Resolution No. 72650 1 2 3 4 5' 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7265 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO VERNON WAREHOUSE COMPANY TO EXPAND AN EXISTING ACCESSORY WAREHOUSE AT 2050 38TH STREET IN THE CITY OF VERNON WHEREAS, Vernon Warehouse Company has proposed to expand their existing 66,156 square foot warehouse by 24,038 square feet located at 2050 38th Street; and WHEREAS, Vernon Warehouse Company is an accessory warehouse to the facility located at 2305 through 2335 38th Street in the City of Vernon; and WHEREAS, the site is in the General Industrial (M) Zone and the project is a permitted use, with the approval of a conditional use permit as stated under Section 26.3.5-3 of the Comprehensive Zoning Ordinance; and WHEREAS, the Community Services Department has performed an Initial Study dated January 11, 1999, to determine whether the Proposed project will have adverse impacts on the environment and has determined that the proposed project will not have a significant adverse effect on the environment, and the Director of Community Services & Water has recommended that a Negative Declaration be adopted in compliance with the California Environmental Quality Act; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City of Vernon has provided notice of its intent to adopt a negative declaration for the Proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, the Proposed project, in terms of location, operation and design, is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the City Council has received a Staff Report dated January 28, 1999 upon which it has relied in making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct, and hereby adopts the same as its findings in this matter. SECTION 2: The City Council hereby finds on the basis of the whole record before it (including the initial study and staff report) that there is no substantial evidence that the project will have a significant effect on the environment individually or cumulatively, and that the Negative Declaration reflects the City of Vernon's independent judgment and analysis, and on the basis of said findings the City Council hereby approves and adopts the Negative Declaration for the project. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: Pursuant to Section 711.4(c) of the Fish and Game Code, the City has found no evidence that the proposed project will have the potential for adverse effects on wildlife resources and the project is therefore exempt from the fees otherwise payable under Section 711.4. SECTION 4: Subject to the conditions set forth below, the conditional use permit is hereby granted to Vernon Warehouse Company for the operation of an accessory warehouse in access of 50,000 square feet at 2050 38th Street. SECTION 5: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at or tied to 2050 38th Street in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. c. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Adequate on -site parking shall be maintained so that no on -street parking will occur. d. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. e. The facility's buildings shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. f. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. g. No equipment or freight shall be stored on the site other than in buildings, trailers or on the docks. h. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. i. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. j. A hazardous materials permit shall be obtained from the City of Vernon Environmental Health Department if hazardous materials/waste are used handled or stored. Hazardous materials/waste shall be handled and managed in compliance with all appropriate federal, state and local laws. The facility shall be operated in a manner that will not impede traffic on Alameda Street, 38th Street, or Ross Street. 1. All required frontage improvements shall be constructed and all existing cracked sidewalk, curb and gutter adjacent to the site on Alameda Street, 38th Street, and Ross Street shall be repaired and maintained to meet City Standards. The applicant shall reconstruct the curb return at the southwest corner of Ross Street and 38th Street to City Standards including the relocation of all utilities. In addition, a 115 by 2.5 foot wide strip of asphalt pavement in Ross Street's right-of-way shall be removed and replaced with a sidewalk that meets City Standards. M. The owner of the property shall provide to the City of Vernon a utility easement for the overhead electrical lines, a power pole, a transformer, and an anchor located on the applicants property in a form and manner subject to approval of the Director of Community Services and Water. n. The site shall not generate more than 70 truck trips and 35 automobile trips per day. o. The property owner shall provide to the City of Vernon a Grant Deed for the property necessary to enlarge curb returns at Alameda Street and 38th Street and Ross Street and 38th Street to current City Standards. -5- I SECTION 6: The City Council hereby approves (1) 2 City of Vernon Community Services Department Staff Report on 3 Vernon Warehouse Company dated January 28, 1999, and (2) the 4 Environmental Checklist Form and Initial Study for the 5 project dated January 11, 1999. Copies of said documents 6 have been submitted to the City Council concurrently 7 herewith, and the City Clerk is directed to receive and file 8 them. Such documents and other materials which constitute 9 the record of proceedings in this matter shall be maintained 10 in the office of the City Clerk, who is and shall be the 11 custodian thereof. 