Resolution No. 74391 RESOLUTION NO. 7439 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEMBER 16, 1999, DECLARING THE 4 RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW 5 WHEREAS, a Special Municipal Election was held and conducted in 6 the City of Vernon, California on Tuesday, November 16, 1999, as 7 required by law; and 8 WHEREAS, pursuant to Resolution No. 7393, adopted August 17, 9 1999, and Resolution No. 7395, adopted August 17, 1999, the election 10 was conducted entirely by mail ballot pursuant to Section 4000, et it sea., of the Elections Code of the State of California; and 12 WHEREAS, notice of the election was given in the time, form and 13 manner required by law; and 14 WHEREAS, election officers were appointed, mail ballots were 15 properly sent to all registered voters, and in all respects the 16 election was held and conducted, the votes were cast, received and 17 canvassed, and the returns were made and declared in the time, form 18 and manner required by law; and 19 WHEREAS, pursuant to Resolution No. 7424, adopted October 19, 20 1999, the City Clerk was ordered to canvass the returns of the 21 election and the City Clerk has certified the results to the City 22 Council, which certification and results are received, attached and 23 made part hereof as Exhibit "A". 24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 25 VERNON AS FOLLOWS: 26 SECTION 1: The City Council of the City of Vernon hereby finds 27 and determines that the recitals contained hereinabove are true and 28 correct. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16I 17'' 18 19'' 20 21 22. 23 24 25 26 27 28 SECTION 2: One (1) voting precinct was established for the purpose of holding said Special Election, consisting of the regular election precinct in the City as established for the holding of State and County elections. SECTION 3: The whole number of votes cast by mail ballots in the City was thirty (30). SECTION 4: The measure voted upon at the election was as follows: MEASURE A Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTION 5.45 OF ARTICLE IV OF CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, REGARDING A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL, A RAILROAD FACILITY OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX; ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF SPECIAL TAXES; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved and adopted? YES NO SECTION 5: The number of votes given in the one voting precinct in the City for and against the measure is as listed in Exhibit "A" attached hereto. SECTION 6: The City Council does declare and determine that as a result of the Special Municipal Election, a two-thirds (2/3) majority of the voters voting on the above Measure A did vote in favor of it, and the measure was carried, and shall be deemed approved and adopted. -2- 1 SECTION 7: The City Clerk shall enter on the records of the City 2 Council of the City, a statement of the result of the election, 3 showing: 4 (1) The whole number of votes cast in the City; 5 (2) The measure voted upon; 6 (3) The number of votes given at each precinct for and against 7 each measure; 8 (4) The number of votes given in the City for and against the 9 measure. 10 SECTION 8: The City Clerk of the City of Vernon shall certify to 11 the passage of this resolution, and thereupon and thereafter the same 12 shall be in full force and effect. 13 APPROVED AND ADOPTED this 23rd day of November, 1999. 14 15 - EONIS C.
