A RESOLUTION OF THE CITY COUNCIL OF
3 THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO TCT TRANSIT
4 SERVICES, INC FOR THE OPERATION OF A
°BUS TERMINAL AT 2715 BONNIE BEACH
5 PLACE
$ WHEREAS,'TCT Transit Services, Inc. has applied for
7 a conditional use permit to operate a bus terminal at 2715
8 Bonnie Beach Place in the City of Vernon; and
9 WHEREAS, the ,City Council of the City of Vernon held
10 a hearing on said application for a conditional use permit on
11 February.16, 1999 and
12 WHEREAS, the proposed site is a permitted use in the
13 Heavy Industry (M-2) Zone with the approval of a conditional
14 use permit; and
15 WHEREAS,the proposed operation includes the
16 transportation of people; and
17 WHEREAS, the proposed site is approximately 1.77
18 acres in area, and is adequate in size, shape and topography
_19 for the proposed operation and has adequate drainage; and
20 WHEREAS, a barrier wall or landscaping shall be
21 extended wherever parking or maneuvering areas adjoin a public
22 street pursuant to the Vernon City Code; and
a
23 WHEREAS,- the proposed site is surrounded by
24 industrial uses compatible with the proposed use and no
25 adverse effects from traffic, parking, noise, odors, dust,
26 smoke, light or glare, or risk of fire, infection or explosion
27 is anticipated from the proposed operation; and
28 WHEREAS, the site has access to Bonnie Beach
Boulevard and Bandini Boulevard and traffic will generally
I travel west on Bandini Boulevard to Downey Road, thence north
2 to freeway access, and the streets to be utilized within the
3 City of Vernon are sufficient to handle the traffic generated
4 form the proposed operations; and
5 WHEREAS, the site, as proposed, has ample room on-
6 site to provide adequate off-street parking and loading
7 facilities as required by the Vernon City Code; and
$ WHEREAS, the conditions imposed on the conditional
9 use permit will adequately protect the public health, safety`
10 and general welfare and the operation is consistent with all
11 applicable rules and laws of the City of Vernon; and,
12 WHEREAS, the proposed use, as to location, operation
13 and design is consistent with the; General Plan and Zoning
14 Ordinance of the City of Vernon; and
15 WHEREAS, the project is categorically exempt from
16 the California Environmental, Quality Act as an existing
17 facility pursuant to Section 15301 of the California
18 Environmental Quality Act Guidelines and a Notice of Exemption
19 shall be filed with the County Clerk pursuant to Section 15062
20 of the California Environmental Quality Act Guidelines.
21 WHEREAS,` the City Council has received a Staff
22 Report, dated on February 10, 1999 upon which it has relied in
23 making the foregoing recitals; and
24 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF "
25 THE CITY OF VERNON AS FOLLOWS:
26 SECTION 1.: The City Council of the City of Vernon
27 hereby finds and determines that the recitals contained
28 hereinabove are true and correct.

SECTION 2: Subject to the conditions set forth
below, the conditional use permit is hereby granted to TCT
Transit Services, Inc. for the operation of a bus terminal at
2715 Bonnie Beach Place.
SECTION 3 In order to adequately protect the public
health and general welfare the following conditions are
required:
a. The facility shall be operated in accordance
with, and made to conform with all current codes, rules,
regulations and subject to permit fees as adopted by the City
of Vernon. All busing operations, including bus parking,
shall be limited to the lot located at 2715 Bonnie Beach Place
in the City of Vernon.
b. All required federal, state, local and
regulatory agencypermits shall be obtained prior to
operation. Prior to occupancy a business license and
occupancy permit shall be obtained.
C. All parking and loading facilities shall be
paved with a hard durable surface material and shall be
adequately drained, and kept free of dust, mud, trash and
weeds. Where parking or maneuvering areas adjoin the public
street a barrier wall or landscaping shall be installed and
maintained to meet City standards. Adequate on -site parking
shall be maintained so that no on -street parking will occur.
d. The facility shall be operated in a manner that
will prevent unsanitary conditions, odors or other nuisances.
The property shall be provided with adequate refuse containers
and refuse disposal services.

