Resolution No. 76041 RESOLUTION NO. 7604 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 7562 BY ADDING 3 SECTION 15(h) TO SAID RESOLUTION AND AMENDING 4 SCHEDULE II, EXHIBIT "B," PAGES 11 AND 15 AND SCHEDULE V, EXHIBIT "E," OF SAID RESOLUTION WHICH 5 FIXED THE COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES 6 7 WHEREAS, on June 27, 2000, Resolution No. 7562 was adopted by 8 the City Council of the City of Vernon to be effective on July 1, 9 2000; and 10 WHEREAS, on September 21, 1999, the City Council of the City 11 of Vernon approved the September 14, 1999 recommendation of the 12 Finance Committee to include specific personnel of the Vernon Police 13 Department in the 4/10 work schedule; and 14 WHEREAS, the City Council of the City of Vernon desires to 15 reaffirm its approval of the inclusion of Lieutenants and Police 16 Captain in the 4/10 work schedule and desires to amend Resolution No. 17 7562 by adding a new Section 15(h) to reflect the fact that said 18 personnel are included in the 4/10 work schedule; and 19 WHEREAS, the City Council of the City of Vernon adopted 20 Resolution No. 7009 on September 2, 1997, which approved a Fourth 21 Side -Letter Agreement between the Municipal Employees Relations 22 Representative and the Vernon Police Officers' Benefit Association 23 amending the Memorandum of Understanding ("MOU") previously adopted by 24 Resolution No. 5489 on March 15, 1988, as amended by a Side -Letter 25 Agreement adopted by Resolution No. 6001 on January 21, 1992, a Second 26 Side -Letter Agreement adopted by Resolution No. 6258 on October 5, 27 1993, and a Third Side -Letter Agreement adopted by Resolution No. 6656 28 on July 11, 1995; and 1 WHEREAS, Section 7.5 of the MOU, as amended by the Fourth 2 Side -Letter Agreement, provides for a cost of living increase in the 3 court appearance and standby status fees effective September 1, 2000; 4 and 5 WHEREAS, Schedule II, Exhibit "B," page 11 of Resolution No. 6 7562 provides for the positions and salary scales of police officers 7 and sergeants in the Vernon Police Department; and 8 WHEREAS, Schedule V, Exhibit "E," of Resolution No. 7562 9 provides for the compensation for court appearances and standby 10 status; and 11 WHEREAS, in accordance with Section 2.4 of the MOU, as 12 amended by the Fourth Side -Letter Agreement, the City Council of the 13 City of Vernon intends to establish a new salary schedule for the 14 positions of police officers and sergeants in the Vernon Police 15 Department;.and 16 WHEREAS, certain schedules of Resolution No. 7562 need to be 17 modified in order to implement the provisions of the Fourth Side- 18 Letter Agreement; and 19 WHEREAS, the City Council of the City of Vernon wishes to 20 amend page 15 of Schedule II, Exhibit "B" of Resolution No. 7562 to 21 add a position of Secretary Trainee in the City Administrator/City 22 Clerk Department with the appropriate salary scale. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 24 CITY OF VERNON AS FOLLOWS: 25 SECTION 1: The City Council of the City of Vernon hereby 26 finds and determines that the recitals contained hereinabove are true 27 and correct. 2 8 - 2 - 1 SECTION 2: Effective August 28, 2000, Section 15, subsection 2 (h) of Resolution No. 7562 shall be added to read as follows: 3 (h) Lieutenants and Police Captain. 4 The City Council of the City of Vernon hereby affirms 5 the inclusion of Lieutenants and Police Captain in the 4/10 work plan 6 pursuant to its approval on September 21, 1999. 7 SECTION 3: Effective September, 1, 2000, Schedule II, Exhibit 8 "B," page 11 of Resolution No. 7562 is hereby amended to establish new 9 salary schedules for the positions of police officers and sergeants in 10 the Vernon Police Department as indicated in Attachment A which is 11 attached hereto and made apart hereof. 12 SECTION 4: Effective September 1, 2000, Schedule V, Exhibit 13 "E" of Resolution 7562 is hereby amended to establish new compensation 14 for court appearances and standby status for the positions of police 15 officers and sergeants in the Vernon Police Department as indicated in 16 Attachment B which is attached hereto and made a part hereof. 17 SECTION 5: Effective August 28, 2000, Schedule II, Exhibit 18 °B," page 15 of Resolution 7562 is hereby amended to establish a new 19 position of Secretary Trainee in the City Administrator/City Clerk 20 Department as indicated in Attachment C which is attached hereto and 21 made a part hereof. 22 SECTION 6: The provisions of Resolution Nos. 7562 not 23 consistent with or in conflict with this resolution are hereby 24 repealed; Towles, Faldetta, and Wohlt Sir: I spoke with the above managers, and they agreed with my proposal regarding the restrictions that will be placed on their comp time use so they can then assume a "10 Plan" work schedule. Those restrictions are as follows: After reaching the 40 hour comp time figure, they will not be eligible for any paid overtime in the event they are called in to work extra hours. They may use comp time off only under these three circumstances: 1) Illness 2) Injury 3) Extreme family emergency. Faldetta Subject: Proposal for the 4-10 work schedule Date: August 5, 1999 I respectfully request that the city consider the 4-10 work schedule for the following personnel: Captain Benudiz, Lt. Towles, Lt. Faldetta, and Lt. Wohlt. At present all four of us are working the modified 5-9 schedule, which is nine days per pay period, working nine hours each day, with every other Friday off. The proposal is that we convert to the 4-10 schedule, with Fridays off, consistent with the City Hall schedule. All of us have pagers and are on call 24 hours a day, every day. At one time or another all of us have been contacted at home and have either given direction by phone or responded to the city. On Fridays, like weekends while City Hall is closed, the Police Department has supervisors (sergeants) on duty. In the event of a criticalincident all of the sergeants have been trained to notify one of us. In addition to the patrol sergeants, Sgt. Jaime (Detective Bureau) and Sgt. Olson, Chief of Police SUBJECT: 4/10 Plan My department has experienced no difficulties involving the 4-10 work schedule. As you know, since we are a "24 hour 7 days a week" organization we always have supervisory personnel on duty to handle any situation. Also, we all know that Friday's are very inactive days throughout the city as many companies have a reduced employee pool on this day which makes our need to have a Captain or Plain Clothes Lieutenant on duty minimal. I have found that Patrol Supervision have been able to deal with any problems that have occurred on Fridays without any difficulty whatsoever. I would certainly recommend that we continue to use this work schedule for all those people that are currently on it.