12 SECTION 7: Noncompliance with the conditions set 13 forth in the conditional use permit shall be grounds for 14 voiding the permit pursuant to Section 26.5.2-10 of the 15 Comprehensive Zoning Ordinance. 16 SECTION 8: Vernon Warehouse Company and any 17 successors in interest shall indemnify, hold harmless, and 18 defend the City of Vernon, its officers, agents, and 19 employees from and against any and all claims, complaints, 20 or petitions for: (1) damages, losses, expanses resulting 21 from bodily injury, sickness, disease, disability or death 22 arising from the operation of the facility excluding 23 therefrom any such claim resulting from the sole negligence 24 or intentional wrongdoing of the City of Vernon, its 25 officers, agents or employees; (2) a peremptory writ or 26 other relief by way of injunction, mandamus, or 27 administrative mandamus; or (3) legal expenses and 28 -6- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 attorney's fees incurred by the City of Vernon on behalf of 'any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 9: Not later than sixty (60) days from the date of this Resolution, Vernon Warehouse Company, shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 5 of this Resolution and the indemnification provision contained in Section 8 of the Resolution. SECTION 10: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Adequate on -site parking shall be maintained so that no on -street parking will occur. d. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. e. The facility's buildings shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. f. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. g. The expansion will allow Vernon Warehouse Company to store more product at their facility at 2050 38th Street while utilizing the 2335 38th Street facility for additional packaging. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan with a conditional use permit. The site is located in the M zone, General Industrial. An accessory warehouse in access of 50,000 square feet is permitted in the M zone with a conditional use permit. 2. SITE The existing 66,156 square foot building in question, is located on a 4.06 acre parcel. Currently the applicant owns and occupies the two neighboring parcels to the west and south. The applicant is proposing to tie the two additional parcels to the property in question. Upon approval of the Merger the entire parcel shall be approximately 8 acres in size. -1- 1#j 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. There are some residential units across Alameda Street to the West. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA) to identify potentially significant impacts on the environment from the project. The study failed to identify any adverse affects due to the construction and operation of the project. A notice of determination will be filed with the County Clerk. 4. ACCESS The sites have a total of two existing truck and automobile driveways located on Ross Street and 38th Street. The applicant is proposing to construct an additional driveway on Ross Street reserved for automobiles only. The site has ample room to provide required parking, loading and maneuvering for trucks and automobiles. The proposed project will comply with the Comprehensive Zoning Ordinance with approval of a conditional use permit and will be readily accessible from the three driveways. The site has access to 38th Street and Ross Street which are 60 feet in width each. Both streets are of adequate size and pavement type to handle the traffic generated by the new facility. As part of the proposed expansion the applicant shall be required to provide frontage improvements along 38th Street and Ross Street. The curb radius on the south west corner of 38th Street and Ross Street shall be enlarged to 60 feet from one point of tangency to the other. The property owner shall grant a -2- deed to the City for the enlargement of the curb radii at the corners of 38th Street and Alameda Street and 38th Street and Ross Street. The applicant shall also be required to relocate the power pole that will be affected by the proposed driveway on Ross Street. 