1 RESOLUTION 7485 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A 3 CONDITIONAL USE PERMIT TO SANDBERG FURNITURE MFG. CO., INC. FOR THE 4 OPERATION OF AN ACCESSORY WAREHOUSE AT 5685 ALCOA AVENUE 5 6 WHEREAS, Sandberg Furniture Mfg. Co., Inc. ("Sandberg 7 Furniture") has applied for a conditional use permit to operate 8 an accessory warehouse at 5685 Alcoa Avenue in the City of 9 Vernon; and 10 WHEREAS, Sandberg Furniture currently has manufacturing, 11 packaging, warehousing, and office space at 6200 Malburg Way, 12 5705 Alcoa Avenue, 3251 Slauson Avenue, and 3215 Slauson Avenue. 13 WHEREAS, the City Council of the City of Vernon held a 14 hearing on said application for a conditional use permit on 15 February 15, 2000; and 16 WHEREAS, the proposed site is a permitted use in the 17 General Industry (M) Zone with approval of a conditional use 18 permit; and 19 WHEREAS, the Community Services Department has performed an 20 Initial Study dated January 25, 2000, to determine whether the 21 Proposed project will have adverse impacts on the environment 22 and has determined that the proposed project will not have a 23 significant adverse effect on the environment, and the Director 24 of Community Services & Water has recommended that a Negative 25 Declaration be adopted in compliance with the California 26 Environmental Quality Act; and 27 28 -1- 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2s WHEREAS, the City of Vernon has provided notice of its intent to adopt a negative declaration for the Proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, a conditional use permit is required under the Zoning Ordinance Section 26.3.5-3(j) in order to operate an accessory warehouse greater than 50,000 square feet in the M- Zone; and WHEREAS, the proposed operation will be an integral part of the manufacturing operation and will include the storage of goods produced in the Sandberg Furniture's manufacturing operation in the City of Vernon; and WHEREAS, the proposed site is approximately 219,663 square feet in size, and is adequate in size, shape and topography for the proposed operation and has adequate drainage; and WHEREAS, a barrier has been installed where parking or maneuvering area adjoin a public street pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and -2- 1 WHEREAS, the paths of travel that were detailed in the 2 Staff Report dated February 8, 2000 has demonstrated the streets 3 to be utilized within the City of Vernon are sufficient to 4 handle the traffic generated form the proposed operations; and 5 WHEREAS, the proposed operation will generate a maximum of 6 approximately 100 vehicle movements, including employee 7 vehicles, to the site daily; and 8 WHEREAS, in the initial study prepared for the Original 9 Parcel Map Subdivision described the number of employees 10 associated with the development of the eight subdivided parcels; 11 and 12 WHEARAS, in that initial study it was shown that there 13 would be a decrease of 510 employees on all eight parcels as 14 compared to the previous occupant; and 15 WHEREAS, the proposed operation will not generate more 16 traffic trips than have been historically generated at the site 17 as a whole, prior to the Parcel Map Subdivision and there will 18 be no traffic impact; and 19 WHEREAS, the site, as proposed, has ample room on -site to 20 provide adequate off-street parking and loading facilities as 21 required by the Vernon City Code; and 22 WHEREAS, the conditions imposed on the conditional use 23 permit will adequately protect the public health, safety and 24 general welfare and the operation is consistent with all 25 applicable rules and laws of the City of Vernon; and 26 WHEREAS, the City Council has received a Staff Report, 27 dated February 8, 2000 upon which it has relied on making the 28 foregoing recitals; and -3- 1 2 3 4 5 6 7 s 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 29 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Sandberg Furniture for the operation of a accessory warehouse at 5685 Alcoa Avenue. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations, and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at or tied to 5685 Alcoa Avenue in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. c. All parking and loading facilities shall be paved with al hard durable surface material and shall be adequately drained,l', and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on -site parking shall be maintained so that no on -street parking will occur. -4- 1 d. The facility shall be operated in a manner that will 2 prevent unsanitary conditions, odors or other nuisances. The 3 property shall be provided with adequate refuse containers and 4 refuse disposal services. 5 e. The facility's buildings shall be structurally 6 maintained to exclude rodents and the property shall be 7 maintained rodent free. 8 f. Servicing of vehicles including washing, steam cleaning 9 and repairing shall be performed in facilities in compliance 10 with appropriate codes. 11 g. No equipment or freight shall be stored on the site 12 other than in buildings, trailers or on the docks. 