A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
VARIANCE TO ANGELUS SANITARY CAN
MACHINE COMPANY FROM SECTION 26.4.2-
7, MINIMUM TRUCK PARKING AND LOADING
FACILITY REQUIREMENTS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4900 PACIFIC
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Angelus Sanitary Can Machine Company owns
the property located at 4900 Pacific Boulevard in the City
of Vernon and is requesting a variance from Section 26.4.2-
7, Minimum truck parking and loading facility requirements,
of the Comprehensive Zoning Ordinance; and
WHEREAS, the property is unique in that the site
is approximately 10 acres in size with the existing
buildings measuring approximately 267,764 square feet, has 2
conforming truck loading spaces, and 5 conforming truck
parking spaces, and the building currently contains both
industrial and office operations; and
WHEREAS, the owner is proposing to construct a
detached 8,768 square foot one story industrial building in
the existing automobile parking lot; and
WHEREAS, Zoning Ordinance Section 26.4.2-7
requires 6 truck loading spaces and 14 truck parking spaces
for this facility, and that each space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.E-4(e)
specifies that a minimum forty (40) feet of unobstructed
space shall be maintained in front of all truck loading and
28IIParking spaces for maneuvering; and
I WHEREAS, Angelus Sanitary Can Machine Company has
2 been in operation since 1910 and has since grown to employ
3 approximately 390 people and occupy 267,764 square feet of
4 manufacturing floor area on approximately 10 acres; and
5 WHEREAS, Angelus Sanitary Can Machine Company has
6 a unique operation in that they only require 2 truck loading
7 needs per week and require an infrequent number of
8 deliveries by small trucks and vans due to the intricacy of
9 the machinery they manufacture; and
10 WHEREAS, the facility has a total of two
11 conforming truck loading spaces, none of which impedes the
12 public right of way, and strict application of the truck
13 parking and loading facility requirements of the
14 Comprehensive Zoning Ordinance would create a hardship on
15 Angelus Sanitary Can Machine Company by requiring them to
16 demolish a portion of their already crowded manufacturing
17 facility to construct unneeded truck parking and loading
18 spaces; and
19 WHEREAS, the variance will not adversely affect
20 the interests of the public or the interests of other
21 residents and property owners within the vicinity of the
22 premises in question; and
23 WHEREAS, the use proposed by Angelus Sanitary Can
24 Machine Company does not require the number of truck parking
25 spaces or the loading area required by the Comprehensive
26 Zoning Ordinance; and
27 WHEREAS, 4900 Pacific Boulevard is located in the
28 M-Zone and the operation is consistent with the objectives

I c) Angelus Sanitary Can Machine Company shall
2 maintain a minimum of two truck loading and five truck
3 parking spaces on the subject site.
4 d) All required federal, state, local and
5 regulatory agency permits shall be obtained prior to
6 occupancy of the proposed building.
7 SECTION 4: Noncompliance with these conditions
8 shall constitute sufficient grounds for the City Council of
9 the City of Vernon to void this variance and require the
10 strict application of Section 26.4.2-7, Minimum truck
11 parking and loading facility requirements, of the
12 Comprehensive Zoning Ordinance.
13 SECTION 5: The City Clerk of the City of Vernon
14 shall certify to the passage of this Resolution and
15 thereupon and thereafter the same shall be in full force and
16 effect.

County (Districts) on March 5, 1999. The proposed development is located within the jurisdictional
boundaries of District No. 23. We offer the following comment regarding sewerage service:
• The proposed project may require an amendment to a Districts' permit for Industrial Wastewater
Discharge. Project developers should contact the Districts' Industrial Waste Section in order to
reach a determination on this matter. If this update is necessary, project developers will be required
to forward a copy of final plans for the proposed project to the Districts for review and approval
before beginning project construction.

