A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
KAL KAN FOODS, INC. FROM SECTION
26.4.2-8(B) AND 26.4.E-4(B) OF THE
COMPREHENSIVE ZONING ORDINANCE FOR THE
PROPERTY LOCATED AT 3250-3376 44TH
STREET IN THE CITY OF VERNON
WHEREAS, Kal Kan Foods,, Inc. (hereinafter referred to
as "Kal Kan") currently owns and occupies the property located
at 3250-3376 44th Street in the City of Vernon and is requesting
a variance from Section 26.4.2-8(b) and 26.4.E-4(b), of the
Comprehensive Zoning Ordinance ("Zoning Ordinance"); and
WHEREAS, the property is located in the M-Zone; and
WHEREAS, Kal Kan currently uses the property for
manufacturing and distribution and intends to continue these
uses, which is consistent with the objectives of the General
Plan and Zoning Ordinance; and
WHEARAS, Kal Kan's National Office Building located at
3250-80 44th Street has non -conforming truck loading spaces; and
WHEREAS, Kal Kan is proposing to re -model their
National Office in two years; and
WHEREAS, Kal Kan's property is land locked on all
sides making expansion of its production capacity impossible
without using land presently dedicated to parking; and
WHEREAS, Kal Kan proposes to use separate parcels for
required parking, of which the primary one will be within 1000
feet of Kal Kan's property; and

WHEREAS, Kal Kan has been unable to acquire additional
land for parking but has been able to lease separate parcels for
parking; and
WHEREAS, the separate parcel is owned by the LADWP and
is a high tension power line right-of-way which bisects the Kal
Kan property; and
WHEREAS, the LADWP's right-of-way is unusable for most
industrial applications, but parking is permitted; and
WHEREAS, the LADWP will not record a covenant
restricting the land for parking use; and
WHEREAS, Kal Kan will enter into a long term lease for
the property and agrees to use the land for parking; and
WHEREAS, Kal Kan also agrees to obtain parking and
comply with the parking requirement in the event it should lose
its lease;
WHEREAS, Kal Kan's second request is for a two year
period in which to bring its loading docks into compliance; and
WHEREAS, Kal Kan proposes to develop and implement a
plan for its property which will expand its facility and bring
it into conformity; and
WHEREAS, Kal Kan is proposing to bring their entire
facility into compliance with the parking, loading and
maneuvering requirements of the current Comprehensive Zoning
Ordinance; and
WHEREAS, Section 26.4.2-8 of the Comprehensive Zoning
Ordinance permits the use of a separate parcel for required
parking if the parcel is within 1000 feet of the main building
or use, a covenant restricting parking be recorded or evidence

1 of the parking restriction be provided to the City so long as
2 the use exists; and
3 WHEREAS, Section 26.4.6-4 (c) of the Zoning Ordinance
4 provides, in part, that a non -conforming building must comply
5 with these standards at the time of any changes in use,
6 occupancy, expansion, structural alteration of the building or
7 within five years of April 18, 1989 whichever occurs first
8 unless a variance is granted; and
9 WHEREAS, strict compliance with the City's parking and
10 loading requirements would force Kal Kan to remodel portions of
11 its operation in order to provide additional required parking
12 and loading and would not allow the continued operation of the
13 pilot plant at 3250-3376 E. 44th Street without loading docks
14 thus creating an unreasonable hardship; and
15 WHEARAS, Section 26.5.1-6 permits the City Council to
16 grant variances from the Comprehensive Zoning Ordinance.
17 WHEREAS, pursuant to Section 26.4.E-4(d), the City
18 Council may relieve an occupant of all or part of the provisions
19 of the off-street parking, access and loading requirements of
20 this ordinance; and
21 WHEREAS, Section 26.4.6 provides that it is the
22 "intent of this Chapter... to permit... nonconformities to continue
23 for a reasonable length of time..." Given Kal Kan's intent to
24 develop a plan to conform its property in a comprehensive
25 manner, the unique nature of the property and surrounding
26 circumstance, granting this variance is appropriate; and
27 WHEREAS, a variance relieving Kal Kan from the
28 covenant recordation requirement will not adversely affect the

