• aa' e . a S 1 RESOLUTION NO. 7477 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON APPROVING AND AUTHORIZING (1) PARTICIPATION IN THE FEDERAL SURPLUS PERSONAL PROPERTY PROGRAM; 4 AND (2) THE EXECUTION OF ALL DOCUMENTS NECESSARY TO SATISFY THE REQUIREMENTS TO ALLOW VERNON TO BE A 5 FEDERAL SURPLUS PROPERTY PARTICIPANT 6 7 WHEREAS, the Federal Property and Administrative Services Act 8 of 1949, as amended, authorized the General Services Administration to 9 allocate federal surplus personal property for transfer to State 10 Agencies for Surplus Property, which in turn distributes such property 11 to eligible recipient agencies; and 12 WHEREAS, the State of California Department of General 13 Services Procurement Division manages the "Federal Surplus Personal �- 14 Property Program" that distributes surpluses to eligible recipient 15 agencies; and 16 WHEREAS, such federal surplus personal property includes such 17 items as handtools, machine tools, furniture, motor vehicles, 18 communication and electronic equipment, and many other types and 19 categories of movable and usable property offered on an "as is, where 20 is" basis, without warranty of any kind; and 21 WHEREAS, at the time the organization identifies the property 22 to be acquired from the state agency's warehouse, the organization 23 will be billed for state agency costs, if any, in handling the 24 personal property and an authorized representative will be required to 25 sign a document stating that: 26 1. the property is usable and necessary; 27 2. the property is required for its own use to fill an 28 existing need; 1 3. the property is not being acquired for any use or 2 purpose other than the purpose indicated; 3 4, the organization will pay the cost of transportation 4 and handling; and 5 S. the organization will abide by the terms, conditions, 6 and restrictions imposed by the federal and state governments which 7 consist of the following: 8 a. all property be placed in use within one year; 9 b. all property with an original acquisition cost of 10 $5,000 or more and passenger motor vehicles will have 18 months of 11 continuous use before title to the property will be considered to have 12 been transferred; 13 c. additional terms and conditions are imposed on 14 the transfer of aircraft and vessels measuring 50 feet or more in 15 length; 16 d. organization must agree to not sell, trade, lend, 17 cannibalize, or otherwise dispose of the property, or remove it 18 permanently for use outside the state without prior approval obtained 19 through the state agency; and 20 WHEREAS, in order to participate in the Federal Surplus 21 Personal Property Program, the City of Vernon needs to (1) sign an 22 Application for Eligibility (Form 201) and an Assurance of Compliance 23 (Form 203); and (2) have the City Council adopt a resolution listing 24 the people who will actually select the property (Form 202); and 25 WHEREAS, by letter dated January 20, 2000, the City 26 Administrator/City Clerk recommended the City's participation in the 27 Federal Surplus Personal Property Program; and 28 - 2 - I WHEREAS, the City of Vernon is interested in participating in 2 the Federal Surplus Personal Property Program because of the 3 opportunity to obtain the equipment offered under the Program ,at a 4 reasonable cost. 5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 6 CITY OF VERNON AS FOLLOWS: 7 SECTION 1: The City Council of the City of Vernon hereby 8 finds and determines that the recitals contained hereinabove are true 9 and correct. 10 SECTION 2: The City Council of the City of Vernon hereby 11 authorizes participation by the City of Vernon in the Federal Surplus 12 Personal Property Program and hereby approves the State of California 13 Application for Eligibility Federal Surplus Personal Property Program 14 (Form 201), Resolution (Form 202), and the Assurance of Compliance 15 (Form 203), copies of which have been presented to the City Council 16 concurrently with this resolution, and the City Council hereby orders 17 said documents to be received and filed by the City Clerk. 18 SECTION 3: The City Council of the City of Vernon hereby 19 approves the submission of such application documents by the Fire 20 Chief, together with a certified copy of this Resolution, to the 21 following: 22 State Agency for Surplus Property 23 701 Burning Tree Road 24 Fullerton, California 92833. 25 SECTION 4: The City Council of the City of Vernon hereby (1) 26 authorizes the Mayor and the City Clerk to execute the Assurance of 27 Compliance (Force 203); The government created this program to distribute surpluses to eligible recipient agencies. Under this program, agencies are able to purchase various items ranging from hand tools to motor vehicles. The cost for each purchase is a fraction of the original costs, however, the following conditions and restrictions exists: 1) All property must be placed into service within one year. 2) Property costing more than $5,000 and all motor vehicles must have 18 months of continuous use prior to transferring the title to the participant. 3) Additional terms are imposed on the transfer of aircraft and vessels over 50 feet in length. 4) Participant may not sell, trade, lend, cannibalize, or otherwise dispose of the property, or remove it outside the state without prior approval. This has been reviewed by the City Attorney, and it is hereby recommended that approval be granted to participate in the Federal Surplus Personal Property Program, and to authorize the execution of all necessary documents to satisfy the requirements to become a participant in said program. In looking into how other teams equipped themselves we were directed to the Federal Surplus Personal Property Program. This program, managed by the State of California Department of General Services Procurement Division, was created to dispose of surplus government property. The Government created this ,program in 1949 to distribute these surpluses to eligible recipient agencies. All of our city departments are eligibie. The items available through this program range from tools to X-ray machines, motor vehicles to office machines, and everything in between. It seems that the only things they don't sell are naval vessels and federal records. When items are purchased only five things are required of us. One, the property is usable and necessary. Two, the property is required for it's own use for an existing need. Three, the property is not being acquired for any use or purpose other than the purpose indicated. Four, we will pay for the cost of handling and shipping, and five that we will abide by the terms, conditions, and restrictions imposed by the federal and state governments. Those items, conditions, and restrictions consist of: 1. That all property will be placed into service within one year. 2. Property costing more than $5,000 and motor vehicles will have 18 months of continuous use before title is transferred to us. 3. Additional terms are imposed on the transfer of aircraft and vessels over 50 feet in length. 4. By following these rules the city will be able to buy equipment it needs for pennies on the dollar. The information on this program has been reviewed and approved by the city attorney. We all feel that this is a winning program for us. To become involved in this program we will need to have one representative from each city department selected to purchase equipment. We will need the signatures of each representative and the forms completed. Last but not least we will need the signature of the Mayor and approval by the city council. Library: A public or nonprofit facility providing library services free to all residents of a community, district, state or region Medical institution: An otherwise eligible public or nonprofit institution, facility, entity, or organization the primary function of which is the furnishing of health and medical services to the public at large or promoting public health through the conduct of research for any such purposes, experiments, training, or demonstrations related to the cause, prevention, and methods of diagnosis and treatment of diseases and injuries.
