Resolution No. 74691 RESOLUTION 7469 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A 3 CONDITIONAL USE PERMIT TO UNITED CARGO LOGISTICS, INC. FOR THE 4 OPERATION OF A TRUCKING AND FREIGHT TERMINAL AT 2065 ROSS 5 STREET 6 7 WHEREAS, United Cargo Logistics, Inc. ("United Cargo") has 8 applied for a conditional use permit to operate a trucking and 9 freight terminal at 2065 Ross Street in the City of Vernon; and 10 WHEREAS, the City Council of the City of Vernon held`a 11 hearing on said application for a conditional use permit on 12 January 4, 2000; and 13 WHEREAS, the proposed site is a legal non -conforming use in 14 the General Industry (M) Zone which has been used previously as 15 a truck and freight terminal by Postal Freight, Inc.; and 16 WHEREAS, a conditional use permit is required under the 17 Zoning Ordinance in order to continue the use as a truck and 18 freight terminal; and 19 WHEREAS, the proposed operation will include the hauling 20 and temporary storage of general products; and 21 WHEREAS, the proposed site is approximately 1.61 acres in 22 size, and is adequate in size, shape and topography for the 23 proposed operation and has adequate drainage; and 24 WHEREAS, a barrier wall or landscaping has been installed 25 where parking or maneuvering area adjoin a public street 26 pursuant to the Vernon City Code; and 27 28 -1- 1 WHEREAS, the proposed site is surrounded by industrial uses 2 compatible with the proposed use and no adverse effects from'. 3 traffic, parking, noise, odors, dust, smoke, light or glare, or 4 risk of fire, infection or explosion is anticipated from the 5 proposed operation; and 6 WHEREAS, the majority of outbound trips will take Ross 7 Street to Alameda Street traveling North to the 10 freeway and 8 visa versa for inbound traffic and the streets to be utilized 9 within the City of Vernon are sufficient to handle the traffic 10 generated form the proposed operations; and 11 WHEREAS, the proposed operation will generate 20 vehicle 12 movements, including employee vehicles, out of the site daily; 13 and 14 WHEREAS, the number of vehicle movements will be the same 15 number as generated by its predecessor Postal Freight, Inc; and 16 WHEREAS, the proposed operation will not generate more 17 traffic trips than have been historically generated at the site 18 and there will be no traffic impact; and 19 WHEREAS, the site, as proposed, has ample room on -site to 20 provide adequate off-street parking and loading facilities as 21 required by the Vernon City Code; and 22 WHEREAS, United Cargo will not maintain their vehicles on- 23 site; and 24 WHEREAS, the conditions imposed on the conditional use 25 permit will adequately protect the public health, safety and 26 general welfare and the operation is consistent with all 27 applicable rules and laws of the City of Vernon; and 28 -2- 1 WHEREAS, the proposed use, as to location, operation and 2 design is consistent with the General Plan and Zoning Ordinance 3 of the City of Vernon; and 4 WHEREAS, the project is categorically exempt from the 5 California Environmental Quality Act as an existing facility 6 pursuant to Section 15301 of the California Environmental 7 Quality Act Guidelines and a Notice of Exemption shall be filed 8 with the County Clerk pursuant to Section 15062 of the 9 California Environmental Quality Act Guidelines. 10 WHEREAS, the City Council has received a Staff Report, 11 dated on December 22, 1999 upon which it has relied on making' 12 the foregoing recitals; and 13 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 14 VERNON AS FOLLOWS: 15 SECTION 1: The City Council of the City of Vernon hereby 16 finds and determines that the recitals contained hereinabove are 17 true and correct. 18 SECTION 2: Subject to the conditions set forth below, the 19 conditional use permit is hereby granted to United Cargo for the 20 operation of a trucking and freight terminal at 2065 Ross 21 Street. 22 SECTION 3: In order to adequately protect the public health 23 and general welfare the following conditions are required: 24 25 26 27 28 -3- 1 a. The facility shall be operated in accordance with, and 2 made to conform with all current codes, rules, regulations and 3 subject to permit fees as adopted by the City of Vernon. All 4 trucking operations, including truck and trailer parking, shall 5 be limited to the lot located at 2065 Ross Street in the City of 6 Vernon. 7 b. All required federal, state, local and regulatory 8 agency permits shall be obtained prior to operation. Prior to 9 occupancy a business license and occupancy permit shall be 10 obtained. 11 C. All parking and loading facilities shall be paved with 12 a hard durable surface material and shall be adequately drained, 13 and kept free of dust, mud, trash and weeds. Where parking or 14 maneuvering areas adjoin the public street a barrier wall or 15 landscaping shall be installed and maintained to meet City 16 standards. Adequate on -site parking shall be maintained so that 17 no on -street parking will occur. 18 d. The facility shall be operated in a manner that will 19 prevent unsanitary conditions, odors or other nuisances. The', 20 property shall be provided with adequate refuse containers and 21 refuse disposal services. 22 e. The facility's buildings shall be structurally 23 maintained to exclude rodents and the property shall be 24 maintained rodent free. 25 f. Servicing of vehicles including washing, steam 26 cleaning and repairing shall be performed in facilities in 27 compliance with appropriate codes. 2s -4- 1 g. No equipment or freight shall be stored on the site 2 other than in buildings, trailers or on the docks. 3 h. A National Pollutant Discharge Elimination System 4 Permit shall be obtained from the California State Board of 5 Water Resources, if required. 