Director of Community Services & Water SKW: pp Attachments cc: City Attorney STAFF REPORT ANGELUS SANITARY CAN MACHINE COMPANY 4900 PACIFIC BOULEVARD VARIANCE APPLICATION (March 25, 1999) Angelus Sanitary Can Machine Company has submitted a variance application for the property located at 4900 Pacific Boulevard in the City of Vernon. They are requesting a variance from Section 26.4.2-7 pursuant to Section 26.4.E-4(d) of the Comprehensive Zoning Ordinance. They are expanding their facility yet have insufficient space on the said lot to conform with required truck loading and parking requirements. Angelus Sanitary Can Machine Company obtained a similar variance on December 18, 1990 for an expansion of use with insufficient truck parking and loading. The variance was granted subject to the conditions that upon change in occupancy the entire facility would be made to conform with the current Comprehensive Zoning Ordinance, no off -site truck loading or parking would occur, and Angelus Sanitary Can Machine Company would maintain five conforming truck loading or parking spaces. Currently they are in conformance with the conditions set forth in their previous variance. Angelus Sanitary Can Machine Company has been in existence since 1910. Since then, their facility has grown to 267,764 square feet of building area on approximately 10 acres. They currently have approximately 390 employees that manufacture automatic machines that close open top "sanitary" cans, also known as Can Seamers. The machines are sold and delivered to -1- canning companies throughout the world. After assembling a Can Seamer it is packaged according to the method of delivery (i.e. ship, air, freight, etc.) and then loaded onto a flat bed truck by an overhead crane. Angelus Sanitary Can Machine Company is proposing to construct a detached 8,768 square foot one story industrial building in the existing automobile parking lot. The addition will be constructed on 23 of the existing automobile parking spaces. Including the proposed addition, the facility shall be required to have 287 conforming automobile parking spaces. After completion of the proposed addition there will be 291 conforming parking spaces remaining. The variance is consistent with the Comprehensive Zoning Ordinance in that strict application would cause an unreasonable hardship to Angelus Sanitary Can Machine Company. Constructing the required loading spaces would render a significant portion of their manufacturing operation off-limits. This would dramatically affect their production line and have a detrimental affect on their manufacturing operation. Furthermore, the variance is intended to be used for additional manufacturing area not warehousing, thus it is consistent with the intent of the General Plan. As previously discussed the existing use has been in operation for over 85 years without adversely effecting the surrounding area. The expansion of their operation will not significantly increase traffic trips or negatively affect the -2- surrounding area. Angelus Sanitary Can Machine Company shall therefore continue to be consistent with the surrounding uses with approval of the variance. Angelus Sanitary Can does not require the number of truck spaces specified by the Comprehensive Zoning Ordinance. Due to the nature of the operation the applicant does not require more than two truck loading trips per week. The proposed site plan has provided two truck loading and five truck parking spaces. Furthermore, the proposed site plan complies with the automobile parking requirements of the Comprehensive Zoning Ordinance. To be in full compliance with the Comprehensive Zoning Ordinance, Angelus Sanitary Can Machine Company is required to have fourteen truck loading and six truck parking spaces. The existing facility has a total of seven conforming truck loading and parking spaces. The trucks enter the facility from one of the two truck driveways on Pacific Boulevard, load, unload, or park at one of the seven truck loading/parking spaces, then exit on Pacific Boulevard. As previously discussed, due to the nature of the operation it is very rare that Angelus Sanitary Can Machine Company has more than one truck at the facility at any one time. There are two truck loading and five truck parking spaces throughout the facility. The two truck loading spaces are situated in the Crane Bay Building located in the center of the facility. These loading spaces are used for shipping and receiving of raw materials used in fabricating the Can Seamers. -3- The truck parking spaces are distributed around the north Crane Bay. All trucks access these spaces from one of two driveways on Pacific Boulevard. The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no substantial expansion of use. A Notice of Exemption will be prepared and filed with the County Clerk. Staff proposes the following findings: a) The facility has a total of two conforming truck loading spaces, none of which impede the public right of way. Strict application of the Comprehensive Zoning Ordinance Code would create a hardship on Angelus Sanitary Can Machine