interest of the public or the interests of other residents and
property owners within the vicinity of the premises because this
requirement is a mechanism of ensuring the parking restrictions
and does not affect the actual parking requirements; and
WHEREAS, Kal Kan has agreed to obtain parking on a
separate parcel and obtain other parking if it should lose its
lease, and
WHEREAS, granting Kal Kan two years to conform to its
property will not adversely affect the interest of the public or
the interests of other residents and property owners within the
vicinity of the premises because Kal Kan will continue to
maintain its required parking consistent with the Comprehensive
Zoning Ordinance and loading on -site and will encourage the
development of conforming property; and
WHEREAS, with the approval of this variance, Kal Kan
will bring its nonconforming truck loading spaces into
compliance and its facility will meet the minimum number of
parking spaces required by the City of Vernon Comprehensive
Zoning Ordinance; and
WHEREAS, the operation is in conformance with the
Comprehensive Zoning Ordinance and the General Plan; and
WHEREAS, the existing use does not and will not
adversely affect the surrounding area because the site has
historically been used for manufacturing; and
WHEREAS, with approval of the variance the property
will have the minimum number of automobile parking, truck
parking, and truck loading spaces as required by Section 26.4.2
of the Zoning Ordinance; and

WHEREAS, the City Council has received a Staff Report
dated May 31, 2000, upon which it has relied in making the
foregoing recitals; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a variance on June 6, 2000; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein -
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8(b) and
26.4.E-4(b) of the Comprehensive Zoning Ordinance, requiring
covenant recordation and full compliance with the Comprehensive
Zoning Ordinance at the time of any expansion of use,
respectively, is hereby granted for the property located at
3250-3376 44th Street.
SECTION 3: The variance granted is subject to the
following conditions:
a. If Kal Kan loses or fails to obtain its•leases with
the LADWP or any of the private third parties for the adjacent
parcels of land, then Kal Kan agrees to comply with the City of
Vernon Comprehensive Zoning Ordinance which may, if necessary
require the demolition of the proposed building to provide the
required parking.
b. Within two years from the date this variance is
granted, Kal Kan shall bring all of its non -conforming loading
docks at 3250-80 44th Street into full compliance with the
current City of Vernon Comprehensive Zoning Ordinance.

1 C. The LADWP parcel that Kal Kan is leasing shall be
2 paved and striped in an acceptable manner to the Director of
3 Community Services and shall provide an adequate number of
4 parking stalls so that the new building at 3250-3376 44th Street
5 is in full conformance with Vernon's parking standards.
6 d. All required frontage improvements shall be
7 constructed including all the necessary deeds prepared for the
8 public right-of-ways on Alcoa Avenue, Vernon Avenue, Packers
9 Avenue, and Downey Road in a manner acceptable by the Director
10 of Community Services.
11 e. The parking lot shall be maintained in a manner that
12 will avoid the creation of nuisances as defined by the Vernon
13 City Code and the Director of Community Services.
14 f. Kal Kan shall provide to the City of Vernon utility
15 easements for all existing and proposed overhead and underground
16 power lines in a form and manner subject to approval by the
17 Director of Community Services.
18 g. Noncompliance with the conditions shall constitute
19 sufficient grounds for the City Council of the City of Vernon to
20 void this variance and require Kal Kan to comply with the
21 parking and loading requirements of the Comprehensive Zoning
22 Ordinance.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

VARIANCE APPLICATION
(May 31, 2000)
RECOMMENDATION
The Department of Community Services recommends approval of
a variance from Section 26.4.2-8(b) of the Comprehensive Zoning
Ordinance, Development Standards for the Kal Kan Foods, Inc.
("Kal Kan") property located at 3250-3376 44th Street in the City
of Vernon. In addition, it is also recommended that Kal Kan be
allowed to bring its nonconforming truck loading spaces at 3250-
80 44th Street into compliance with the Comprehensive Zoning
Ordinance over a two year period.
REASON FOR VARIANCE
Kal Kan is proposing to construct a new manufacturing
building on its property as well as make other structural and
operational modifications throughout the facility. The addition
is an extension of Kal Kan's manufacturing operation and will be
constructed in an area currently used for landscaping, a fire
access roadway, and a battery station. The requested variance
would allow Kal Kan to locate required parking and loading spaces
on a separate parcel without tying the properties with a covenant
as set forth by Section 26.4.2-8(b) of the Comprehensive Zoning
Ordinance.
In addition, the applicant is requesting a variance to
permit it to bring its loading docks into conformity over a two
=a
year period. Kal Kan intends to bring its loading docks into
conformity with the Comprehensive Zoning Ordinance, but requests
a variance in order to allow it to develop and implement a plan
to do so in a reasonable and comprehensive manner.
VARIANCE METHODOLOGY
Kal Kan is requesting a variance from the covenant
recordation requirement of Section 26.4.2-8(b) of the
Comprehensive Zoning Ordinance. Section 26.4.2-8(b) specifies
the restrictions for required parking located on the same or
separate lots from the project site. Section 26.4.2-8(b) states
that all required parking shall be provided on the same parcel or
lot as the use or occupancy or on a separate lot or parcel if a
covenant is recorded restricting the use of the separate property
for parking. Kal Kan is proposing to use a separate parcel,
owned by the Los Angeles Department of Water and Power ("LADWP")
for the location of required parking. The LADWP will not execute
a covenant restricting the use of its property to parking. Kal
Kan has indicated that if it loses its lease with the LADWP, then
Kal Kan is prepared to acquire additional land for parking as
required, either on or off -site. Therefore, a variance from the
covenant recordation requirement of Section 2.4.2-8(b) should be
granted in accordance with Section 26.5.1-6 of the current City
of Vernon Comprehensive Zoning Ordinance.
In addition, Kal Kan is requesting a two year period in
which to bring its loading docks into complete conformity with