On March 16, 1999 the City Council of the City of Vernon
continued the Public Hearing regarding the application for
variance for Angelus Sanitary Can Machine Company located at 4900
Pacific Boulevard continued to March 30, 1999. The Department of
Community Services has amended the findings that pertain to the
aforementioned variance and are contained in the revised Staff
Report dated March 25, 1999. The Staff Report now indicates that
the variance is intended to be used for additional manufacturing
area not warehousing, thus it is consistent with the intent of
the General Plan; and an addition to finding b. which states that
no street parking or loading shall be allowed to occur as pint of
Angelus Sanitary Can Machine Company's operation. A copy of the
revised Staff Report with the new findings is attached for your
review.

VARIANCE APPLICATION
(March 25, 1999)
Angelus Sanitary Can Machine Company has submitted a
variance application for the property located at 4900 Pacific
Boulevard in the City of Vernon. They are requesting a variance
from Section 26.4.2-7 pursuant to Section 26.4.E-4(d) of the
Comprehensive Zoning Ordinance. They are expanding their
facility yet have insufficient space on the said lot to conform
with required truck loading and parking requirements.
Angelus Sanitary Can Machine Company obtained a similar
variance on December 18, 1990 for an expansion of use with
insufficient truck parking and loading. The variance was granted
subject to the conditions that upon change in occupancy the
entire facility would be made to conform with the current
Comprehensive Zoning Ordinance, no off -site truck loading or
parking would occur, and Angelus Sanitary Can Machine Company
would maintain five conforming truck loading or parking spaces.
Currently they are in conformance with the conditions set forth
in their previous variance.
Angelus Sanitary Can Machine Company has been in existence
since 1910. Since then, their facility has grown to 267,764
square feet of building area on approximately 10 acres. They
currently have approximately 390 employees that manufacture
automatic machines that close open top "sanitary" cans, also
known as Can Seamers. The machines are sold and delivered to

canning companies throughout the world. After assembling a Can
Seamer it is packaged according to the method of delivery (i.e.
ship, air, freight, etc.) and then loaded onto a flat bed truck
by an overhead crane.
Angelus Sanitary Can Machine Company is proposing to
construct a detached 8,768 square foot one story industrial
building in the existing automobile parking lot. The addition
will be constructed on 23 of the existing automobile parking
spaces. Including the proposed addition, the facility shall be
required to have 287 conforming automobile parking spaces. After
completion of the proposed addition there will be 291 conforming
parking spaces remaining.
The variance is consistent with the Comprehensive Zoning
Ordinance in that strict application would cause an unreasonable
hardship to Angelus Sanitary Can Machine Company. Constructing
the required loading spaces would render a significant portion of
their manufacturing operation off-limits. This would
dramatically affect their production line and have a detrimental
affect on their manufacturing operation. Furthermore, the
variance is intended to be used for additional manufacturing area
not warehousing, thus it is consistent with the intent of the
General Plan.
As previously discussed the existing use has been in
operation for over 85 years without adversely effecting the
surrounding area. The expansion of their operation will not
significantly increase traffic trips or negatively affect the

surrounding area. Angelus Sanitary Can Machine Company shall
therefore continue to be consistent with the surrounding uses
with approval of the variance.
Angelus Sanitary Can does not require the number of truck
spaces specified by the Comprehensive Zoning Ordinance. Due to
the nature of the operation the applicant does not require more
than two truck loading trips per week. The proposed site plan
has provided two truck loading and five truck parking spaces.
Furthermore, the proposed site plan complies with the automobile
parking requirements of the Comprehensive Zoning Ordinance.
To be in full compliance with the Comprehensive Zoning
Ordinance, Angelus Sanitary Can Machine Company is required to
have fourteen truck loading and six truck parking spaces. The
existing facility has a total of seven conforming truck loading
and parking spaces. The trucks enter the facility from one of
the two truck driveways on Pacific Boulevard, load, unload, or
park at one of the seven truck loading/parking spaces, then exit
on Pacific Boulevard. As previously discussed, due to the nature
of the operation it is very rare that Angelus Sanitary Can
Machine Company has more than one truck at the facility at any
one time.
There are two truck loading and five truck parking spaces
throughout the facility. The two truck loading spaces are
situated in the Crane Bay Building located in the center of the
facility. These loading spaces are used for shipping and
receiving of raw materials used in fabricating the Can Seamers.

