RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A 3 CONDITIONAL USE PERMIT TO SI-NOR,'INC, FOR THE OPERATION OF A TRUCK TERMINAL -4 AT 3689 BANDINI BOULEVARD 5 WHEREAS, Si -Nor, Inc. has applied for a. conditional 6 use permit to operate a truck terminal at 3689 Bandini, 7 Boulevard; and 8 WHEREAS, the City Council of the City of Vernon held 9 a hearing on said application for a. conditional use permit` on: 10 March 16, 1999;and; 11 WHEREAS, the proposed site is in the M-2 Heave 12 Industrial Zone and Section 26.3.E-3 of the Comprehensive 13 Zoning Ordinance requires a truck terminal to obtain a 14 conditional use permit and 15 WHEREAS,, the proposed site is approximately 1 acre 16 and is- adequate in size, shape and topography for the proposed 17 operation, has adequate drainage, and landscaping, if 18 required, will be installed pursuant to the Vernon. City Cade; 19 and 20 WHEREAS,' the proposed site is surrounded by 21 industrial uses compatible with the proposed use and no 22 adverse effects are anticipated from the proposed operation; 23 and 24 WHEREAS, ` the site has access to Bandini Boulevard 25 and traffic will generally travel on Bandini Boulevard east to 26 the freeway system or on Bandini Boulevard to established 27 collection routes in the City of Vernon Bandini Boulevard is 28 of adequate size and pavement -type to handle the trafi.c 1 generated by the proposed operations; and 2 WHEREAS, the site, as proposed, has adequate off- 3 street parkingand loading facilities as required by the 4 Vernon City Code; and 5 WHEREAS, the Community Services Department has 6 performed an Initial Study to determine the potential adverse 7 impacts to the environment that the proposed project may cause 8 and has determined that while the proposed project will 9 potentially have significant effects on the environment, 10 revisions in the project plans or proposals made by or agreed 11 to by ,the applicant before the proposed mitigated negative 121 declaration and initial study were released for public review 13 will avoid' the effects or mitigate the effects to a paint 14 where clearly no significant effects would occur, and there is 15 no substantial evidence, inlightof the whole record before 16 the agency, that the project as revised will have a 171 significant effect on the environment. The Director of 18 Community Services & Water has recommended' that a Negative 191 Declaration be adopted in compliance with the California 20 Environmental Quality Act; and 21 WHEREAS, the conditions imposed on the conditional 22 use permit will adequately protect the public health, safety 23 and general welfare and the operation is consistent with all 24 applicable rules and laws of the 'City of Vernon; and 25 WHEREAS, the proposed use, as to location, operation 26 and design is consistent with the General Plan and Zoning 27 Ordinance of the City of Vernon; and 28 -2 I WHEREAS, the CityCouncil has received a Staff 2 Report, dated on February 8,'1999 upon which it has r lii6d,in 3 making the foregoing recitals; and 4 NOW THEREFORE, BE IT RESOLVED ,BY THE CITY COMCIL OF 5 THE CITY OF VERNON AS FOLLOWS: 6 SE TON 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained 8 hereinabove are true and correct. 9 SECTION 2: The City Council hereby finds on the 10 basis of the whole record before it (including the initial 11 study and any comments received) that there is no substantial 12 evidence that the project will have a significant effect on 13 the environment individually or cumulatively, and that the 14 Negative Declaration reflects the City of Vernon's independent 15 judgment and analysis, and on the basis of said findings the 16 City Council hereby approves and adopts the Mitigated Negative 17 Declaration for the project 18 SECTION3: Pursuant to Section 711.4(c) of the Fish 19 and Game Code, the City has found, no evidence that the 20 proposed project will have the potential for adverse effects 21 on wildlife resources and the project is therefore exempt from 22 the fees otherwise payable under Section 711.4. 23 ES CTIQN 4 Subject to the conditions set forth 24 below, the conditional use permit is hereby granted toSi-Nor, 25 Inc., for the operation of a trucking and freight terminal at 26 3689 Bandini Boulevard. 2? 28 / f -3- 1 SEQJICN 5: In order to adequately protect the pUblic 2 health and general welfare the following conditions are 3 required 4 A. The facility shall be operated in accordance 5 with, and made to conform with all current codes,rules, 6 regulations and subject to permit fees as adopted by the City 7 of Vernon.. All trucking operations, including truck and 8 trailer parking, shall be limited to the lot located at 3689 9 Bandini Boulevard in the City of Vernon. 10 B. The owner of the property shall provide to the 11 City of Vernon a utility easement for overhead electrical 12 lines located on the property in a form and manner subject to 13 approval by the Director of Community Services and Water and 14 with ,proper clearance subject to the approval of the Director 15 lof Utilities. 16 C. No equipment or freight shall be stored on the 17 site, other than in the office building. 18 D. All required federal, `state, local and 19 regulatory agency` permits shall be obtained prior to 20 operation. Prior to occupancy a business license and 21 occupancy permit shall be obtained. 