Resolution No. 77251 2 3 4' 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7725 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO HERNANDEZ TRUCKING FOR THE OPERATION OF A TRUCKING AND FREIGHT TERMINAL AT 2901 SUNOL DRIVE WHEREAS, Hernandez Trucking has applied for a conditional use permit to operate a trucking and freight terminal at 2901 Sunol Drive in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on March 21, 2001; and WHEREAS, the proposed site is a legal conforming use in the Heavy Industry (M-2) Zone which has been continuously used as a truck facility previously operated by Thermo King and which requires a conditional use permit under the Zoning Ordinance; and WHEREAS, the proposed operation will include the hauling and temporary storage of steel and machinery; and WHEREAS, the proposed site is approximately 4.08 acres in size, and is adequate in size, shape and topography for the proposed operation and has adequate drainage; and WHEREAS, a barrier wall or landscaping has been installed where parking or maneuvering area adjoin a public street pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or 1 2 3 4 5 6 7 8 UN 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 F7i 27 LT-1 glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has access to Sunol Drive and (traffic will generally travel from the site on Ayers Avenue to Bandini Boulevard thence easterly to the I-710, vehicle arriving at the site will generally exit the I-710 and travel westbound to Sunol Drive then southbound to the subject site and the streets to be utilized within the City of Vernon are sufficient to handle the traffic generated from the proposed operations; land WHEREAS, the site, as proposed, has ample room on -site to provide adequate off-street parking and loading facilities as required by the Vernon City Code; and WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all Japplicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation land design is consistent with the General Plan and zoning Ordinance of the City of Vernon; and WHEREAS, the project is categorically exempt from the California Environmental Quality Act as an existing facility pursuant to Section 15301 of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines; and WHEREAS, the City Council has received a Staff Report, dated March 14, 2001 upon which it has relied in making the -2- 1 foregoing recitals, and 2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 3 THE CITY OF VERNON AS FOLLOWS: 4 SECTION 1: The City Council of the City of Vernon 5 hereby finds and determines that the recitals contained 6 hereinabove are true and correct. 7 SECTION 2: Subject to the conditions set forth 8 below, the conditional use permit is hereby granted to Hernandez 9 Trucking for the operation of a trucking and freight terminal at 10 2901 Sunol Drive. 11 SECTION 3: In order to adequately protect the 12 public health and general welfare the following conditions are 13 required: 14 a. The facility shall be operated in accordance with, 15 and made to conform with all current codes, rules, regulations, 16 and subject to permit fees as adopted by the City of Vernon. 17 All trucking operations, including truck and trailer parking, 18 shall be limited to the lot located at 2901 Sunol Drive in the 19 City of Vernon. 20 b. All parking and loading facilities shall be paved 21 with a hard durable surface material and shall be adequately 22 drained, and kept free. of dust, mud, trash and weeds. Where 23 parking or maneuvering areas adjoin the public street a barrier 24 wall or landscaping shall be installed and maintained to meet 25 City standards. Adequate on -site parking shall be maintained so 26 that no on -street parking will occur. 27 c. No servicing of vehicles including washing, steam 28 cleaning and repairing shall be performed on the facility unless 1 conducted in compliance with appropriate codes, rules and 2 regulations. 3 d. A National Pollutant Discharge Elimination System 4 Permit shall be obtained from the California State Board of 5 Water Resources, if required. 6 e. No equipment or freight shall be stored on the 7 site, other than in buildings, trailers or on the docks. 8 f. Adequate plans and materials must be available for 9 handling leaks or spills from vehicles during storage or 10 transportation. 11 g. All required federal, state, local and regulatory 12 agency permits shall be obtained prior to operation. Prior to 13 occupancy a business license and occupancy permit shall be 14 obtained. 15 h. A hazardous materials inventory and 16 business/contingency plan shall be submitted and a hazardous 17 materials permit shall be obtained from the City of Vernon 18 Health Department. Hazardous materials/waste shall be handled 19 and managed in compliance with all appropriate federal, state 20 and local laws. 21 i. The facility shall be operated in a manner that 22 will prevent unsanitary conditions, odors or other nuisances. 23 The property shall be provided with adequate refuse containers 24 and refuse disposal service. 25 j. The facility's building shall be structurally 26 maintained to exclude rodents and the property shall be 27 maintained rodent free. 28 k. All existing cracked sidewalk, curb and gutter adjacent to the site in Sunol Drive shall be repaired and maintained to meet City Standards. m. The site shall not generate more than 20 truck trips (10 inbound and 10 outbound) and 20 automobile trips (10 inbound and 10 outbound) per day. n. Any change in ownership or occupancy at 2901 Sunol Drive will require a new conditional use permit. SECTION 4: Hernandez Trucking and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. Hernandez Trucking is a trucking company providing pick-up and delivery services utilizing flat bed trucks to haul and temporarily store steel and machinery. The owner of the property, Joseph T. Ryerson & Sons, Inc. has consented to Hernandez Trucking's Application. BACKGROUND 2901 Sunol Drive has historically been used as a truck facility and is a conforming use in the M-2 Zone. The proposed site was previously occupied by Thermo King. GENERAL PLAN The proposed use is in accordance with the General Plan. The site is located in the M-2 Zone, Heavy Industry. A truck and freight terminal is a conforming use in the M-2 Zone, allowed with a conditional use permit. SITE The proposed lot is approximately 4.08 acres and contains -1- two buildings. Hernandez Trucking will occupy the most westerly 4900 square foot building for office use. The size, shape, topography and drainage of the facility is adequate for the proposed operation. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts on traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to result from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared. ACCESS There is one driveway adjoining the property on Sunol Drive. Sunol Drive is 60 feet wide and is of adequate size to handle the traffic generated from the proposed operation. Sunol Drive is built out to the Master Plan of Street Widths dated June 16, 1992. VEHICLE MOVEMENTS Hernandez Trucking will operate 7 trucks out of the facility. Operations will be from 5:00 a.m. to 8:00 p.m. Monday to Friday. Trucks traveling to the site will travel from the I- 710 freeway, exiting onto Bandini Boulevard in the westbound direction to Sunol Drive, thence south on Sunol Drive to the subject site. Trucks exiting the site will travel east and north -2- , on Ayers Avenue, thence east on Bandini Boulevard to the I-710 freeway. The site will generate 14 daily truck trips (7 inbound and 7 outbound). The facility has 7 employees that access the site per day (7 inbound and 7 outbound). The site has ample room to provide adequate off-street parking and loading facilities. The previous occupant operated a much larger fleet of trucks. There are no expected impacts from the proposed vehicular movements. To provide for growth the City is proposing to place a condition limiting the number of truck movements to 20 (10 inbound and 10 outbound) and 20 automobile trips (10 inbound and 10 outbound). This additional traffic will not create any adverse effects on the environment. OPERATIONS Hernandez Trucking will use the facility as their operational head quarters to operate a truck and freight terminal. Hernandez Trucking's business is the flatbed hauling of steel and machinery. All maintenance and washing of vehicles on -site shall be permitted if in compliance with the Federal, State, and Local government rules, policies and procedures. STATE OR FEDERAL CONDITIONS All Federal, State and local regulatory permits shall be obtained as required for the operation. They propose to operate a truck and freight terminal at 2901 Sunol Drive. The project is subject to the California Environmental Quality Act (CEQA) but is categorically exempt under CEQA Guidelines Section 15301, because it is an existing use. A Notice of Exemption will be filed. It is recommended that a public hearing for this conditional use permit be held on March 21, 2001.