Section 26.4.2-8, Development Standards, of the City of Vernon
Comprehensive Zoning Ordinance. Section 26.4.2-8 specifies the
dimensional requirements for truck loading and parking spaces.
Kal Kan is proposing to expand its main office building,
otherwise known as its National Office, over the next two years.
As part of this expansion, Kal Kan will comply with the
dimensional requirements of the Comprehensive Zoning Ordinance.
Kal Kan is requesting a two year time period to complete its
current project and begin the planning and redesign of it
National Office which will include bringing its truck loading
spaces into conformity. Undertaking the redesign of the non-
conforming truck loading spaces without this variance would cause
Kal Kan significant hardship in terms of money and time. In
addition, Kal Kan would have to make certain operational changes
in its production and distribution system which will affect the
design of its National Office and delay bringing its non-
conforming truck loading spaces into compliance.
BACKGROUND
Kal Kan is proposing to construct a new manufacturing
building at its facility as well as make some other structural
and operational modifications throughout the facility. Section
26.4.E-4(b) of the Comprehensive Zoning Ordinance requires that
any building that is out of compliance with the parking loading
provisions of this chapter shall be brought into compliance at
the time of any expansion or structural alteration. Therefore,

due to the addition of the building at the Kal Kan facility, it
is now required to come into complete compliance with the current
Comprehensive Zoning Ordinance. The facility currently does not
meet the minimum number of required vehicle parking and loading
requirements. To meet the facility's parking needs Kal Kan will
lease a 100 foot wide easement from the LADWP that runs through
the length of the property and some privately owned property.
(See Table 1).
Now that Kal Kan is required to fully comply with the
parking and loading requirements of the Comprehensive Zoning
Ordinance, it requests permission to use certain leased portions
of land as its required parking area and in calculating its
loading totals without tying the leased properties to the subject
property with a covenant as required by Section 26.4.2-8(b). Kal
Kan has indicated that the separate parcels are under long term
leases and stable arrangements. In addition, Kal Kan has agreed
to acquire the required number of vehicular parking and loading
requirements pursuant to the current Comprehensive Zoning
Ordinance if any of the said leases are terminated. The length
of said leases are set forth in Table 1.

In 1993 a similar variance was issued to Fruitland
Associates to utilize a portion of a LADWP Easement for required
parking and loading. The variance was granted on April 27, 1993
by the City Council of the City of Vernon with the conditions
that: 1) if the lease was lost then the proposed building would
be demolished to provide required parking loading and
maneuvering, and 2) the leased area shall be paved and striped in
compliance with the Vernon City Code.
REQUIRED FRONTAGE IMPROVEMENTS
A condition of the present variance will be that Kal Kan
shall comply with the required frontage improvements determined
by the Department of Community Services. The frontage
improvements include but are not limited to the following items:
1. Kal Kan shall reconstruct the street, curb, gutter, and
sidewalk in accordance with the Master Plan of Streets, dated
June 16, 1992 along Vernon Avenue and Alcoa Avenue.