22 E. The Environmental Health Department shall be 23 notified and all applicable permits shall be obtained any time 24 the soil is exposed or site -cap is disturbed. 25 F. Servicing of vehicles including washing, steam 26 cleaning and repairing shall not be permitted on -site. 27 2 -4- t 1 G. AA National Pollutant Discharge Elimination' 2 System Permitshall be obtained from the California ;Mate 3 Board of Water Resources, if required. 4 H. Adequate plans and materials must be avb1ilable 5 for handling leaks or spills from vehicles during storage or 6 transportation. 7 I. A hazardous materials permit shall be obtained 8 from the City of Vernon Environmental Health Department if 9 hazardous materials/waste are used handled or stored. 10 Hazardous materials/waste shall be handled and managed in 11 compliance with all appropriate federal, state and local laws 12 J. The facility shall be operated in a manner that 13 will prevent unsanitary conditions, odors or other nuisances. 14 The property shall be provided with adequate refuse containers 15 and refuse" disposal service. 16 K. If hazardous waste will be accumulated and 17 disposed of from the site, the applicant must 'obtain an EPA ID 18 number from the California Department of Toxic Substances 19 Control. . 20 L. A: hazardous materials closure report is required 21 from the previous occupant before the Environmental i alth 22 Department will approve the new Certificate of Occupancy.` 23 M. The existing driveway on Bandini Boulevard shall: 24 be widened to 5© feet and all existing frontages including but 25 not limited to, trees, signs, cracked sidewalk, curb and 26 gutters adjacent to the site in. Bandini Boulevard shall be 27 removed, repaired, replaced and/or maintained to meet City 28 Standards. -5- ` R r w u 1 N. Trucks shall only access the site at 389 2 Bandini Boulevard from driveways that have direct access to ` 3 the facility. 4 4. The facility shall be operated in compliance 5 with the "Mitigation Monitoring Program for Si -Nor, Inc. to 6 operate a Trucking; Terminal at 3689 Bandini Boulevard`Vernon, 7 CA February 8, 1999." 8 SECTIQN 6: The City Council hereby approves (1) City 9 of Vernon Community Services Department Staff Report on Si- 16 Nor, Inc. Conditional Use Permit to operate a Truck Terminal 11 at 3689 Bandini Boulevard dated February 8, 1999 and (2) the 12 Environmental Checklist Form and Initial Study for the project 13 dated February 8, 1999. Copies of said documents have been 14 submitted to the City Council concurrently herewith, and the 15 City Clerk is directed to receive and file them. Such 16 documents and other materials which constitute the record of 17 proceedings in this matter shall be maintained in the office 18 of the City Clerk, who is and shall be the custodian thereof. 19 SECTION 7: Noncompliance with the conditions set 24 forth in Section 4 of this Resolution shall be grounds for G 21 voiding the permit pursuant to Section 26.5.2-10 of the 22 Comprehensive Zoning Ordinance 23 SECTION 8: Si -Nor, Inc and any successors in 24 interest shall indemnify, hold harmless, and defend the City 25 of Vernon, its officers, agents, and employees from and: 26 against any and all claims, complaints, or petitions for! (1) 27 damages, losses, expanses resulting from bodily injury,`, 28 sickness, disease, disability or death arising from the -6- I operation of the facility excluding therefrom any such claim 2 resulting from the sole negligence or intentional wrongdoing 3 of the City of Vernon, its officers,agents or employees; (2) 4 a peremptory writ or other relief by way of injunction, 5 mandamus, or administrative mandamus, or (3) legal expenses 6 and attorney's 'fees incurred by the City of Vernon, on behalf 7 of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense 9 of any such action 10 SECTION 9: Not later than sixty (60) days from the 11 date of adoption of this Resolution, Si -Nor, Inc,, shall 12 indicate, in writing, its acceptance of and agreement with the 13 conditions contained in Section 4 of this Resolution and the 14 indemnification provision contained in Section S of this 15 Resolution: 16 SECTION 10: The, City Clerk of the City of Vernon 17 shall certify to the passage of this resolution and thereupon 18 and thereafter the same shall be in full force and effect. 19 APPROVED AND ADOPTED this 16th day of March, 1999. 20 21 eonis C. OPERATIONS REPORT Si -Nor, Inc. proposes to establish a Truck Terminal facility for its own private use located at 3689 Bandini Boulevard in the City of Vernon, California. The basic operation is to park and store Si -Nor, Inc. refuse trucks and trailers in a secure environment. No waste material will be brought to the facility. The property is bounded by Bandini. Boulevard to the west, power line towers owned by the Los Angeles City Department of Water and Power to the north, and industrial property owned by the Atchison & Topeka Railroad to the east and south. There is no evidence of any residences within one-half mile of the subject property. The proposed Layout is simple with only one small office building (20'x20') to be placed on the property. This small office building consists of three rooms; a storage room (12'x8'), a bathroom (8'x8') and a dispatcher/communication office (20'x 12'). Only one employee will occupy the office building per eight hour shift. The Facility will be open during the hours 