEYING AND MOISTURE CONTROL
After being loaded into the system's feeder collector
screw, the wet feedstock passes through the "fiberizer",
which breaks up large clumps of the material to enable its
• further transport through the system. The material then
moves through the system, propelled by a series of screw
conveyors. Moisture control within the system begins as
the screw conveyors introduce the wet feedstock into one of
three conical cyclonic "flash dryers". A relatively high -
velocity, low -temperature heated air stream is separately
ducted into each flash dryer. The high -velocity air stream
is generated by three centrifugal fans and is heated by a
"low-Nox" gas -fired burner. Within each conical dryer,
differential drag and shear forces on the materials begin
the separation process as evaporation of surface moisture
occurs within each cone. The processed product then drops
out the conical bottom of each dryer. The residual air
stream from each cone is discharged into another series of
high -efficiency cyclones, which collect any residual
particles which may be entrained within the discharge air
stream.
D. MECHANICAL OPERATION —CONVEYING AND SEPARATING
At this point in the process the material is still a blend
of both "desirable" (fiber -containing, damp paper) and
"undesirable" (plastic bag fragments) components.
Transported into the separator by the cross -incline and
separator feed screws, the material passes over a metering
reel, onto a "bumper roll" and into a diffused, controlled-

• velocity air stream, which is generated by a series of
vane -axial fans built into one end of the separator. The
lighter, plastic materials are blown by the air stream into
a shrouded container. A slightly negative air pressure is
maintained on the plastics container both to facilitate
separation and to collect any fine particles in an air
filtration "baghouse" which is attached to the plastics
container's enclosure. The heavier, damp, fiber -containing
paper material falls by gravity from the "bumper roll" into
the fiber discharge screw, which conveys and deposits the
now -separated fiber -containing material into one of two
containers for subsequent return to the client's plant.

• 9. HAZARDOUS MATERIALS REPORT
The applicant plans to store minimal quantities of
lubricants and fuel for its machinery and materials
handling equipment. The applicant will create an open,
ventilated and secured storage area to contain from two to
three propane cylinders outside the building. Normal on-
board quantities of automotive fuels and lubricants
(required to power and maintain the hauler's trucks) will
be transported through the city of Vernon (by others) in
support of this project. Proper handling of these fuels
and lubricants should not be the responsibility of the
applicant.

• A. OVERVIEW 5. TRAFFIC REPORT
As described in Section 8., OPERATIONS REPORT, below, the
applicant hopes to negotiate one or more service agreements
with one or more of a number of large manufacturers of
recycled paper containerboard to provide mechanical
separating services in support of the proposed client's
basic paper manufacturing activities. Such proposed,
generic agreements would provide that each manufacturer's
contracted trucking company may deliver up to fifty tons
(4-5 trucks) per day of its initially processed, primary
feedstock -- a mixture generally consisting of wet
cardboard and scraps of plastic packaging materials -- to
the applicant's processing facility at 4405 Fruitland
Avenue. After processing, the trucker would return a like
amount of separated feedstock to the manufacturer's
facilities. Prior to engaging AirSep Systems, Inc.'s
services, these materials are generally being trucked from
each manufacturer's facilities to various landfills as
unusable, non -hazardous waste.
B. PROSPECTIVE CLIENTS' TRAFFIC PATTERNS AND OPERATIONS
• Since the prospective clients and the locations of their
facilities are unknown at this time, it is not possible to
indicate specific routes between their operations and the
applicant's facility at 4405 Fruitland Avenue. The
applicant's prospective clients, however, typically receive
tons of reclaimed cardboard packaging materials each week,
primarily from local and regional retailers, which are used
as inbound feedstock for their containerboard-manufacturing
operations.
Each day these materials are unbaled and loaded into the
manufacturer's initial feedstock preparation system for
conversion into brown containerboard. The unbaled
materials are initially blended with water in a large
circular concrete tank to create a fiber -containing slurry.
Each bale, however, contains a certain amount of unusable
materials - primarily miscellaneous metal fragments,
plastic bags or other non -paper packaging materials --
which must be removed from the usable fiber -containing
feedstock slurry.
For each ton of dry mixed feedstock loaded into the system,
approximately thirteen to fifteen percent (13%-15%) is
mechanically screened out of the feedstock mixture because
• it contains excessive amounts of the unusable materials

. described above or has coagulated into "clumps" which are
too hard or too large to be further processed.

After screening and extraction of large amounts of
entrained water, the rejected materials are typically
loaded into "roll -off" containers of 640 cubic -foot
capacity, which are then transported to nearby landfills.
C. TRAFFIC PATTERNS AND OPERATIONS AFTER CUP APPROVAL
After approval of this conditional use permit the applicant
hopes to negotiate one or more service agreements as
described above. Such proposed, generic agreements would
provide that the applicant's operations will allow each
client to reclaim and reuse the material now being trucked
to landfills as unusable waste each day.
The distance between the applicant's proposed facility at
4405 Fruitland Avenue and each client's plant site is
unknown at this time. It is safe to assume, however, that
the distance between the applicant's proposed location and
each proposed client's facilities will be less than the
distance between the potential clients' facilities and the
local or regional landfills to which they must now haul
their unusable, rejected mixed feedstock.
