1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY -OF VERNON GRANTING A CONDITIONAL USE PERMIT TO PACIFIC ARROW EXPRESS FOR THE OPERATION OF A TRUCKING AND FREIGHT TERMINAL AT 2860 ALAMEDA STREET WHEREAS, Pacific Arrow Express has applied for a conditional use permit to operate a trucking and freight terminal at 2860 Alameda Street in the City of Vernon; and WHEREAS, Pacific Arrow Express presently operates a truck and freight terminal at 2043 Ross Street; and WHEREAS, Pacific Arrow Express plans on relocating its facility to 2860 Alameda Street on or about September 15, 2000; and WHEREAS, the owner of the property, Los -Angeles By - Products Company, has consented in writing to Pacific Arrow Express, application for a conditional use permit; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on July 11, 2000; and WHEREAS, the proposed site is a legal non -conforming use in the General Industry (M) Zone which has been continuously used as a truck and freight terminal and which requires a conditional use permit under the Zoning Ordinance in order to continue the use; and -1- 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the site has been determined to be a grandfathered, non -conforming use in Resolution No. 6361 approved on December.7, 1993, and Resolution 6745 approved on February 6, 1996, and in Resolution No. 6772 approved on April 16, 1996; and WHEREAS, the proposed operation will include the hauling and temporary storage of general products; and WHEREAS, the proposed site, which is larger than Pacific Arrow Express' current truck terminal, is approximately 1.80 acres in size, contains two buildings, and is adequate in size, shape and topography for the proposed operation, has adequate drainage, and landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has access to Ross Street, Alameda Street and traffic will generally travel to Alameda Street then north to the I-10 freeway or east to 37th Street then to the I- 710 freeway. Ross Street is of adequate size and pavement -type to handle the traffic generated from the proposed operations; and WHEREAS, the site will generate 40 daily truck trips (20 inbound and 20 outbound) and will have 4 employees accessing the site per day; and -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the site, as proposed, has adequate off- street parking and loading facilities as required by the Vernon City Code; and WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the project is categorically exempt from the California Environmental Quality Act as an existing facility pursuant to Section 15301 of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines. WHEREAS, the City Council has received a Staff Report, dated June 26, 2000 upon which it has relied in making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Pacific Arrow Express for the operation of a trucking and freight terminal at 2860 Alameda Street. -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. Pacific Arrow is not permitted to occupy the proposed facility and the Conditional Use Permit will not be effective until the Certificate of Occupancy has been issued to Pacific Arrow for the property located at 2860 Alameda Street. Any changes in occupancy at 2860 Alameda Street will require a new Conditional Use Permit. b. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations, and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 2860 Alameda Street in the City of Vernon. C. The owner of the property shall provide to the City of Vernon a utility easement for the overhead power lines which are located on the property in a form and manner subject to approval of the Director of Community Services and Water. d. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. No servicing of vehicles including washing, steam cleaning and repairing shall be performed on the facility unless conducted in compliance with appropriate codes. f. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. g. No equipment or freight shall be stored on the site, other than in buildings, trailers or on the docks. h. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. i. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. j. A hazardous materials inventory and business/contingency plan shall be submitted and a hazardous materials permit shall be obtained from the City of Vernon Health Department. Hazardous materials/waste shall be handled and managed in compliance with all appropriate federal, state and local laws. k. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal service. 