2am-6pm, 7 days a week. The facility can accommodate up to fourteen (14) refuse trucks, but Si -Nor, Inc. currently only operates seven (7) units in this area. There is also fourteen (14) parking spaces including one handicap parking space for all employees. There are currently only eight (8) employees including one office person. The front gate of the facility will be opened by the office person, and kept open during the hours of operation (2am-6pm). The drivers will park their personal vehicles, go to their assigned trucks and drive their trucks out of the facility at their designated times throughout the day and return their trucks to the facility after their route completion. There will be no waste material delivered to or from the Facility. The storage yard which is lighted, consists of fourteen (14) parking stalls with dimensions of 40' x 10'. The refuse trucks have dimensions ranging from 32'- 35' (bumper to bumper) and 9' (mirror to mirror) in width. The refuse trucks can be turned within a 20' radius. The entrance from Bandini Boulevard allows for a minimum 65' turning radius by these trucks either way. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 3689 Bandini Boulevard in the City of Vernon. b. The owner of the property shall provide to the City of Vernon a utility easement for overhead electrical lines located on the property in a form and manner subject to approval by the Director of Community Services and Water and with proper clearance subject to the approval of the Director of Utilities. C. No equipment or freight shall be stored on the site, other than in the office building. d. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. e. The Environmental Health Department shall be notified and all applicable permits shall be obtained any time the soil is exposed or site -cap is disturbed. f. Servicing of vehicles including washing, steam cleaning and repairing shall not be permitted on -site. Honorable City Council -3- March 10, 1999 g. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. h. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. i. A hazardous materials permit shall be obtained from the City of Vernon Environmental Health Department if hazardous materials/waste are used handled or stored. Hazardous materials/waste shall be handled and managed in compliance with all appropriate federal, state and local laws. j. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal service. k. If hazardous waste will be accumulated and disposed of from the site, the applicant must obtain an EPA ID number from the California Department of Toxic Substances Control. 1. A hazardous materials closure report is required from the previous occupant before the Environmental Health Department will approve the new Certificate of Occupancy. M. The existing driveway on Bandini Boulevard shall be widened to 50 feet and all existing frontages including but not limited to, trees, signs, cracked sidewalk, curb and gutters adjacent to the site in Bandini Boulevard shall be removed, repaired, replaced and/or maintained to meet City Standards. n. CONDITIONAL USE PERMIT TO OPERATE A TRUCK TERMINAL AT 3689 BANDINI BOULEVARD (January 18, 1999) Si -Nor, Inc. has submitted an application for a conditional use permit as required by the Comprehensive'Zoning Ordinance Section 26.3.E-3(c) to operate a truck terminal at 3689 Bandini Boulevard. Si -Nor, Inc. is a refuse collection company that is proposing to park their empty trash trucks at the facility when not in operation. The facilities operating hours will be from 3:00 a.m. to 3:00 p.m. seven days per week. Si -Nor, Inc. has had a history of activity dealing with occupying the proposed site. On October 18, 1996 they expressed interest in using the proposed site for a, "Material Recovery Center." Then in February of 1997 they applied for a conditional use permit to operate a truck terminal. Their application was incomplete and after a year of 'correspondence their application was rejected and returned. Si -Nor, Inc. was refunded 80% of their application fee on March 19, 1998. The previous occupant, L.A. Express Assembly and Distribution obtained a Certificate of Occupancy on November 26, 1991 to operate a trucking terminal. The building was demolished by Si -Nor, Inc. in August of 1997. The site was cleared and left as a dirt lot. However, due to lead contamination in the soil, Si -Nor, Inc. was required to provide environmental remediation by -1- 0 capping the site with an impermeable surface. 1. GENERAL PLAN With the approval of the conditional use permit the proposed use shall be in compliance with the General Plan. The site is located in the M-2 Zone, Heavy Industry. A truck terminal is a permitted use with the approval of a conditional use permit. 2. SITE The lot is currently an empty lot approximately one acre in size. The site has been temporarily capped to comply with Environmental Health Department requirements. Upon approval of this conditional use permit the applicant shall pave the lot according the submitted site plans. The said plan shows the site draining by sheet flow to Bandini Boulevard. The site, as proposed, is adequate in size, shape and topography for the proposed operation and provides adequate drainage. The site is on filled soil which contains elevated concentrations of heavy metals. The Environmental Health Department has notified the applicant that the site must meet all environmental requirements before occupying the facility. This includes, but is not limited to, the submittal of a hazardous materials closure report by the previous occupant. