OF THE CITY OF VERNON AMENDING AN
3 EXISTING CONDITIONAL USE PERMIT
FOR UNITED CARGO LOGISTICS, INC.
4 FOR THE OPERATION OF A TRUCKING
AND FREIGHT TERMINAL AT 2065 ROSS,
5 STREET

7 WHEREAS, the City of Vernon City Council approved and
8 adopted Resolution 7469 on January 4, 2000, granting United
9 Cargo Logistics, Inc. ("United Cargo") a conditional use Permit
10 for the operation of a trucking and freight terminal at 2065
11 Ross Street: and
12
WHEREAS, the City Council's decision was based on a Staff
13
Report prepared and submitted to it for its consideration and a
14
public hearing; and
15
16 WHEREAS, the original conditional use permit limited the
17
truck trips to twenty (20) truck trips per day; and
18 WHEREAS, subsequent to the approval of the conditional use
19 permit United Cargo requested a reconsideration of the permitted
20 number of truck trips; and
21 WHEREAS, there had been some ambiguity about the number of
22 round trips and one-way trips that would occur on the site,
23 resulting in a misinterpretation of the number of truck trips
24 that would occur due to the proposed use; and
25
WHEREAS, City Staff has again reviewed the background
26
information contained in the application for a conditional use
27
permit submitted by United Cargo and the uses of the -surrounding
28
properties; and

WHEREAS, the City Staff prepared a Staff Report, dated
February 17, 2000, in which it finds, among other things, that
the neighboring facilities have similar uses that are compatible
with United Cargo's proposed use, the number of traffic trips is
consistent with these sites, and the number of traffic trips
generated by United Cargo will not significantly impact the
neighboring facilities or public streets' ability to handle the
traffic load; and
WHEREAS, Staff recommends an amendment to condition "m" of
United Cargo's conditional use permit; and
WHEREAS, the number of truck trips allowed to access the
site will be increased from twenty (20) round trips per day in
the original conditional use permit to forty (40) round trips
per day in the amended conditional use permit; and
WHEREAS, conditions "a" through "1" approved as part of the
original_ conditional use permit for United Cargo shall remain
unchanged; and
WHEREAS, the City Council of the City of Vernon held a
public hearing on March 21, 2000 to address the impacts, if any,
of the additional traffic trips in the area; and
WHEREAS, the existing site is a legal non -conforming use in
the General Industry (M) Zone which is currently being used as a
truck and freight terminal by United Cargo; and
WHEREAS, the existing occupant, United Cargo, currently
hauls and temporarily stores general products; and

WHEREAS, the site is approximately 1.61 acres in size, and
is adequate in size, shape and topography for the operation and
has adequate drainage; and
WHEREAS, a barrier wall or landscaping already exists where
parking or maneuvering areas adjoin a public street pursuant to
the Vernon City Code; and
WHEREAS, the site is surrounded by industrial uses
compatible with the use and no adverse effects from traffic,
parking, noise, odors dust, smoke, light or glare, or risk of
fire, infection or explosion is anticipated from the amendment
to the conditional use permit; and
WHEREAS, the majority of outbound trips will take Ross
Street to Alameda Street traveling North to the 10 freeway and
visa versa for inbound traffic and the streets utilized within
the City of Vernon are sufficient to handle the traffic
generated from the operations; and
WHEREAS, the operation will not generate access traffic
trips inconsistent with it's neighboring facilities; and
WHEREAS, the site has ample room on -site to provide
adequate off-street parking and loading facilities as required
by the Vernon City Code; and
WHEREAS, United Cargo will not maintain their vehicles on -
site; and

WHEREAS, the conditions imposed on the conditional use',
permit as set forth heroin will adequately protect the public)
health, safety and general warfare, and the operation isl
consistent with all applicable rules and laws of the City of
Vernon; and
WHEREAS, the use, as to location, operation and design.is
consistent with the General Plan and Zoning Ordinance of the
City of Vernon; and
WHEREAS, the project is categorically exempt from the
California Environmental Quality Act as an existing facility
pursuant to Section 15301 of the California Environmental
Quality Act Guidelines and Notice of Exemption shall be filed
with the County Clerk pursuant to Section 15062 of the
California Environmental Quality Act Guidelines.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.
SECTION 2: Subject to the condition set forth below, the
conditional use permit granted to United Cargo for the operation
of a trucking and freight terminal at 2065 Ross Street is
amended as forth in condition"m.
SECTION 3: In order to adequately protect the public health
and general welfare the following conditions are required:

