FOR THE OPERATION OF A RECYCLED MATERIALS PROCESSING FACILITY AT 3056 BANDINI BOULEVARD IN THE CITY OF VERNON WHEREAS, Pacific Poly Plastics, Inc. has applied for a conditional use permit to continue operating a recycled materials processing facility at 3056 Bandini Boulevard; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on February 21, 2001; and WHEREAS, the proposed site is in the General Industry M-2 Zone, Section 26.3.E-3(a) and Section 26.3.5-3 of the Comprehensive Zoning Ordinance requires a recycled materials processing facility obtain a conditional use permit; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, has adequate drainage, and landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and adverse effects anticipated from the proposed operation have been addressed in the mitigation monitoring program; and WHEREAS, the site has access to Bandini Boulevard and traffic will generally travel on Bandini Boulevard to the freeway system. WHEREAS, the site has vehicle parking that is preexisting and legally non -conforming and will only be required to come into complete conformance with the requirements of the current Comprehensive Zoning Ordinance as required by Section 26.4.E-4(b) of said Ordinance; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, paring, noise orders, dust smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the project is categorically exempt from the California Environmental Quality Act as an existing facility pursuant to Section 15301 of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines. WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the city of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon with approval of a conditional use permit; and WHEREAS, the City Council has received a Staff Report dated January 29, 2001 upon which it has relied on making the foregoing recitals; and 2 1 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 2 CITY OF VERNON AS FOLLOWS: 3 SECTION 1: The City Council of the City of Vernon 4 hereby finds and determines that the recitals contained herein- 5 above are true and correct. 6 SECTION 2: Subject to the`conditions set forth below, the 7 conditional use permit is hereby granted to Pacific Poly 8 Plastics, Inc. for the operation of a recycled materials 9 processing facility at 3056 Bandini Boulevard. 10 SECTION 3: In order to adequately protect the public health 11 and general welfare the following conditions are required: 12 a. The facility shall be operated in accordance with, 13 and made to conform with all current codes, rules, regulations 14 and subject to permit fees as adopted by the City of Vernon. 15 b. Any hazardous substances used, handled or stored 16 shall have prior approval from the Vernon Fire and Health 17 Departments. A Health Permit shall be obtained if there are 18 reportable quantities of hazardous materials on the site. 19 C. Servicing of vehicles including washing, steam 20 cleaning and repairing shall be performed in facilities in 21 compliance with appropriate codes. 22 d. In accordance with National Pollutant Discharge 23 Elimination System permit regulations, Pacific Poly shall 24 submit a Notice of Intent to the State Water Resources Control 25 Board and shall prepare a prevention plan and monitoring 26 program within the Board's time limitations. 27 e. All processing and recycling operations shall take 28 place within the existing buildings. No equipment or 3 1 materials shall be stored outside with the exception of 2 pallets or materials stored within tankers or trailers. 3 Adequate written plans and materials must be available for 4 cleaning up leaks or spills of plastic materials or other 5 substances associated with Pacific Poly's operation. 6 f. Broken or cracked sidewalk, curb, gutter or driveway 7 in Bandini Boulevard adjacent to the site shall be repaired as 8 directed by the Director of Community Services and Water. 9 g. The entire site shall have a neat and clean 10 appearance and shall be kept free of dust, mud, weeds and 11 trash. The site and surrounding area shall be kept free of 12 all plastic materials associated with Pacific Poly's 13 operations including but not limited to raw materials, 14 recycled materials, finished product, pellets and waste' 15 material. 16 h. Waste water,generated by the plant operations must 17 be contained for proper disposal and shall not be discharged 18 onto the ground surface. 19 i. The facility shall meet the requirements of any 20 regulations adopted pursuant to Public Resources Code, Section 21 43209 and the requirements of any other applicable sections of 22 the California Integrated Waste Management Act of 1989 (Public 23 Resources Code, Section 40000, et. Seq.). 24 j. Pacific Poly shall obtain all required federal, state, 25 local and regulatory agency permits prior to operation. Prior to 26 occupancy a business license and occupancy permit shall be 27 obtained. 28 4 f 1 • f 1 k. Pacific Poly shall maintain records that include the 2 amount of waste recycled and the name and location of the 3 company that produced it, of all plastics recycled at this 4 facility so that it may be determined what plastics are 5 collected within the City of Vernon. 6 1. The proponent shall submit an annual report to the 7 Environmental Health Department on diversion and disposal 8 tonages. 