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. Although the Initial Study identifies potentially significant impacts from the project, revisions in the project plans or proposals made by or agreed to by the applicant, all set forth as conditions of -2- approval for this conditional use permit, will avoid the effects or mitigate the effects to a point where clearly no significant impact on the environment will occur. Staff has therefore recommended adoption of a Mitigated Negative Declaration for this project. 4. ACCESS There is one driveway that accesses the site located on Bandini Boulevard. The proposed 50 foot driveway shall be shared by truck and automobile traffic accessing the site. The section of Bandini Boulevard fronting the proposed site has been built out to the Master Plan of Street widths as of June 16, 1992. Bandini Boulevard is of the adequate size and pavement type to handle the traffic generated from the proposed operation. 5. VEHICLE MOVEMENTS Si -Nor, Inc. proposes to operate a truck terminal and park their 7 refuse collection vehicles on - site. The facility has been designed to accommodate 14 refuse trucks, however, the applicant currently only has 7 units in the area. Operating hours will be from 3:00 a.m. to 3:00 p.m. seven days per week. The first refuse truck begins its route at 3:00 a.m. at which time a security guard will open the gate. The office personnel officially opens the gate at 6:00 a.m.. Operation continues until 3:00 p.m. at which time the office personnel closes the gate and the security guard takes over until 6:00 a.m.. The drivers will drive their assigned trucks out of the facility at their designated time and return to the facility when their routes are complete. The trucks shall be returned to -3- the facility free of,any waste material. The facility has ample room on -site to provide the required number of truck and automobile parking and loading spaces. The proposed facility has provided 14 truck parking/loading spaces and 12 automobile parking spaces. The facility also has adequate maneuvering on -site to avoid queuing on Bandini Boulevard. The security guard will be instructed at what time the first driver will arrive at the site and will have the gate open at that time to prevent the driver from queueing on Bandini Boulevard. All employees will access the facility from the 40 foot driveway located on Bandini Boulevard. The trucks have routes in various cities such as, Torrance, Los Angeles, and Vernon. The trucks either stay in Vernon or proceed east on Bandini Boulevard to the I-710 Freeway South or North to their respective routes. The majority of the employee trips will also access and exit the site using Bandini Boulevard and travel to and from the I-710 Freeway. The section of Bandini Boulevard fronting the proposed site has been built out to the Master Plan of Street widths as of June 16, 1992. Bandini Boulevard is of the adequate size and pavement type to handle the traffic generated from the proposed operation. 6. OPERATIONS Si -Nor, Inc., will use the facility to operate a trucking and freight terminal. This facility will be the base of operation for routes located in the Cities of Torrance, Los Angeles, Vernon, Westwood, and other cities in the greater Los Angeles area. The Comprehensive Zoning Ordinance requires that the project have l automobile parking space and 1 truck loading space on - site. The current site plan has ample space for parking, loading and maneuvering as required by the Comprehensive Zoning Ordinance. The applicant has indicated that the gate fronting Bandini Boulevard will remain open during operating hours. All office functions will take place in the designated office area located in the office building. This area will include office space for the office personnel during operating hours and the security guard during non -operating hours. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests: A. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 3689 Bandini Boulevard in the City of Vernon. B. The owner of the property shall provide to the City of Vernon a utility easement for overhead electrical lines located on the property in a form and manner subject to approval by the Director of Community Services and Water and with proper clearance subject to the approval of the -5- Director of Utilities. C. No equipment or freight shall be stored on the site, other than in the office building. D. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. E. The Environmental Health Department shall be notified and all applicable permits shall be obtained any time the soil is exposed or site -cap is disturbed. F. Servicing of vehicles including washing, steam cleaning and repairing shall not be permitted on -site. G. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. H. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. I. A hazardous materials permit shall be obtained from the City of Vernon Environmental Health Department if hazardous materials/waste are used handled or stored. Hazardous materials/waste shall be handled and managed in compliance with all appropriate federal, state and local laws. J. