3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
4 VERNON DETERMINING THE TAX ON ALL PARCELS
SUBJECT TO THE SPECIAL PARCEL TAX IMPOSED BY
5 ORDINANCE NO. 1076 FOR FISCAL YEAR 2000-2001

7 WHEREAS, Articles XIIIA and XIIIC of the California Constitution require special
8 taxes to be submitted to the voters for approval; and
9
WHEREAS, Ordinance No. 1057, which imposed a special tax, was approved on
to
11 April 14, 1998 by the City of Vernon voters; and
12 WHEREAS, Ordinance No. 1057 added Section 5.45 to the City of Vernon
13 Municipal Code; and
14 WHEREAS, Section 5.45 established a special parcel tax on warehouses, truck
15
terminals, freight terminals and other distribution facilities; and
16
17 WHEREAS, the maximum tax rate that was established in Ordinance No. 1057 was
18 $1.00 per 100 square foot of gross area of land; and
19 WHEREAS, the revenues raised from this special tax were and are to be used for
zo
construction, improvement and maintenance of streets, bridges, and other public right-of-way,
21
including acquisition of land; and
22
23 WHEREAS, the City Council of the City of Vernon determined after studying the
24 possible need to increase the maximum tax rate, that such an increase was appropriate in order to
25 equitably distribute the cost of maintaining the City's infrastructure to those placing the greatest
26
demand on the infrastructure and that a measure implementing the increase should be submitted to
27
28 the voters for their approval; and

1 WHEREAS, on August 17, 1999, the City Council of the City of Vernon approved
2
the submission of Ordinance No. 1076 or Measure A to its voters for approval and adoption; and

WHEREAS, Ordinance No. 1076 would amend the special parcel tax by increasing
4
5 the maximum tax rate imposed on warehouses, truck terminals, freight terminals, railroad facilities
6 and other distribution facilities from the tax rate established in Ordinance No. 1057; and
7 WHEREAS, the City called for a Special Municipal Election to be held on
8
November 16, 1999 for the voters to consider the approval and adoption of Ordinance No. 1076;
9
and
10
11 WHEREAS, on November 16, 1999 a Special Municipal Election was held; and
12 WHEREAS, Ordinance No. 1076 received the required approval of at least two-
13 thirds of the voters of the City voting thereon and became effective; and
14
WHEREAS, Section 5.45(c) of the Code of the City of Vernon, as amended by
15
16 Ordinance No. 1076, established a new maximum tax rate for the special parcel tax of $20.00 per
17 100 square feet of gross area of land; and
18 WHEREAS, Section 5.45(e) of the Code of the City of Vernon, as amended by
19
Ordinance No. 1076, provides that the City Council, is authorized to determine, by ordinance or
20
resolution, the special tax to be imposed on warehouses, truck terminals, freight terminals, railroad
21
-22 facilities and other distribution facilities for each fiscal year; and
23 WHEREAS, the City Council has determined that the tax for fiscal year 2000-2001
24 should be imposed at the maximum rate of $20.00 per 100 square feet of gross area of land; and
25
WHEREAS, attached hereto and marked as Exhibit "A" is a list containing all
26
27 parcels subject to the special parcel tax, including the assessor's parcel number and the total amount

of tax to be paid by each parcel, calculated at the rate of $20.00 per 100 square feet of gross area of
land.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby finds and determines
that the recitals contained hereinabove are true and correct.
SECTION 2: The City Council of the City of Vernon hereby determines that the
special tax for fiscal year 2000-2001, for each parcel subject to said tax shall be as shown on the list
attached hereto as Exhibit "A", the same being incorporated herein by this reference as though set
forth at length.
SECTION 3: The City Clerk or his designee, is hereby directed to transmit a copy
of this resolution, together with such other information as may be required for placement of the
special tax on the County property tax bills, to the Department of Auditor -Controller of the County
of Los Angeles addressed as follows, or to any other address specified by the Auditor -Controller's
guidelines:

within the time frame set by the Auditor -Controller and in a manner consistent with the Auditor -
Controller's guidelines.
SECTION 4: The City Clerk is hereby authorized to amend the aforesaid list to add
any parcel subject to the tax omitted therefrom, with said tax calculated at the rate of $20.00 per 10C
square feet of gross area of land, and to delete any parcel erroneously included.

SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of
this resolution, and thereupon and thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 16th day of May, 2000.