13 h. A National Pollutant Discharge Elimination System Permit 14 shall be obtained from the California State Board of Water 15 Resources, if required. 16 i. Adequate plans and materials must be available for 17 handling leaks or spills from vehicles during storage or 18 transportation. 19 j. If required a hazardous materials permit shall be 20 obtained from the City of Vernon Environmental Health Department 21 if hazardous materials/waste are used handled or stored. 22 Hazardous materials/waste shall be handled and managed in 23 compliance with all appropriate federal, state and local laws. 24 k. The facility shall be operated in a manner that will not 25 impede traffic on Alcoa Avenue and Slauson Avenue. 26 27 28 -5- 1 1. All required frontage improvements shall be constructed 2 and all existing cracked sidewalk, curb and gutter adjacent to 3 the site on Alcoa Avenue shall be repaired and maintained to 4 meet City Standards. 5 m. The owner of the property shall provide to the City of 6 Vernon a utility easement for the underground electric lines and 7 padmounted transformer located on the owners property in a form 8 and manner subject to approval of the Director of Community 9 Services and Water. 10 n. No more than 10% of the entire Sandberg Furniture 11 facility shall be converted from manufacturing, milling, and/or 12 packaging space to warehousing space. 13 SECTION 4: Sandberg Furniture and any successors in 14 interest shall indemnify, hold harmless, and defend the City of 15 Vernon, its officers, agents, and employees from and against any 16 and all claims, complaints, or petitions for: (1) damages, 17 losses, expanses resulting from bodily injury, sickness, 18 disease, disability or death arising from the operation of the 19 facility excluding therefrom any such claim resulting from the 20 sole negligence or intentional wrongdoing of the City of Vernon, 21 its officers, agents or employees; (2) a peremptory writ or 22 other relief by way of injunction, mandamus, or administrative 23 mandamus; or (3) legal expenses and attorney's fees incurred by 24 the City of Vernon on behalf of any party in such actions or 25 proceedings. The City of Vernon does not waive its right to 26 participate in the defense of any such action 27 2s -6- 1 SECTION 5: Not later than sixty (60) days from the date of 2 this Resolution, Sandberg Furniture shall indicate, in writing, 3 its acceptance of and agreement with the conditions contained in 4 Section 3 of this Resolution and the indemnification provision 5 contained in Section 4 of the Resolution. 6 SECTION 6: The City Clerk of the City of Vernon shall 7 certify to the passage of this resolution and thereupon and 8 thereafter the same shall be in full force and effect. 9 APPROVED AND ADOPTED this 15th day of February, 2000. r 10 11 L is C. They are proposing to operate more than 50,000 square feet of a new tilt up industrial building as an accessory warehouse at 5685 Alcoa Avenue in the City of Vernon. After review of the application by the Community Services Department, it is recommended that the conditional use permit be granted. Herewith for your consideration are the following supporting documents: 1. Staff Report. 2. Request for conditional use permit and information supporting the application. 3. Notice of Public Hearing, notice of intent, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. 4. Environmental Checklist Form and Initial Study. 5. Proposed Negative Declaration. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA) which identifies potentially significant impacts on the environment from the project. The study failed to identify any adverse affects due to the construction and operation of the project. A notice of determination will be filed with the County Clerk. CO., INC. TO OCCUPY AN ACCESSORY WAREHOUSE IN EXCESS OF 50,000 SQUARE FEET AT 5685 Alcoa Avenue (February 8, 2000) Sandberg Furniture Mfg. Co., Inc. (hereafter referred to as "Sandberg Furniture") is a furniture manufacturer in the City of. Vernon, presently operating out of four separate buildings in the M-Zone. Sandberg Furniture's main warehouse and corporate offices are located at 3251 Slauson Avenue. The rest of its facility consists of; milling at 3215 Slauson Avenue, and assembly at 5705 Alcoa Avenue and 6200 Malburg Way. Sandberg Furniture is proposing to expand its operation by adding another building at 5685 Alcoa Avenue, adjacent to 3251 Slauson Avenue. The 116,450 square foot building will include approximately 16,000 square feet of office space. The existing office spaces located at 3251 Slauson will ;be relocated to the new corporate office facility at 5685 Alcoa Avenue. The remaining 100,000 square feet will be used as an accessory warehouse for their existing manufacturing facilities and will operate as an integral part of manufacturing and stores goods produced in the City. The existing warehousing space at 3251 Slauson will make up a portion of the new accessory warehouse at 5685 Alcoa Avenue. In order to comply with the Comprehensive Zoning Ordinance -1- and operate an accessory warehouse greater than 50,b00 square feet in the M-Zone, a conditional use permit is required. As defined in Section 26.3.5.3(j), an accessory warehouse is an integral part of a manufacturing operation located in the City of Vernon and storing goods produced in that operation. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan with the granting of a conditional use permit. The site of the proposed use is located in the M- zone, General Industrial. An accessory warehouse in excess of 50,000 square feet is permitted in the M zone with a conditional use permit. 2. SITE The proposed 116,450 square foot building at 5685 Alcoa Avenue is currently under construction on a 219,663 square foot parcel. The proposed building is situated on parcel five of the recently approved Final Parcel Map Number 24894. The existing facility is adequate in size, shape, topography and drainage for the operation. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. There are some residential units east of the project site. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA) dated January 25, 2000 to identify potentially significant impacts on the environment from the project. The study did not identify any adverse affects due to the construction and operation of the project. No adverse -2- affects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation. The City of Vernon has provided notice of its intent to adopt a negative declaration for the Proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines. The Director of Community Services and water will recommend that a Negative Declaration be adopted. A notice of determination will be filed with the County Clerk. 4. ACCESS The project site, as proposed, will have two driveways on Alcoa Avenue and one additional access gate on the south end of the property facing the Sandberg Furniture building located at 3251 Slauson. The on -site driveway connecting the two sites will be gated and is not intend for regular use. A barrier in compliance with Section 26.4.2-8(g) has been proposed where parking or maneuvering area adjoin a public street pursuant to the Vernon City Code. The site has adequate room on -site to provide required parking, loading and maneuvering for trucks and automobiles as required by the City of Vernon Comprehensive Zoning Ordinance. The proposed project will comply with the Comprehensive Zoning Ordinance with approval of a conditional use permit and will be readily accessible from the two driveways on Alcoa Avenue. The site has access to Alcoa Avenue which is 55 feet in -3- width. The west side of Alcoa Avenue from the centerline between Fruitland Avenue and Slauson Avenue has been improved to comply with the Master Plan of Street width dated June 16, 1992. The east side of Alcoa, which is outside the project site, from the centerline between Fruitland Avenue and Slauson Avenue still requires five feet in order to comply with the Master Plan of Street Widths dated June 16, 1992. However, given this restriction the street is adequate in size and pavement type to handle the traffic generated by the new facility. Part of the entire development of the Alcoa site included a Parcel map and the construction of five new buildings on five new parcels. The proposed Sandberg Furniture property is the fifth building located on the southern most parcel directly north of the existing Sandberg Furniture property. Upon completion, 5685 Alcoa will have access, via a driveway, to the existing Sandberg Furniture facility on their shared property line. 5. VEHICLE MOVEMENTS Due to construction, traffic has increased slightly around the entire Alcoa development. However, upon completion of the facility traffic will not be significantly altered. The traffic generated as a result of the new building are pre-existing traffic trips from the neighboring Sandberg Furniture facility. Only the employees from the existing warehouse and office building at 3251 Slauson Avenue will be relocated into the new building. Therefore, there will be no impact on transportation during operation due to increased traffic trips. As discussed earlier the proposed facility is directly north of the existing facility. All the office and warehousing space will be transferred from 3251 Slauson Avenue to 5685 Alcoa Avenue as seen in Figure 1. According to the applicant they do not propose to hire any additional personnel upon completion of the new facility. Therefore, vehicle movements will not be significantly altered. Essentially, traffic associated with office and warehousing operations at 3251 Slauson Avenue will be, shifted to 5685 Alcoa Avenue. Traffic trips to the entire Sandberg Furniture facility will be comprised of approximately 53 employee automobiles, 38 shuttles, 3 local delivery trucks, 3 out of town trucks, and 1 bobtail truck. According to the traffic report submitted by the applicant as part of the application, there will be approximately 53 employee traffic trips to the facility per day. These trips vary in terms of their route to the facility but will consistently arrive between 6:30 a.m. and 