RESOLUTION NO. 7256
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO POSTAL
FREIGHT, INC. FOR THE OPERATION OF A
TRUCKING AND FREIGHT TERMINAL AT 2065
ROSS STREET
WHEREAS, Postal Freight, Inc. has applied for a
conditional use permit to operate a trucking and freight
terminal at 2065 Ross Street in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a conditional use permit on
January 5, 1999; and
WHEREAS, the proposed site is a legal non -conforming
use in the General Industry (M) Zone which has been
continuously used as a truck and freight terminal previously
operated by Southern Counties Transportation and which
requires a conditional use permit under the Zoning Ordinance
in order to continue the use; and
WHEREAS, the proposed operation will include the
hauling and temporary storage of general products; and
WHEREAS, the proposed site is approximately 1.61
acres in size, and is adequate in size, shape and topography
for the proposed operation and has adequate drainage; and
WHEREAS, a barrier wall or landscaping has been
installed where parking or maneuvering area adjoin a public
street pursuant to the Vernon City Code; and

WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effects from traffic, parking, noise, odors, dust,
smoke, light or glare, or risk of fire, infection or explosion
is anticipated from the proposed operation; and
WHEREAS, the site has access to Ross Street and
traffic will generally travel from the site on Ross Street to
37th and then either to Alameda Street, thence north to freeway
access or to 37th Street, thence east to the 710 Freeway, and
the streets to be utilized within the City of Vernon are
sufficient to handle the traffic generated form the proposed
operations; and
WHEREAS, the site, as proposed, has ample room on -
site to provide adequate off-street parking and loading
facilities as required by the Vernon City Code; and
WHEREAS, the conditions imposed on the conditional
use permit will adequately protect the public health, safety
and general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the proposed use, as to location, operation
and design is consistent with the General Plan and Zoning
Ordinance of the City of Vernon; and
WHEREAS, the project is categorically exempt from
the California Environmental Quality Act as an existing
facility pursuant to Section 15301 of the California
Environmental Quality Act Guidelines and a Notice of Exemption
shall be filed with the County Clerk pursuant to Section 15062
of the California Environmental Quality Act Guidelines.

1 WHEREAS, the City Council has received a Staff
2 Report, dated on December 21, 1998 upon which it has relied in
3 making the foregoing recitals; and
4 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
5 THE CITY OF VERNON AS FOLLOWS:
6 SECTION 1: The City Council of the City of Vernon
7 hereby finds and determines that the recitals contained
8 hereinabove are true and correct.
9 SECTION 2: Subject to the conditions set forth
10 below, the conditional use permit is hereby granted to Postal
11 Freight, Inc. for the operation of a trucking and freight
12 terminal at 2065 Ross Street.
13 SECTION 3: In order to adequately protect the public
14 health and general welfare the following conditions are
15 required:
16 a. The facility shall be operated in accordance
17 with, and made to conform with all current codes, rules,
18 regulations and subject to permit fees as adopted by the City
19 of Vernon. All trucking operations, including truck and
20 trailer parking, shall be limited to the lot located at 2065
21 Ross Street in the City of Vernon.
22 b. All required federal, state, local and
23 regulatory agency permits shall be obtained prior to
24 operation. Prior to occupancy a business license and
25 occupancy permit shall be obtained.

l c. All parking and loading facilities shall be
2 paved with a hard durable surface material and shall be
3 adequately drained, and kept free of dust, mud, trash and
4 weeds. Where parking or maneuvering areas adjoin the public
5 street a barrier wall or landscaping shall be installed and
6 maintained to meet City standards. Adequate on -site parking
7 shall be maintained so that no on -street parking will occur.
8 d. The facility shall be operated in a manner that
9 will prevent unsanitary conditions, odors or other nuisances.
10 The property shall be provided with adequate refuse containers
11 and refuse disposal services.
12 e. The facility's buildings shall be structurally
13 maintained to exclude rodents and the property shall be
14 maintained rodent free.
15 f. Servicing of vehicles including washing, steam
16 cleaning and repairing shall be performed in facilities in
17 compliance with appropriate codes.
18 g. No equipment or freight shall be stored on the
19 site other than in buildings, trailers or on the docks.
20 h. A National Pollutant Discharge Elimination
21 System Permit shall be obtained from the California State
22 Board of Water Resources, if required.
23 i. Adequate plans and materials must be available
24 for handling leaks or spills from vehicles during storage or
25 transportation

I j. A hazardous materials permit shall be obtained
2 from the City of Vernon Environmental Health Department if
3 hazardous materials/waste are used handled or stored.
4 Hazardous materials/waste shall be handled and managed in
5 compliance with all appropriate federal, state and local laws.
6 k. The facility shall be operated in a manner that
7 will not impede traffic on Ross Street.
8 1. All existing cracked sidewalk, curb and gutter
9 adjacent to the site in Ross Street shall be repaired and
10 maintained to meet City Standards.
11 M. The site shall not generate more than 14 truck
12 trips (7 inbound and 7 outbound) per day.
13 SECTION 4: Postal Freight, Inc. and any successors
14 in interest shall indemnify, hold harmless, and defend the
15 City of Vernon, its officers, agents, and employees from and
16 against any and all claims, complaints, or petitions for: (1)
17 damages, losses, expanses resulting from bodily injury,
18 sickness, disease, disability or death arising from the
19 operation of the facility excluding therefrom any such claim
20 resulting from the sole negligence or intentional wrongdoing
21 of the City of Vernon, its officers, agents or employees; (2)
22 a peremptory writ or other relief by way of injunction,
23 mandamus, or administrative mandamus; or (3) legal expenses
24 and attorney's fees incurred by the City of Vernon on behalf
25 of any party in such actions or proceedings. The City of
26 Vernon does not waive its right to participate in the defense
27 of any such action