2. Kal Kan shall deed a five foot stripe along Alcoa Avenue
north of 44th Street adjoining the Kal Kan property in accordance
with the Master Plan of Streets dated June 16, 1992.
3. Kal Kan shall build a new driveway at the property line
along Alcoa Avenue facing 44th Street.
PARKING ANALYSIS
Due to the addition of building square footage, Kal Kan is
required to come into full compliance with the current
Comprehensive Zoning Ordinance as stated in Section 26.4.2-8. Kal
Kan currently operates 24 hours per day and generates a maximum
of 79 truck, 14 delivery van, 475 associate automobile and 30
visitor automobile trips to the entire facility per day, as seen
in Table 2a. Upon completion of the building addition, the
facility will generate a total of 94 truck, 14 delivery van, 570
associate automobile and 30 visitor automobile trips to the
entire facility per day, as seen in Table 2b. Therefore, the
proposed building addition will create a total of 15 new truck
and 95 new automobile trips to the entire facility per day, as
seen in Table 2c. The following table shows the traffic loading
for a 24-hour period.

Approximately 90% of the trucks delivering to the factory come in
on the 710 Freeway or the 5 Freeway to either Bandini Boulevard
or Washington Boulevard to Downey Road. Approximately 10% of the
trucks are local and use 44th Street to Boyle Avenue. The trucks
then travel up to Vernon Avenue to Downey Road and then to the
factory.
CEQA REVIEW
The proposed site is surrounded by industrial uses
compatible with the proposed use. There are some residential
units north of the project site. An initial study has been
conducted for the project in compliance with the California
Environmental Quality Act (CEQA) dated (May 17, 2000) to identify
potentially significant impacts on the environment from the
project. The study -did not identify any adverse affects due to
the construction and operation of the project. No adverse
affects from traffic, parking, noise, odors, dust, smoke, light
or glare, or risk of fire, infection or explosion is anticipated
from the proposed operation. The City of Vernon has provided
notice of its intent to adopt a negative declaration for the
proposed project and has provided a public review period of not
less than 20 days, as required by the California Environmental
Quality Act and the State CEQA Guidelines. The Director of
Community Services will recommend that a Negative Declaration be
adopted. A notice of determination will be filed with the County
Clerk.
STAFF FINDINGS AND CONDITIONS
Staff proposes the following findings as required by Section
26.5.1-6, of the City of Vernon Comprehensive Zoning Ordinance:
a) Kal Kan's property is land locked on all sides making
expansion of its production capacity impossible without using
land presently dedicated to parking. Kal Kan has been unable to
acquire additional land for parking but has been able to lease
separate parcels for parking. Strict compliance with the City's
parking and loading requirements would force Kal Kan to remodel
portions of its operation in order to provide additional required
parking and loading and would not allow the continued operation
of the pilot plant at 3250-3376 E. 44th Street without loading
docks. Alternatively, Section 26.4.2-8 of the Comprehensive
Zoning Ordinance permits the use of a separate parcel for
sea
required parking if the parcel is within 1000 feet of the main
building or use, a covenant restricting parking be recorded or
evidence of the parking restriction be provided to the City so
long as the use exists.
1. Kal Kan proposes to use separate parcels for required
parking. The primary separate parcel Kal Kan will use is within
1000 feet of Kal Kan's property. The separate parcel is owned by
the LADWP and is a high tension power line right-of-way which
bisects the Kal Kan property. The LADWP's right-of-way is
unusable for most industrial applications, but parking is
permitted. LADWP will not record a covenant restricting the land
for parking use. Kal Kan will enter into a long term lease for
the property and agrees to use the land for parking. Kal Kan
also agrees to obtain parking and comply with the parking
requirement in the event it should lose its lease.
Granting Kal Kan a variance from the covenant recordation
requirement of Section 26.4.2-8(b) is appropriate given the
unique circumstances and the hardship of following strict
compliance with the parking.
2. Kal Kan's second request is for a two year period in
which to bring its loading docks into compliance. Kal Kan
proposes to develop and implement a plan for its property which
will expand its facility and bring it into conformity. Section
26.4.6 provides that it is the "intent of this Chapter... to
permit... nonconformities to continue for a reasonable length of

time..." Given Kal Kan's intent to develop a plan to conform its
property in a comprehensive manner, the unique nature of the
property and surrounding circumstance, granting this variance is
appropriate.
b) A variance relieving Kal Kan from the covenant
recordation requirement will not adversely affect the interest of
the public or the interests of other residents and property
owners within the vicinity of the premises because this
requirement is a mechanism of ensuring the parking restrictions
and does not affect the actual parking requirements. Kal Kan has
agreed to obtain parking on a separate parcel and obtain other
parking if it should lose it's lease. Granting Kal Kan two years
to conform to its property will not adversely affect the interest
of the public or the interests of other residents and property
owners within the vicinity of the premises because Kal Kan will
continue to maintain all its required parking and loading on -site
and will encourage the development of conforming property.
c) With the approval of this variance, Kal Kan will bring
its nonconforming truck loading spaces into compliance and its
facility will meet the minimum number of parking spaces required
by the City of Vernon Comprehensive Zoning Ordinance. The
operation is in conformance with the Comprehensive Zoning
Ordinance and the General Plan. Therefore, it is recommended
that the variance be granted with the following conditions:
a. If Kal Kan loses or fails to obtain its leases with the

