3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
4 WATER RIGHT LICENSE BY AND BETWEEN THE CITY OF
VERNON AND PACIFIC COAST BUILDING PRODUCTS, INC.,
5 WHICH GRANTS THE CITY OF VERNON A LICENSE TO EXTRACT
800 ACRE-FEET OF THE ALLOWED PUMPING ALLOCATION OF
6 PACIFIC COAST BUILDING PRODUCTS, INC. FOR THE PERIOD
JULY 1, 1999 THROUGH JUNE 30, 2000

8 WHEREAS, the City of Vernon and Pacific Coast Building
9 Products, Inc. ("Pacific") wish to enter into an agreement providing
10 for the City to lease 800 acre-feet of the allowed pumping allocation
11 of Pacific; and
12 WHEREAS, the Director of Community Services & Water and
13 Pacific have negotiated a Water Right License for the period of
14 July 1, 1999 through June 30, 2000, with an agreed price of One
15 Hundred Forty Thousand Dollars and No Cents ($140,000.00); and
16 WHEREAS, a "Statement" of account dated June 30, 1999,
17 providing that the sum of One Hundred Forty Thousand Dollars and No
18 Cents ($140,000.00) (for 1999-2000) will be paid to Pacific has been
19 submitted to the City and approved by the Director of Community
20 Services & Water; and
21 WHEREAS, Mr. Dave Lucchetti, President, CEO for Pacific,
22 signed said Statement on July 2, 1999, agreeing thereto.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24 CITY OF VERNON AS FOLLOWS:
25 SECTION 1: The City Council of the City of Vernon hereby
26 finds and determines that the recitals contained hereinabove are true
27 and correct.
28 SECTION 2: The City Council of the City of Vernon hereby
I approves the Water Right License and the Statement; an original of
2 which have been presented to the City Council concurrently with this
3 resolution, and the City Council hereby orders said documents to be
4 received and filed by the City Clerk.
5 SECTION 3: The City Council of the City of Vernon hereby
6 authorizes the Mayor and the City Clerk to execute said License for,
7 and on behalf of, the City of Vernon.
8 SECTION 4: The City Clerk of the City of Vernon shall
9 certify to the passage of this resolution, and thereupon and
10 thereafter the same shall be in full force and effect.
11 APPROVED AND ADOPTED this 13th day of July, 1999.

Transmitted herewith is the Water Right License and Agreement with
Pacific Coast Building Products, Inc. for the rights to 800 acre-feet
of water. The cost of this water is $175.00 per acre foot or
$140,000.00 total.
This has been reviewed by the Director of Community Services and the
City Attorney, and it is hereby recommended that the Agreement be
approved and the Mayor and City Clerk be authorized to sign the
Agreement.