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal service. K. If hazardous waste will be accumulated and disposed of from the site, the applicant must obtain an EPA ID number from the California Department of Toxic Substances Control. L. A hazardous materials closure report is required from the previous occupant before the Environmental Health Department will approve the new Certificate of Occupancy. M. The existing driveway on Bandini Boulevard shall be widened to 50 feet and all existing frontages including but not limited to, trees, signs, cracked sidewalk, curb and gutters adjacent to the site in Bandini Boulevard shall be removed, repaired, replaced and/or maintained to meet City Standards. N. Trucks shall only access the site at 3689 Bandini Boulevard from driveways that have direct access to the facility. It is also recommended that the following mitigation measures, as seen in the Mitigation Monitoring Program, be set on the permit as part of the Negative Declaration in order to adequately protect the public interests: a. All on -site construction or improvements shall be in compliance with the 1994 Uniform Codes (Building, Fire, Mechanical, Plumbing and Electrical). The proponent shall obtain all necessary building, fire, mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department. b. All parking and maneuvering areas shall be paved and maintained with a hard, durable and smooth surface material that adequately drains to Bandini Boulevard, and -7- shall be kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on -site parking shall be maintained so that no on -street parking will occur. In addition, an Operation and Maintenance Schedule shall be completed on a monthly bases by the applicant. C. The proponent shall obtain a covenant indicating that the site has high concentrations of heavy metals in the soil and that it shall remain capped for the life of the operation. d. The proponent shall submit a Notice of Intent to the California Regional Water Quality Control Board (CRWQCB) to address National Pollutant Discharge Elimination System (NPDES) requirements regarding storm water runoff. A copy of the Storm Water Pollution Prevention Plan (SWPPP) as required under the NPDES permit shall be submitted to the Environmental Health Department for review. e. All maneuvering of vehicles shall be done on -site. Vehicles shall not be allowed to queue or impede traffic on Bandini Boulevard or use neighboring driveways for turnarounds. f. The facility shall be limited to producing a maximum of 14 daily truck trips and 14 daily automobile trips per day. g. The facility's building shall be structurally maintained to exclude rodents and the site shall be maintained in a sanitary manner which will prohibit the harborage and/or breeding of vectors. Building doors shall remain closed when the facility is not in operation. The applicant shall maintain a log on -site that indicates that a licensed pest extermination service was contracted for monthly inspection and extermination, if needed. h. The entire site shall be enclosed with a durable fence -like material to prevent the migration of litter off - site. This shall include a block wall at least 30 inches in height where parking and loading adjoin Bandini Boulevard. i. A litter control program shall be implemented to maintain the facility in a safe, sanitary and attractive condition for the life of the project. The litter control program shall include, but not be limited to, the tarping or covering of all open vehicles entering and exiting the property and the daily sweeping of the property. The proponent shall clean up any debris resulting from trucks traveling to or from the site. At the request of the City of Vernon, the proponent shall clean up any debris on City streets caused by the operation. The channelized Los Angeles River runs through the City, but the project will not affect the river. IV. WATER. The project is located in a highly urbanized area and is served by the existing drainage system. The entire site is currently paved and m the event of a storm, tainwater sheet flows to Ban,dini Boulevard. The proposed site Mall be completely with a drainage system dug diverts the storm water to an existing catch basin on Bandini Boulevard. Since the site has historically been paved and developed, the passibility of an impact associated with the dwage in the amount of surface' WSW in any water body is negligible. The proponent shall be required to comply with the Natiortal Pollutant Discharge Elimination System (NPDLS) requirements and obtain a permit if necessary. As part of the facilities NPDES permit they shall follow bat management practices as outlined in the Indust iailCommercial Best Management Practices Handbook, for a truck terminal. Therefore, the impact will briers than significant. b) Exposure of people or property to water related hazards such as flooding9 p p 0 X b. According to the MEA, the Los Angeles River flows through the City in a concrete channel'. The river channel, in conjunction with other major improvements in the region, has greatly reduced the probability of a major flood occurring in the City of Vernon. However, intense thunderstorms of short duration have been known to occur and result in localized flooding and ponding in areas extensively covered by buildings or paving. The project has proposed drainage improvements