1 e. The facility's buildings shall be structurally
2 maintained to exclude rodents and the property shall be
3 maintained rodent free.
4 f. Servicing of vehicles including washing, steam
5 cleaning and repairing shall be performed in facilities in
6 compliance with appropriate codes which includes but is not
7 limited to connecting the existing clarifier to a sewer main.
$ g. No equipment, freight, or materials such as but
9 not limited to hazardous materials, hazardous waste, refuse,
10 tires, batteries or abandoned vehicles shall be stored on the
11 site other than in buildings approved by the City of Vernon
12 for such a use
13 h. A National Pollutant Discharge Elimination
14 System Permit shall be obtained from the California State
15 Board' of Water Resources, if required'.
16 i. Adequate plans and materials must be available
17 for handling leaks or spills from vehicles during storage or
18 transportation.
19 j. A hazardous materials, permit shall be obtained
20 from the City of Vernon Environmental Health Department if
21 hazardous materials/waste are used handled or stored.
22 Hazardous materials/waste shall be handled and managed in
23 compliancewithall appropriate federal, state and local laws.
24 k. The facility shall be operated in a manner that
25 will not impede traffic on Bonnie Beach Place or Bandini
26 Boulevard:
27 1. All existing cracked sidewalk, curb and gutter
28 a.djacent, to the site in Bonnie Beach Place and Bandini

Boulevard shall be repaired .and maintained to meet City
Standards. A ramp accessible to persons with disabilities
shall be constructed at the Northwest corner of Bonnie Beach
Place; and Bandini Boulevard in compliance with City Standards.
The non -conforming portion of the existing driveway on the
site fronting Bonnie Beach Place shall be removed and replaced
with curb, gutter, sidewalk and a barrier wall shall be
installed were required in compliance with City Standards.
M. The owner of the property shall provide to the
City of Vernon'a utility easement for the overhead electrical
lines located on the applicants property in a form and manner
subject to approval of the Director of Community Services and
Water:
n. TCT Transit Services, Inc. shall not generate
more than 32 Bus trips ,and 50 employee trips per day.
o. All above ground fuel tanks shall comply with
local building, fire, and health codes, and county
regulations.
p. All buses parked on the facility shall be
limited to 30 feet in length and shall not obstruct
maneuvering on -site.
q. The facility shall supply the adequate number of
bathrooms, toilets, sinks and other facilities as required by
the EnvironmentalHealth Department.
SECTION 4: TCT Transit Services, Inc and any
successors in interest shall indemnify, hold harmless, and
defend the City of Vernon, its officers, agents, and employees''
from and against any and all claims, complaints, or petitions

1 for: (1) damages, losses, expanses resulting from bodily
2 injury, sickness, disease, disability or death arising from
3 the operation, of the facility excluding therefrom anysuch
4 claim resulting from the sole negligence or intentional
5 wrongdoing of the City of Vernon, its officers, agents or
6 employees (2) a peremptory writ or other relief by way of
7 injunction, mandamus, or administrative mandamus; or (3) legal
8 expenses and attorney's fees incurred by the City of Vernon on
9 behalf of any party in such actions or proceedings. The City
10 of Vernon does not waive its right to participate in the
11 defense of any such action
12 SECTION 5: Not later than sixty (60) days from the
13 date of this Resolution, TCT Transit Services, Inc'.,, shall
14 indicate, in writing, its acceptance of and agreement with the
15 conditions contained in Section 3 of this Resolution and the
16 indemnification provision contained in Section 4 of the
17 Resolution.
18 - SECTION 6: The City Clerk of the City of Vernon
19 shall certify to the passage of ;this resolution and thereupon'
20 and thereafter the same shall be in full force' and effect.

