Resolution No. 75741 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO, 7574 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND RATIFYING THE LETTER BY THE CITY ADMINISTRATOR TO THE INDEPENDENT SYSTEM OPERATOR GIVING NOTICE OF INTENT BY THE CITY OF VERNON TO JOIN THE INDEPENDENT SYSTEM OPERATOR TO BECOME A PARTICIPATING TRANSMISSION OWNER WHEREAS, the California State Legislature adopted Assembly Bill 1890 (approved by the Governor September 23, 1996, filed with the Secretary of State September 24, 1996), which provided for the restructuring and partial deregulation of the electric industry in the State of California; and WHEREAS, a nonprofit entity known as the Independent System Operator (hereinafter "ISO") was formed to control the scheduling and access to electric transmission facilities on a nondiscriminatory basis in order to implement the development of a competitive generation market; and WHEREAS, the City of Vernon owns and operates a system for the generation, transmission, and purchase of electric capacity and energy and for the distribution, sale, and use of such electricity within its community; and WHEREAS, the City of Vernon is located within the control area of the ISO and is a customer of the ISO; and WHEREAS, on March 24, 1998, the City Council of the City of Vernon adopted Resolution No. 7103 approving a Certificate of Deposit Security Agreement to meet the requirement of the ISO that the City provide security guaranteeing the payment of all fees owing to the ISO by the City under the Scheduling Coordinator Agreement, the ISO Tariffs and the ISO Protocols to enable the City's Light and Power Department 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to schedule Energy and Ancillary Services on the ISO Controlled Grid pursuant to the Scheduling Coordinator Agreement when the ISO commenced operations on or about March 31, 1998; and WHEREAS, on March 2, 1999, the City Council of the City of Vernon adopted Resolution No. 7278 approving and ratifying the execution by the Utilities Department, formerly the Light and Power Department, of an ISO Scheduling Coordinator Application on October 30, 1997, an ISO Scheduling Coordinator Agreement on November 20, 1997, together with amendments on December 3, 1997, an ISO Meter Service Agreement for Scheduling Coordinators dated November 20, 1997 together with amendments dated December 3, 1997, and an ISO System Security Policies and Procedures Agreement dated November 3, 1998; and WHEREAS, the City of Vernon has been an active participant at the Federal Energy Regulatory Commission ("FERC") in various proceedings concerning issues which impact ISO arrangements with the goal of assuring that if Vernon chooses to become a Participating Transmission Owner that it receive appropriate compensation for the transmission facilities and transmission contract rights they contribute to the ISO Grid; and WHEREAS, on March 31, 2000, the ISO filed an Amendment No.-27 Ito the ISO's Operating Agreement and Tariff (the "ISO Tariff"), (Docket No. ER00-2019); and WHEREAS, on May 31, 2000, the FERC issued an Order of Acceptance of the aforementioned filing; and WHEREAS, pursuant to Section 3.1.1 of the ISO Tariff, by July 1, 2000, the City of Vernon needed to provide its notice of intent to join the ISO to become a Participating Transmission Owner on January 1, 2001; and - 2 - 1 WHEREAS, the City of Vernon intends to participate with the 2 ISO staff in negotiations concerning the application process and 3 necessary agreements; and 4 WHEREAS, in order to meet the participation deadline, Section 5 3.1.1 of the ISO Tariff required the notice of intent be submitted by 6 July 1, 2000, and the City Administrator executed said letter subject 7 to ratification by the City Council; and 8 WHEREAS, said letter was submitted to the ISO on June 30, 9 2000; and 10 WHEREAS, the City Council desires to approve and ratify the 11 letter as executed by the City Administrator. 12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 13 CITY OF VERNON AS FOLLOWS: 14 SECTION 1: The City Council of the City of Vernon hereby 15 finds and determines that the recitals contained hereinabove are true 16 and correct. 17 SECTION 2: The City Council of the City of Vernon hereby 18 approves, authorizes and ratifies the submittaltothe ISO of a letter 19 of intent to join the ISO to become a Participating Transmission Owner 20 on January 1, 2001, a copy of which is attached hereto as Exhibit "A" 21 and made a part hereof. 22 23 24 25 26 27 28 / / / 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
