Resolution No. 73001 RESOLUTION NO, 7300 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 7062 WHICH PROVIDED 4 FOR THE ESTABLISHMENT OF ELECTRICAL RATES TO BE CHARGED FOR ELECTRICAL ENERGY DISTRIBUTED AND 5 SUPPLIED BY SAID CITY WITHIN ITS BOUNDARIES BY ADDING NEW RATE SCHEDULE NO. NM (NET METERING) 6 7 WHEREAS, the City Council of the City of Vernon adopted 8 Resolution No. 7062 on December 16, 1997, which provided for the 9 establishment of electrical rates to be charged for electrical energy 10 distributed and supplied by the City within its boundaries; and 11 WHEREAS, the City Council of the City of Vernon adopted 12 Ordinance No. 1030 on May 15, 1984, providing that rates to be charged 13 for electrical energy distributed and supplied by said City within its 14 boundaries shall be set by resolution; and 15 WHEREAS, the City of Vernon desires to establish "net energy 16 metering" pursuant to § 2827 of the Public Utilities Code; and 17 WHEREAS, the City Council of the City of Vernon finds it 18 necessary to add new Schedule No. NM (Net Metering) in order to 19 establish rates and charges for electricity sold in conformance with 20 § 2827 of the Public Utilities Code. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 22 CITY OF VERNON AS FOLLOWS: 23 SECTION 1: The City Council of the City of Vernon does 24 hereby find and determine that the recitals contained hereinabove are 25 true and correct. 26 SECTION 2: The City Council of the City of Vernon hereby 27 adopts, as the City's rates, terms and conditions for the distribution 28 of the electrical energy supplied by the City of Vernon, Rate Schedule 1 No. NM (Net Metering), Exhibit "A," pages 44 and 45 to be effective 2 April 1, 1999, a copy of which has been presented to the City Council 3 concurrently with this resolution, and the City Council hereby orders 4 said Schedule to be received and filed by the City Clerk. 5 SECTION 3: In all other respects, Resolution No. 7062 shall 6 remain in full force and effect and the provisions contained in 7 Resolution No. 7062 not consistent with or in conflict with this 8 resolution are hereby repealed. 9 SECTION 4: The City Clerk of the City of Vernon shall 10 certify to the passage of this resolution and thereupon and thereafter 11 the same shall be in full force and effect. 12 APPROVED AND ADOPTED this 30th day of March, 1999. 13 G EONIS C. This standard contract or tariff is to be made available to eligible customer -generators upon request, on a first -come, first -serviced basis until the time that the total rated generating capacity used by eligible customer -generators equals one -tenth of one percent (0.1%) of the electric service provider's aggregate customer peak demand. Submitted herewith is proposed Schedule No. NM, Net Metering, which has also been reviewed by the City Attorney, and it is hereby recommended that said Schedule be approved. Malkenhorst, City Administrator FROM: Kenneth I DeDario, Director of Utilities SUBJECT: Net Metering Assembly Bill 1755, which was enacted on September 24, 1998, requires every electric service provider in the state to develop a standard contract on ariff providing for net energy metering for eligible customer -generators. AB 1755 defines an eligible customer -generator as a residential or small commercial customer who uses a solar or wind turbine electrical generating facility, or a hybrid system of both, with a capacity of not more than 10 kW that is located on the customer's premises. This standard contract or tariff is to be made available to eligible customer -generators, upon request, on a first -come, first -serviced basis until the time that the total rated generating capacity used by eligible customer -generators equals one -tenth of one percent (0.1%) of the electric service providers aggregate customer peak demand. For the City of Vernon, the impact will be minimal. Based on a worst -case scenario, assuming a peak of approximately 200 MW for the coming summer, the City would lose approximately 200 kW of load meaning our peak would be reduced to approximately 199.8 MW. I recommend approval of the attached City of Vernon, Utilities Department, Schedule No. NM, Net Metering. The City Attorney has reviewed this Schedule. KJD:dm Attachment CITY OF VERNON UTILITIES DEPARTMENT Schedule No. NM NET METERING APPLICABILITY Applicable to individually metered residential service and small commercial service for customers who meet these requirements: Customer owns and operates a solar or wind turbine electrical generating facility or a hybrid system of both with a capacity of not more than 10 kilowatts that is located on the customer's premises. a. The generating facility operates in parallel with the Department's transmission and distribution facilities. b. The generating facility is intended to primarily offset part or all of the customer's own electrical requirements. C. Customer pays all costs associated with the Department's interconnection of customer's generation. d. Customer signs a Parallel GenerationInterconnection Agreement provided by the Department. SPECIAL CONDITIONS a. Net energy metering means measuring the difference between the electricity supplied through the electric grid and the electricity generated on the customer's premises and fed back to the electric grid. b. Net energy metering shall be accomplished using a non -demand, non -time differentiated meter capable of registering the flow of electricity in two directions. If the existing electrbal meter is not capable of measuring the flow of electricity in two directions, the customer shall be responsible for the expense of purchasing and installing a meter that is able to measure electricity flow in two directions. If an additional meter or meters are installed, the net metering calculation shall yield a result identical to that of a single meter. C. The Department at its expense may purchase and install additional meters with the consent of the customer to provide the information necessary to accurately credit or bill the customer or to collect solar or wind generating system performance information for research purposes. This schedule will be closed to all new customers once the aggregate capacity of all residential and small commercial solar or wind turbine electrical generating facilities or hybrid of both reaches one tenth of one percent (0.1 %) of Vernon's aggregate customers' peak demand. e. An eligible customer will be assigned a rate schedule to which it would otherwise be assigned to if the customer was not eligible under net metering rate schedule. All charges, terms and Special Conditions under the rate schedule shall remain effective. BILLING a. The customer shall be billed for the net energy supplied and other applicable charges under schedule assigned to it pursuant to Special Condition Subsection (e). b. In the event the energy generated by the customer and fed back into the utility grid exceeds the energy supplied by the utility, the customer will not receive a credit for the difference. Customer shall be billed for other applicable charges under schedule assigned to it pursuant to Special Condition Subsection (e). C. Each bill shall include the customer's net energy consumption information and current monetary balance owed to the utility. d. The customer may also elect to annualize the period over which the net energy measurement is calculated. The conditions for this option are as follows: 1. The Department shall measure the net energy produced or consumed in accordance with the Department's normal metering practice. 2. The customer shall be billed for the net energy consumed and other applicable charges under Rate Schedule assigned to it pursuant to Special Condition Subsection (e). 3. In the event the energy generated by the customer and fed back to the utility grid exceeds the energy supplied by the utility, the customer will not receive a credit for the excess electricity generated. Customer shall be billed for other applicable charges under Rate Schedule assigned to it pursuant to Special Condition Subsection (e).