SECTION 5: Not later than sixty (60) days from the
date of this Resolution, Postal Freight, Inc., shall indicate,
in writing, its acceptance of and agreement with the
conditions contained in Section 3 of this Resolution and the
indemnification provision contained in Section 4 of the
Resolution.
SECTION 6: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

Postal Freight, Inc. has applied for a conditional use

After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:

AT 2065 ROSS Street
(December 21, 1998)
Postal Freight, Inc. has submitted an application for a
conditional use permit to operate a truck terminal at 2065 Ross
Street. They are an interstate trucking company on contract with
the United States Postal Service which provides pick-up and
delivery service. They are proposing to generate 20 vehicle
movements, including employees vehicles, out of the site daily.
The site was previously occupied by Southern Counties Transport,
another trucking company, that generated approximately 30 vehicle
trips per day. Postal Freight, Inc. will generate 10 fewer
vehicle trips per day then their predecessor.
1. GENERAL PLAN The proposed use is a grandfathered
nonconforming use in the General Industrial, M Zone, which has
been continually used as a truck terminal.
2. SITE The proposed site is adequate in size, shape and
topography for the proposed operation and has adequate drainage.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use. No potentially
significant impacts are expected to result from noise, odor,
dust, smoke, light or glare from the project. The project is
categorically exempt under Section 15301 of the California

Environmental Quality Act because it is an existing facility with
no expansion of use. A Notice of Exemption will be prepared.
4. ACCESS The site has access to Ross Street which is 60
feet wide. The street is of adequate size to handle the traffic
generated form the proposed operation.
5. VEHICLE MOVEMENTS Postal Freight, Inc. will operate
approximately five 28 foot vans and two 48 foot vans out of the
facility. They will arrive at the site between 6:00 p.m. and
11:59 p.m. daily from Alameda Street or Washington Boulevard to
37th Street and then to Ross Street. The out bound schedule
includes two 28 foot vans and two 48 foot vans that depart
between 7:00 a.m. and 9:00 p.m. daily from Ross Street and
proceed to either 37th Street then to Alameda Street or
Washington Boulevard.
6. OPERATIONS Postal Freight, Inc., will use the facility
to operate a trucking and freight terminal and maintain their
vehicles. Postal Freight, Inc. is a contractor to the U.S.
Postal Service and therefore, does not transport any hazardous
material. Other operational activities include sales and
customer service of existing freight customers. Postal Freight,
Inc. will also do light maintaining on their vehicles on -site.
7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.
8. CONDITIONS It is recommended that the following

ON POSTAL FREIGHT, INC.
CONDITIONAL USE PERMIT
TO OPERATE A TRUCK TERMINAL
AT 2065 ROSS Street

Postal Freight, Inc. has submitted an application for a
conditional use permit to operate a truck terminal at 2065 Ross
Street. They are an interstate trucking company on contract with
the United States Postal Service which provides pick-up and
delivery service. They are proposing to generate 20 vehicle
movements, including employees vehicles, out of the site daily.
The site was previously occupied by Southern Counties Transport,
another trucking company, that generated approximately 30 vehicle
trips per day. Postal Freight, Inc. will generate 10 fewer
vehicle trips per day then their predecessor.
1. GENERAL PLAN The proposed use is a grandfathered
nonconforming use in the General Industrial, M Zone, which.has
been continually used as a truck terminal.
2. SITE The proposed site is adequate in size, shape and
topography for the proposed operation and has adequate drainage.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use. No potentially
significant impacts are expected to result from noise, odor,
dust, smoke, light or glare from the project. The project is
categorically exempt under Section 15301 of the California

Environmental Quality Act because it is an existing facility with
no expansion of use. A Notice of Exemption will be prepared.
4. ACCESS The site has access to Ross Street which is 60
feet wide. The street is of adequate size to handle the traffic
generated form the proposed operation.
5. VEHICLE MOVEMENTS Postal Freight, Inc. will operate
approximately five 28 foot vans and two 48 foot vans out of the
facility. They will arrive at the site between 6:00 p.m. and
11:59 p.m. daily from Alameda Street or Washington Boulevard to
37th Street and then to Ross Street. The out bound schedule
includes two 28 foot vans and two 48 foot vans that depart
between 7:00 a.m. and 9:00 p.m. daily from Ross Street and
proceed to either 37th Street then to Alameda Street or
Washington Boulevard.
6. OPERATIONS Postal Freight, Inc., will use the facility
to operate a trucking and freight terminal and maintain their
vehicles. Postal Freight, Inc. is a contractor to the U.S.
Postal Service and therefore, does not transport any hazardous
material. Other operational activities include sales and
customer service of existing freight customers. Postal Freight,
Inc. will also do light maintaining on their vehicles on -site.
7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.
8. CONDITIONS It is recommended that the following

conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance.with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of.Vernon. All
trucking operations, including truck and trailer parking, shall
be limited to the lot located at 2065 Ross Street in the City -of
Vernon.
b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City
standards. Adequate on -site parking shall be maintained so that
no on -street parking will occur.
d. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.
e. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
f. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.

g. No equipment or freight shall be stored on the site
other than in buildings, trailers or on the docks.
h. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources, if required.
i. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
j. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/waste shall be handled and managed in compliance with
all appropriate federal, state and local laws.
k. The facility shall be operated in a manner that will not
impede traffic on Ross Street.
1. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
m. The site shall not generate more than 14 truck trips (7
inbound and 7 outbound) per day.
