TO OPERATE AN ACCESSORY WAREHOUSE AT 5233 ALCOA AVENUE IN THE CITY OF VERNON WHEREAS, Lucky Brand Dungarees, Inc. (hereinafter referred to as "Lucky Brand") has proposed to operate an accessory warehouse at 5233 Alcoa Avenue; and WHEREAS, the building was previously occupied by US Filter for the storage and distribution of virgin activated carbon; and WHEREAS, Lucky Brand has existing warehousing and manufacturing operations in the City of Vernon located at 4899 District Boulevard and 4575 District Boulevard in the City of Vernon with a third facility in the City of Santa Fe Springs; and WHEREAS, Lucky Brand proposes to consolidate all three operations into the one site located at 5233 Alcoa Avenue to be used as a warehousing, accessory warehousing, land manufacturing facility; and WHEREAS, Lucky Brand is proposing to operate an accessory warehouse in excess of 50,000 square feet located in the M-Zone of the City of Vernon; and WHEREAS, an accessory warehouse in excess of 50,000 square feet is only permitted in the M-Zone with approval of a conditional use permit; and WHEREAS, Lucky Brand is proposing to operate an 1 f I accessory clothing warehouse that works with local clothing 2 manufacturers in the City of Vernon to assemble clothing 3 that is ultimately distributed out of the 5233 Alcoa Avenue 4 site; and 5 WHEREAS, the manufacturers with whom Lucky Brand 6 currently subcontract with are all located in the City of 7 Vernon; and 8 WHEREAS, Lucky Brand's warehouse will operate as 9 an integral part of these manufacturing operations; and 10 WHEREAS, Lucky Brand will store goods produced in 11 their operation; and 12 WHEREAS, the proposed site is approximately 5.17 13 acres in size, and is adequate in size, shape and topography 14 for.the proposed operation and has adequate drainage; and 15 WHEREAS, the proposed site is surrounded by 16 industrial uses compatible with the proposed use and no 17 adverse effects from traffic, parking, noise, odors, dust, 18 smoke, light or glare, or risk of fire, infection or 19 explosion are anticipated from the proposed operation; and 20 WHEREAS, the site has access to Alcoa Avenue which 21 is sufficient to handle the traffic generated form the 22 proposed operations; and 23 WHEREAS, the site complies with on -site parking 24 and loading requirements as stated in the City of Vernon 25 Comprehensive Zoning Ordinance; and 26 WHEREAS, the conditions imposed on the conditional 27 use permit will adequately protect the public health, safety 28 -2- 1 2 3 4 5' 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the project is categorically exempt from the California Environmental Quality Act as an existing facility pursuant to Section 15301 of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines. WHEREAS, the City Council has received a Staff Report, dated on December 6, 2000 upon which it has relied in making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct, and hereby adopts the same as its findings in this matter. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Lucky Brand for the operation of an accessory warehouse in excess of 50,000 square feet at 5233 Alcoa Avenue. SECTION 3: In order to adequately protect the public health and general welfare the following conditions -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 are required: A. Lucky Brand must be issued a City of Vernon Certificate of Occupancy to occupancy the site located at 5233 Alcoa Avenue. B. Lucky Brand must not utilize more than 50,000 square feet for warehousing at 5233 Alcoa unless it continues to operate as an Accessory Warehouse as defined in the City of Vernon Comprehensive Zoning Ordinance. C. Any change of use that affects Lucky Brand's status as an Accessory Warehouse shall be reviewed by the Department of Community Services and may affect the status of the conditional use permit. D. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at or tied to 5233 Alcoa Avenue in the City of Vernon. E. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy.permit shall be obtained. F. All parking and loading facilities shall be kept paved with a hard durable surface material and shall be kept adequately drained, and free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be maintained to me I meet City standards. Adequate on -site parking shall be 2 maintained so that no on -street parking will -occur. 3 G. The facility shall be operated in a manner 4 that will prevent unsanitary conditions, odors or other 5 nuisances. The property shall be provided with adequate 6 refuse containers and refuse disposal services. 7 H. No equipment, supplies, materials, or freight 8 shall be stored on the site other than in buildings, 9 trailers or on the docks. 10 I. A hazardous materials permit shall be obtained 11 from the City of Vernon Environmental Health Department if 12 hazardous materials/waste are used handled or stored. 13 Hazardous materials/waste shall be handled and managed in 14 compliance -with all appropriate federal, state and local 15 laws. 16 J. The facility shall be operated in a manner 17 that will not impede traffic on Alcoa Avenue. 18 K. The owner of the property shall provide to the 19 City of Vernon a utility easement for the underground power 20 cables, manholes, padmount transformers, and padmounted 21 utility switches located on the owner's property in a form 22 and manner subject to approval of the Director of Community 23 Services and Water. 