The truck parking spaces are distributed around the north Crane
Bay. All trucks access these spaces from one of two driveways on
Pacific Boulevard.
The proposed site is surrounded by industrial uses
compatible with the proposed use. No potentially significant
impacts are expected to result from the project. The project is
categorically exempt under Section 15301 of the California
Environmental Quality Act because it is an existing facility with
no substantial expansion of use. A Notice of Exemption will be
prepared and filed with the County Clerk.
Staff proposes the following findings:
a) The facility has a total of two conforming truck loading
spaces, none of which impede the public right of way. Strict
application of the Comprehensive Zoning Ordinance Code would
create a hardship on Angelus Sanitary Can Machine Company, by
requiring them to demolish a portion of their already crowded
manufacturing facility to construct unneeded truck loading and
parking spaces.
b) This variance will not adversely affect the interest of
the public or the interests of other residents and property
owners within the vicinity of the premises because the
applicant's loading spaces will not impede the public right of
way. In addition no street parking or loading shall be allowed
to occur as part of Angelus Sanitary Can Machine Company's
operation.
c) The facility does not meet the minimum number of truck
loading spaces, however as previously indicated it is rare that

loading at the facility, at any one time. Angelus Sanitary Can
Machine Company does not require the number of truck loading
spaces as indicated in Section 26.4.2-7(b).
The operation is in conformance with the Comprehensive
Zoning Ordinance and General Plan. Therefore, it is recommended
that the variance be granted with the following conditions:
a) Upon any change in use or occupancy of all or a portion
of the site, the entire site shall be made to conform to all
truck and automobile parking requirements and all truck loading
requirements.
b) No on -street automobile parking, truck loading, or truck
parking shall occur as a by product of Angelus Sanitary Can
Machine Company's operation. All truck maneuvering shall be
performed on -site.
c) Angelus Sanitary Can Machine Company shall maintain a
minimum of two truck loading and five truck parking spaces on the
subject site.
d) All required federal, state, local and regulatory agency
permits shall be obtained prior to occupancy of the proposed
building.

Seamer it is packaged according to the method of delivery (i.e.
ship, air, freight, etc.) and then loaded onto a flat bed truck
by an overhead crane.
Angelus Sanitary Can Machine Company is proposing to
construct a detached 8,768 square foot one story industrial
building in the existing automobile parking lot. The addition
will be constructed on 23 of the existing automobile parking
spaces. Including the proposed addition, the facility shall be
required to have 287 conforming automobile parking spaces. After
completion of the proposed addition there will be 302 conforming
parking spaces remaining.
To be in full compliance with the Comprehensive Zoning
Ordinance, Angelus Sanitary Can Machine Company is required to
have 14 truck loading and 6 truck parking spaces. The existing.
facility has a total of 7 conforming truck loading and parking
spaces. The trucks enter the facility from one of the two truck
driveways on Pacific Boulevard, load, unload, or park at one of
the 7 truck loading/parking spaces, then exit on Pacific
Boulevard. Due to the nature of the operation it is very rare
that Angelus Sanitary Can Machine Company has more than one truck
at the facility at any one time.
There are 2 truck loading and 5 truck parking spaces
throughout the facility. Two truck loading spaces are situated
in the Crane Bay Building located in the center of the facility.
These two truck loading spaces are used for shipping and