7:00 a.m. and depart between 3:30 p.m. and 4:00 p.m. As mentioned above, in addition to the automobile trips, there will be three (3) local truck and trailers which travel from the I-710 freeway to either District or Slauson Avenue and then proceed to Alcoa Avenue before accessing the site. These trips depart between 8:00 a.m. and 9:30 a.m. and arrive between -5- 4:30 p.m. and 5:00 p.m. The one (1) bobtail truck which accesses the site also enters Vernon from the I-710, proceeds to Atlantic, travels to District Boulevard and then to Alcoa Avenue where it enters the site. It departs from the site at 10:00 a.m. and arrives at 4:30 The facility also has two (2) shuttles that travel to and from the various Sandberg Furniture buildings. The shuttles are essentially 2_forty foot truck and trailers that transport product to and from the various buildings of the facility. As previously described, the Sandberg Furniture operation is situated in various buildings along Slauson Avenue, Alcoa Avenue, and Malburg Way. Some buildings are used for milling the product while others are used for packaging and warehousing. Therefore, the shuttles are used to transport product from one site to another depending on whether it is being milled, packaged, or warehoused. The shuttles have two routes; one on Alcoa Avenue and the other on Malburg Way, which transport product to and from the sites. At this rate each shuttle accesses the site approximately 19 times per day, making a total of 38 trips to the site. The out of town trucks operate Tuesday through Sunday on various schedules. On Tuesday two trucks depart at 11:00 p.m. On Wednesday one truck departs at 11:00 p.m. while two access the site at 11:00 a.m. and 11:30 a.m. On Thursday one truck departs from the site at 1:00 a.m. On Friday two trucks arrive at the site at 11:00 p.m. On Saturday one truck arrives at the site at 12:00 p.m. On Sunday three trucks depart from the site between 2:00 p.m. and 3:00 p.m. On an average week approximately five (5) out of town trucks, access the site and six (6) depart from the site. All of the aforementioned vehicle trips, except for the out of town trucks access the site Monday through Friday. The total number of vehicles trips to the site would be the sum of every vehicle that accesses the site per day. In calculating the total number of vehicle trips, the two shuttles were considered to have generated 38 vehicles trips each to and from all the Sandberg Furniture sites per day Monday through Friday. Therefore, the maximum number of vehicle trips that access the site per day would be approximately 100. Furthermore, the initial study prepared for the Original Parcel Map Subdivision of the Alcoa Project described the number of employees associated with the development of the eight subdivided parcels. It was shown that there would be a decrease of 510 employees on all eight parcels as compared to the previous occupant, Alcoa Aluminum'. Based on the current development of the site these totals appear to be accurate. Considering that there will be 510 fewer employees, the total number of traffic trips will also be significantly reduced thus causing less of an -7- impact than had historically been at the site. 6. OPERATIONS Sandberg Furniture is an existing facility in the City of Vernon that is proposing to expand their operation by relocating their warehousing and corporate offices in the new building located at 5685 Alcoa Avenue. The proposed building is approximately 116,000 square feet with 100,000 square feet dedicated to accessory warehouse and 16,000 to office. A conditional use permit is required for any accessory warehouse in excess of 50,000 square feet. With the addition of the new building the Sandberg Furniture operation has proposed to reorganize their operation to maximize their manufacturing operations. Prior to the proposed expansion the square footages per use in all the Sandberg Furniture Facilities as a whole can be seen in Figure 1. Upon approval of the applicant's conditional use permit they have proposed to reorganize their distribution of uses as seen in Figure 2. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations, and subject to permit fees as adopted by the City of Vernon. Slauson 3251 �� 3215 Expansion of Mill Mill & Assy The only other change will be that some of the assembly will be done at 3251 Slauson in addition to the other two assembly plants at 6200 Malburg and 5705 Alcoa. 3. Sandberg Furniture has already hired approximately 25 additional employees for the new assembly line that will be placed in 3251 East Slauson. These employees are being trained on current lines in 5705 Alcoa and 6200 Malburg and will be moved to 3251 East Slauson at time of move. No new employees are required for mill at 3215 Slauson or no additional office employees will be hired. 