Resolution No. 77061 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7706 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITY OF VERNON AND THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT WHEREAS, the FBI ViCAP Program (the "Program") is a computer database which houses information gathered from law enforcement agencies throughout the United States relating to violent crimes that assists law enforcement agencies to identify similarities between crimes with the intent of increasing the number of cases solved which are committed by the same offender; and WHEREAS, the Program's local hub site for Los Angeles County is intended to be the point of entry for all the data submitted to the Program by participating law enforcement agencies in the county; and WHEREAS, the Program's hub site will be housed at the Los Angeles County Sheriff's Department (the "Sheriff's Department"), Homicide Bureau, located in the City of Commerce; and WHEREAS, the City of Vernon and the Sheriff's Department desire to -enter into a Memorandum of Understanding setting forth the objectives and responsibilities of both parties relating to the utilization of the Program hub site for Los Angeles County; and WHEREAS, by letter dated February 1, 2001, Bruce V. Malkenhorst, City Administrator/City Clerk, recommended the approval and execution of the Memorandum of Understanding. 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 2 OF VERNON AS FOLLOWS 3 SECTION 1: The City Council of the City of Vernon hereby finds 4 and determines that the recitals contained hereinabove are true and 5 SECTION 2: The City Council of the City of Vernon hereby 6 approves the Memorandum of Understanding with the Sheriff's Department, 7 a copy of which is attached hereto as Exhibit "A" and made a part 8 hereof. 9 SECTION 3: The City Council of the City of Vernon hereby 10 authorizes the Mayor and the City Clerk to execute said Memorandum of 11 Understanding for, and on behalf of, the City of Vernon. 12 SECTION 4: The City Clerk of the City of Vernon shall certify 13 to the passage of this resolution, and thereupon and thereafter the 14 same shall be in full force and effect. 15 APPROVED AND ADOPTED this 7th day of February, 2001. 16 17 18 EONIS C. MALKENHORST, City Clerk - 3 - EXHIBIT A MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding (MOU) is entered into by the Los Angeles County Sheriff's Department and the Vernon Police Department, 1. PURPOSE The purpose of this MOU is to set forth the objectives and responsibilities of the above agencies as related to the utilization of the ViCAP hub site for Los Angeles County. 11. 1)HFIN-jjj MON The FBI ViCAP Program is a computer database which houses information gathered fromlaw enforcement agencies throughout the United States related to violent crimes; specific criteria being homicides, missing persons where foul play is suspected and unidentified dead bodies. Cases submitted to ViCAP may be compared to all other cases in the database.in an attempt to identify similar cases. The submitting agencies are then advised if a match is made so that they can further their investigative efforts, The ViCAP local hub site for Las Angeles County is intended to be the point of entry for all ViC.AV data submitted by participating law enforcement agencies in the county. This hub site is housed at the Los Angeles County Sheriffs Department, I1ornicide Bureau, at 5747 Rickenbacker Road, Commerce 90040, phone (323) 890-5533. Ill. OB TI+,CTTVF To assist law enforcement agencies in Los Angeles County in identifying similarities between homicides as well as the additional violent crimes within the criteria committed in the various jurisdictions with the intent of increasing the number of cases solved which are committed by the same offender(s). IV. MI THOD OF IMPLli<ml+ TAT10N The Vernon Police Department agrees to complete a ViCAP Crime Analysis Report Form (FD-676 Rev.) on all current homicides, missing persons cases where foul play is suspected and unidentified dead body cases and submit the form to the local ViCAP hub site for entry into the computer database. Additionally, the agency agrees to submit a ViCAP fonn on all open homicide cases for the past ten years. Submission of ViCAP case data is intended to be via computer from the participating agency to the ViCAP local hub site utilizing the Sheriffs Data Network. The Vernon Police Department further agrees that the ViCAP information submitted may be forwarded to the FBI ViCAP Unit Quantico, Virginia, by the Los Angeles County Sheriff's Department for inclusion in the national database. Police departments that have the Los Angeles County Sheriffs Department investigate homicides in their jurisdiction agree to allow the LASD to submit the cases to ViCAP on their behalf. This agreement does not preclude any participating agency from direct communication with the 17BI National Center for the Analysis of Violent Crime, nor does it preclude an agency -- from direct submission of ViCAP information to the FBI. V. CON HILANTIAI<,ITY Los Angeles County Shoi fPs Department and local "Hub Site" participating police agencies agree that dissemination of information obtained from any agency and contained in the ViCAP Crime Analysis Report form must be compatible with the purpose and intent far which the information was originally collected, In no case shall that information be shared with any other person or agency, with the exception of regular employees of the FBI's ViCAP Unit, without the expressed and informed consent of the agency making the original submission of drat information. In the event of a possible linkage between or among two or more cases, the agency name, case number, case investigator's naive and telephone number, and the victim's name for each associated case may be provided to each of the involved case investigators in accordance with the provisions set forth in section VI of this agreement. All agencies agree to maintain the confidentiality of the information as required by law. VI. CC)ORnTN `ia �raN C1F PrIO'I'IFICATYON OF PC?SSII3I.Y RELA TFD GASr,S The Los Angeles County Sheriffs Department and/or local "Hub Site" participating police agencies shall make no notification regarding possibly related cases which have been submitted to ViCAP via the LASD hub site without first notifying the ViCAP Unit of their findings and intent to notify the concerned agencies. Likewise, ViCAP and participating police agencies shall male no notification regarding possibly related Los Angeles County cases received via the LASD local hub site without giving similar notice to the Los Angeles County Sheriff's Department. This requirement of notice shall not, however, prevent either the LASD, ViCAP or participating police agencies from .subsequently notifying the concerned agencies whether or not agreement exists as to the validity of the tentative case associations.. The notification is to serve only as a means of coordinating the activities of the participating, police agencies and both the LASD and the FBI ViCAP Unit. 2 VII. +. 1 ]TPM^ N�TQiJIREML+;NTS Participant agencies will be responsible for having as a mirihnuin the following computer hardware to facilitate program utilization.