Company, by requiring them to demolish a portion of their already crowded manufacturing facility to construct unneeded truck loading and parking spaces. b) This variance will not adversely affect the interest of the public or the interests of other residents and property owners within the vicinity of the premises because the applicant's loading spaces will not impede the public right of way. In addition no street parking or loading shall be allowed to occur as part of Angelus Sanitary Can Machine Company's operation. c) The facility does not meet the minimum number of truck loading spaces, however as previously indicated it is rare that -4- Angelus Sanitary Can Machine Company has more than one truck loading at the facility, at any one time. Angelus Sanitary Can Machine Company does not require the number of truck loading spaces as indicated in Section 26.4.2-7(b). The operation is in conformance with the Comprehensive Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the following conditions: a) Upon any change in use or occupancy of all or a portion of the site, the entire site shall be made to conform to all truck and automobile parking requirements and all truck loading requirements. b) No on -street automobile parking, truck loading, or truck parking shall occur as a by product of Angelus Sanitary Can Machine Company's operation. All truck maneuvering shall be performed on -site. c) Angelus Sanitary Can Machine Company shall maintain a minimum of two truck loading and five truck parking spaces on the subject site. d) All required federal, state, local and regulatory agency permits shall be obtained prior to occupancy of the proposed building. -5- CITY COUNCIL / LEONIS C. NOTICE TO APPLICANT: In the variance procedure it shall be shown that the following five (5) conditions exist in reference to the property being considered. The applicant should answer the following statements. If you have difficulty finding reasonable answers to the statements contained in this application it may be an indication that your request has insufficient factors to justify approval. (Attached additional sheet (s) if necessary) (1) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not generally applicable to other lands, structures, or buildings in the same vicinity and zone: The existing facility was developed in 1910 on a portion of the site which was added to over the years to its current approximately 10 acres. As competition and technology demands have increase to meet world wide demands, the Company with about 390 employees, needs additional space in order to accommodate our needs. Unlike other industrial uses in the area on smaller parcels of land, we have sufficient space to provide for expansion as well as providing substantial parking for employees and visitors in compliance with Section 26.4.2-6 of the Code. The fact that the Company has been on the site since 1910, indicates the special circumstances and conditions not applicable to other properties. (2) That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same vicinity and zone in which the property is located, under the terms of this Chapter. Section 26.4.2-7, provides truck parking and truck loading standards which would require 14 truck parking spaces at 20,000 square feet per gross floor area 274,902 divided by 20,000 and 6 truck loading spaces. Our plant has no more than two truck loading needs operations per week and therefore, its expansion does not require any additional truck demands. Other services needs are provided by small trucks and delivery vans on an infrequent basis. Thus, the literal interpretation of the ordinance would result in the deprivation of a property right enjoyed by other properties in the same zone and vicinity. Page 3 of 4 (3) That the special conditions and circumstances do not result from actions of the applicant: The special conditions and circumstances are uniquely applied in this instance since the applicant operates a plant facility which is not the usual or customary operation in that it is not served by large number of 18 wheel trucks to distribute its production. No more than two (2) trucks per week and at times no trucks serve this facility. (4) That granting the variance requested will not confer on the applicant any special privilege that is denied by this Chapter to other lands, structures, or buildings in the same vicinity and zone in which the property is located: The granting of a variance to the applicant will not result in a special privilege since the applicants facility is unique in its operation and that the truck parking and loading provisions of the Code do not affect or benefit the applicant's plant facility in terms of its operation and distribution. (5) That the granting of such variance will be in harmony and not adversely affect the Comprehensive General Plan: The granting of a variance in this particular case will not be adverse to any element of the General Plan and will also, by the same token, be in harmony since its expansion will not increase any large truck traffic in and around its facility. It is requested that no