LADWP or any of the private third parties for the adjacent
parcels of land, then Kal Kan agrees to comply with the City of
Vernon Comprehensive Zoning Ordinance which may, if necessary
require the demolition of the proposed building to provide the
required parking.
b. Within two years from the date this variance is
granted, Kal Kan shall bring all of its non -conforming loading
docks at 3250-80 44th Street into full compliance with the
current City of Vernon Comprehensive Zoning Ordinance.
C. The LADWP parcel that Kal Kan is leasing shall be paved
and striped in an acceptable manner to the Director of Community
Services and shall provide an adequate number of parking stalls
so that the new building at 3250-3376 44th Street is in full
conformance with Vernon's parking standards.
d. All required frontage improvements shall be constructed
including all the necessary deeds prepared for the public right-
of-ways on Alcoa Avenue, Vernon Avenue., Packers Avenue, and
Downey Road in a manner acceptable by the Director of Community
Services.
e. The parking lot shall be maintained in a manner that
will avoid the creation of nuisances as defined by the Vernon
City Code and the Director of Community Services.
f. Kal Kan shall provide to the City of Vernon utility

easements for all existing and proposed overhead and underground
power lines in a form and manner subject to approval by the
Director of Community Services
g. Noncompliance with the conditions shall constitute
sufficient grounds for the City Council of the City of Vernon to
void this variance and require Kal Kan to comply with the parking
loading requirements of the Comprehensive Zoning Ordinance.

That special conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not generally applicable to other lands,
structures, or buildings in the same vicinity and zone:
The site is bisected by the Los Angeles Department of Water and Power high tension power
line right of way. The DWP's restrictions on use of this land render it unusable for most
industrial applications, however use as a parking lot is permitted. Its proximity to our
existing parking lots makes it an ideal site for such use. Kal Kan has leased this property for
this purpose for the past 8-10 years and is in the process of renewing these leases for an
extended term (5-10 years).
2. That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other propertied in the same vicinity and
zone in which the property is located, under the terms of this Chapter.
Kal Kan needs to expand the size and scope of its manufacturing operation in Vernon. The
fact that our site is land locked on all sides makes further expansion of our production
capacity impossible without using land which presently dedicated to parking. The only other
option is to build a muli-level parking structure. The cost of such a structure, when added to
the cost of the expansion itself makes the total expansion economically infeasible when
compared to other sites. We have made consistent efforts to acquire land for additional
parking, and have been unable to acquire sufficient additional land to replace the lost parking
spaces resulting from the expansion
3. That the special conditions and circumstances do not result from actions of the
applicant:
As stated above, Kal Kan has made every reasonable effort to acquire land to provide
additional parking. These efforts will continue in anticipation of future expansion needs
which could further infringe on land currently used for parking or truck maneuvering.
4. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Chapter to other lands, structures, or buildings in the
same vicinity and zone in which the property is located.
At least one other business in the area is using DWP land as a parking lot. Presumably, the
City would be willing to grant the same variance to another business under similar
circumstances.
5. That the granting of such variance will be in harmony and not adversely affect the
Comprehensive General Plan.
The granting of this variance will facilitate off street parking for Kal Kan's associates and
visitors, as well as the continued off street maneuvering and parking of trucks and trailers on
our site for the foreseeable future. Kal Kan will guarantee that if, for whatever reason, the
leases in question are ever vacated, Kal Kan will take immediate steps to comply with the
City's requirements, either by acquisition of additional land or construction of multi -story
parking structure(s).

Non -conforming use of the neighboring lands, structures or buildings shall not be
considered grounds for the issuance of a variance.