that provide for adequate site drainage, in compliance with existing City Standards. Therefore, the proposed project will cause no impact. c) Discharge into surface waters or other alteration of surface water quality (e.g. temperature, dissolved -2- ti oxygen or turbidity)? p p p X c. No surface water bodies are located near the project and the project is not expected to directly discharge into such water or change the amount of any water bodice located- in the vicinity. All modifcaYtions of existing facilities will proceed in compliance with the NPDES requirements. All trucks that enter the facility shall be empty and free of refuse. No washing or maintenance of trucks or vehicles shall occur on -site. All washing and maintenance of trucks shall be done off -site. To prevent any impacts to ground water the facility has been paved with an impermeable surface that will drain to Bandini Boulevard. No excavation or other below grade work is anticipated to occur thus there will be no impact to quantity, direction, or flow of groundwater. h) Impacts to groundwater quality? p X p p h. Due to industrial activities from the previous occupant the site has significant concentrations of title 22 heavy metals in the soil. The City of Vernon Environmental Health Department has required the applicant to cap the site with a hard impermeablesurface to avoid the toxins from leaching into the groundwater. In order to prevent any impact to groundwater, a series of mitigation measures shall be implemented. First, the entire site shall be paver] with an impermeable surface to prevent toxins from leaching into the groundwater. The maintenance on the rap shall be logged in a form and manner approved by the City of Vernon Environmental Health Department. In addition, the applicant shall be required to obtain a covenant on the site indicating that there we significant concentrations of title 22 heavy metals in the soil. In compliance with the Stornr Water Pollution prevention Plan (SWPPP) a checklist for categorizing the project as exempt or priority was completed. It was determined that the project is a Priority Project as defined by the SWPPP. Therefore, an additional mitigation measure shall be implemented that required the applicant to submit a Notice of Intent to the Californi& Regional Quality Control Board (C RWQCB) to address National Pollution Discharge Elimination System r qunenxmtL Themf0t e, no impact is expected to occur from the proposed project V AIR QUALIW: Would the prioposatr a) Violate any air quality standard or contribute to an existing or projected air quality violation? O p X p a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a b 600-square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin ismonitoredby the South Coast Air Quality Management District (SCAQMD) at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. During Construction The project only entails the construction of a 400 square foot office building with no substantial grading or substructures. As compared to a similar project in the area the proposed project will not have a significant air quality impace. This was determined using the Thresholds of Significant indicated in the CEQA Air Quality Manual'; The air quality impacts associated -3- Y with construction are negligible and clearly cause no significant impact. During Operation The project site has had a history of truck terminals in the past. The proposed pro ject,does not substantially exceed the traffic trips generated by previous truck terminals. Based on previous traffic studies performed for projects of much huger scale the proposed project is not of the magnitude to produce a significant impacts Therefore, there will clearly be no significant impact. b) Expose sensitive receptors to pollutants? p p p X b. Vernon is strictly an industrial community with similar uses surrounding the project site. There are no sensitive receptors (e.g., residences, hospitals, schools) adjacent to or within one -quarter mile of the project site (distancae threshold established by the South Coast Air Quality Management Districtr. The nearest sensitive receptor is approximately.34 miles south west of the project's boundary. c) Alter air movement, moisture, or temperature, or cause any change in climate? p 0 O X +c. Vernon is a strictly industrialized area with no sensitive receptors within .25 miles of the project site. To further prevent odors, trucks and roll -offs shalt be washed and steam cleaned off -site on a, regular basis. V1. TRANSPORTATION/CIRCULATION. Would the proposal result iir: a) Increased vehicle trips or traffic congestion? O O X p a. Several freeways serve Vernon.