4. There are no plans for additional expansion within next five to ten years. The site is surrounded by compatible uses and will not disrupt or divide the physical arrangement of any established communities. IL POPULATION AND HOUSING. The topography of the City of Vernon is relatively level. Although there are no known earthquake faults in the City, Vernon is in a seismically active region and several faults in the area are likely to cause moderate ground shaking in Vernon. To ensure life safety, all construction shall be required to be in compliance with Zone 4 seismicity requirements of Uniform Building Code. A large portion of site was previously demolishedanda new building is currently being constructed in its place. The construction has involved minor grading related to building construction, however, there will not be any significant changes to the geologic substructure or topography. There will not be covering of any unique geologic or physical features, any increase in wind or water erosion to the soil, since the ground it relatively level landslides and mudslides are unlikely. IV. The proposed building is being constructed on a parcel that was part of a larger Parcel Map Subdivision'. The Parcel Map subdivided the lot into 8 individual parcels and demolished the existing structures on site. An initial study was preformed as part of this project which studied the affects of water quality impacts?. In the Parcel Map Subdivision, it was determined that a large portion of the site has been demolished and is currently vacant. Historically, however, the site has been fully developed and the new development is not expected to substantially change absorption rates, drainage patterns or the rate and amount of surface runoff since the proposed development will have similar lot coverage to the previous facility. The development will be designed such that all runoff will flow to the storm drain system as approved by the City. People or property will not be exposed to -4- flooding because of the development. Alteration of surface water quality is unlikely. All businesses will be required to obtain an NPDES permit, if required. There are no surface water bodies within the vicinity of the project. No changes in water currents or water movements will occur. There will be no impacts on the direction or rate of flow of groundwater and no impact on its quality. The City of Vernon is the primary water service provider in Vernon. Prior to the subdivision discussed earlier, the entire site was fully developed by Alcoa Aluminum. It had been demonstrated in the initial study preformed for the original Parcel Map Subdivision that there will be a decrease of s employees upon development of the eight subdivided parcels'. Therefore, there will be no substantial increase in public water demand and no reduction in the demand for groundwater. V AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ ❑ x a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District (SCAQMD) at 35 monitoring stations throughout the area. The monitoring -station nearest to the -City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. During Construction The initial study prepared for the Original Parcel Map Subdivision discusses air quality impacts associated with the development of the eight subdivided parcels. The proposed facility may cause some dust associated with normal construction tion activities. The contractor has established a dust control program in place in compliance with AQMD standards to avoid any impacts. The community services department has been monitoring the construction activities during routine site inspections. Based on previous studies of air quality impacts caused by emissions from other construction related equipment of projects of this magnitude, it has been determined that the project will not generate a significant impact4 S. During Operation The initial study prepared for the Original Parcel Map Subdivision discusses air quality impacts associated with the development of the eight subdivided parcels. It had been determined that vehicle emissions due to traffic entering and exiting the site would be the only contributing factor to air quality during operation. The original Initial Study for the Parcel Map Subdivision also determined that there would be a decrease of 510 employees. Based on the current development of the site these totals appear to be accurate. Furthermore, the applicant has indicated that there will not be any additional employees due to the move into the new building. Only the employees from the existing warehouse and office building at 3251 Siauson Avenue will be relocated into the new building. Therefore, there will be no impact on air quality during operation due to increased traffic trips. b) Expose sensitive receptors to pollutants? ❑ ❑ ❑ x b. Vernon is strictly an industrial community with similar uses surrounding the project site. The project involves using more than 50,000 square feet of a new proposed industrial tilt up building for accessory warehouse. Such a use requires a conditional use permit and therefore CEQA review. The accessory warehousing use itself will not have any negative affects to any sensitive receptors. Incidentally the nearest sensitive receptors (i.e. residential dwelling units) are approximately 1,200 feet east of the project boundaries. The project