RESOLUTION NO. 7314
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF ADDITIONAL NON-EXCLUSIVE SOLID
WASTE FRANCHISE AGREEMENTS PURSUANT TO ARTICLE
VI OF CHAPTER 12 OF THE VERNON CITY CODE BY
AND BETWEEN THE CITY OF VERNON AND VARIOUS
PRIVATE SOLID WASTE COLLECTION BUSINESSES
WHEREAS, the City Council of the City of Vernon adopted
Ordinance No. 1067 on December 8, 1998, which added Article VI to
Chapter 12 of the Vernon City Code, establishing a non-exclusive
franchise system for solid waste collection in the City; and
WHEREAS, one purpose for establishing the non-exclusive
franchise system is to improve the accuracy of the data needed for
compliance with the source reduction and recycling requirements of
Public Resources Code § 40000, et sea. (commonly referred to as
"AB 93911); and
WHEREAS, on February 2, 1999, the City Council adopted
Resolution No. 7271, establishing a franchise fee for franchises
issued pursuant to the aforesaid Article VI of Chapter 12; and
WHEREAS, the Environmental Health Department has
contacted all solid waste collection businesses that operated in
the City at the time of the adoption of Ordinance No. 1067, and
has provided them with information about the franchise application
process; and
WHEREAS, applications from forty-one (41) firms were
originally received by the Director of the Environmental Health
Department, twenty-one (21) of which were granted franchises by
the City by adoption of Resolution No. 7299 on March 30, 1999; and

separate resolution.

SECTION 5: The City Clerk
of the
City of Vernon shall

certify to the passage of this resolution,
and thereupon and

thereafter the same shall be in full
force
and effect.

On March 30, 1999, City Council approved Non -Exclusive Franchise
Agreements with 21 solid waste haulers. The Environmental Health
Department attempted to have all interested haulers submit
agreement packages for approval at one time; however, some
companies were unable to fulfill all requirements by the March
30t'' meeting. Provisions in Ordinance No. 1067 permit approval
of franchise agreements as they are submitted and completed.
This has been reviewed by the Director of Environmental Health
and the City Attorney's office; and it is hereby recommended that
each additional company that completes a Non -Exclusive Franchise
Agreement be approved.

On March 30, 1999, the City Council approved Non -Exclusive Franchise
Agreements with twenty-one solid waste haulers. Although we attempted to have