additional truck parking and loading facilities be provided for the additional building area which when added will increase the existing 267,764 sq. ft. of structures to 274,968 square foot. Section 26.4.2-7, provides truck parking and truck loading standards which would require 14 truck parking spaces at 20,000 square feet per gross floor area 274,968 divided by 20,000 and 6 truck loading spaces. Malkenhorst, City Administrator FROM: Samuel "Kevin" Wilson, Director of Community Services & Water SUBJECT: VARIANCE - Angelus Sanitary Can Machine Co. at 4900 Pacific Boulevard On March 16, 1999 the City Council of the City of Vernon continued the Public Hearing regarding the application for variance for Angelus Sanitary Can Machine Company located at 4900 Pacific Boulevard continued to March 30, 1999. The Department of Community Services has added the underlined section of finding a) in the Staff Report dated March 25, 1999: a) The facility has a total of two conforming truck loading spaces, none of which impede the public right of way. Strict application of the truck parking and loading facility requirements of the Comprehensive Zoning Ordinance would create a hardship on Angelus Sanitary Can Machine Company, by requiring them to demolish a portion of their already crowded manufacturing facility to construct unneeded truck loading and parking spaces. A copy of the revised Staff Report with the new findings is attached for your review. SKW:pp STAFF REPORT ANGELUS SANITARY CAN MACHINE COMPANY 4900 PACIFIC BOULEVARD VARIANCE APPLICATION (March 25, 1999) Angelus Sanitary Can Machine Company has submitted a variance application for the property located at 4900 Pacific Boulevard in the City of Vernon. After completion oftheproposed addition there will be 291 conforming parking spaces remaining. Furthermore, the variance is intended to be used for additional manufacturing area not warehousing, thus it is consistent with the intent of the General Plan As previously discussed the existing use has been in operation for over 85 years without adversely effecting the surrounding area. Strict application of the truck parking and loading facility requirements of the Comprehensive Zoning Ordinance would create a hardship on Angelus Sanitary Can Machine Company, by requiring them to demolish a portion of their already crowded manufacturing facility to construct unneeded truck loading and parking spaces. b) This variance will not adversely affect the interest of the public or the interests of other residents and property owners within the vicinity of the premises because the applicant's loading spaces will not impede the public right of way. In addition no street parking or loading shall be allowed to occur as part of Angelus Sanitary Can Machine Company's operation. c) The facility does not meet the minimum number of truck loading spaces, however as previously indicated it is rare that -4- a Angelus Sanitary Can Machine Company has more than one truck loading at the facility, at any one time. -5- • 0 FILL ' NOTICE OF EXEMPTION APR 151999 CONNY B. Sanitary Can Machine Company is proposing to construct a detached 8,768 square foot one story industrial building in the existing automobile parking lot. The addition will be constructed on 23 of the existing automobile parking spaces to expand their already crowded manufacturing facility. The addition will not create additional traffic trips. The facility currently has 7 truck loading and parking spaces. Strict application of the Comprehensive Zoning Ordinance would require the facility to demolish a portion of their facility to provide the required 14 truck loading and 6 truck parking spaces. This would cause Angelus Sanitary Can Machine Company an unreasonable hardship. Due to the intricacy of the machinery they manufacture, they only require 2 truck deliveries per week. The facility manufactures Caning Machines in a 267,764 square foot Industrial plant and employs approximately 390 people. IS CE' V . i MALKENHORS / City Administrator/ ty Clerk March 30, 1999 TO: Bruce V. SKW: pp STAFF REPORT ANGELUS SANITARY CAN MACHINE COMPANY 4900 PACIFIC BOULEVARD VARIANCE APPLICATION (March 25, 1999) Angelus Sanitary Can Machine Company has submitted a variance application for the property located at 4900 Pacific Boulevard in the City of Vernon. Including the proposed addition, the'facility shall be required to have 287 conforming automobile parking spaces. In addition no street parking or loading shall be allowed to occur as part of Angelus Sanitary Can Machine Company's operation. c) The facility does not meet the minimum number of truck loading spaces, however as previously indicated it is rare that -4- Angelus Sanitary Can Machine Company has more than one truck loading at the facility, at any one time. 'All truck maneuvering shall be performed on -site. c) Angelus Sanitary Can Machine Company shall maintain a minimum of two truck loading and five truck parking spaces on the subject site. d) All required federal, state, local and regulatory agency permits shall be obtained prior to occupancy of the proposed building. -5-