Kal Kan requests that parking spaces and truck parking/maneuvering on land which is
leased on a long term basis from third parties (with the exception of land leased from the
City of Vernon) and is either adjacent to, or within 1000 feet of the site's property line be
counted for purposes of determining compliance with the Article IV, Section 26.4.2 of
the City's Comprehensive Zoning Ordinance, for as long as the leases remain in effect.
In addition Kal Kan is requesting that a two year grace period be extended by the City to
enable Kal Kan to bring the truck dock operation at 3250 E. 44a' St into compliance with
that same Ordinance.
Notice to Applicant: In the variance procedure it shall be shown that the following five

Traffic Report
Kal Kan currently generates a maximum of 93 truck (including delivery vans), 475 associate
automobile and 30 visitor automobile trips to the entire facility per day. Upon completion of the
building addition, the facility will generate a total of 108 truck, 570 associate automobile and 30
visitor automobile trips to the entire facility per day. Therefore, the proposed building addition will
create a total of 15 new truck and 95 new automobile trips to the entire facility per day.
Hazardous Materials Report
The proposed building addition will provide floor space to be used for additional pet food
manufacturing capability. The equipment required to produce this additional product will be
similar to existing equipment currently installed at the site. Therefore, there will be no new
hazardous materials stored on -site due to the proposed manufacturing facility.
South Coast Air Quality Management District Report
Find attached the revised Facility Permit to Operate dated April 24, 2000.
National Office Truck Loading
Literal interpretation of the City's Ordinance regarding off street maneuvering of trucks would
force Kal Kan to shut down its pilot plant operations at 3250 E. 44th St. with immediate effect.
The variance requests two years for Kal Kan to achieve compliance.

Washington to Downey. Approximately 10% are local and use 44t' St. to Boyle. They then go up

The proposed building addition will provide floor space to be used for additional pet food
manufacturing capability. The equipment required to produce this additional product will be
similar to existing equipment currently installed at the site. Therefore, there will be no new
hazardous materials stored on -site due to the proposed manufacturing facility.

Literal interpretation of the City's Ordinance regarding off street maneuvering of trucks would

1. How many parking spaces are thereon each leased properly?
1.1. Lot 73, Southwest corner of Alcoa and old 45th St. — 3 Truck parking spaces.
1.2. Lots 109 & 110, Paved area immediately east of Vernon Plant stockroom and north of
old 45th St —13 Car spaces.
1.3. Lots 111 & 117, Paved area southeast corner of Downey Rd and 45th St — 17 Truck
spaces.
1.4. All DWP Lots —168 Car spaces.
2. How long is each lease?

lease. Historically this has been a 5-year lease.

part of their compliance with the Comprehensive Zoning Ordinance
without tying the properties with a covenant as required by Section

requesting that a two year grace period be extended by the City of
Vernon to enable Kal Kan to bring the non -conforming truck loading

Please take notice that a recommendation from the Director of
Community Services will be made to the City Council of the City of
Vernon during the regular meeting on June 6, 2000 to adopt a
Negative Declaration in. accordance with the California
Environmental Quality Act.
A copy of the- supporting evidence is available for public

Monday through Thursday.
You must submit written comments on these documents which will

spaces in a leased portion of the Los Angeles Department of Water and Power right-of-way and property
leased from a third party as part of their compliance with the Comprehensive Zoning Ordinance without
tying the properties with a covenant as required by Section 26.4.2-8(b) of said ordinance. In addition, the
applicant is requesting that a two year grace period be extended by the City of Vernon to enable Kai Kan to
bring the non -conforming truck loading spaces at 3250 44t' Street into compliance with the Comprehensive
Zoning Ordinance.

period. The increase of 95 employees is not substantial and will not have any impacts on population projections or
induce substantial growth in the area directly or indirectly.

expand an existing facility. All construction shall be required to be in compliance with all requisite seismic safety

e through h. Aside from minor excavation to construct the foundation, there will be no substantial excavations to
occur with the proposed project. Grading and other site preparation activities on the proposed site will be
relatively limited and will not have the potential to result in unstable soil conditions or change the geological
substructures. All construction activity will proceed in compliance with the City requirements which include
measures to prevent erosion or unstable soil conditions. Therefore, this impact is considered less than significant.
Vernon is a fully urbanized industrial city. No geologic features exist within the project area. The
channelized Los Angeles River runs through the City, but the project will not affect the river.
IV. WATER Would the proposal result in:
a) Changes in absorption rates, drainage patterns,

a. The project is located in a highly urbanized area and is served by the existing drainage system. The entire
site is currently paved and in the event of a storm, rainwater flows to Vernon Avenue, Downey Road, Packers