a. The facility shall be operated in accordance with,
and made to conform with all current codes, rules, regulations
and subject to permit fees as adopted by the City of Vernon. All
trucking operations, including truck and trailer parking, shall
oe limited to the lot located at 2065 Ross Street in the City of
Vernon.
b. All required federal, state, local and regulatory
agency permits shall be obtained prior to operation. Prior to
occupancy a business license and occupancy permit shall be
obtained.
C. All parking and loading facilities shall be paved with
a hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City
standards. Adequate on -site parking shall be maintained so that
no on -street parking will occur.
d. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.
e. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
f. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance
with appropriate codes.

g. No equipment or freight shall be stored on the site
Dther than in buildings, trailers or on the docks.
h. A National Pollutant Discharge Elimination System
Permit shall be obtained from the California State Board of Waters
3esources, if required.
i. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
j. A hazardous materials permit shall be obtained from the
City of Vernon Environmental Health Department if hazardous
materials/waste are used handled or stored. Hazardous
materials/waste shall be handled and managed in compliance with
all appropriate federal, state and local laws
k. The facility shall be operated in a manner that will
not impede traffic on Ross Street.
1. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
M. The site shall not generate more than 40 truck trips
(20 inbound and 20 outbound) per day.

SECTION 4: United Cargo and any successors in interest
shall indemnify, hold harmless, and defend the City of Vernon,
its officers, agents, and employees from and against any and all
claims, complaints, or petitions for: (1) damages, losses,
expanses resulting from bodily injury, sickness, disease,
disability or death arising from the operation of the facility
excluding therefrom any such claim resulting from the sole
negligence or intentional wrongdoing of the City of Vernon, its
officers, agents or employees; (2) a peremptory writ or other
relief by way of injunction, mandamus, or administrative
mandamus; or (3) legal expenses and attorney's fees incurred by
the City of Vernon on behalf of any party in such actions or
proceedings. The City of Vernon does not waive its right to
participate in the defense of any such action
SECTION 5: Not later than sixty (60) days from the date of
this Resolution, United Cargo shall indicate, in writing, its
acceptance of and agreement with the conditions contained in
Section 3 of this Resolution and the indemnification provision
contained in Section 4 of the Resolution.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

The Conditional Use Permit for United Cargo Logistics, Inc. was approved by the
City Council on January 4, 2000. Upon further consideration staff would like to amend
condition `m' of their conditional use permit. They are currently operating a trucking
terminal at 2065 Ross Street.
Herewith for your consideration are the following supporting documents:
1. Staff Report.
2. Request for conditional use permit and information supporting the application.
3. Notice of Public Hearing, copies of notification letters to owners and tenants in
the area and affidavits of posting and mailing.
The project is categorically exempt from the California Environmental Quality
Act because it is an existing facility with no expansion of use as defined in Section
15301. A Notice of Exemption will be prepared.
In my opinion the proposed operation is consistent with the General Plan as
adopted by the City of Vernon, will pose no adverse effects to the City of Vernon, will
have no significant effects on the environment, and no mitigation measures are required.
It is recommended that the City Council find that the proposed use is categorically
exempt from the California Environmental Quality Act process and is consistent with the
General Plan.

ON UNITED CARGO LOGISTICS, INC.
CONDITIONAL USE PERMIT
TO OPERATE A TRUCK TERMINAL
AT 2065 ROSS Street
(February 17, 2000)
United Cargo Logistics, Inc. has submitted an application
for a conditional use permit to operate a truck terminal at 2065
Ross Street. The proposed operation will include the hauling and
temporary storage of general products and provide pick-up and
delivery services. They are proposing to generate 16 inbound
employee automobiles and 20 inbound delivery truck trips to the
site daily. The site was previously occupied by Postal Freight,
Inc., another trucking company, that generated approximately 13
inbound employee automobile and 7 inbound delivery truck trips to
the site daily. Prior to their occupancy, Southern Counties
Transport, another trucking company, generated a total of
approximately 30 vehicle trips to the site daily.
The neighboring facilities have similar uses that are
compatible with United Cargo Logistics, Inc. The number of
traffic trips generated at United Cargo Logistics, Inc. is
consistent with these sites. Bret E. Jessup Transportation, Inc.
and Heitz Trucking, Inc. operate approximately 40 trucks out of
their facility at 3375 Ross Street per day. New Willig Freight
Lines located at 2043 Ross Street generate approximately 20
delivery truck trips out of their facility daily. Therefore, the
number of traffic trips generated by the applicant will not