1. The facility shall be operated in a manner which will not impede traffic on Ross Street or Alameda Street. n. All existing cracked sidewalk, curb and gutter adjacent to the site in Ross Street and Alameda Street shall be repaired and maintained to meet City Standards. o. The site shall not generate more than 50 truck trips (25 unbound and 25 outbound) and 50 automobile trips (25 inbound andl 25 outbound) per day. SECTION 4: Pacific Arrow Express and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 5: Not later than sixty (60) days from the date of this Resolution, Pacific Arrow Express, shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 4 of the Resolution. MALKENHORST City Administrator/City Clerk CITY OF VERNON COMMUNITY SERVICES DEPARTMENT STAFF REPORT ON PACIFIC ARROW EXPRESS CONDITIONAL USE PERMIT TO OPERATE A TRUCK AND FREIGHT TERMINAL AT 2860 ALAMEDA STREET (June 26, 2000) RECOMMENDATION The Department of Community Services recommends that the application for a conditional use permit submitted by Pacific Arrow Express (hereinafter referred to as `Pacific Arrow") to relocate their existing truck and freight terminal from 2043 Ross Street to 2860 Alameda Street be approved by the City Council of the City of Vernon. Pacific Arrow is a trucking company providing pick-up and delivery services of a wide range of items. The facility is currently occupied by Maxam International, Inc. until September 15, 2000. The owner of the property, Los Angeles By -Products Company has consented to Pacific Arrow's Application. The facility's operating hours will be from 3:00 a.m. to 8:00 p.m. Monday to Friday with occasional work on Saturdays as needed. BACKGROUND Both sites have historically been used as truck terminals and have maintained their legal non -conforming status. The proposed site located at 2860 Alameda Street is currently occupied by Maxam International, Inca by Resolution 6772 approved April 16, 1996. Prior to Maxam -1- International, Inc. the site was occupied by Vecta Transportation Systems, Inc. by Resolution 6745 approved February 6, 1996. Prior to Vecta Transportation Systems, the site was occupied by Reeder Fastway Trucking, Inc by Resolution 6361 approved December 7, 1993. The existing site located at 2043 Ross Street is currently occupied by the applicant, Pacific Arrow by Resolution 7173 approved July 7, 1998. Prior to Pacific Arrow the site was occupied by New Willig Freight Lines by Resolution 7013 approved on September 2, 1997. Prior to New Willig Freight Lines, the site was occupied by Southern Countries Transport by Resolution 6665 approved on August 1, 1995. Prior to Southern Countries Transport, the site was occupied by LAWI/CSA Consolidators, Inc. by Resolution 6620 approved May 2, 1995. GENERAL PLAN The proposed use is in accordance with the General Plan. The site is located in the M Zone, General Industry. A truck terminal is a non -conforming use in the M Zone. However, because it is a pre-existing terminal, the non- conforming use may be continued provided that it does not expand as specified in Section 26.4.6-1. The Comprehensive Zoning Ordinance Section 26.5.2-11, Existing Uses, states that such a use may continue with approval of a conditional use permit when the occupant is issued a new occupancy permit. -2- SITE The proposed lot is approximately 1.80 acres and contains one warehouse/office building. The size, shape, topography and drainage of the facility is adequate for the proposed operation. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared. ACCESS There are three driveways adjoining the property on Ross Street that measure 45,40, and 40 feet in width respectively from east to west. There is one driveway adjoining the property on Alameda Street that measures approximately 35 feet in width. The trucks may enter and exit from all four driveways. Ross Street and Alameda Street are 60 and 40 feet wide respectively and are of adequate size to handle the traffic generated from the proposed operation. They are both built out to the Master Plan of Street Widths dated June 16, 1992. The north east corner of the intersection has a thirty-foot radius. -3- Although the radius is sufficient for the proposed use it is considered sub -standard by City Standards and will be improved as part of the Alameda Corridor Project. VEHICLE MOVEMENTS Pacific Arrow will operate 20 trucks out of the facility. Operations will be 3:00 a.m. to 8:00 p.m. Monday to Friday with occasional work on Saturdays as needed. The trucks traveling from the east or north will use the I-10 freeway, exit South on Alameda Street to Ross Street and to the site. Trucks traveling from the south and east will use the I-710 freeway, exit East on Bandini Boulevard and proceed to 37th Street, Ross Street and then to the site. The trucks will follow the same route when exiting the site. The site will generate 40 daily truck trips (20 inbound and 20 outbound). The facility has 4 employees that access the site per day (4 inbound and 4 outbound) 3:00 a.m. to .8:00 p.m., Monday to Friday and occasionally on Saturdays. The previous occupant Mexam International, Inc. operated 12 trucks out of the site per day. The proposed occupant will operate 20 trucks out of the site per day. However, the parcel they are moving from is only .74 acres in area while the proposed site is 1.8 acres in area. The proposed site at 2860 Alameda is a much larger site thus capable of accommodating more trucks. There are no expected impacts from the proposed move. OPERATIONS Pacific Arrow will use the facility as their operational head quarters to operate a truck and freight terminal. All maintenance and washing of vehicles on -site shall be permitted if in compliance with the Federal, State, and Local government rules, policies and procedures. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation.