Avenue, and/or Alcoa Avenue. The project will not substantially alter the existing amount of impervious surfaces,
surface runoff, the absorption rate, or the existing drainage patterns. If required, the proponent shall obtain a
National Pollutant Discharge Elimination System (NPDES) permit, before obtaining a Certificate of Occupancy.
As part of the facilities NPDES Permit they shall follow best management practices as outlined in the
Industrial/Commercial Best Management Practices Handbook, fora truck terminal

b. According to the MEA, the Los Angeles River flows through the City in a concrete channel'. The river
channel, in conjunction with other major improvements in the region, has greatly reduced the probability of a major
flood occurring in the City of Vernon. However, intense thunderstorms of short duration have been known to
occur and result in localized flooding and ponding in areas extensively covered by buildings or paving. The
project has drainage improvements that provide for adequate site drainage, in compliance with existing City
Standards. Therefore, the proposed project will cause no impact.
c) Discharge into surface waters or other alteration of
surface water quality (e.g. temperature, dissolved

c. No surface water bodies are located near the project and the project is not expected to directly discharge
into such water or change the amount of any water bodies located in the vicinity. All modifications of existing

waste/material permits from the Environmental Health Department. The proposed project will also be required to
comply with NPDES permit requirements and any conditions issued by the Regional Water Quality Control Board.
These requirements are designed to prevent groundwater pollution during the operation of such a project. The
entire site is paved, and there will be little percolation occurring. Therefore, no impact is expected to occur from
the proposed project.
V AIR QUALITY: Would the proposal:
a) Violate any air quality standard or contribute to
an existing or projected air quality violation? ❑ ❑ ❑
a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600-
square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San
Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District
(SCAQMD) at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon
the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon.
During Construction
The site is completely paved with existing structures on -site. The proposed facility may cause some dust
associated with normal construction activities. If required the applicant shall have a dust control program in place
in compliance with AQMD standards to avoid any impacts. The community services department shall monitor the
construction activities during routine site inspections. Because the site is currently paved, it is not predicted that
the project will create significant impacts from dust associated with construction. Based on previous studies of air
quality impacts caused by emissions from other construction related equipment of projects of this magnitude, it has
been determined that the project will not generate a significant impact4 s
During Operation
Traffic entering and exiting the site is predicted to be the only contributing factor to air quality during
operation. The number of round trip truck and automobile traffic trips is predicted to increase by 110. In
comparison to the 598 traffic trips that the facility currently generates, the increase is only 18%. Of these
additional,110 traffic trips 34 of them or 30% will be during off peak hours of 10:00 p.m. to 6:00 a.m. Therefore,
the facility will only increase 76 traffic trips to and from the facility per day during peak traffic periods.
b) Expose sensitive receptors to pollutants? ❑ ❑ ❑
b. Vernon is strictly an industrial community with similar uses surrounding the project site. The proposed
project includes expanding an existing manufacturing facility. The facility manufactures pet food. The nearest
sensitive receptors (i.e. residential dwelling units) are less then 300 feet north of the project boundaries. The
project as proposed will not cause an impact to these sensitive receptors.
In addition to the new manufacturing building the applicant has proposed to reorganize their existing Vernon
facility as described in the "Vernon Plan Areas of Work for Year 2000" (Available at the Department of
Community Services for review). The plan described the removal, relocation, and minor construction of
equipment and structures. The project centers around the construction of the new approximately 45,000 square
foot manufacturing building. The construction and operation of said building, as previously indicated will not pose
a significant impact on the environment. Therefore, there are no significant impacts expected.

a. Several freeways serve Vernon. To the north is the Santa Ana (1-5), Santa Monica (I-10) and the
Hollywood (1-101) freeways, to the west is the Harbor Freeway (I-110), and to the cast is the Long Beach Freeway
(I-710). Vernon has several arterials which bisect the City. The site has access to Ross Street and 38s' Street
which are 60 feet in width.
Kal Kan currently operates 24 hours per day and generates a maximum of 79 truck, 14 delivery van, 475
associate automobile and 30 visitor automobile trips to the entire facility per day. Upon completion of the building
addition, the facility will generate a total of 94 truck, 14 delivery van, 570 associate automobile and 30 visitor
automobile trips to the entire facility per day. Therefore, the proposed building addition will create a total of 15
new truck and 95 new automobile trips to the entire facility per day. The following table shows the traffic loading
for the 24 hour period.