9 M. All parking and loading facilities shall remain 10 paved with a hard durable surface material in good repair and 11 shall remain adequately drained, and kept free of dust, mud, 12 trash and weeds. Where parking or maneuvering areas adjoin 13 the public street a barrier wall or landscaping shall be 14 installed and maintained to meet City standards. Adequate on- 15 site parking shall be maintained so that no on -street parking 16 will occur. 17 n. A system shall be established to drain the site to a 18 clarifier with a rain water diversion valve prior to the 19 discharge to the storm drain. The on -site storm drain shall 20 be protected from unauthorized discharge of wastewater. 21 0. The building shall be repaired so as to prevent the 22 entrance of rodents. 23 SECTION 4: Noncompliance with the conditions set forth in 24 the conditional use permit shall be grounds for voiding the 25 permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning' 26 Ordinance. 27 SECTION 5: Pacific Poly Plastics, Inc. and any successors 28 in interest shall indemnify, hold harmless, and defend the City 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the gross negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 6: Not later than sixty (60) days from the date of this Resolution, Pacific Poly Plastics, Inc., shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 5 of the Resolution. SECTION 7: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. After review of the application by the Community Services Department, it is recommended that the conditional use permit be granted. Herewith for your consideration are the following supporting documents: 1. Staff Report. 2. Request for conditional use permit and information supporting the application. 3. Notice of Public Hearing, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. The project is categorically exempt from the California Environmental Quality Act because it is an existing facility with no expansion of use as defined in Section 15301. A Notice of Exemption will be prepared. In my opinion the proposed operation will pose no adverse effects to the City of Vernon and will have no significant effects on the environment. CONDITIONAL USE PERMIT TO OPERATE A RECYCLED MATERIALS PROCESSING FACILITY AT 3056 BANDINI BOULEVARD (February 8, 2001) Pacific Poly Plastics Inc. ("Pacific Poly") has submitted an application for a conditional use permit to continue operating a recycled materials processing facility presently located at 3056 Bandini Boulevard. The site was previously occupied by Ellics Enterprise Inc., a recycled materials processing facility. The proposed use will continue processing recycled materials and operate from 7:00 a.m. to 3:30 p.m. six days per week. 1. GENERAL.PLAN The location of the proposed use is consistent with the Zoning Ordinance and the General Plan. The site is located in the M-2 Zone, Heavy Industry. Pursuant to Section 26.3.E-3(a) and Section 26.3.5-3(k) a recycled materials processing facility is allowed in the M-2 Zone with approval of a conditional use permit. 2. SITE The proposed operation sits on a .99 acre lot. The applicant has not proposed any changes to the size, shape or topography of the existing site. The processing facility will continue to operate in the same manner as it was under the previous occupant. The site plans for the proposed operation indicates the site is adequate in size, shape, topography, including drainage and landscaping. i Staff Report.wpd 3. ADVERSE EFFECT The proposed use is surrounded by properties with industrial uses that are compatible. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent of abutting properties. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared. 4. ACCESS The site has two driveways located on Bandini Boulevard at opposite ends of the property. The western most driveway will be used primarily by automobiles while the eastern most driveway will be used primarily by trucks. Bandini Boulevard is 100 feet wide and is of adequate size to handle the traffic generated from the proposed operation. As previously stated, the prior use was also a recycled materials processing facility. The parking requirements are were both "grandfathered" into compliance with the current Comprehensive Zoning Ordinance and subject to the requirements of the Comprehensive Zoning Ordinance. However, considering the proposed applicant will only continue to operate the facility as a recycled materials processing facility, they will not be required to comply with the current parking, loading, and maneuvering standards as set forth by the current Comprehensive Zoning Ordinance. Therefore, the use will remain legally a Staff Report.wpd nonconforming within the limitation described in Section 26.4.6 of the Comprehensive Zoning Ordinance. 5. VEHICLE MOVEMENTS Traffic to and from the existing building will not change from the previous traffic counts. There will be one inbound (1) bobtail truck trip that delivers raw materials to the facility per day. The delivery of the finished product also consists of one (1) outbound bobtail truck trip per day. 6. OPERATIONS Pacific Poly proposes to continue the operation of a plastics recycling facility which converts recycled plastic materials into plastic pellets which are sold to target customers which in turn remold and remanufacture these pallets into light weight plastics such as sandwich bags and shopping plastic bags. Currently there are three (3) manufacturing laborers and two (2) office personnel. Normal shift hours are from 7:00 a.m. to 3:30 p.m. six days per week. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8.