Additional Information
Environmental Setting
#33 The proposed site is currently used by another company engaged in similar work, the repair,
maintenance and dispatch of tour buses. The topography is level and there is no soil instability.
Animal and plant life are not present. No cultural, historic or scenic elements are present on the
site. The existing structure is a 10,000 sq. ft newer metal building. TCT will occupy
approximately 40% of the building designed to accommodate the repair of large vehicles such as
buses.
#34 The surrounding properties are all industrially zoned and are developed to accommodate medium
to heavy industries. Examples of surrounding industries are: Magnetic Associates, 7tn Street
Warehouse Partners, Ryerson Steel, Maxi Trim & Buttons, and International Iron Works.
Traffic Report
Twenty one buses [30' in length] will be assigned to this location. Of the 21 units, 16 will be in
service and 5 will be spare vehicles. The buses will depart the site between the hours of 5:30 am
and 630 am and return between the hours of 630pm and 730pm Monday through Friday. Saturday
departures will be between 800am and 900 am and returns will be between 500pm and 600pm.
All of the buses will remain at the site on Sunday. When at the facility, the buses will be parked
in assigned parking spaces. In light of safety considerations, TCT policy prohibits left turns
across traffic out of its facilities. Consequently, departing buses will turn right out of the site
[westbound] to a right on Downey to access the I-5, Highway 60 and I-10 freeways. Employees
will generally arrive at the site from 1-710 to Bandini. It is expected that most employees will be
from the communities south of Vernon.
Operations Report
TCT will operate between the hours of 500 am and midnight on Weekdays and between the hours
of 800am and midnight on Saturday. A total of 50 employees are required generally spread over
the day as follows: Two shifts of drivers or approximately 16 each shift. Eight administrative and
managers between the hours of 700am and 500pm and eight mechanics and service personnel
spread between two shifts, six days a week will maintain and service the vehicles. Their tasks
include cleaning and performing preventive and corrective maintenance. No heavy maintenance,
body work or painting will be performed at this site.

TCT Transit Services, Inc. has applied for a conditional use permit
to operate a bus terminal at 2715 Bonnie Beach Place.
Herewith for your consideration are the following supporting
documents:
1. Staff Report.
2. Request for conditional use permit and information supporting
the application.
3. Notice of Public Hearing, copies of notification letters to
owners and tenants in the area and affidavits of posting and mailing.
The project is categorically exempt from the California
Environmental Quality Act because there is an existing facility at the
site with no expansion of use as defined in Section 15301. A Notice of
Exemption will be prepared.
In my opinion the proposed operation is consistent with the General
Plan as adopted by the City of Vernon, will pose no adverse effects to the
City of Vernon, will have no significant effects on the environment, and
no mitigation measures are required.
It is recommended that the City Council find that the proposed use
is categorically exempt from the California Environmental Quality Act
process and is consistent with the General Plan.
Further it is recommended that a Notice of Exemption be filed with
the County Clerk and the conditional use permit be granted with the

following conditions:
a. The facility shall be operated in accordance with, and made to
conform with all current codes, rules, regulations and subject to permit
fees as adopted by the City of Vernon. All busing operations, including
bus parking, shall be limited to the lot located at 2715 Bonnie Beach
Place in the City of Vernon.
b. All required federal, state, local and regulatory agency permits
shall be obtained prior to operation. Prior to occupancy a business
license and occupancy permit shall be obtained.
C. All parking and loading facilities shall be paved with a hard
durable surface material and shall be adequately drained, and kept free of
dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the
public street a barrier wall or landscaping shall be installed and
maintained to meet City standards. Adequate on -site parking shall be
maintained so that no on -street parking will occur.
d. The facility shall be operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. The property shall be
provided with adequate refuse containers and refuse disposal services.
e. The facility's buildings shall be structurally maintained to
exclude rodents and the property shall be maintained rodent free.
f. Servicing of vehicles including washing, steam cleaning and
repairing shall be performed in facilities in compliance with appropriate
codes which includes but is not limited to connecting the existing
clarifier to a sewer main.
g. No equipment, freight, or materials such as but not limited to
hazardous materials, hazardous waste, refuse, tires, batteries or
abandoned vehicles shall be stored on the site other than in buildings
approved by the City of Vernon for such a use.
h. A National Pollutant Discharge Elimination System Permit shall
be obtained from the California State Board of Water Resources, if
required.
i. Adequate plans and materials must be available for handling
leaks or spills from vehicles during storage or transportation.
j. A hazardous materials permit shall be obtained from the City of
Vernon Environmental Health Department if hazardous materials/waste are
used handled or stored. Hazardous materials/waste shall be handled and
managed in compliance with all appropriate federal, state and local laws.
k. The facility shall be operated in a manner that will not impede
traffic on Bonnie Beach Place or Bandini Boulevard.
1. All existing cracked sidewalk, curb and gutter adjacent to the