receiving of raw materials used in fabricating the Can Seamers.
The truck parking spaces are distributed around the north Crane
Bay. All trucks access these spaces from one of two driveways on
Pacific Boulevard.
The proposed site is surrounded by industrial uses
compatible with the proposed use. No potentially significant
impacts are expected to result from the project. The project is
categorically exempt under Section 15301 of the California
Environmental Quality Act because it is an existing facility with
no substantial expansion of use. A Notice of Exemption will be
prepared and filed with the County Clerk.
Staff proposes the following findings:
a) As previously mentioned, the facility has a total of 2
conforming truck loading spaces, none of which impede the public
right of way. Strict application of the Comprehensive Zoning
Ordinance Code would create a hardship on Angelus Sanitary Can
Machine Company, by requiring them to demolish a portion of their
already crowded facility to construct unneeded truck loading and
parking spaces.
b) This variance will not adversely affect the interest of
the public or the interests of other residents and property
owners within the vicinity of the premises because the
applicant's loading spaces will not impede the public right of
way.
c) The facility does not meet the minimum number of truck
loading spaces, however as previously indicated it is rare that

Angelus Sanitary Can Machine Company has more than one truck
loading at the facility, at any one time. Angelus Sanitary Can
Machine Company does not require the number of truck loading
spaces as indicated in Section 26.4.2-7(b).
The operation is in conformance with the Comprehensive
Zoning Ordinance and General Plan. Therefore, it is recommended
that the variance be granted with the following conditions:
a) Upon any change in use or occupancy of all or a portion
of the site, the entire site shall be made to conform to all
truck and automobile parking requirements and all truck loading
requirements.
b) No on -street automobile parking, truck loading, or truck
parking shall occur as a by product of Angelus Sanitary Can
Machine Company's operation. All truck maneuvering shall be
performed on -site.
c) Angelus Sanitary Can Machine Company shall maintain a
minimum of two truck loading and five truck parking spaces on the
subject site.

employees and visitors in compliance with Section 26.4.2-6 of the Code. The fact that the Company
has been on the site since 1910, indicates the special circumstances and conditions not applicable to

(2) That literal interpretation of the provisions of this ordinance would deprive the applicant of rights
commonly enjoyed by other properties in the same vicinity and zone in which the property is located,
under the terms of this Chapter.
Section 26.4.2-7, provides truck parking and truck loading standards which would require 14 truck
parking spaces at 20,000 square feet per gross floor area 274,902 divided by 20,000 and 6 truck
loading spaces. Our plant has no more than two truck loading needs operations per week and

ANGELUS SANITARY CAN MACHINE COMPANY
4900 PACIFIC BOULEVARD
VARIANCE APPLICATION
(March 25, 1999)
Angelus Sanitary Can Machine Company has submitted a
variance application for the property located at 4900 Pacific
Boulevard in the City of Vernon. They are requesting a variance
from Section 26.4.2-7 pursuant to Section 26.4.E-4(d) of the
Comprehensive Zoning Ordinance. They are expanding their
facility yet have insufficient space on the said lot to conform
with required truck loading and parking requirements.
Angelus Sanitary Can Machine Company obtained a similar
variance on December 18, 1990 for an expansion of use with
insufficient truck parking and loading. The variance was granted
subject to the conditions that upon change in occupancy the
entire facility would be made to conform with the current
Comprehensive Zoning Ordinance, no off -site truck loading or
parking would occur, and Angelus Sanitary Can Machine Company
would maintain five conforming truck loading or parking spaces.
Currently they are in conformance with the conditions set forth
in their previous variance.
Angelus Sanitary Can Machine Company has been in existence
since 1910. Since then, their facility has grown to 267,764
square feet of building area on approximately 10 acres. They
currently have approximately 390 employees that manufacture
automatic machines that close open top "sanitary" cans, also
known as Can Seamers. The machines are sold and delivered to

