CITY OF VERNON APPROVING A LOT LINE
e3 ADJUSTMENT REQUESTED BY RIEDER ENTERPRISES,
LLC AND THE BURLINGTON NORTHERN AND SANTA
4 FE RAILWAY COMPANY (BNSF)

6 WHEREAS, Rieder Enterprises, LLC ("Rieder") is the
7 owner of three adjoining parcels of land (parcels 1 through 3)
8 in the City of Vernon, all as described and shown on the
9 attached Exhibit "A" consisting of four (4) pages which are
10 incorporated herein by this reference as though fully set forth
11 at length; and
12 WHEREAS, Burlington Northern and Santa Fe Railway
13 Company ("BNSF") is the owner of parcel 4 depicted on Exhibit
14 ; and
15 WHEREAS, Rieder and BNSF desire to adjust the common
16
boundaries between the four parcels; and
17
WHEREAS, Rieder desires to merge their above
18
entioned three lots into one; and
19
20 WHEREAS, said Lot Line Adjustment will create two new
21 properties as described and shown cn the attached Exhibit "B"
22 consisting of three (3) pages which are incorporated herein by
23 this reference as though fully set forth at length; and
24 WHEREAS, Rieder and Catellus Management Corporation
25 as agent for BNSF have applied for a Lot Line Adjustment
26 ursuant to Government Code Section 66412(d), which provides
27 that the Subdivision Map Act does not apply to the following:
28 (d) A lot line adjustment between two or more

and
existing adjacent parcels, where the land taken from
one parcel is added to an adjacent parcel, and where
a greater number of parcels than originally existed
is not thereby created, Provided the lot line
adjustment is approved by the local agency, or
advisory agency...."
WHEREAS, Parcel 1 on Exhibit B will be owned by
eder and will be used as a truck wash facility; and
WHEREAS, Parcel 2 on Exhibit B will be owned by BNSF
and will be used for the placement of a spur track; and
WHEREAS, Section 22.14 of the Vernon City Code
provides that spur tracks should be operated and maintained
subject to such other regulation and conditions as may be
rescribed from time to time by the City Council; and
WHEREAS, the City presently regulates lot size
through its Comprehensive Zoning Ordinance; and
WHEREAS, the purpose and intent for regulations of
of size is to encourage the continued development of
industrial uses throughout the City; and
WHEREAS, the proposed uses of the parcels at issue
re consistent with the purpose and intent of the City's
egulations of lot size and Comprehensive Zoning Ordinance; and
WHEREAS, the parcels resulting from the Lot Line
djustment will conform to the building ordinances of the City
f Vernon.

1 WHEREAS, Samuel Kevin Wilson, Director of Community
2 Services & Water, has recommended that said Lot Line Adjustment
3 be approved; and
4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
5 THE CITY OF VERNON AS FOLLOWS:
6 SECTION 1: The City Council of the City of Vernon
7 does hereby find and determine that the recitals contained
8 hereinabove are true and correct.

SECTION 2: The request for a Lot Line Adjustment dated
10
August 30, 2000, to adjust the common boundaries of the four
11
existing properties being described in the attached Exhibit "A
12
13 hereby said adjustment will create two new properties as
14 described in the attached Exhibit "B" is hereby approved in
15 accordance with the recommendation of Samuel Kevin Wilson,
16 Director of Community Services & Water.
17 SECTION 3: The City Clerk of the City of Vernon
18 shall certify to the passage of this resolution and thereupon
19 and thereafter the same shall be in full force and effect.
20 APPROVED AND ADOPTED this 19th day of September, 2000.

Rieder Enterprises, LLC and the Burlington Northern and Santa Fe
Railway Company (BNSF), are the owners of four adjoining parcels of
land located at the southwest corner of Downey Avenue and �i
Avenue in the City of Vernon.
Rieder Enterprises, LLC and BNSF have requested an adjustment of the
boundary lines between the parcels. The boundary line adjustment will
result in Rieder Enterprises, LLC merging three lots into one and
portion of land being transferred from BNSF to Rieder Enterprises,,+
LLC.
It is hereby recommended that the requested lot line adjustment be
granted.
