RESOLUTION NO. 7398
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
WATER RIGHT LICENSE BY AND BETWEEN THE CITY OF
VERNON AND CALIFORNIA WATER SERVICE COMPANY, WHICH
GRANTS THE CITY OF VERNON A LICENSE TO EXTRACT 1,900
ACRE-FEET OF THE ALLOWED PUMPING ALLOCATION OF
CALIFORNIA WATER SERVICE COMPANY FOR THE PERIOD
JULY 1, 1999 THROUGH JUNE 30, 2000
WHEREAS, the City of Vernon and California Water Service
Company ("California") wish to enter into an agreement providing for
the City to lease 1,900 acre-feet of the allowed pumping allocation of
California; and
WHEREAS, the Director of Community Services & Water and
California have negotiated a Water Right License for the period of
July 1, 1999 through June 30, 2000, with an agreed price of Three
Hundred Eighty -Nine Thousand Five Hundred Dollars and No Cents
($389,500.00); and
WHEREAS, a "Statement" of account dated July 19, 1999,
providing that the sum of Three Hundred Eighty -Nine Thousand Five
Hundred Dollars and No Cents ($389,500.00) will be paid to California,
for the period of July 1, 1999 through June 30, 2000, has been
submitted to the City and approved by the Director of Community
Services & Water; and
WHEREAS, Mr. Robert R. Guzzetta, Vice President Engineering
and Water Quality for California, signed said Statement on August 2,
1999, agreeing thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
I finds and determines that the recitals contained hereinabove are true
2 and correct.
3 SECTION 2: The City Council of the City of Vernon hereby
4 approves the Water Right License and the Statement, copies of which
5 have been presented to the City Council concurrently with this
6 resolution, and the City Council hereby orders said documents to be
7 received and filed by the City Clerk.
8 SECTION 3: The City Council of the City of Vernon hereby
9 authorizes the Mayor and the City Clerk to execute said License for,
10 and on behalf of, the City of Vernon.
11 SECTION 4: The City Clerk of the City of Vernon shall
12 certify to the passage of this resolution, and thereupon and
13 thereafter the same shall be in full force and effect.
14 APPROVED AND ADOPTED this 17`h day of August, 1999.