` To the north is the Santa Ana (1-5), Santa Monica (1-10) and the Hollywood (1-101) freeways, to the west is the Harbor Freeway (1-110), and to the east is the Long Beach Freeway (1-710). Vernon has several arterials which bisect the City. The site has access to Bandini Boulevard which is 90 feet in width. During Constrvctfon The Proposed project will consist of paving the existing site and constructing a 400 square foot office building. Basal on Previous traffic studiesperformed for projects of much larger scale the proposed project is not of the magnitude to produce a significant impact` Therefore, there willclearly be no significant impact during construction. During Opa^atea During operation the faality will generate approximately 15 - 20 traffic trips per day. This is consistent with previous true terminal wed at the proposed site in the past. The traffic generated byt he proposed project was compared to Previously studied projects that are much larger in scope and it was determined that the proposed project would create clearly ; DO significant impact during operation. The flow of traffic generated by the project is outlined in the City of Vernon Community Services Department Staff Report on Si -Nor, Inc. Conditional use petrnie. To further prevent the impacts to traffic and circulation two mitigation measures shall be implemented. The first mitigation prohibits the applicant from queuing on Bandini Boulevard. Tice second, limits the number of truck and automobile trips that the facility may generate per day. The effect the traffic from the proposed' project will have on Bandini Boulevard is negligible The mitigation measures shall further reduce these traffic effects. Therefore, there will clearly be no significant impact. b) Hazards, to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? 0 O 0 X b. The proposed site is located in an existing industrial area, and the project iscompatiblewith surrounding uses. To avoid any impacts to emergency response plans, the facility shalt provide fire access as required by the 1"4 Uniform Fire Code. All queuing of vehicles shall be conducted on -site so as not to interfere with any emergency response traffic. Therefore, there will be no impact, c and d. To avoid any impacts that may be associated with the harborage or breeding of vectors on -site, a series of mitigation measures shall be implemented. In order to exclude rodents the facility's building shall be structurally maintained to exclude such vectors and the site shall be maintained in a sanitary manner. Building doors shall remain closed when the facility is not in operation. The applicant will also be required to maintain a log on -site that indicates when a licensed pest extermination service was contracted for inspection and extermination. To further avoid the impacts of any vectors entering the site a durable fence -like material shall be installed and maintained around the entire site. A litter control program shall also be implemented to maintain the facility in a safe, sanitary, and attractive condition for the life of the project. The litter control program shall include, but not be limited to, the tarping or covering of all open vehicles entering and exiting the property and the daily sweeping of the property. The proponent shall clean up any debris resulting from trucks traveling to or from the site. At the request of the City of 'Vernon, the proponent shall clean up any debris on City streets caused by the operation. Because no substantial excavation is anticipated as part of the development, the chance of unearthing any historical resources is remote. Cumulative impacts from this project and a proposed nearby projects were considered. The project is not significant enough to cause a cumulative impact to air quality, traffic, noise, groundwater, surface water, or exposure to hazardous materials. During construction the project will produce short term localized impacts associated with construction activities such as breaking of gravel, back-up safety devices, construction vehicle traffic, very minimal dust from construction, and limited use of hazardous materials used in normal construction activities. These impacts are negligible and will not create a significant impact. During the facility will operate the same. The only difference is that they will generate I I additional traffic trips; 6 additional employee trips and 5 additional tractor trips. The additionaal traffic generated during operation is negligible and will not pose a cumulative impact. Therefore, the cumulative impact for the proposed project will be clearly less then significant. d) Does the project have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly? p X 0 Ci d. FINDINGS: The City Council of the City of Vernon has determined that this project will not have a significant effect on the environment. The mitigation measures and conditions are designated to ensure protection of public health and the environment. L,: U MITIGATION MONITORING PROGRAM SI-NOR, INC. TRUCKING TERMINAL LOCATED AT 3689 BANDINI BOULEVARD VERNON, CALIFORNIA (February 8,1999) Introduction The Negative Declaration, prepared for Si -Nor, Inc., Trucking Terminal (State Clearinghouse No.XXXXXXXXX) at 3689 Bandini Boulevard in the City of Vernon, indicates that the proposal may have potential impacts on the environment in the absence of any mitigation. The Negative Declaration indicates specific measures and programs that should be adopted, as part of the development approval, to ensure the potential adverse impacts are mitigated. In accordance with requirements of Section 21081.6 of the Public Resources Code, the City Council makes the following, additional findings: • A mitigation reporting and monitoring program shall be implemented as specified for the Trucking Terminal. • Site plans and/or building plans, submitted for approval by the responsible monitoring agency, shall include the required mitigation measures/conditions; and • An accountable enforcement agency and monitoring agency shall be identified for mitigation measures/conditions adopted as part