Resolution No. 73531 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7353 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON (i) RATIFYING THE ISSUANCE OF BID NOS. 1381 AND 1382 BY THE PURCHASING DEPARTMENT FOR THE PURCHASE OF ONE UTILITY TRUCK AND ONE UTILITY TRUCK BODY FOR THE COMMUNITY SERVICES AND WATER DEPARTMENT; (ii) ACCEPTING THE BIDS OF DOWNEY FORD FOR BID NO. 1381 AND ROYAL TRUCK FOR BID NO. 1382; AND (iii) APPROVING THE ISSUANCE OF PURCHASE ORDERS RESPECTING BID NOS. 1381 AND 1382 WHEREAS, the Community Services and Water Department of the City of Vernon is in need of a new service truck and a utility truck body; and WHEREAS, on May 17, 1999, the Finance Committee recommended that the City Council authorize the Purchasing Department to seek formal bids for the purchase of a new truck and utility body for the Community Services and Water Department, at the approximate total amount of Sixty Nine Thousand Dollars and No Cents ($69,000.00); and WHEREAS, on May 19, 1999, the Purchasing Department issued Bid No. 1381 for the purchase of one utility truck, and posted Notice Inviting Sealed Bids, to be opened on June 7, 1999 and; WHEREAS, on May 19, 1999, the Purchasing Department issued Bid No. 1382 for the purchase of one utility truck body, with installation, and posted Notice Inviting Sealed Bids, to be opened on June 7, 1999; and WHEREAS, sealed bids for Bid Nos. 1381 and 1382 were opened on June 7, 1999; and WHEREAS, the following bids were received on Bid No. 1 2 3 4 5 6. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1381: Downey Ford Inc. bid a total of Twenty Nine Thousand One Hundred Eighty Two Dollars and One Cent ($29,182.01), with a one percent discount included; Midway Ford bid a total of Twenty Nine Thousand Nine Hundred Twenty Nine Dollars and No Cents ($29,929.00) for a vehicle which is in its current inventory and also Twenty Seven Thousand Eight Hundred Eighty Five Dollars and No Cents ($27,885.00) for a vehicle which is not in its current inventory and would have to be ordered from the factory; and WHEREAS, the bid by Midway Ford on Bid No. 1381, offering a utility truck which was not in its inventory, but would have to be ordered, on behalf of the City, from the factory was not responsive to the City's request for quotation for a utility truck which could be supplied by Midway Ford and, therefore, is considered to be non -responsive and unacceptable; and WHEREAS, the following bids were received on Bid 1382: C-Tec bid a total of Thirty Nine Thousand Nine Hundred Twenty Seven Dollars and No Cents ($39,927.00) for an option which would include an auto crane and also Thirty Nine Thousand Two Hundred Ninety Two Dollars and No Cents ($39,292.00) which would include a Venturo Crane, Pacific Truck bid a total of Forty Four Thousand Six Hundred Fifty Six Dollars and No Cents ($44,656.00), and Royal Truck Body, Inc. bid a total of Thirty Seven Thousand Six Hundred Ninety Two Dollars and No Cents ($37,692.00); and WHEREAS, the Community Services and Water Department and the Purchasing Department have reviewed the bids and have approved the bid of Downey Ford of Twenty Nine Thousand One Hundred Eight Two Dollars and One Cent ($29,182.01), with a one percent discount included, Downey Ford being the lowest responsible bidder meeting -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the requirements of Bid No. 1381; and WHEREAS, the Community Services and Water Department and the Purchasing Department have reviewed the bids and have approved the bid of Royal Truck Body of Thirty Seven Thousand Six Hundred Ninety Two Dollars and No Cents ($37,692.00), Royal Truck Body -being the lowest responsible bidder meeting the requirements of Bid No. 1382; and WHEREAS, on June 22, 1999, the Finance Committee approved the recommendation by Bruce V. Malkenhorst, the Director of Finance, that Bid No. 1381 be awarded to Downey Ford and that Bid No. 1382 be awarded to Royal Truck Body; and WHEREAS, the City Council of the City of Vernon desires. to ratify the Purchasing Department's issuance of Bid Nos. 1381 and 1382, and to approve the recommendations to purchase the utility truck from Downey Ford, Inc. and the utility truck body, with installation, from Royal Truck Body, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council hereby ratifies the Purchasing Department's issuance of Bid Nos. 1381 and 1382, including the specifications for the utility truck and utility truck body which were provided along with the bids. SECTION 3: The City Council hereby accepts and approves the contract documents for Bid Nos. 1381 and 1382, copies of which have been presented to the City Council concurrently with this -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26' 27 '2 8 Resolution, and hereby orders said contract documents to be received and filed by the City Clerk. SECTION 4: The City Council of the City of Vernon does hereby award a contract for Bid No. 1381 to Downey Ford, Inc., authorizes the Mayor and City Clerk to execute the contract documents on behalf of the City and authorizes issuance of a purchase order for the purchase of the utility truck from Downey Ford, Inc. SECTION 5: The City Council of the City of Vernon does hereby award a contract for Bid No. 1382 to Royal Truck Body, Inc., authorizes the Mayor and City Clerk to execute the contract documents on behalf of the City and authorizes the issuance of a purchase order for the purchase of the utility truck body from Royal Truck Body, Inc. SECTION 6: All other bids in connection with Bid Nos. 1381 and 1382 are rejected, subject to execution of the aforesaid contracts and the City Treasurer is directed to return to any unsuccessful bidders any cashier or certified checks which may have been deposited with said bids, upon receipt of the executed contracts with Downey Ford, Inc. and Royal Truck Body, Inc., accompanied by all required bonds and certificates. Consistent with its Bid, Royal Truck agrees to sell the utility truck body, with installation, to the City, and City agrees to purchase the utility truck body, with installation, from Royal Truck, for the total sum of Thirty Seven Thousand Six Hundred Ninety Two Dollars and No Cents ($37,692.00). 3. Warranties. The warranties applicable to the City's purchase of the utility truck body from Royal Truck shall be, at a minimum, those which are contained in the warranty documents provided to the City by Royal Truck which are attached hereto as Exhibit "B" and incorporated herein by reference. 4. Governing Law. The validity, interpretation and performance of this contract shall be controlled and construed under the laws of the State of California. 5. Notices.