as proposed will not cause an impact to these sensitive receptors. c) Alter air movement, moisture, or temperature, or cause any change in climate? ❑ ❑ ❑ x c. The proposed project will create no unusual conditions which could alter air movement, moisture, -5- temperature, or climate. d) Create objectionable odors? ❑ ❑ ❑ X d. The proposed project will not create objectionable odors and thus there will be clearly no significant environmental impact. VL TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? ❑ ❑ ❑ X a. Several freeways serve Vernon. To the north is the Santa Ana (1-5), Santa Monica (I-10) and the Hollywood (1-101) freeways, to the west is the Harbor Freeway (1-110), and to the east is the Long Beach Freeway (I-710). Vernon has several arterials which bisect the City. The site has access to Alcoa Avenue which is 55 feet in width. The initial study prepared for the Original Parcel Map Subdivision discusses the number of employees associated with the development of the eight subdivided parcels. It had been demonstrated that there will be a decrease of 510 employees on all eight parcels as compared to the previous occupant, Alcoa AluminuO. Based on the current development of the site these totals appear to be accurate. Considering that there will be 510 fewer employees the total number of traffic trips will also be significantly reduced thus causing less of an impact than had historically been at the site. As discussed in the Air Quality Section of this initial Study, the traffic generated as a result of the new building are pre-existing traffic trips from the neighboring Sandberg Furniture facility. Only the employees from the existing warehouse and office building at 3251 Slauson Avenue will be relocated into the new building. Therefore, there will be no impact on transportation during operation due to increased traffic trips. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. No safety hazard resulting from incompatible uses are expected. c) Inadequate emergency access or access to nearby uses? ❑ ❑ ❑ X c. The proposed site will include emergency access and access to nearby uses, as required by the City. d) Insufficient parking capacity on -site or off -site? ❑ ❑ ❑ X d. According to the Comprehensive Zoning Ordinance the project as proposed requires 133 car parking spaces, 8 truck parking spaces and 5 truck loading spaces. The current site plan has 136 car parking spaces and 9 truck parking and 6 truck loading spaces and the maneuvering area required by the Comprehensive Zoning Ordinance'. Therefore, the proposed site will supply sufficient parking on site and will create no impact. e) Hazards or barriers for pedestrians or bicyclists? ❑ ❑ ❑ X f) Conflicts with adopted policies supporting alternative transportation (e.g. bus turnouts, bicycle racks)? 0 0 ❑ X g) Rail, waterborne or air traffic impacts? ❑ ❑ ❑ X e through g. The energy used by this operation will not be substantial. There will be no impact to the City of Vernon Utilities Department. Therefore, the impact will be less than significant. IX. HAZARDS. Use and storage of hazardous materials at any facility within the City of Vernon is regulated by the local Certified Unified Program Agency (CUPA) which is the City of Vernon Environmental Health Department. All facilities within the City are regularly inspected by the Vernon Fire and Environmental Health Departments for code violations. The inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully manned hazardous materials unit. All personnel are trained in -7- hazardous material response. The proposed Existing regulations and permitting requirements will be adhered to by the facility and this compliance will reduce potential hazards to less than significant levels. If required, a Hazardous Materials Establishment Permit, as required of all facilities within the City, must be submitted to and approved by the City of Vernon Environmental Health and Fire Departments. A Hazardous Materials Establishment Permit shall include, but not be limited to, instruction and on-the-job training of employees to identify and handle hazardous materials and shall be conducted by an individual knowledgeable in hazardous materials management. These requirements are standard requirements of facilities located within the City of Vernon to regulate the handling and storage of hazardous materials involved in the everyday function of non -hazardous businesses. Therefore, this impact will be less than significant. e) Increased fire hazard in areas with flammable brush, grass, or tees? ❑ ❑ ❑ X e. The proposed site is located in a completely built -out urbanized area that does not contain flammable grass, brush, or trees. X. NOISE. Would the proposal result in: a) Increases in existing noise levels? ❑ ❑ ❑ X b) Exposure of people to severe noise levels? ❑ ❑ ❑ X a and b. The project is within an industrial area and the surrounding manufacturing and warehousing uses are not noise sensitive. Normal operation within the facility include trucks entering the facility, transferring freight, and leaving. These operations are not