6 i. Adequate plans and materials must be available for 7 handling leaks or spills from vehicles during storage or 8 transportation 9 j. A hazardous materials permit shall be obtained from 10 the City of Vernon Environmental Health Department if hazardous 11 materials/waste are used handled or stored. Hazardous 12 materials/waste shall be handled and managed in compliance with 13 all appropriate federal, state and local laws. 14 k. The facility shall be operated in a manner that will 15 not impede traffic on Ross Street. 16 1. All existing cracked sidewalk, curb and gutter 17 adjacent to the site in Ross Street shall be repaired and 18 maintained to meet City Standards. 19 m. The site shall not generate more than 20 truck trips 20 (10 inbound and 10 outbound) per day. 21 22 23 24 25 26 27 28 -5- 1 SECTION 4: United Cargo and any successors in interest 2 shall indemnify, hold harmless, and defend the City of Vernon, 3 its officers, agents, and employees from and against any and all 4 claims, complaints, or petitions for: (1) damages, losses, 5 expanses resulting from bodily injury, sickness, disease, 6 disability or death arising from the operation of the facility 7 excluding therefrom any such claim resulting from the sole 8 negligence or intentional wrongdoing of the City of Vernon, its 9 officers, agents or employees; (2) a peremptory writ or other 10 relief by way of injunction, mandamus, or administrative 11 mandamus; or (3) legal expenses and attorney's fees incurred by 12 the City of Vernon on behalf of any party in such actions or 13 proceedings. The City of Vernon does not waive its right to 14 participate in the defense of any such action 15 SECTION 5: Not later than sixty (60) days from the date of 16 this Resolution, United Cargo shall indicate, in writing, its 17 acceptance of and agreement with the conditions contained in 18 Section 3 of this Resolution and the indemnification provision 19 contained in Section 4 of the Resolution. 20 SECTION 6: The City Clerk of the City of Vernon shall 21 certify to the passage of this resolution and thereupon and 22 thereafter the same shall be in full force and effect. 23 APPROVED AND ADOPTED this 4th day of January, 2000. 24 -7 25 e.onis C. The project is categorically exempt from the California Environmental Quality Act because there is an existing facility at the site with no expansion of use as defined in Section 15301. A Notice of Exemption will be prepared. In my opinion the proposed operation is consistent with the General Plan as adopted by the City of Vernon, will pose no adverse effects to the City of Vernon, will have no significant effects on the environment, and no mitigation measures are required. It is recommended that the City Council find that the proposed use is categorically exempt from the California Environmental Quality Act process and is consistent with the General Plan. Further, it is recommended that a Notice of Exemption be filed with the County Clerk and the conditional use permit be granted with the following conditions: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. CONDITIONAL USE PERMIT TO OPERATE A TRUCK TERMINAL AT 2065 ROSS Street (December 22, 1999) United Cargo Logistics, Inc. has submitted an application for a conditional use permit to operate a truck terminal at 2065 Ross Street. They are an interstate trucking company which provides pick-up and delivery service. They are proposing to generate 20 vehicle movements, including employees vehicles, out of the site daily. The site was previously occupied by Postal Freight, Inc., another trucking company, that generated approximately 20 vehicle trips per day. United Cargo Logistics, Inc. will generate approximately the same number of vehicle trips per day as their predecessor. 1. GENERAL PLAN The proposed use is a legally nonconforming use in the General Industrial, M Zone, which has been historically used as a truck terminal. 2. SITE The proposed site is adequate in size, shape and topography for the proposed operation and has adequate drainage. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from noise, odor, dust, smoke, light or glare from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with -1- no expansion of use. A Notice of Exemption will be prepared. 4. ACCESS The site has access to Ross Street which is 60 feet wide. The street is of adequate size to handle the traffic generated form the proposed operation. 5. VEHICLE MOVEMENTS United Cargo Logistics, Inc. will operate approximately twelve 24 foot vans and seven 53 foot trucks out of the facility. They will arrive at the site between 6:00 a.m. on Monday and 12:00 a.m. on Friday and occasionally on Saturdays as needed. The vehicles will arrive primarily from Alameda Street to Ross Street. In addition to the trucks and vans there will be approximately 16 automobile trips into and out of the facility daily. Inbound freight arrive at the facility between 9:00 a.m. and 6:00 p.m. while outbound trips depart from 9:00 a.m. to 11:00 p.m. Monday through Friday. The majority of inbound and outbound trips will take Ross Street to Alameda Street traveling North to the 10 freeway on outbound traffic and visa versa for inbound traffic. Approximately 20% of all trucks will go South down Alameda to Slauson to Access the 110 Freeway and 5% will use 371h Street to Santa Fe Avenue for Access to the City and the 10 Freeway. 6. OPERATIONS United Cargo Logistics, Inc., will use the facility to operate a trucking and freight terminal. They will not maintain their vehicles on site. All merchandise that is stored and transferred by United Cargo Logistics, Inc. are manufactured finished goods. No hazardous materials will be -2- stored or transferred on site. Other operational activities include sales and customer service of existing freight customers. 7.