24 SECTION 4: The City Council hereby approves the 25 City of Vernon Community Services Department Staff Report on 26 Lucky Brand dated December 6, 2000. Such documents and other materials which constitute the record of proceedings in this matter shall be maintained in the office of the City Clerk, who is and shall be the custodian thereof. SECTION 5: Noncompliance with the conditions set forth in the conditional use permit shall be grounds for voiding the permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning Ordinance. SECTION 6: Lucky Brand and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 7: Not later than sixty (60) days from the date of this Resolution, Lucky Brand, shall indicate, in writing, its acceptance of and agreement with the conditions 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 contained in Section 3 of this Resolution and the indemnification provision contained in Section 6 of the Resolution. Since that time, the building has been vacated and now Lucky Brand is proposing to lease the building from the property owner. Lucky Brand, is currently located at 4599 District Boulevard, 4575 District Boulevard and a third facility in the City of Santa Fe Springs. It is proposing to consolidate all three locations at the Alcoa Site. The facility will operate as an accessory warehouse with some manufacturing operations within the building. However, since it is proposing to operate more than 50,000 square feet as an accessory warehouse in the M-Zone, they are required to apply for a conditional use permit. 1. GENERAL PLAN The proposed use conforms tolthe Zoning Ordinance and the General Plan with a conditional use permit. The site is located in the M-Zone, General Industrial. An accessory warehouse in access of 50,000 square feet or more per lot or parcel being operated as an integral part -of a -1- manufacturing operation located in the City of Vernon and storing goods produced in the operation is permitted in the M-Zone with a conditional use permit. 2. SITE The new 117,000 square foot building in question, is located on a 5.17 acre parcel. The proposed use of the building is an accessory warehouse, manufacturing, and distribution facility. Currently the applicant is proposing to lease the property from the owner of the property, X.A. Partners, LLC. The size, shape, topography and drainage of the facility is adequate for the proposed operation. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared. 4. ACCESS The sites have a total of two existing truck and automobile driveways located on Alcoa Avenue. The truck driveway measures 40' in width while the automobile driveway measures 25' in width. Alcoa.Avenue has already been widened on the project side of the right-of-way to comply with the Master Plan of Streets as part of a multi -building construction project. The site has adequate room to provide required parking, loading and maneuvering for trucks and automobiles. The -2- proposed project will comply with the Comprehensive Zoning Ordinance with approval of a conditional use permit and will be readily accessible from the two driveways. The site has access to Alcoa Avenue which is of adequate size and pavement type to handle the traffic generated by the new facility. S. VEHICLE MOVEMENTS The proposed project is an accessory warehouse that transports goods and materials to and from local clothing manufacturers in the City. The number of trips and routes are detailed in the traffic report as part of the application available for review in the Department of Community Services. The materials are easy to'transport and therefore are delivered by passenger cars, vans or bobtails. The facility will generate 14 vehicle trips per day to transport materials to and from the manufacturers located in Vernon to the central warehouse on Alcoa Avenue. Meanwhile, two (2) semi -trucks per week will deliver the goods from the project site to vendors located outside the City. The number of employees will remain substantially the same with possibly some growth expected sometime next year to accommodate for company expansion. The employees are all currently employed at 4599 and 4575 District Boulevard in the City of Vernon and with some additional employees in a warehousing facility in Santa Fe Springs. The proposed operation will consolidate the three facilities into one central operation located at 5233 Alcoa Avenue. Currently they have 173 employees -3- however, that includes their sales staff and other personal that are not at the location. The number of parking spaces provided at the proposed site is sufficient for the applicant's needs. Truck and automobile traffic that travel to the site will access the facility from the two (2) driveways located on Alcoa Avenue. -Trucks shall access the truck docks on the site from the 40' driveway located on the north end of the site while automobiles will access the site from the 25' driveway located on the south end. Delivery routes to and from the facility are detailed in the traffic report in the proponent's application available for review in the Department of Community Services. 6. OPERATIONS Lucky Brand is an existing facility in the City of Vernon that is proposing to relocate their operation to 5233 Alcoa Avenue. They propose to operate an accessory warehouse, manufacturing and distribution facility with operating hours remaining from 7:00 a.m. to 7:00 p.m. Monday through Friday, as in their previous facility. The building on the proposed site was recently constructed for a manufacturing use and complies with the parking, loading, and maneuvering requirements of the Comprehensive Zoning Ordinance. Shortly after construction US Filter occupied the building as a warehouse and distribution facility but since has vacated. Lucky Brand is also proposing to operate a warehouse, distribution accessory warehouse facility. The operation is not a dramatic change in land use from the previous tenant. -4- Lucky Brand is proposing to operate an accessory clothing warehouse that works with local clothing manufacturers in the City of Vernon to assemble clothing that is ultimately distributed out of the 5233 Alcoa Avenue site.