of the decision maker's final determination. This Mitigation Monitoring Program (MMP) was prepared by the City of Vernon Community Services Department in accordance with AB 3180. The comprehensive MMP presents the mitigation measures which have been adopted as conditions of approval by the Vernon City Council, in conjunction with the adoption of the Negative Declaration prepared for this project, and the respective monitoring of these measures to be conducted by City staff and/or by their environmental consultant. The MMP will serve a dual purpose of verifying implementation of the mitigation measures for the Trucking Terminal and of generating information on the effectiveness of the mitigation measures to guide future mitigation programs. Scope of the MMP The environmentalanalysis contained in the Initial Study incorporated herein by reference, focused on issues determined to be potentially significant by the City of Vernon. The environmental analysis concluded that the environmental issues discussed in the Initial Study, the significant and potentially significant impacts -could be avoided or reduced to a level below significance through the implementation of recommended mitigation measures. 1 Components of the MMP The MMP is comprised of three separate phases of monitoring to ensure that all project mitigation measures have been fully implemented: (1) monitoring that will occur prior to issuance of permit; (2) monitoring that will occur during the project's construction; and (3) monitoring that will occur on an on -going basis throughout the life -time of the project. onitorin2 Prior to Permit Issu The first phase of the monitoring will occur prior to the issuance of project permits (e.g., conditional use permit, building permit and grading permit) and will involve review and approval, by the City or other agencies, of the various design details and plans necessary to implement the project. The Initial Study calls for certain design details, as well as other specific plans, to be implemented during project operations. City staff and other agencies, as part of their plan review, will check to make sure that the required items have been incorporated into these plans. onitorin2 Durine Constructio Once the mitigation measures have been adopted as conditions of approval by the City of Vernon, a construction monitoring team will be identified. Managing the team will be the responsibility of a mitigation compliance coordinator at the City. Prior to any project implementation activities, a pre -construction meeting will take place between the City of Vernon staff and all individuals involved in the completion of the MMP to clearly establish the responsibility and authority of the participants. An effective reporting system will be established prior to any monitoring activities. All parties involved will have a clear understanding of the mitigation measures as adopted, and the mitigation measures must be distributed to the participants of the monitoring effort. Those that will have a complete list of all the mitigation measures adopted by the City would include the City of Vernon, the applicant and the construction crew supervisor. Compliance report forms will be prepared with each mitigation measure written out on the top of the form. All persons responsible for monitoring measures shall complete the report and file it with the City following each monitoring activity. The compilation of these forms for each monitoring effort will be condensed into a comprehensive Monitoring Report by the appropriate City staff. The Monitoring Report will describe the major accomplishments of the monitoring program, summarize the problems encountered in achieving the goals of the program, evaluate solutions developed to overcome problems, and provide a list of recommendations for future monitoring efforts. �m-going tvionitoring The requirements for on -going monitoring will be specified in the permit conditions of the project or in the back-up reports required as a result of those permit conditions. The City of Vernon will be -2- responsible for ensuring that their permit conditions for the Trucking Terminal are being implemented. Actual monitoring activities may be carried out by City -staffed field inspections, other agency -staffed inspections, or by specialists hired by the City or the project applicant to carry out specific programs. In this case, the City or other permitting agency will be responsible for reviewing the monitoring reports as they are submitted by the project applicant or monitors. Non -Compliance Procedures There are generally three separate categories of non-compliance associated with the adopted conditions of approval: • Non-compliance requiring an immediate halt to a specific task or piece of equipment. • Non-compliance requiring immediate corrective action, with no work or task delay. • Non-compliancethat does not warrant immediate corrective action and results in no work or task delay. In all three cases, the City will notify the applicant. If non-compliance continues, the responsibility for enforcement is with the City. Some methods commonly used by other lead agencies include: "stop work" orders, fines and penalties (civil), permit revocations, citations, and injunctions. It is essential that all parties involved in the MAP understand the authority and responsibility of the on - site monitors.
