1 RESQLUTION NO. 7246 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING THE RELEASE OF VERNON'S INTEREST IN 4 AN ELECTRIC UTILITY EASEMENT AT 4425 BANDINI BOULEVARD 5 6 WHEREAS, the Southern California Edison Company ("Edison") 7 obtained an electric utility easement applicable to property located 8 at 4425 Bandini Boulevard, Vernon,, California, in order to provide 9 electrical service to electrical customers in Vernon, which was 10 recorded on June 13, 1957; and 11 WHEREAS, Edison and the City of Vernon ("Vernon") entered 12 into a settlement agreement in 1962, wherein Edison released all of 13 the claims it had on the Vernon Electrical System; and 14 WHEREAS, said releases were not recorded; and 15 WHEREAS, Energy Services, Inc. ("ESI"), a wholly -owned 16 subsidiary of Edison, entered into a maintenance and operation 17 agreement with Vernon to operate the Light and Power Department 18 effective on May 1, 1977, which was later terminated as of July 1, 19 1989; and 20 WHEREAS, Edison assigned and released all of its interest in 21 utility easements in Vernon which were needed to operate the Vernon 22 light and power system to Vernon and is willing to quitclaim their 23 interest in any such easements if Vernon no longer needs such 24 easements; and 25 WHEREAS, the Vernon Utilities Department has indicated that 26 there is no existing or future use for the electrical utility easement 27 located at 4425 Bandini Boulevard, Vernon, California, County of Los 28 Angeles, that would be needed by Vernon to operate the Utilities 1 Department or to provide electric service to Vernon customers; and 2 WHEREAS, the owner of said property is constructing a 3 building on said property and has requested that the utility easement 4 be removed; and 5 WHEREAS, Vernon desires to quitclaim its interests in the 6 electrical utility easement to the owner of the property and to assist 7 the owner in removing the grant of the original easement held by 8 Edison. 9 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 10 CITY OF VERNON AS FOLLOWS: 11 SECTION 1: The City Council of the City of Vernon does 12 hereby find and determine that the recitals contained hereinabove are 13 true and correct. 14 SECTION 2: The City Council of the City of Vernon hereby 15 approves the release and quit claim of Vernon's interest in an 16 electric utility easement at 4425 Bandini Boulevard in Vernon to the 17 owner of the property and to assist the owner in removing the grant of 18 the original easement held by Edison. 19 SECTION 3: The City Council of the City of Vernon hereby 20 authorizes the Mayor to execute a Quitclaim Deed and to execute any 21 other documents and to perform such other acts and deeds as may be 22 necessary or convenient to effect the purposes of this resolution to 23 assist the property owner to remove the easement from the property at 24 4425 Bandini Boulevard. 25 SECTION 4: The City Clerk of the City of Vernon shall 26 certify to the passage of this resolution and thereupon and thereafter 27 the same shall be in full force and effect. 28 -2- 1 APPROVED AND ADOPTED this 8th day of December, 1998. 2 LEONIS C. (Government Code Sections 27361, et seq.) A page is one side of a sheet 8 1 /2" x 14" or smaller. Effective July 1, 1994 a page is one side of a sheet 8 1 /2" x 11 If any page does not conform with these dimensions, there is a $3 extra charge for each page of the document containing the non -conforming page. INDEXING FEE (Government Code Section 27361.8) The charge for a document containing more than 10 names to be indexed will be the base fee plus $1 for each additional group of 10 names or portion thereof. REFERENCING FEE (Government Code Section 27361.2) The charge for a document containing references to previously recorded documents requiring additional indexing will be the base fee plus $1 for each additional recording reference other than the first reference, which is included in the base fee. PENALTY PRINT (Government Code Section 27361) In addition to the base fee, $1 will be added for each page on which penalty print appears. Penalty print consists of wording added to the printed form which is spaced either more than nine lines per vertical inch, or has more than 22 characters and spaces per inch measured horizontally, for not less than three inches in one sentence. This charge is not applicable to explanatory statements providing instructions for completion of the blank spaces of a printed form. 20 DAY PRELIMINARY NOTICE (Civil Code 3097) The filing fee for a 20 Day Preliminary Notice is $64. DISTRICT ATTORNEY FRAUD (Government Code Section 27388) $2 additional charge to the base recording fee for every Real Estate Instrument, paper, or notice, except any "DEED" subject to a Documentary Transfer Tax. UNIFORM COMMERCIAL CODE (Commercial Code 9403) The uniform fee for recording an original financing Statement, an Amendment, a Continuation Statement, a Termination Statement, a Statement of Release and an Assignment shall be twenty dollars ($20) if the statements are on a standard form prescribed by the Secretary of State and thirty dollars ($30) if they are not.