5. VEHICLE MOVEMENTS During construction, traffic will increase slightly due to normal construction activities. This is consistent with the normal activities throughout Vernon and will not cause a significant impact. Currently, the total vehicle trips associated with the proposed facility consist of employee trips and truck trips. The facility currently generates 90 trips to the facility per day; 10 tractor trailers, 13 delivery trucks, 20 outside truck carriers, 3 miscellanies truck deliveries, 5 automobile trips by visitors and 29 automobile trips by employees. Upon completion of the proposed expansion the facility will generate a total of 101 trips to the facility per day; 5 additional tractor trailer trips and 6 additional employee trips. Truck and automobile traffic that travel to the site will access the facility from three proposed entrances. Trucks travel from the site on 38th Street to Ross Street to 37th Street and proceed to Bandini Boulevard. Another route includes traveling from the site on 38th Street to Alameda then south to Slauson Avenue then east to Santa Fe Avenue, north to Bandini Boulevard and east to the I-710 freeway. Trucks accessing the site currently have to use one of the two truck driveways on either -3- 38th Street or Ross Street. The applicant is proposing to construct an additional driveway on Ross Street strictly for automobiles. Traffic will increase by a total of 11 traffic trips. Ross Street and 38th Street are built out to the Master Plan of Streets dated June 16, 1992. Both streets are adequate to handle the additional 11 traffic trips and will have an insignificant effect on these arterials and the rest of the City. Therefore, there will be no need for a traffic study. 6. Currently they are in the process of relocating an underground fuel tank used by their delivery vehicles. The applicant is "Muired to obtain all required permits to operate the fueling station. The facility also maintains hazardous materials such as propane, oils and other materials required to operate their on -site equipment. Such materials shall be stored and handteo in a manner that will avoid exposure to sensitive receptors. Vernon has several arterials which bisect the Ci(y. The site has access to Ross Sweet and 38° Street which are 60 feet in width. The total vehicle trips associated with the proposed facility consist of employee trips and truck trips. The facility eaun=dY generates 90 trips to the facility per day-,10 tractor traders,13 delivery trucks, 20 outside truck carriers, 3 rmiseellarhies truck deliveries, S automobile trips by visitors and 29 automobile trips by employees. The proposed facility will a anal of 101 trips to the facility per day; S additional tractor trailer trips and 6 additional employee trips. Truck and automobile traffic that travel to the site will access the facility from throne proposed entrances. Trucks travel fiorn the site on 38° Street to Ross Street to 371h Strea and proceed to Bandini Boulevard. Another route includes traveling from the site on 38• Street to Alameda then south to Sisusem Avenue then east to Santa Fe Avenue, north to Bandini Boulevard and east to the 1-710 freeway. Trucks are limited to entering and exiting the site on 381 Street while automobiles may access the site either from 38' Street or from Ross Street. Traffic will increase by a total of i 1 traffic trips. Ross Street is built out to the Mmter Plan of Streets dated June 16, 1992. The right -of way on 3e Street is built out, however, tine side walk will be terms to create a 44 foot street. TRAFFIC REPORT Introduction: Raw and finished product is received at and shipped from the Vernon Warehouse Company via truck and rail transportation. An office facility is also located on the site generating automotive traffic. Site Description: (Plate A) The site is bounded by Alameda Street East, 38th Street, Ross Street and railroad tracks. Current curb to curb roadway widths are: Alameda Street - 29 ft. 38th Street - 40 ft. Ross Street - 40 ft. Access to the site is presently via a 65 ft. wide driveway off 38th Street and a cross railroad roadway from the Transfreight Facility at the Southwest area of the property. (Transfreight is a truck transportation/maintenance subsidiary operation of Vernon Warehouse Company). No access currently exists on the Alameda and Ross Street boundaries. -However, and automotive driveway is proposed for access from Ross Street. There are seven doublewide dock high loading doors on the north face of the existing warehouse set back approximately 144 ft. from the North property line. This allows for all truck maneuvering to be accomplished on -site. Except for some landscaping on the west side of the office building and an approximately 5-ft. wide strip at the 38th and Ross Street office frontages, the entire site is paved with asphaltic material. 107 W. No backing from public way is required for spotting trucks at the loading bays. Also, there is sufficient yard space for on -site staging and transient truck parking without interfering or encroachment of automotive parking. Present City of Vernon parking requirements provide automotive parking in excess of actual necessity. Both present and future automotive parking is accomplished in the immediate area of the office building. Because of this limited land usage, additional space is available for truck staging and/or transient parking if required. The overall affect of traffic chance due to the proposed project is limited to a slight increase in product transfer between the warehouse and production facilities.
