A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND'RATIFYING THE EXECUTION OF A
WAIVER FOR YEAR THREE OF THE JUVENILE
ACCOUNTABILITY INCENTIVE BLOCK GRANT PROGRAM
WHEREAS, by Resolution No. 7274 adopted on February 16, 1999,
the City Council of the City of Vernon authorized the reallocation of
funds made available through the Juvenile Accountability Incentive
Block Grant ("JAIBG") in the amount of Eight Thousand Four Hundred
Eleven Dollars and No Cents ($8,411.00) to the Los Angeles County
District Attorney's Office, Los Padrinos Court; and
WHEREAS, by Resolution No. 7488 adopted on February 15, 2000,
the City Council of the City of Vernon authorized the reallocation of
funds made available through the JAIBG Program in the amount of Eight
Thousand Four Hundred Thirty -Three Dollars and No Cents ($8,433.00) to
the Los Angeles County District Attorney's Office, Los Padrinos Court;

WHEREAS, the JAIBG Program Grant, which is administered by
Ithe Office of Criminal Justice Planning ("OCJP"), is intended to be
lutilized for matters relating to the suppression of juvenile
delinquency, including, but not limited to, funding a contract with a
District Attorney or a probation officer relating to juvenile
1prosecution and
WHEREAS, the Los Angeles County District Attorney's Office
has requested that the City continue its partnership with the Los
Angeles County District Attorney's Office in the JAIBG Program for Year
Three under the same terms as the past year; and
WHEREAS, the City of Vernon, acting alone, would not be able

to achieve the goals of the Program with the amount of grant money it
has been provided; and
WHEREAS, the City of Vernon would directly benefit by
authorizing the entire amount of its subgrant award in Year Three of
the Program to be expended by the Los Angeles County District
Attorney's Office, Los Padrinos Court; and
WHEREAS, the City's grant allocation this year is Eight
Thousand Three Hundred Fifty -Five Dollars and No Cents ($8,355.00); and
WHEREAS, the Los Angeles County District Attorney's Office
has requested that the City execute a Waiver of Direct Subgrant Award
From Unit of Local Government (the "Waiver") in order to indicate the
City's desire to participate in the Program; and
WHEREAS, the Los Angeles County District Attorney's Office
required that the signed Waiver, also deemed the City's letter of
intent, be submitted to them prior to February 15, 2001, and the City
Administrator executed the Waiver on February 1, 2001, subject to
ratification by the City Council; and
WHEREAS, on February 14, 2001, Bruce V. Malkenhorst, City
Administrator/City Clerk, recommended to the City Council that the City
ratify his execution of the Waiver on February 1, 2001; and
WHEREAS, the City Council of the City of Vernon desires to
approve and ratify the Waiver, as executed by the City Administrator,
and to continue its partnership with the Los Angeles District
Attorney's Office in Year Three of the JAIBG Program and, therefore,
declines to directly accept funds made available through the JAIBG
(Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: The City Council of the City of Vernon waives its
right to its entire direct subgrant award under the JAIBG Program and
authorizes the funds to be expended by the Los Angeles County District
Attorney's Office, Los Padrinos Court, for the mutual benefit of both
units of local government.
SECTION 3: The City Council of the City of Vernon hereby
approves and ratifies the execution of the Waiver by the City
Administrator on behalf of the City of Vernon, a true and correct copy
of which is attached hereto as Exhibit "A" and made a part hereof.
SECTION 4: The City Council of the City of Vernon recognizes
that any liability arising out of the performance of the Grant Award
Agreement, including civil court actions for damages, shall be the
responsibility of the grant recipient and that the State of California
and the OCJP disclaim responsibility for any such liability.
SECTION 5: The grant funds received under the JAIBG Program
shall not be used by the City of Vernon to supplant expenditures
controlled by the City of Vernon.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.

The Office of Criminal Justice Planning (OCJP) has informed us that we are now entering
the third funding cycle and annual application period for the Juvenile Accountability
Incentive Block Grant (JAIBG). Your city council should also have received a JAIBG
Request for Application (RFA) and corresponding paperwork from OCJP. As we did last
year, we are again writing to advise you of the time frame to complete the grant
application.
For the past two years, the District Attorney's Office has utilized its share of Los Angeles
County's JAIBG funds to place one senior Grade IV deputy district attorney in each of our
nine juvenile court offices. In addition, fifty-six cities have released their JAIBG funds to
the District Attorney's Office to support the following prosecution programs selected by
the cities: HEAT (Heightened Enforcement and Targeting, a juvenile gang prosecution
program), ACT (Abolish Chronic Truancy), and the "707" program (focusing on serious,
violent juvenile offenders). This past year, four cities collaborated with our office to
expand the Juvenile Offender Intervention Network (JOIN), a diversion program for first-
time, non-violent juvenile offenders.
Since the inception of these JAIBG programs, our prosecutors have received positive
feedback from cities and local law enforcement agencies for their dedication and service in
juvenile investigations and prosecutions. In the coming year, the District Attorney's Office
will continue its commitment to the assignment of a senior deputy district attorney in each
juvenile court. In addition, we are pleased to offer our continuing support for the HEAT,
ACT and 707 prosecution programs in your cities, as well as continuation of the JOIN
program.
The new allocation for the City of Vernon is $8,355. We are taking this opportunity to
ask if you would like to continue your partnership with the Los Angeles County District
Attorney's Office in the JAIBG program for Year Three under the same terms as this past
year.'
' All cities are encouraged to determine whether they wish to release their JAIBG funds to another
jurisdiction for Year Three. These cities will need to communicate with their partner agency and complete the
waiver as described in this correspondence and the RFA.

If your city chooses to continue in the JAIBG program, we will need a letter of intent to
release your allocated funds to the Office of the District Attorney no later than
February 15, 2001. This year, OCJP has substituted a waiver form for the previously
required city council resolution. We will need to receive the attached (sample) waiver form,
completed and forwarded to Special Assistant District Attorney Mia Baker by March 15,
2001. Although the actual deadline for the completed county -wide application to be
submitted to OCJP is March 2, 2001, only your letter of intent is needed before that date if
your city intends to release funds to the District Attorney.
In past years, several cities submitted individual applications for JAIBG funding. These
cities must again apply directly to the Office of Criminal Justice Planning for Year Three .
JAIBG funds, unless they wish to join one of the programs described above. If your city did
not previously release its funds for one of these programs, but you are interested in working
together during this current funding cycle, please contact Deputy District Attorney Susan
Steinfeld at (213) 974-9870.