Vernon and the Los Angeles County Auditor -Controller.
3. Resolution No. 7536 adopted by the City Council of the City of Vernon on May 16, 2000,
which determined the tax on all parcels subject to the special parcel tax imposed by
Ordinance No. 1076 for fiscal year 2000-2001.
It is our understanding from telephone conversations with Sandra Curtis of your office that (i) last
year's agreement is sufficient and no new agreement needs to be executed; and (ii) no certified

16 RECITALS
17 WHEREAS, the CITY requires the LAC Auditor -Controller to
18 provide the service of placement of a special parcel tax on the
19 Secured Tax Roll and distribution of collections to the CITY.
20 WHEREAS, the CITY desires to engage the LAC Auditor
21 Controller for the services hereinafter described.
22 NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS
23 SET FORTH HEREIN:
24 I• PROPERTY TAX SERVICES.
25 Los Angeles County will place special parcel taxes on the
26 Secured Tax Roll and distribute collections to the CITY at the
27 same time and in the same manner as Los Angeles County property
28 taxes are collected and distributed. The CITY will adhere to the

policies and procedures established by the LAC Auditor -Controller
as outlined in the Direct Assessment Submission Procedure Manual.
Fee for Billing Services. For billing of special
parcel taxes, the LAC Auditor -Controller shall collect the
following charges:
Automated (tape) Input - $0.17 per assessment per parcel
Manual Input - $1.40 per assessment per parcel
An Insurance/Liability Surcharge of three percent
(3%) per assessment per parcel will be collected on direct
assessment accounts that are NOT special districts for contracting
cities.
For correction of special parcel taxes requested by
the CITY after extension of the tax roll, the LAC Auditor -
Controller will collect $13.00 per correction.
The LAC Auditor -Controller will charge an
additional fee for extended services provided to the CITY that are
outlined in the Auditor -Controller Direct Assessment Submission
Procedure Manual.
II. COLLECTION OF AUDITOR -CONTROLLER FEES.
Direct Assessment billing charges are collected once a
year, on the January ten percent (10%) advance distribution. Any
additional charges are deducted on the next available distribution
of monies.
III. ACCOUNTING SERVICES.
The LAC Auditor -Controller has available a report of
special parcel taxes levied for the tax year by parcel and will be
provided to the CITY. Accounting Services. beyond this will be
considered extended services and will be subject to additional

1 charges and fees.
2 IV. MODIFICATION OF COLLECTION FEES AND CHARGES.
3 The LAC Auditor -Controller reserves the right to increase
4 or decrease any charges herein provided, in proportion to any
5 changes in costs incurred by the Auditor -Controller in providing
6 the services described herein, provided that written notice'of any
7 increase or decrease in charges is given to the CITY.
8 V. AUTHORITY FOR LEVY AND COMPLIANCE WITH LAW.
9 Requests for the levy of special parcel taxes shall be
10 accompanied by the authority for such levy, e.g., resolution,
11 ordinance or election. The CITY warrants that the taxes, fees, or
12 assessments imposed by the CITY and collected pursuant to this
13 Agreement comply with all requirements of state law, including but
14 not limited to Articles XIIIC and XIIID of the California
15 Constitution (Proposition 218).
16 The CITY hereby releases and forever discharges Los
17 Angeles County and its officers, agents and employees from any and
18 all claims, demands, liabilities, costs and expenses, damages,
19 causes of action, and judgments, in any manner arising out of the
20 CITY's responsibility under this Agreement or other action taken
21 by the CITY in establishing a special tax, fee, or assessment and
22 implementing collection of special taxes, fees, or assessments as
23 contemplated in this Agreement.
24 The CITY agrees to and shall defend, indemnify and save
25 harmless Los Angeles County and its officers, agents and employees
26 ("indemnified parties") from any and all claims, demands,
27 liabilities, costs and expenses, damages, causes of action and
28 judgment, in any manner arising out of any of the CITY's

responsibility under this Agreement, or other action taken by the
CITY in establishing a special tax, fee, or assessment and
implementing collection of special taxes, fees, or assessments as
contemplated in this Agreement.
If any judgment is entered against any indemnified party
as a result of action taken to implement this Agreement, the CITY
agrees that Los Angeles County may offset the amount of any
judgment paid by Los Angeles County or by any indemnified party
from any monies collected by Los Angeles County on the CITY's
behalf, including property taxes, special taxes, fees, or
assessments. Los Angeles County may, but is not required to,
notify CITY of its intent to implement any offset authorized by
this paragraph.
VI. TERMS OF AGREEMENT.
All existing agreements between Los Angeles County -
Controller and CITY pertaining to the collectiop of special parcel
taxes shall be terminated upon the execution of this Agreement.
This Agreement shall continue from year to year and shall be
subject to cancellation by either party by giving a thirty (30)
day written notice to the other party of cancellation.