site in Bonnie Beach Place and Bandini Boulevard shall be repaired and
maintained to meet City Standards. A ramp accessible to persons with
disabilities shall be constructed at the Northwest corner of Bonnie Beach
Place and Bandini Boulevard in compliance with City Standards. The non-
conforming portion of the existing driveway on the site fronting Bonnie
Beach Place shall be removed and replaced with curb, gutter, sidewalk and
a barrier wall shall be installed were required in compliance with City
Standards.
M. The owner of the property shall provide to the City of Vernon a
utility easement for the overhead electrical lines located on the
applicants property in a form and manner subject to approval of the
Director of Community Services and Water.
n. TCT Transit Services, Inc. shall not generate more than 32 Bus
trips and 50 employee trips per day.
o. All above ground fuel tanks shall comply with local building,
fire, and health codes, and county regulations.
p. All buses parked on the facility shall be limited to 30 feet in
length and shall not obstruct maneuvering on -site.
q. The facility shall supply the adequate number of bathrooms,
toilets, sinks and other facilities as required by the Environmental
Health Department.

CONDITIONAL USE PERMIT
TO OPERATE A BUS TERMINAL
AT 2715 BONNIE BEACH PLACE
(February 10, 1999)
TCT Transit Services, Inc. has submitted an application for
a conditional use permit to operate a bus terminal at 2715 Bonnie
Beach Place. They are a Busing company that provide
transportation for various customers. They are proposing to
maintain 21 buses at the proposed facility. The facility will
have a total of 50 people employed at the facility spread over
two shifts from 6:00 a.m. to 12:00 a.m. Monday through Saturday.
The facility is currently occupied by TourCoach, an existing
bus terminal. TCT Transit Services, Inc. is proposing to occupy
approximately 40% of the site to repair, wash, and park their 21
buses while TourCoach will retain the remaining 60%. TourCoach
was issued a conditional use permit February 4, 1997 and a Notice
of Determination was filed with the County Clerk.
1. GENERAL PLAN The proposed use conforms to the
Comprehensive Zoning Ordinance and is in accordance with the
General Plan. The site is located in the M-2 Zone, Heavy
Industry. A truck terminal (i.e. bus terminal) is allowed in
this zone with a conditional use permit.
2. SITE According to the County Assessors Map the site
consists of two parcels, tied together, and measuring a total of
approximately 2 acres. A letter has been submitted by the owner

indicating that the parcels have been tied together for tax roll
purposes only and have not been merged and held as one parcel.
TCT Transit Services, Inc. is proposing to operate from the
southern most parcel located on the corner of Bonnie Beach Place
and Bandini Boulevard measuring 1.77 acres in area. The proposed
site is adequate in size, shape and topography for the proposed
operation and has adequate drainage.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use. No potentially
significant impacts are expected to result from noise, odor,
dust, smoke, light or glare from the project. The project is
categorically exempt under Section 15301 of the California
Environmental Quality Act because the site is currently occupied
by an identical use with no expansion. A Notice of Exemption
will be prepared and filed with the county.
4. ACCESS The site has access to Bonnie Beach Place and
Bandini Boulevard which are 60 feet and 100 feet in width,
respectively. Both streets are built out to the City of Vernon
Master Plan of Streets approved June 16, 1992. The parcel in
question has two driveways, one on each of the said streets both
of which are used for truck and automobile access. Both streets
are of adequate size to handle the traffic generated from the
proposed operation.
5. VEHICLE MOVEMENTS TCT Transit Services, Inc. will
accommodate 21, 30 foot buses at the facility. Of the 21 buses

