Resolution No. 75321 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7532 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON CONSENTING TO THE ESTABLISHMENT OF A PORTION OF SOTO STREET OVER THE LOS ANGELES RIVER IN THE CITY OF VERNON TO BE A PART OF THE SYSTEM OF HIGHWAYS OF THE COUNTY OF LOS ANGELES FOR THE PURPOSE OF PERFORMING A SEISMIC SAFETY RETROFIT OF THE BRIDGE WHEREAS, the Los Angeles County Board of Supervisors on November 16, 1999, duly adopted a Resolution declaring the portion of Soto Street over the Los Angeles River, within the City of Vernon, to be a part of the System of Highways of the County of Los Angeles, as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California, for the limited purpose of performing a seismic safety retrofit of the bridge at the aforementioned location; and WHEREAS, the Board of Supervisors by said Resolution requested the City Council of the City of Vernon to give its consent to allow the County to perform the above -described improvements within said portion of Soto Street over Los Angeles River in the City of Vernon described above; and WHEREAS, pursuant to Section 15301, Class 1 (c) and (d), of the California Environmental Quality Act (CEQA) Guidelines, the Secretary of Resources designated this type of project as categoricallyli exempt. The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Consent to Inclusion in County Highway System. (The City Council of the City of Vernon hereby consents to the establishment of that portion of Soto Street over the Los Angeles River, within the City of Vernon, as part of the System of Highways of the County of Los Angeles as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California, for the limited purpose of performing a seismic safety retrofit of the bridge at the aforementioned location. SECTION 3: Finding of Categorical Exemption. The City Council of the City of Vernon hereby finds that the project is categorically exempt from the requirement for an Environmental Impact Report pursuant to Section 15301, Class 1 (c) and (d), of the CEQA Guidelines. SECTION 4: Finding of a Minor Nature. The Public Resources Code provides that this type of project, by reason of the work proposed, does not have a significant effect on the environment. Accordingly and pursuant to Section 15301, Class 1 (d), of the California Environmental Quality Act Guidelines, we have found that this project is categorically exempt from the provisions of said Act. If you concur that this project is categorically exempt, please have your duly authorized City officials make such a finding in the Resolution or Ordinance of consent to the jurisdiction. However, if your Council is unable to make this environmental finding, Council action granting jurisdiction should be deferred until the appropriate environmental finding can be made. In our conversation with the County staff regarding the impact on traffic during the project, the County has suggested to perform the work from inside the channel and during the hours of 7:00 p.m. to 4:00 a.m. nightly. I don't see any impact on the traffic with the work being performed during these hours. Under State Law, the County is the lead agency for projects to retrofit all non -State highway seismically deficient bridges in L.A. County to current structural standards and will pay the cost. The county in their inspection, has determined that additional bridge repair is necessary at an estimated cost of $120,000. The Community Services and Water Department agrees with their finding did budget $150,000 for said repairs. In order to proceed with the retrofit, the City should consent to the establishment of that certain portion of Soto Street within the City as part of the System of Highways of the County of L.A. The bridge is scheduled to be retrofitted in spring 2001. Staff has determined the project is categorically exempt under Section 15301 of the California Environmental Quality Act, and that there will be minimal impact on traffic during normal working hours.
