RESOLUTION NO. 7665
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING CONTRACT NO. 555 (REVISED) OF THE
CITY OF VERNON FOR VERNON GAS DISTRIBUTION SYSTEM,
REPLACEMENT OF GAS MAIN COUPLINGS AND AUTHORIZING
NOTICE INVITING SEALED PROPOSALS OR BIDS IN
ACCORDANCE THEREWITH
WHEREAS, on September 5, 2000, the City Council of the City
of Vernon adopted Resolution No. 7613, approving Contract No. 555,
Vernon Gas Distribution System, Replacement of Gas Main Couplings, and
called for bids; and
WHEREAS, the only qualified bid received substantially
exceeded the Department's estimate and as a result the bid was
rejected by City Council Resolution No. 7651 on October 17, 2000; and
WHEREAS, said Resolution No. 7651 ordered that such services
be procured by negotiated agreement without further compliance with
the Purchasing Ordinance, as permitted by Section 2.27 of the Code of
the City of Vernon; and
WHEREAS, after final review, the Director of Community
Services & Water has recommended that the negotiated bid of Doty Bros.
Equipment Co. be rejected and new bids be advertised; and
WHEREAS, the specifications for Vernon Gas Distribution
System, Replacement of Gas Main Coupling, have been revised and are
herewith.submitted for reconsideration as Contract No. 555 (Revised);
and
WHEREAS, the Director of Community Services & Water has
recommended that Contract No. 555 (Revised) be approved by the City
Council and advertised for bids; and
WHEREAS, the City Council of the City of Vernon has
I determined that it is in the best interests of the City of Vernon that
2 Contract No. 555 (Revised), be advertised in accordance with applicable
3 State law.
4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
5 CITY OF VERNON AS FOLLOWS:
6 SECTION 1: The City Council of the City of Vernon hereby
7 finds and determines that the recitals contained hereinabove are true
8 and correct.
9 SECTION 2: Contract No. 555 (Revised), Vernon Gas
10 Distribution System, Replacement of Gas Main Coupling, is hereby
11 approved by the City Council of the City of Vernon.
12 SECTION 3: The City Clerk of the City of Vernon is hereby
13 directed to file in his office at the City Hall of the City of Vernon
14 a copy of said contract.
15 SECTION'4: The City Clerk of the City of Vernon is hereby
16 directed to give notice, in writing,�inviting sealed proposals or bids
17 for Vernon Gas Distribution System, Replacement of Gas Main Coupling,
18 in accordance with Contract No. 555 (Revised) and in accordance with
19 this resolution.
20 SECTION 5: There being no newspaper of general circulation
21 printed, published or circulated in the City of Vernon, the City Clerk
22 is hereby directed to post said notice,.or cause the same to be
23 posted, in three of the most public places in the City of Vernon, to
24 wit: the northwest corner of 38`h Street and Santa Fe Avenue, the
25 northeast corner of Leonis Boulevard and Pacific Boulevard, and on the
26 bulletin board in the lobby of the City Hall of the City of Vernon,
27 located at 4305 Santa Fe Avenue, in said City.
28 SECTION 6: The City Clerk of the City of Vernon is hereby

directed to post said notice forthwith and the first posting of said
notice shall be not less than ten (10) days before the opening of the
bids for the proposed contract. Said notice shall provide that sealed
proposals or bids will be received by the City of Vernon at the office
of the City Clerk of the City, at the City Hall, 4305 Santa Fe Avenue,
Vernon, CA 90058-0805, until the hour of 2:00 p.m. on the 12th day of
December, 2000.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 21st day of November, 2000.

NOTICE INVITING SEALED PROPOSALS (BIDS)
NOTICE IS HEREBY GIVEN that the City of Vernon,
(her'einafter "City") invites and will receive sealed proposals
(bids) up to the hour of two (2) o'clock p.m. on December 12,
2000 for the furnishing to said City of all transportation,
equipment, materials, supplies and services necessary for
Contract No. 555, Vernon Gas Distribution System, Replacement of
Gas Main Couplings. Proposals (bids) shall be submitted to:

Vernon, CA 90058
At said time, proposals will be publicly opened and
announced at the offices of the City. Said bids shall conform to
and be responsive to the Contract Documents for said work as
heretofore provided by said City and must be accompanied by the
security referred to therein.
The City Council of the City reserves the right to
reject any and all bids.
Copies of the Contract Documents are on file and may be
examined in the office of the City located at:

First set of copies may be obtained from said office at
no cost. Additional copies may be purchased for $75.00 per set
($100.00 if mailed).

The Finance Committee at their meeting held October 16, 2000, had
approved the negotiated proposal from Doty Bros., for the replacement
of the gas couplings at an approximate cost of $528,910.00.
Based on a review of the references submitted by Doty Bros., staff
does not feel that they have the required experience for the job. It
is hereby recommended that no further action be taken on retaining the
services of Doty Bros. for this project. It is also recommended that
revised Contract No. 555 be approved and authority be granted to seek
bids/proposals for the replacement of the gas couplings in accordance
with Contract No. 555.

Our review of the references submitted by Doty Bros. on the above contract has been
completed. The investigation for their qualification indicates that they do not have the

Therefore, it is our recommendation to reject their negotiated bid and proceed to
advertise for new bids.
