Resolution No. 73971 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO 7397 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELECTIONS WHEREAS, Sections 9220 and 9285 of the Elections Code of the State of California authorize the City Council, by majority vote, to adopt procedures to provide for the filing of rebuttal arguments for City measures submitted at Municipal Elections; and WHEREAS, the City Council by Ordinance Nos. 1076 and Resolution No. 7395 has ordered the following question submitted to the qualified voters of the City at the November 16, 1999, Special Municipal Election: MEASURE A Shall an ordinance entitled „AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTION 5.45 OF ARTICLE IV OF CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, REGARDING A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL, A RAILROAD FACILITY OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX; ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF SPECIAL TAXES; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved and adopted? YES NO NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are ,1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 true and correct. SECTION 2: Pursuant to Sections 9220 and 9285 of the Elections Code of the State of California, when the City Clerk has selected the arguments for and against the measure which will be printed and distributed to the voters, the City Clerk shall send copies of the argument in favor of the measure to the authors of the argument against, and copies of the argument against to the authors of the argument in favor. The authors may prepare and submit rebuttal arguments not exceeding 250 words. The rebuttal arguments shall be filed with the City Clerk not more than ten (10) days after the final date for filing direct arguments. Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal argument shall immediately follow the direct argument which it seeks to rebut. SECTION 3: All previous resolutions providing for the filing of rebuttal arguments for City measures are repealed. SECTION 4: The provisions of Section 2 shall apply only to the election to be held on November 16, 1999. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