16 will be in use and 5 will be maintained on -site as spares.
They will depart from the facility between 5:30 a.m. and 6:30
a.m. and return between 6:30 p.m. and 7:30 p.m. Monday through
Friday. Saturday, the buses depart between 8:00 a.m. and 9:00
a.m. and return between 5:00 p.m. and 6:00 p.m.. The facility
will not operate on Sundays. The buses will exit the facility on
Bandini Boulevard and turn right toward Downey Road and travel
north to access the I-5 Freeway, the 60 Highway, or I-10 Freeway.
Most employees will access the facility from the I-710 and
proceed west on Bandini Boulevard to the site.
6. OPERATIONS TCT Transit Services, Inc., will use the
facility to operate a busing terminal and maintain their
vehicles. The buses transport people and do not have bathrooms.
In addition to transporting people the applicant has proposed to
maintain and wash his buses on -site. Conditions have been
implemented that require the applicant to comply with all
applicable regulations if such facilities are to be used.
However, no bodywork or painting shall be performed on site.
During operation a total of 50 employees will be spread over
two shifts. These employees include two shifts of 16 drivers,
one shift of 8 administrative personnel and 8 mechanics and
service personnel spread over two shifts. A condition shall be
implemented that requires the applicant to comply with bathroom
requirements of the Environmental Health Department.
7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the

operation.
8. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and

As stipulated in our letter of February 17, 1999 regarding the City of Vernon's approval of a
accept this letter as TCT's acceptance of, and agreement
with the stated conditions in Section 3 of Resolution 7275 and the indemnification provision

Dear Mr. Wilson,
Thank you for your letter dated February 4, 1999 concerning the conditional use permit
requested by the above referenced business.
We have been in our location for 7 years and have noticed a 3 fold increase in truck and
auto traffic on the Vernon streets.
Obviously this is probably due to our robust economy as well as the 1525 truck -trailer
marshaling yard that has just opened on Bandini and Downey Road.
It seems to me with all of this business expansion and growth in the Vernon area, the city
has failed in complying with the heavy onslaught of traffic, i.e. try getting onto the 710
Freeway North or South ramps mid -morning or late afternoon, try turning left from
Downey Road to Bandini, the traffic is unbearable.
To allow another business in an already congested area just confirms my thoughts that the
city either does not know or care about the traffic problem,.
The proposed site for this new business is already congested with buses and support
personnel vehicles, why would you allow another bus business to go on top of him.

Next time you are out here take a look in the back of the building, there's old tires, old
parts stacked up, not enough toilet facilities, rat infestation, bus parking congestion, etc.
I would oppose anymore micro -business's in an already heavily congested area.

I would like to convey to you my thanks for the assistance your staff has provided in support of
our applications for the various permits and licenses required to occupy and operate in Vernon.
Mr. Peter Pirnejad in particular has been immensely helpful in providing information on
completion of the C.U.P. application.
We are grateful as well for scheduling our application on the City Council Agenda for Tuesday,
February 16, 1999. As you know, our application has and continues to be very time sensitive in
terms of beginning actual operations as soon as possible [I realize this must be a refrain you and
your staff hear often from applicants] and we appreciate the early agenda slot.
As of this date we have completed all of the items identified by Electrical, Health and Mechanical
as identified in the inspections conducted on January 11,1999, and have arranged for re -inspections
today for those Departments. Building will re -inspect on Tuesday. February 16, 1999. All items
identified in the Building inspection have been completed except the removal of the storage
container which is in process and will be completed this weekend. Finally, Mr. Burgess of the Fire
Department has advised me that he has reinspected and has approved our application.
Additionally, we have applied for our Business License and paid the appropriate fee and submitted
our application for a Certificate of Occupancy. Finally, we have completed the relevant sections
of the Hazardous Materials Establishment Reporting Form and are prepared to submit it.
Y—JRegarding, the C.U.P., we have or are prepared and commit to meeting all of the conditions [a.
through q.] stipulated therein. I intend to secure a contractor for the curb and ramp work today and
be in position to provide documentation of our efforts to comply with Condition "L" by applying
for the Encroachment Permit no later than Tuesday, February 16, 1999.
Based on this information, and assuming that all re -inspections result in compliance and that we
receive City Council approval, I would like to request that TCT Transit Services, Inc. be granted
a Temporary Occupancy Permit in order that we may start actual operations on Wednesday,
February 17, 1999 or Thursday, February 18, 1999 at the latest. We are prepared to meet any
additional requirements that may be needed for this to occur.
