Resolution No. 75391 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 1 RESOLUTION NO. 7539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE BID OF WONDRIES FORD ON BID NO. 1396 FOR THE PURCHASE OF ONE FORD F450 UTILITY TRUCK FOR THE COMMUNITY SERVICES AND WATER DEPARTMENT AND APPROVING AND AUTHORIZING THE EXECUTION OF A VEHICLE PURCHASE CONTRACT AND THE ISSUANCE OF A PURCHASE ORDER RESPECTING SAID BID WHEREAS, the Community Services and Water Department is in need of a new utility truck; and WHEREAS, pursuant to Resolution No. 7510 adopted by the City Council of the City of Vernon on March 21, 2000, the City Clerk was directed to give notice inviting sealed proposals or bids for the purchase of a utility truck in accordance with a Bid Proposal (Bid No. 1396); and WHEREAS, the Bid Proposal (Bid No. 1396) of the City of Vernon) was approved by the City Council of the City of Vernon pursuant to Resolution No. 7510, and sealed bids were opened on April 24, 2000; and WHEREAS, the following bids were received on Bid No. 1396: Wondries Ford bid a total of Seventy -Six Thousand Four Hundred Forty - Two Dollars and Twenty -One Cents ($76,442.21), including tax; Midway Ford bid a total of Seventy -Eight Thousand Seven Hundred Seventy -Three Dollars and Fifty -Three Cents ($78,773.53), including tax; Golden State Truck bid a total of Eighty Thousand Seven Hundred Thirty -Five Dollars and Two Cents ($80,735.02), including tax; and WHEREAS, said bid was reviewed and approved by the Community (Services and Water Department; and 1 WHEREAS, Bruce V. Malkenhorst, Director of Finance, by letter 2 dated May 2, 2000, recommended that Bid No. 1396 be awarded to Wondries 3 Ford, the lowest responsible bidder meeting the requirements of Bid No. 4 1396. 5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 6 OF VERNON AS FOLLOWS: 7 SECTION 1: The City Council of the City of Vernon hereby 8 9 finds and determines that the recitals contained hereinabove are true 10 and correct. 11 SECTION 2: The City Council of the City of Vernon hereby 12 awards Bid No. 1396 to Wondries Ford and accepts and approves the 13 Vehicle Purchase Contract, a copy of which is attached hereto as 14 Exhibit "A" and made a part hereof. 15 16 SECTION 3: The City Council of the City of Vernon hereby 17 authorizes the Mayor and the City Clerk to execute the Vehicle Purchase 18 Contract on behalf of the City and authorizes the issuance of a 19 purchase order for the purchase of a Ford F450 Utility Truck pursuant 20 to Bid No. 1396. 21 SECTION 4: The City Council of the City of Vernon hereby 22 23 directs the City Clerk, or his designee, to send a copy of this 24 resolution and one fully executed Contract to: 25 Wondries Ford 26 Attn: Mike Ladner 400 South Atlantic Boulevard 27 Alhambra, CA 91801 28 2 - 1 2 3 4' 5I 6i 7 81I 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5: All other bids in connection with Bid No. 1396 are rejected, subject to execution of the aforesaid contract documents from IWondries Ford, accompanied by all required certificates. Atlantic Boulevard 13 Alhambra, CA 91801 14 15 WHEREAS, the City is in need of a Ford F450 Utility Truck for 16 its Community Services and Water Department; and 17 WHEREAS, on March 30, 2000, the City issued Bid No. 1396 18 which sets forth specifications for the Ford F450 Utility Truck 19 required by the City; and 20 WHEREAS, on April 24, 2000, Wondries Ford responded to Bid 21 No. 1396; and 22 WHEREAS, the City has accepted the bid of Wondries Ford and 23 desires to purchase the Ford F450 Utility Truck from Wondries Ford. 24 NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS SET 25 FORTH HEREIN: 26 1. Purchase. Payment Terms. The City agrees to pay Wondries Ford 10 a total of Seventy -Six Thousand Four Hundred Forty -Two Dollars and 11 Twenty -One Cents ($76,442.21), for the purchase of the Ford F450 12 Utility Truck within thirty (30) days net of receipt of the truck. 13 4. Warranties. Wondries Ford shall provide, at a 14 minimum, a one (1) year labor and material warranty to begin upon 15 acceptance of the Ford F450 Utility Truck by the City. All 16 manufacturers' warranties, and any other warranties made applicable by 17 law, shall apply to the City's purchase of the above -referenced truck. 18 5. General Provisions. 19 A. Governing Law. The laws of the State of 20 California shall govern the rights, obligations, duties and liability 21 of the parties to this Contract and shall also govern the 22 interpretation of this Contract. 23 B.
