RESOLUTION NO. 7376
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 7356 AND
APPROVING AND AUTHORIZING THE EXECUTION OF
PURCHASE CONTRACT DOCUMENTS BY AND BETWEEN THE
CITY OF VERNON AND WESCO DISTRIBUTION, INC. (c/o
ABB POWER) FOR THE PURCHASE OF FIVE PADMOUNT
TRANSFORMERS FOR THE UTILITIES DEPARTMENT
WHEREAS, the Utilities Department of the City of Vernon
is in need of five (5) padmount transformers; and
WHEREAS, pursuant to Resolution No. 7356, the City
Council of the City of Vernon ratified the Purchasing Department's
issuance of Bid No. 1384 and approved the recommendation by Bruce
V. Malkenhorst, the Director of Finance, which was approved by the
Finance Committee on June 14, 1999, that Bid No. 1384 be awarded
to ABB Power (c/o Wesco) as the lowest responsible bidder; and
WHEREAS, pursuant to letter dated July 1, 1999, Wesco
Distribution, Inc. advised that the contract for the purchase of
the padmount transformers needed to be executed by Wesco, not ABB
Power; and
WHEREAS, the City Council's intent in passing Resolution
No. 7356 was to accept the low bid which was made by ABB Power on
behalf of Wesco Distribution, Inc., and to authorize the execution
of the necessary purchase documents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon does
hereby find and determine that the recitals contained hereinabove
are true and correct.
SECTION 2: The City Council hereby amends Section 4 of

Resolution No. 7356 to read as follows:
The City Council of the City of Vernon does
hereby award a contract for Bid No. 1384 to
Wesco Distribution, Inc. (c/o ABB Power),
authorizes the issuance of a purchase order for
the purchase of the five padmount transformers
from Wesco Distribution, Inc. and authorizes the
Mayor and the City Clerk to execute the Contract
Documents on behalf of the City.
SECTION 3: The City Council further amends Section 5 of
Resolution No. 7356 as follows:
All other bids are rejected subject to the
execution of the aforesaid contract, and the
City Treasurer is directed to return to any
unsuccessful bidders any cashier or certified
checks which may have been deposited with said
bids, upon receipt of the executed contract with
Wesco Distribution, Inc. (c/o ABB Power)
accompanied by all required bonds and
certificates.
SECTION 4: The City Council of the City of Vernon hereby
orders the agreement between the City and Wesco Distribution,
Inc., a copy of which has been presented to the City Council
concurrently with this Resolution, to be received and filed by the
City Clerk.
SECTION 5: That in all respects, Resolution No. 7356
shall remain in full force and effect and that the provisions
contained in Resolution No. 7356 not consistent with or in

conflict with this resolution are hereby repealed.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution, and thereupon and
thereafter the same shall be in full force and effect.

At the Finance Committee meeting held on June 29, 1999, Purchase
Contracts were approved for ABB c/o Wesco Distribution, Inc. for
the purchase of five padmount transformers for the Utilities
Department. At this time, it is necessary to change the contract
documents.
It is hereby recommended that approval be granted to issue a
purchase order and approve the purchasing contracts in the name
of Wesco Distribution, Inc. (c/o ABB Power) for the purchase of
five padmount transformers for the Utilities Department and that
the resolution previously adopted be rescinded.
