FROM SECTION 26.4.2-8(C), DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 3113 26TH STREET IN THE CITY OF VERNON WHEREAS, World Wide Drapery Fabric, Inc. (hereinafter referred to as "World Wide") currently occupies the property located at 3113 26th Street in the City of Vernon and is requesting a variance from Section 26.4.2-8(c), Developme.nt Standards, of the Comprehensive Zoning Ordinance ("Zoning Ordinance"); and WHEREAS, World Wide is located in the M-Zone; and WHEREAS, the property is currently occupied by World Wide and is used for warehousing and distribution which is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the applicant has indicated that they have not and do not propose to perform any structural alterations to their facility which would consequently require them to come into compliance with the frontage improvement requirements of the current Comprehensive Zoning Ordinance; and WHEREAS, the proposed building on the property measures approximately 60,000 square feet, and was constructed with eight (8) non -conforming truck loading spaces; and WHEREAS, these truck loading spaces all front 26th Street; and -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the property has eight (8) non -conforming truck loading spaces measuring 10.0 feet in width: four loading spaces measure 54.3 feet in length and the remaining four measure 26.0 feet in length; and WHEREAS, the property has one truck loading dock measuring fifty (50) foot long and over 150 feet in length that meet the minimum requirements of five (5) truck loading spaces; and WHEREAS, the building located at 3113 26th Street is approximately 60,000 square feet in area; and WHEREAS, Section 26.4.2-7(b) of the Zoning Ordinance requires four (4) truck loading spaces for buildings with a gross floor area of between 50,001 and 100,000 square feet in size; and WHEREAS, Section 26.4.2-8(c) of the Zoning Ordinance specifies that each truck loading space shall be a minimum of ten (10) feet wide, sixty-five (65) feet long, and fifteen (15) feet in height; and WHEREAS, Section 26.4.6-4 (c) of the Zoning Ordinance provides, in part, that a non -conforming building must comply with these standards at the time of any changes in use, occupancy, expansion, structural alteration of the building or within five years of April 18, 1989 whichever occurs first unless a variance is granted; and WHEREAS, World Wide Drapery Fabric, Inc. have stated that the eight (8) non -conforming truck loading spaces facing 26th Street will be limited to trucks that do not extend into the Master Plan of Street Widths dated June 16, 1992; and -2- 1 WHEREAS, pursuant to Section 26.4.E-4(d), the City 2 Council may relieve an occupant of all or part of the provisions 3 of the off-street parking, access and loading requirements of 4 this ordinance; and 5 WHEREAS, strict application of the loading 6 requirements of Section 26.4 of the Zoning Ordinance would 7 require World Wide Drapery Fabric, Inc. to demolish a 8 significant portion of their building thus creating an 9 unreasonable financial hardship; and 10 WHEREAS, the existing use does not and will not 11 adversely affect the surrounding area because the site has 12 historically been used for warehousing and distribution; and 13 WHEREAS, World Wide Drapery Fabric, Inc. has complied 14 with the loading area requirements specified in this Ordinance 15 for the loading dock measuring approximately 50 feet in width 16 and 150 feet in length and has agreed to use shorter trucks in 17 the non -conforming truck loading fronting 26th Street to ensure 18 that vehicles will not extend into the street right-of-way; and 19 WHEREAS, World Wide Drapery Fabric, Inc.'s use of 20 shorter trucks will not require as much space as required and 21 will reduce the congestion in the area; and 22 WHEREAS, with approval of the variance the property 23 will have the minimum number of truck loading spaces as required 24 by Section 26.4.2-7(b) of the Zoning Ordinance which will 25 conform to the requirements of Section 26.4.2-8(c); and 26 27 28 -3- 1 WHEREAS, the City Council has received a Staff Report 2 dated August 16, 2000, upon which it has relied in making the 3 foregoing recitals; and 4 WHEREAS, the City Council of the City of Vernon held a 5 hearing on said application for a variance on September 5, 2000; 6 and 7 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 8 THE CITY OF VERNON AS FOLLOWS: 9 SECTION 1: The City Council of the City of Vernon 10 hereby finds and determines that the recitals contained herein- 11 above are true and correct. 12 SECTION 2: A variance from Section 26.4.2-8(c) of the 13 Comprehensive Zoning Ordinance, requiring all truck loading 14 spaces to be ten (10) feet wide by sixty-five (65) feet long, is 15 hereby granted for a portion of the property located at 3113 16 26th Street. 17 SECTION 3: The variance granted is subject to the 18 following conditions: 19 20 1. The applicant shall maintain the fifty (50) foot loading 21 dock on the property free, clear and accessible for longer 22 trucks to utilize. 23 24 2. The usage of the non -conforming truck loading spaces 25 shall be limited so that no truck parked at or using the loading 26 docks shall extend into the street right-of-way as shown on the 27 Master Plan of Streets, dated June 16, 1992. 28 -4- 3. The owner of the property shall provide and maintain, for the City of Vernon, utility easements, for the existing power lines on the east end of property, and for electrical substation on the roof of the building, located on the owners property, in a form and manner subject to approval of the Director of Community Services and Water. 4. This variance shall only be valid while World Wide occupies the property. A new variance will be required upon change of ownership or occupancy. 5. All existing and future tenants shall be notified of these restrictions and a condition stating this shall be placed in all future leases. 6. This variance shall automatically expire at the time of any expansion or structural alteration of the building, or on August 19, 2009, whichever occurs first, at which time the use of the parking, access or loading area(s) allowed by this variance shall be discontinued unless brought into compliance with all applicable standards for parking, access and loading areas set forth in the Comprehensive Zoning Ordinance. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. MALKENHORST City Administrator/City Clerk STAFF REPORT WORLD WIDE DRAPERY FABRIC, INC. 3113 2 6Tx STREET VARIANCE APPLICATION (August 16, 2000) RECOMMENDATION The Department of Community Services recommends approval of a variance from Section 26.4.2-8(c) of the Comprehensive Zoning Ordinance, for World Wide Drapery Fabric, Inc. ("World Wide") located at 3113 26th Street in the City of Vernon. This section pertains to off-street parking, access, and loading requirements. PROJECT World Wide is currently occupying the property identified by the address 3113 26th Street located in the M-Zone of the City of Vernon. In order for World Wide to utilize the eight (8) non- conforming truck loading docks at the facility they are required to obtain a variance. Therefore, they have applied for a variance from said section in order to occupy the proposed building. The owner of the property is Vernon Real Estate Holding, LLP. The owner of World Wide has been made aware that any change in occupancy will require a new variance application. However, since the owner of World Wide has indicated that he is also an owner of Vernon Real Estate Holding LLP this should not pose any problems. an EACKGROUND The building that World Wide is occupying was constructed with eight (8) non -conforming truck loading spaces and one loading dock measuring approximately 50 feet in width and 150 feet in length. Prior to World Wide a variance was approved for World Bazaars, Inc. for the approval of eight (8) non -conforming truck loading spaces measuring 10.0 feet in width: four loading spaces measure 54.3 feet in length and the remaining four measure 26.0 feet in length. World Bazaars, Inc. had agreed that only vehicles of smaller lengths would be used at the non -conforming truck loading spaces. The building is used for warehousing and is approximately 60,000 square feet'. REASON FOR VARIANCE Section 26.4.2-8(c) of the current City of Vernon Comprehensive Zoning Ordinance specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long. Section 26.4.E-4(c) provides that a non -conforming building must comply with these standards within five (5) years of April 18, 1989 unless a variance is granted. Although World Bazaars, Inc. was granted a Variance in 1994 pursuant Resolution 6425, a new variance is required upon a change in occupancy. Therefore World Wide is requesting a variance for their non -conforming truck loading docks. -2- For the building to conform with the current Comprehensive Zoning Ordinance, a significant portion of the building would need to be demolished. The strict application of the off-street parking, access and loading requirements of the ordinance at this time would cause an unreasonable hardship to the applicant. VARIANCE METHODOLOGY The applicant is requesting a variance from Section 26.4.6- 4(c) of the City of Vernon Comprehensive Zoning Ordinance pursuant Section 26.4.E-4(d) in lieu of the required findings listed in Section 26.5.1-6. PARKING ANALYSIS Considering the site is a preexisting site that has not been vacant for a continuous period of more than one year and is not undertaking any structural alterations, it is not required to come into complete compliance with the parking, loading, maneuvering requirements of the current City of Vernon Comprehensive Zoning Ordinance. However, upon approval of this variance the site shall maintain its legal non -conforming status and is only required to comply with the size requirements of the Comprehensive Zoning Ordinance not otherwise addressed by a grant of a variance. The building has eight (8) non -conforming truck loading spaces measuring 10.0 feet in width: four loading spaces -3- measuring 54.3 feet in length and the remaining four measure 26.0 feet in length. On the north side of the building, the building has a long dock measuring approximately 50 feet in width and 150 feet in length that may be used for five conforming truck loading spaces. Therefore, a condition should be placed in this variance that requires World Wide to maintain a minimum of five (5) conforming truck loading positions. In addition, World Wide will be required to use shorter trucks that are docked in the non- conforming spaces to avoid protruding into the public right-of- way as defined by the Master Plan of Streets dated June 16, 1992. CEQA REVIEW The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from noise, odor, dust, smoke, light or glare from the project. The project is categorically exempt under -Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared. STAFF FINDINGS AND CONDITIONS Staff finds the following to be true: a) As previously mentioned the applicant's building was built with eight (8) non -conforming truck loading spaces and one truck loading dock measuring approximately 50 feet in width and 150 feet in length. For the building to conform with the current Comprehensive Zoning Ordinance, a significant portion of the building would need to be demolished. The strict application of the off-street parking, access and loading requirements of the ordinance at this time would cause an unreasonable hardship to the applicant. b) This building has been used'for warehousing and distributing in the past and despite a change in occupancy, it continues to be used for the same purpose. Consequently, the existing use does not and will not adversely affect the surrounding area. c) As previously mentioned, the applicant has stated that only vehicles of smaller lengths will be used at the shorter non- conforming truck loading spaces to ensure that vehicles will not extend into the street right-of-way while in the loading space. As long as the applicant complies with this condition, the variance will be consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan and the use will not require the area specified by this Ordinance. Therefore, it is recommended that the variance be granted with the following conditions: a. The applicant shall maintain the fifty (50) foot loading dock on the property free, clear and accessible for longer trucks to utilize. -5- b. The usage of the non -conforming truck loading spaces shall be limited so that no truck parked at or using the loading docks shall extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992. C.