expected to cause any significant noise impacts. XIL UTILITIES AND SERVICE SYSTEMS. Would the proposal result in a need for new systems, or substantial alterations to the following utilities: a) Power or natural gas ❑ ❑ X ❑ a. The proposed site is located in an area that is fully urbanized and served by an existing extensive electricity and gas infrastructure. The applicant will need to grant a utility easement for the underground electrical lines and padmounted transformer located on the owner's property. A condition shall be placed in the conditional use permit to insure that the easement is granted thus alleviating any potential impact. Implementation is not expected to result in the need for new power lines or natural gas systems. b) Communications systems? ❑ ❑ ❑ X b. The proposed site will be served by existing communication systems. The telephone, cable, and other communication systems are adequate and available to serve the proposed site. All main lines are in place and the proposed operation will not require any additional services beyond those presently offered. The proponent will provide their own refuse pick up. The project is in an area that is extensively urbanized with industrial buildings and accessory structures, and does not provide any scenic vista open to the public. The site is located in an industrial area and lighting of facilities is common, therefore no impacts from light are anticipated. The facility is not expected to create any impact from glare. The project is on a site that has been developed for many years and has been built with structures and parking lots. The project will not involve extensive excavation therefore, the potential for disturbing previously unencountered archaeological resources is remote. Therefore, the project will create no impact. c) Affect historical resources? 0 0 0 X c. The project site has historically been developed and has been built with structures and parking lots. The extent of excavation is limited to a foundation with no extensive underground features, therefore, the chance of unearthing any historical resource is remote. Therefore, the proposed project will create no impact. d) Have the potential to cause a physical change which would affect unique ethnic cultural values? ❑ ❑ ❑ X e) Restrict existing religious or sacred uses within the potential impact area? 0 ❑ ❑ X d and e. The project area is highly industrialized, no known unique ethnic cultural resources, or religious or sacred uses exist in the project area. Therefore, no impact is expected. XV. RECREATION. The project will not result in an increase in residential population in Vernon. No impact on the demand for recreation opportunities is anticipated. No parks or recreation facilities exist on the project site nor is one planed on the site. XVL MANDATORY FINDINGS OF SIGNIFICANCE. a) Does the project have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory? ❑ ❑ ❑ X a. The City of Vernon is primarily made up of industrial and distribution type facilities with limited plant life. Plant life is limited to non-native and ornamental species which are used for landscaping. Animal life in Vernon and nearby urban communities consists of bird, reptile and mammal species that live in close proximity to man. There are no endangered des in Vernon. The site is an existing facility and -there is no potential for finding important examples of major periods of California history. Therefore, the proposed project will create no impact. b) Does the project have the potential to achieve short-term, to the disadvantage of long-term, environmental goals? ❑ ❑ ❑ X b. The proposed project is in conformance with the City of Vernon General Plan. The zoning of the site is M, which allows an accessory warehouse with a floor area more than 50,000 square feet per lot as an integral part of a manufacturing operation located in the City of Vernon with approval of a conditional use permit. There will not be an impact on long-term environmental goals. c) Does the project have impacts that are individually limited, but cumulatively considerable? ("Cumulatively considerable" means that the -10- incremental effects of a project are considerable when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects) ❑ C X ❑ c. Cumulative impacts from this project and proposed nearby projects were considered. The project is not significant enough to cause a cumulative impact to air quality, traffic, noise, groundwater, surface water, or exposure to hazardous materials.. During construction the project will produce short term localized impacts associated with construction activities such as compacting of dirt, painting, back-up safety devices, construction vehicle traffic, very minimal dust from construction, and limited use of hazardous materials used in normal construction activities. These impacts are negligible and will not create an impact to sensitive receptors. Therefore, the cumulative impact for the proposed project will be clearly less then significant. d) Does the project have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly? ❑ ❑ ❑ X d.