significantly impact the neighboring facilities or public
street's ability to handle the traffic load.
The facility is subject to review by the California
Environmental Quality Act (CEQA). However, as an existing
facility the project is categorically exempt from CEQA pursuant to
Section 15301 of CEQA Guidelines and a Notice of Exemption shall
be filed with the County Clerk pursuant to Section 15062 of the
CEQA Guidelines.
1. GENERAL PLAN The proposed use is a legally
nonconforming use in the General Industrial, M Zone, which has
been historically used as a truck terminal.
2. SITE The proposed site is approximately 1.61 acres in
size, and is adequate in size, shape and topography for the
proposed operation and has adequate drainage. As previously
mentioned, this site has historically been used for similar
purposes. A barrier wall or landscaping has been installed where
parking or maneuvering area adjoin a public street pursuant to
the Vernon City Code.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use. The proposed
use is also the same as the past use of this site. No
potentially significant impacts are expected to result from
traffic, parking, noise, odor, dust, smoke, light or glare from
the project. The project is categorically exempt under Section
15301 of the CEQA because it is an existing facility with no

expansion of use. A Notice of Exemption will be prepared.
4. ACCESS The site has access to Ross Street which is 60
feet wide. The street is of adequate size to handle the traffic
generated form the proposed operation as further described in
section 5.
5. VEHICLE MOVEMENTS United Cargo Logistics, Inc. will
operate approximately twelve 24 foot vans and seven 53 foot
trucks out of the facility. As proposed, the site has ample room
for off-street parking and loading facilities for these vehicles
as required by the Vernon City Code. Normal operation times will
be from 9:00 a.m. to 9:00 p.m. Monday through Friday and
occasionally on Saturdays on an as needed basis. Most trucks
will depart from 9:00 a.m. to 11:00 a.m. and return from 3:00
p.m. to 6:00 p.m.. The vehicles will arrive primarily from
Alameda Street to Ross Street. In addition to the trucks and
vans there will be approximately 16 automobiles that access the
facility daily during normal operating hours. Approximately 20%
of all trucks will go South down Alameda to Slauson to Access the
110 Freeway and approximately 5% will use 37th Street to Santa Fe
Avenue for Access to the City and the 10 Freeway. The majority
of inbound and outbound trips will take Ross Street to Alameda
Street traveling North to the 10 freeway on outbound traffic and
visa versa for inbound traffic.
OPERATIONS United Cargo Logistics, Inc., will use the
facility to operate a trucking and freight terminal. They will

not maintain their vehicles on -site. All merchandise that is
stored and transferred by United Cargo Logistics, Inc. are
manufactured finished goods. No hazardous materials will be
stored or transferred on -site. Other operational activities
include sales and customer service of existing freight customers.
6. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and

BURDEN OF PROOF
The applicant is required to establish the following before submitting a conditional use permit

properties. The site has been an active truck termi al for the past 20
years. Most of the adjacent properties are currently used as truck
terminals.

properties. All of the adjacent uses on Ross Street are existing truck
terminals.
D) The site has sufficient access to streets and highways, which are adequate in width and
pavement type to carry the quantity of traffic generated by the proposed use, and that the
routes which vehicles will have to follow to reach the site are adequate in width and pavement
type to carry the volume of traffic generated by the proposed use. The site has a very
large yard area 67,518 sq. ft. There are two curb cuts to access the site

I am writing to inform you that we are requesting
certain documents as part of the Community Development
Block Grant (CDBG) program. The documents being requested
are the payroll certification for those employees you hired
with the CDBG monies.
Please send us the payroll certifications for the past
12 months. We are requesting one payroll certification per
month for each employee. These documents will be placed in
our files and used when the State staff member reviews and
monitors our files. In addition, please fax me a copy of
the invoice for the equipment that you purchased.
