WHEREAS, the City
Council
of the City of
Vernon, by
8
adoption of Resolution No.
6934 on
March 25, 1997,
authorized
9 execution of Agreement No. 96-EDBG-471 between the City of Vernon
10 and the State of California, acting by and through the Department
11 of Housing and Community Development, pertaining to Community
12 Development Block Grant funds; and
13 WHEREAS, pursuant to said Agreement, the City has
14 implemented an Infrastructure and Equipment Loan Program under
15 which grants and loans are provided to assist in the expansion,
16 relocation and modernization of local businesses and the creation
17 of jobs in the community; and
18 WHEREAS, regulations of the federal Department of Housing'
19 and Urban Development found at 24 C.F.R. Part 58 require that a
20 "certifying officer" be designated to execute the Request for
21 Release of Funds required under the Community Development Block
22 Grant ("CDBG") program pursuant to 24. C.F.R. § 58.71, as well as
23 documents required for compliance with the National Environmental
24 Policy Act ("NEPA") pursuant to 24 C.F.R. § 58.13; and
25 WHEREAS, it is appropriate that the City's Director of
26 Community Services and Water be designated as the City's
27 certifying officer under 24 C.F.R. Part 58 in connection with the
28 City's administration and implementation of the CDBG program; and
1 WHEREAS, on April 1, 1999, the Director of Community
2 Services and Water executed on the City's behalf a Notice of
3 Finding of No Significant Impact and Notice of Intent to Request
4 Release of Funds ("the Notice") relative to use of CDBG funds for
5 a project known as the Alcoa Project, and caused the Notice to be
6 posted pursuant to 24 C.F.R. SS 58.43 and 58.45; and
7 WHEREAS, it is desirable that the Notice be approved and
8 ratified by the City Council.
9 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
10 CITY OF VERNON AS FOLLOWS:
11 SECTION 1: The City Council of the City of Vernon does
12 hereby find and determine that the recitals contained hereinabove
131 are true and correct.
14 SECTION 2: The City Council of the City of Vernon hereby
15 designates the Director of Community Services and Water as the
16 City's "certifying officer" under 24 C.F.R. Part 58 in connection
17 with the City's administration and implementation of the Community
18 Development Block Grant Program.
19 SECTION 3: The City Council of the City of Vernon hereby
20 approves and ratifies the Notice dated April 1, 1999, executed by
21 the Director of Community Services and Water, a copy of which has
22 been presented to the Council concurrently with this resolution,
23 and the City Council hereby orders a copy of said Notice to be
24 received and filed by the City Clerk.

Title 1 of the Housing and Community Development Act of 1974 , as amended, to undertake a project
known as the Alcoa Project, for the purpose of installing a 4inch deep 4foot wide sidewalk around the
park perimeter for pedestrian safety.
FINDING OF NO SIGNIFICANT IMPACT
The City of Vernon has determined that the project will have no significant impact on the human
environment. Therefore, an Environmental Impact Statement under the National Environmental Policy
Act (NEPA) of 1969 is not required. Additional project information is contained in the Environmental
Assessment (EA) on file at The City of Vernon, Community Services and Water Division, 4305 Santa Fe
Avenue, Vernon, CA 90058 and may be examined or copied weekdays between 8:00 a.m. and 5:00 p.m.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the
project may submit written comments to the City of Vernon, Community Services and Water Division,
4305 Santa Fe Avenue, Vernon, CA 90058. All comments received by the 300' of April 1999 will be
considered by the City of Vernon prior to submission of a request for release of funds. Comments should
specify which Notice they are addressing.

that Kevin Wilson in the capacity as Director of Community Services and Water Division consents to
accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to
the environmental review process and that these responsibilities have been satisfied. The California State
Department of Housing and Community Development's acceptance of the certification satisfies its
responsibilities under NEPA and allows the City of Vernon to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The California State Department of Housing and Community Development will accept objection to its
release of funds and the City of Vernon certification for a period of fifteen days following the anticipated
submission date or its actual receipt of the request (whichever is later) only if it is on one of the following
bases: (a) the certification was not executed by the Certifying Officer of the City of Vernon; (b) the City
of Vernon has omitted a step or failed to make a decision or finding required by HUD regulations a 24
CFR Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before approval
of a release of funds by the California State Department of Housing and Community Development; or (d)
another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the
project is unsatisfactory from the standpoint of environmental quality. Objection must be prepared and
submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the
State Department of Housing and Community Development Administration Office at the State CDBG
Program Room 390-2, PO Box 952054 in Sacramento, California 94252-2054. Potential objectors should

The developments being considered for CDBG funding require a CEQA
and NEPA review. One of the requirements for posting of the NEPA
document is that a certifying officer must be designated to sign
the document and he is also required to request the reliance of
funds from the State.
This CDBG program has been reviewed by the Director of Community
Services & Water and the City Attorney's office, and it is hereby
recommended that the Director of Community Services & Water be
designated as the certifying officer for the program.

We are currently reviewing and gathering the necessary loan documents and collateral for
three potential CDBG loan applications:

office, Rick Morillo stated that any city official can be authorized to sign related documents as the
certifying officer.
It is recommended that the Director of Community Services & Water be as the certifying
officer for the CDBG Program. If this is approved, the City Attorney's office would need to
prepare a resolution detailing this designation.
