Resolution No. 73371 RESOLUTION NO. 7337 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON ESTABLISHING HEALTH PERMIT, HAZARDOUS MATERIALS ESTABLISHMENT PERMIT, AND APPLICATION 4 FEES FOR PERMITS GRANTED BY THE CITY OF VERNON PURSUANT TO SECTIONS 11.25, 13.7, 13.31, 13.53, 5 25.12, AND 25.13-6 OF THE VERNON CITY CODE AND REPEALING RESOLUTION NOS. 6955 AND 7298 6 WHEREAS, Sections 11.25, 13.7, 13.31, 25.12, and 25.13-6 7 of the Vernon City Code provide for the issuance of health permits 8 for various types of businesses, vehicles, facilities and uses; 9 and 10 WHEREAS, Section 13.53 to the Code of the City of Vernon 11 provides for the issuance of p permits for hazardous materials 12 establishments; and 13 WHEREAS, Sections 11.25, 13.8, 13.34, 13.55, and 25.12-4 14 of the Vernon City Code provide that the City Council of the City 15 of Vernon shall establish health permit fees, hazardous materials 16 establishment permit fees, and application fees therefor by 17 resolution; and 18 WHEREAS, the City Council of the City of Vernon adopted 19 Resolution No. 6955 on May 20, 1997, and Resolution No. 7298 on 20 March 30, 1999, establishing health permit fees, hazardous 21 materials establishment permit fees, and application fees in 22 accordance with said Code; and 23 WHEREAS, fees established by said resolutions have been 24 determined to be inadequate; and 25 WHEREAS, the City Council of the City of Vernon held a 26 duly notice public hearing in -this matter on June 1, 1999; or less than 1 kilogram (2.2 lbs) of extremely hazardous waste 24 per month. 25 Class B: $267 26 Handling of 100 kilograms (220 lbs) to 1,000 kilograms (2,200 lbs) of hazardous materials per 27 month; or over 10 kilograms (22 lbs) of extremely hazardous waste per month. TO AMEND PERMIT: $ 47 CERTIFICATE OF CLOSURE $267 For the purpose of determining the above fees, 1 gallon (3.79 liters) of liquid shall be equivalent to 7 pounds (3.18 kilograms). Establishments which have hazardous substances stored in underground storage tanks, for which a valid operating permit has been issued by the City of Vernon, shall be exempt from including the volume of the underground storage capacity when determining the permit fee classification for a hazardous materials establishment. SECTION 6: The City Council of the City of Vernon hereby establishes the following application fees, fee for filing an appeal, and fee to amend a well permit granted by the City of Vernon pursuant to Section 25.12-4 of the Vernon City Code: TYPE OF BUSINESS OR VEHICLE ANNUAL FEE (a) Drilling a water well or destroying or converting an existing water well $184 (b) Drilling a monitoring well (ground water) $110 (c) Filing an appeal $ 74 (d) Amendment to a well permit $ 47 -5- I 1 SECTION 7: Delinquent fees shall be subject to the 2 penalties set forth in Vernon City Code Sections 13.15, 13.34, 3 13.55(b), or 25.12-1, as applicable. 4 SECTION 8: In addition to the foregoing, the licensee 5 or permittee shall pay all other necessary fees or deposits which 6 may be required by other ordinances or resolutions of the City of 7 Vernon or applicable State law. 8 SECTION 9: The fees provided for herein shall be 9 effective June 15, 1999, and all provisions of Resolution Nos. 10 6354, 6618, and 6619, and all other resolutions in conflict 11 herewith are repealed. 12 SECTION 10: The City Clerk of the City of Vernon shall 13 certify the passage of this resolution, and thereupon and 14 thereafter the same shall be in full force and effect. 15 APPROVED AND ADOPTED this 1st day of June, 1999. 16 17 Li�qNIS C. Fees have not been adjusted since 1997, and this year's survey shows that our 1998-1999 fees are generally less than other health agencies. Pozzebon, Director, Environmental Health Department sublt: EQUEST FOR INCREASE IN HEALTH PERMIT FEES date: May 12, 1999 Annually we conduct a health permit fee survey of other local environmental health jurisdictions (Los Angeles County and the cities of Long Beach and Pasadena). The purpose of the fee survey (attached) is to identify significant disparities between Vernon's fees and the fees charged by these other jurisdictions. In the past, when large disparities were noted, we have raised fees to levels which are slightly below those of the other jurisdictions. Because we have not raised fees since 1997 and this year's survey shows that our 1998- 99 fees are generally less than other health agencies, I am recommending that the fees be raised five per cent (5%) this year. The five per cent increase is based on cost of living increases which have averaged about two and a half per cent each of the last two years. Based on our discussion on May 11, 1999, and with your concurrence, I am forwarding this recommendation for submission to the Finance Committee to raise health permit fees this year with an effective date of June 15, 1999.