4 VERNON DETERMINING THE TAX ON ALL PARCELS
SUBJECT TO THE SPECIAL PARCEL TAX IMPOSED BY
5 ORDINANCE NO. 1076 FOR FISCAL YEAR 2000-2001

7 WHEREAS, Articles XIIIA and XIIIC of the California Constitution require special
8 taxes to be submitted to the voters for approval; and
9
WHEREAS, Ordinance No. 1057, which imposed a special tax, was approved on
to
April 14, 1998 by the City of Vernon voters; and
11
12 WHEREAS, Ordinance No. 1057 added Section 5.45 to the City of Vernon
13 Municipal Code; and
14 WHEREAS, Section 5.45 established a special parcel tax on warehouses, truck

terminals, freight terminals and other distribution facilities; and
16
WHEREAS, the maximum tax rate that was established in Ordinance No. 1057 was
17
18 $1.00 per. 100 square foot of gross area of land; and
19 WHEREAS, the revenues raised from this special tax were and are to be used for
20 construction, improvement and maintenance of streets, bridges, and other public right-of-way,
21
including acquisition of land; and
22
WHEREAS, the City Council of the City of Vernon determined after studying the
23
24 possible need to increase the maximum tax rate, that such an increase was appropriate in order to
25 equitably distribute the cost of maintaining the City's infrastructure to those placing the greatest
26
demand on the infrastructure and that a measure implementing the increase should be submitted to
27
the voters for their approval; and

WHEREAS, on August 17, 1999, the City Council of the City of Vernon approved
the submission of Ordinance No. 1076 or Measure A to its voters for approval and adoption; and
WHEREAS, Ordinance No. 1076 would amend the special parcel tax by increasing
the maximum tax rate imposed on warehouses, truck terminals, freight terminals, railroad facilities
and other distribution facilities from the tax rate established in Ordinance No. 1057; and
WHEREAS, the City called for a Special Municipal Election to be held on
November 16, 1999 for the voters to consider the approval and adoption of Ordinance No. 1076;
and
WHEREAS, on November 16, 1999 a Special Municipal Election was held; and
WHEREAS, Ordinance No. 1076 received the required approval of at least two-
thirds of the voters of the City voting thereon and became effective; and
WHEREAS, Section 5.45(c) of the Code of the City of Vernon, as amended by
Ordinance No. 1076, established a new maximum tax rate for the special parcel tax of $20.00 per
100 square feet of gross area of land; and
WHEREAS, Section 5.45(e) of the Code of the City of Vernon, as amended by
Ordinance No. 1076, provides that the City Council, is authorized to determine, by ordinance or
resolution, the special tax to be imposed on warehouses, truck terminals, freight terminals, railroad
facilities and other distribution facilities for each fiscal year; and
WHEREAS, the City Council has determined that the tax for fiscal year 2000-2001
Ishould be imposed at the maximum rate of $20.00 per 100 square feet of gross area of land; and
WHEREAS, attached hereto and marked as Exhibit "A" is a list containing all
Iparcels subject to the special parcel tax, including the assessor's parcel number and the total amount

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
-_ITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby finds and determines
that the recitals contained hereinabove are true and correct.
SECTION 2: The City Council of the City of Vernon hereby determines that the
special tax for fiscal year 2000-2001, for each parcel subject to said tax shall be as shown on the list
attached hereto as Exhibit "A", the same being incorporated herein by this reference as though set
forth at length.
SECTION 3: The City Clerk or his designee, is hereby directed to transmit a copy
of this resolution, together with such other information as may be required for placement of the
special tax on the County property tax bills, to the Department of Auditor -Controller of the County
of Los Angeles addressed as follows, or to any other address specified by the Auditor -Controller's
guidelines:

square feet of gross area of land, and to delete any parcel erroneously included.

SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of
his resolution, and thereupon and thereafter the same shall be in full force and effect.

On November 16, 1999, the City's voters approved Ordinance No.
1076 which established the maximum tax rate of $20.00 per 100
square feet of gross area of land for certain parcels of real
property in the City. The revenue raised from this special tax
are to be used for construction, improvements and maintenance of
streets, bridges and other public right-of-way, including
acquisition of land.
The Staff Report submitted to the City in support of Ordinance
No. 1076, demonstrates that a significant disparity exists
between those parcels which are subject to the tax and those,
such as manufacturers and cold storage warehouses that have been
exempted from the tax. Warehouses presently account for only
approximately 4.2% of the General Fund Revenues.
Nevertheless, as discussed in the Staff Report, the warehouses
produce significant truck traffic that is resulting in the
deterioration of the City's streets, and the need for further
infrastructure improvements. Setting the special parcel tax at
the maximum rate of $20.00 per 100 square feet of gross area of

land will offset the cost of maintaining the infrastructure. It
is, therefore, recommended that the maximum tax rate under
Ordinance No. 1076 be imposed on the subject parcels. Towards
that end, Resolution No. 7536 has been prepared and is on the
agenda for the City Council meeting of May 16, 2000, for your
consideration.
