RESOLUTION NO. 7472
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
WATER RIGHT LICENSE BY AND BETWEEN THE CITY OF
VERNON AND KAL-KAN FOODS, INC. WHICH GRANTS THE CITY
OF VERNON A LICENSE TO EXTRACT 140 ACRE-FEET OF KAL
KAN'S ALLOWED PUMPING ALLOCATION FOR THE PERIOD JULY
1, 1999 THROUGH JUNE 30, 2000
WHEREAS, the City of Vernon and Kal-Kan Foods, Inc. ("Kal-Kan")
have entered into various agreements since 1990 providing for the City to
lease 140 acre-feet of Kal-Kan's allowed pumping allocation; and
WHEREAS, the Director of Community Services & Water and Kal-Kan
have negotiated a new Water Right License with an agreed price for the
period of July 1, 1999 through June 30, 2000 of Twenty -Seven Thousand
Three Hundred Dollars and No Cents ($27,300.00), and said money being
applied as a credit towards Kal-Kan's regular water bills; and
WHEREAS, the City of Vernon sent a "Statement" of account dated
January 10, 2000, which provides that the sum of Twenty -Seven Thousand
Three Hundred Dollars and No Cents ($27,300.00) (for 1999-00) will be
applied to the Kal-Kan Water Account No. 12-19740-01-0, for the period
of July 1, 1999 through June 30, 2000; and
WHEREAS, said "Statement" has been submitted to the City and
approved by the Director of Community Services & Water; and
WHEREAS, Mr. John L. Glenn, the Commercial Manager for Kal-
-Kan, signed said "Statement" on January 11, 2000, agreeing thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION_1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the Water Right License and the "Statement," which is attached
thereto, a copy of which has been presented to the City Council
concurrently with this resolution, and the City Council hereby orders
said documents to be received and filed by the City Clerk.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor and the City Clerk to execute said License for, and
on behalf of, the City of Vernon.
SECTION 4: The City Clerk of the City of Vernon shall certify
to the passage of this resolution, and thereupon and thereafter the same-
shall be in full force and effect.