Utilities Department. Therefore, the impact will be less than significant.

the local Certified Unified Program Agency (CUPA) which is the City of Vernon Environmental Health
Department. Existing regulations and permitting requirements will be adhered to by the facility and this
compliance will reduce potential hazards to less than significant levels. If required, the City of Vernon shall
require a Hazardous Materials Establishment Permit, to be submitted to and approved by the City of Vernon
Environmental Health and Fire Departments. A Hazardous Materials Establishment Permit shall include, but not
be limited to, instruction and on-the-job training of employees to identify and handle hazardous materials and shall
be conducted by an individual knowledgeable in hazardous materials management. As required by the Hazardous
Materials Establishment Permit a detailed log shall be maintained to account for and monitor all hazardous
materials that are brought into, stored, and leave the site. These requirements are standard requirements of
facilities located within the City of Vernon to regulate the handling and storage of hazardous materials involved in
the everyday function of non -hazardous businesses.
The proposed building addition will provide floor space to be used for additional pet food manufacturing
capability. The equipment required to produce this additional product will be similar to existing equipment
currently installed at the site. Therefore, there will be no new hazardous materials stored on -site due to the
proposed manufacturing facility. Therefore, this impact will be less than significant.
e) Increased fire hazard in areas with flammable
brush, grass, or tees? ❑ ❑ ❑ X
e. The proposed site is located in a completely built -out urbanized area that does not contain flammable grass,

no endangered species in Vernon. The site is an existing facility and there is no potential for finding important
examples of major periods of California history. Therefore, the proposed project will create no impact.

to hazardous materials. During construction the project will produce short term localized impacts associated with
construction activities such as breaking of gravel, back-up safety devices, construction vehicle traffic, very minimal
dust from construction, and limited use of hazardous materials used in normal construction activities. These impacts
are negligible and will not create an impact to sensitive receptors. During operation the facility will operate essentially
the same as before except there will be an additional portion of the facility that will manufacture another commodity.
Therefore, the cumulative impact for the proposed project will be clearly less then significant.

Kal Kan Foods, Inc. located at 3250 44th Street in the City of Vernon has
requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2-8(b),
Development Standards. The variance is to allow the applicant to provide required
automobile parking spaces in a leased portion of the Los Angeles Department of Water
and Power right-of-way and property leased from a third party as part of their compliance
with the Comprehensive Zoning Ordinance without tying the properties with a covenant
as required by Section 26.4.2-8(b) of said ordinance. In addition, the applicant is
requesting that a two year grace period be extended by the City of Vernon to enable Kal
Kan to bring the non -conforming truck loading spaces at 3250 44th Street into compliance
with the Comprehensive Zoning Ordinance.
FINDINGS:
The City Council of the City of Vernon has determined that this project will not

Dear Mr. Wilson:
Packaging Advantage Corp ("PAC") is the neighbor to the south of the proposed lease addition to
Applicant's property. PAC supports and urges approval of Applicant's request subject to the
following conditions which would mitigate any adverse consequences to PAC or the real property
which PAC occupies relative to the leased portion of the DWP easement south of Packers Ave
(See Exhibit A enclosed):
1. Enclose with a chain link fence; minimum 8' - 0" high with 3 strands barbed wire on top.
2. Drainage to slope away from adjacent or PAC property.
3. Construct a minimum 6" high curb at the south, east and west perimeters.
4. Provide adequate security lighting.
5. Limit the southerly boundary south of Packers Avenue to 268' — 0" in a southerly direction
from Packers Avenue as shown in Exhibit A and Maps on file with the City of Vernon.
6. Provide gate and legal entitlement (easement) to allow ingress and egress from Packers
Avenue to PAC's property.

In response to your comment letter dated May 30, 2000 regarding the Kal Kan Foods,
Inc. ("Kal Kan") application for variance, the City of Vernon has prepared the following
response. The condition requesting drainage on the Los Angeles Department of Water and
Power to slope away from your property shall be considered when Kal Kan applies for a
paving permit. As part of said permit a drainage plan is required that provides adequate
drainage to a public storm drain and off neighboring sites.
The other conditions that you requested be placed on the Kal Kan variance were also
considered. However, the City of Vernon does not have any code requirements that would
require Kal Kan to comply with these conditions. In consideration of your concerns the
City has forwarded your letter to Kal Kan.
The City Council date shall remain June 6, 2000, which you are welcome to attend. If
