Resolution No. 7481Y 1 RESOLUTION NO. 7481 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON, CALIFORNIA APPOINTING HILARIO GONZALES AND WILLIAM J. DAMS TO THE CITY COUNCIL OFFICES THAT 4 WERE TO BE ELECTED ON TUESDAY, APRIL 11, 2000 5 6 WHEREAS, a General Municipal Election is scheduled for 7 Tuesday, April 11, 2000, to fill two vacancies on the City Council of 8 the City of Vernon for the full term of four years; and 9 WHEREAS, the General Municipal Election is required by the 10 Charter of the City of Vernon and was called by Resolution No. 7440, 11 which was approved and adopted on November 23, 1999; and 12 WHEREAS, Resolution No. 7441 was approved and adopted on 13 November 23, 1999, requesting the Board of Supervisors of the County 14 of Los Angeles to render specified services to the City relating to 15 the conduct of the General Municipal Election to be held on Tuesday, 16 April 11, 2000; and 17 WHEREAS, Resolution No. 7442 was approved and adopted on 18 November 23, 1999, adopting regulations for candidates for elective 19 offices pertaining to candidates' statements submitted to the voters 20 at the General Municipal Election to be held on Tuesday, April 11, 21 2000; and 22 WHEREAS, a Notice of Election was properly given on 23 December 7, 1999; and 24 WHEREAS, the nomination period began on December 20, 1999 and 25 ended on January 19, 2000; and 26 WHEREAS, Section 2.90 of the Vernon City Code and Section 27 10229 of the Elections Code of the State of California, authorize the 28 appointment of the nominees for office in a City of Vernon municipal I election if the election is uncontested; and 2 WHEREAS, as of 5:00 p.m. on January 19, 2000, only one person 3 was nominated for each of the two elected offices to be elected in this 4 City, said nominees consisting of Hilario Gonzales and William J. 5 Davis; and 6 WHEREAS, Section 2.90 of the Vernon City Code and Section 7 10229 of the Elections Code allows one of the following courses of 8 action to be taken by the City Council: 9 1. Appoint to an office the person who has been 10 nominated; 11 2. Appoint to an office any eligible voter if no one has 12 been nominated; 13 3. Hold the election if no appointment has been made; and 14 WHEREAS, pursuant to Section 10229 of the Elections Code, a 15 notice that only the above -named persons were nominated for each office 16 was posted and published in a newspaper of general circulation and in a 17 manner consistent with the requirements of Government Code Section 18 6061; and 19 WHEREAS, the posting occurred on January 20, 2000, and the 20 publication occurred on January 21, 2000; and 21 WHEREAS, Section 10229 of the Elections Code provides that 22 said appointments may be made "after the fifth day following the date 23 of posting or publication" and Section 2.90 of the Vernon City Code 24 provides that said appointments shall be made "by the 50th day prior to 25 the municipal election;" and 26 WHEREAS, the 50th day prior to April 11, 2000, falls on 27 February 21, 2000; and 28 WHEREAS, the City Council meetings scheduled for February 1 - 2 - and February 15, 2000, fall on dates which satisfy the requirements of Section 2.90 of the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Pursuant to Section 2.90 of the Vernon City Code, the following persons are hereby appointed to the offices to which they were nominated NAME OFFICE TERM HILARIO GONZALES Member of the City Council Four, Years WILLIAM J. DAVIS Member of the City Council Four Years SECTION 3: The election scheduled to be held on Tuesday, April 11, 2000, is hereby cancelled, and the City Clerk is hereby directed to notify the Los Angeles County Registrar of Voters of the cancellation of the election.
