Resolution No. 73951 2 3 4 5 6 7 8 9 10 11 12 131 14i 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7395 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, ORDERING THE SUBMISSION OF A QUESTION TO THE QUALIFIED VOTERS OF THE CITY RELATING TO AN AMENDMENT TO SECTION 5.45 OF ARTICLE IV OF CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, REGARDING A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 16, 1999 WHEREAS, the City Council of the City of Vernon on January 6, 1998, adopted Ordinance No. 1057, which among other things added Article IV to Chapter 5 of the Code of the City of Vernon, California, 1959, which established a special parcel tax on property used or designed for use as a warehouse, truck terminal, freight terminal or other distribution facility; and WHEREAS, the City Council of the City of Vernon, by adoption of Resolution No. 7069, on January 6, 1998, submitted these ordinances to the qualified voters for approval and adoption at the April 14, 1998, General Municipal Election; and WHEREAS, Ordinance No. 1057 was approved and adopted by the qualified voters on April 14, 1998; and WHEREAS, the results of the election were certified to the City Council, pursuant to Resolution No. 7083, as amended by Resolution No. 7102; and WHEREAS, the City Council of the City of Vernon, by adoption of Resolution 7115, on April 28, 1998, received the results of the April 14, 1998, General Municipal Election, recited the facts of the General Municipal Election and declared the results thereof; and t 1 2 3 4 5 6 7 8 9 10 11 iWIAI 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City Council of the City of Vernon, by adoption of Resolution No. 7393 on August 17, 1999, has ordered that a Special Municipal Election be held in the City on Tuesday, November 16, 1999; and WHEREAS, pursuant to the provisions of Article V of the Charter of the City of Vernon, the question hereinafter set forth as Measure A shall be submitted to the qualified voters of the City at said Special Municipal Election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council, pursuant to its right and authority, does hereby order submitted to the qualified voters at the Special Municipal Election to be held on Tuesday, November 16, 1999, the following question: -2- 1 2 3 4 5 6 7 8 9 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 MEASURE A Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTION 5.45 OF ARTICLE IV OF CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, REGARDING A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL, A RAILROAD FACILITY OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX; ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE.LEVY OF SPECIAL TAXES; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved and adopted? YES lZco SECTION 3: The proposed ordinance is on file with the City Clerk and may be examined during regular business hours. SECTION 4: The ballots to be used at the election shall be in form and content as required by law. SECTION 5: The City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 6: Pursuant to Section 4000 of the Elections Code of the State of California, the election will be conducted entirely by mailed absent voter ballots. Ballots may be submitted by mail or hand delivered but must be received by the City Clerk by 8:00 p.m. on November 16, 1999, as required by Section 4103 of the Elections Code of the State of California. The City Clerk's Office at the City Hall located at 4305 Santa Fe Avenue in the -3- 1 City of Vernon shall remain open from 7:00 a.m. to 8:00 p.m. on 2 election day. 3 SECTION 7: In all particulars not recited in this 4 resolution, the election shall be held and conducted as provided 5 by law for holding municipal elections. 6 SECTION 8: Notice of the time and place of holding the 7 election is given and the City Clerk is authorized, instructed and 8 directed to give further or additional notice of the election, in 9 time, form and manner as required by law. 10 SECTION 9: The City Clerk of the City of Vernon shall 11 certify to the passage of this resolution and thereupon and 12 thereafter the same shall be in full force and effect. 13 APPROVED AND ADOPTED this 17th day of August, 1999. 14 e� 15 THOMAS A.