canning companies throughout the world. After assembling a Can
Seamer it is packaged according to the method of delivery (i.e.
ship, air, freight, etc.) and then loaded onto a flat bed truck
by an overhead crane.
Angelus Sanitary Can Machine Company is proposing to
construct a detached 8,768 square foot one story industrial
building in the existing automobile parking lot. The addition
will be constructed on 23 of the existing automobile parking
spaces. Including the proposed addition, the facility shall be
required to have 287 conforming automobile parking spaces. After
completion oftheproposed addition there will be 291 conforming
parking spaces remaining.
The variance is consistent with the Comprehensive Zoning
Ordinance in that strict application would cause an unreasonable
hardship to Angelus Sanitary Can Machine Company. Constructing
the required loading spaces would render a significant portion of
their manufacturing operation off-limits. This would
dramatically affect their production line and have a detrimental
affect on their manufacturing operation. Furthermore, the
variance is intended to be used for additional manufacturing area
not warehousing, thus it is consistent with the intent of the
General Plan
As previously discussed the existing use has been in
operation for over 85 years without adversely effecting the
surrounding area. The expansion of their operation will not
significantly increase traffic trips or negatively affect the

surrounding area. Angelus Sanitary Can Machine Company shall
therefore continue to be consistent with the surrounding uses
with approval of the variance.
Angelus Sanitary Can does not require the number of truck
spaces specified by the Comprehensive Zoning Ordinance. Due to
the nature of the operation the applicant does not require more
than two truck loading trips per week. The proposed site plan
has provided two truck loading and five truck parking spaces.
Furthermore, the proposed site plan complies with the automobile
parking requirements of the Comprehensive Zoning Ordinance.
To be in full compliance with the Comprehensive Zoning
Ordinance, Angelus Sanitary Can Machine Company is required to
have fourteen truck loading and six truck parking spaces. The
existing facility has a total of seven conforming truck loading
and parking spaces. The trucks enter the facility from one of
the two truck driveways on Pacific Boulevard, load, unload, or
park at one of the seven truck loading/parking spaces, then exit
on Pacific Boulevard. As previously discussed, due to the nature
of the operation it is very rare that Angelus Sanitary Can
Machine Company has more than one truck at the facility at any
one time.
There are two truck loading and five truck parking spaces
throughout the facility. The two truck loading spaces are
situated in the Crane Bay Building located in the center of the
facility. These loading spaces are used for shipping and
receiving of raw materials used in fabricating the Can Seamers.

The truck parking spaces are distributed around the north Crane
Bay. All trucks access these spaces from one of two driveways on
Pacific Boulevard.
The proposed site is surrounded by industrial uses
compatible with the proposed use. No potentially significant
impacts are expected to result from the project. The project is
categorically exempt under Section 15301 of the California
Environmental Quality Act because it is an existing facility with
no substantial expansion of use. A Notice of Exemption will be
prepared and filed with the County Clerk.
Staff proposes the following findings:
a) The facility has a total of two conforming truck loading
spaces, none of which impede the public right of way. Strict
application of the truck parking and loading facility
requirements of the Comprehensive Zoning Ordinance would create a
hardship on Angelus Sanitary Can Machine Company, by requiring
them to demolish a portion of their already crowded manufacturing
facility to construct unneeded truck loading and parking spaces.
b) This variance will not adversely affect the interest of
the public or the interests of other residents and property
owners within the vicinity of the premises because the
applicant's loading spaces will not impede the public right of
way. In addition no street parking or loading shall be allowed
to occur as part of Angelus Sanitary Can Machine Company's
operation.
c) The facility does not meet the minimum number of truck
loading spaces, however as previously indicated it is rare that

Machine Company does not require the number of truck loading
spaces as indicated in Section 26.4.2-7(b).
The operation is in conformance with the Comprehensive

that the variance be granted with the following conditions:

of the site, the entire site shall be made to conform to all
truck and automobile parking requirements and all truck loading
requirements.
b) No on -street automobile parking, truck loading, or truck
parking shall occur as a by product of Angelus Sanitary Can
Machine Company's operation. All truck maneuvering shall be
performed on -site.
c) Angelus Sanitary Can Machine Company shall maintain a
minimum of two truck loading and five truck parking spaces on the
subject site.
d) All required federal, state, local and regulatory agency
permits shall be obtained prior to occupancy of the proposed
building.
