A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO UNITED-S-
TRANSFER FOR THE OPERATION OF A TRUCKING
AND FREIGHT TERMINAL AT 2043 ROSS STREET
WHEREAS, United-S-Transfer has applied for a
conditional,use permit to operate a trucking and freight
terminal at 2043 Ross Street in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a conditional use permit on
March 21, 2001; and
WHEREAS, the proposed site is a legal conforming use
In the General Industry (M) Zone which has been continuously
used as a truck terminal previously operated by Pacific Arrow
Express and which requires a conditional use permit under the
Zoning Ordinance in order to continue the use; and
WHEREAS, the proposed operation will include the
hauling and temporary storage of general products; and
WHEREAS, the proposed site is approximately 1.12 acres
in size, and is adequate in size, shape and topography for the
proposed operation and has adequate drainage; and
WHEREAS, a barrier wall or landscaping has been
installed where parking or maneuvering area adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by industrial
uses compatible with the proposed use and no adverse effects
from traffic, parking, noise, odors, dust, smoke, light or

glare, or risk of fire, infection or explosion is anticipated
from the proposed operation; and
WHEREAS, the site has access to Ross Street and
traffic will generally travel from the site on Ross Street to
either 37th Street or Alameda Street, thence either north to the
I-10 Freeway or east on 37th Street to the I-710 Freeway. The
streets to be utilized within the City of Vernon are sufficient
to handle the traffic generated from the proposed operations;
and
WHEREAS, the site, as proposed, has ample room on -site
to provide adequate off-street parking and loading facilities as
required by the Vernon City Code; and
WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the proposed use, as to location, operation
and design is consistent with the General Plan and zoning
Ordinance of the City of Vernon; and
WHEREAS, the project is categorically exempt from the
California Environmental Quality Act as an existing facility
pursuant to Section 15301 of the California Environmental
Quality Act Guidelines and a Notice of Exemption shall be filed
with the County. Clerk pursuant to Section 15062 of the
California Environmental Quality Act Guidelines; and
WHEREAS, the City Council has received a Staff Report,
dated March 14, 2001 upon which it has relied in making the
foregoing recitals, and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: Subject to the conditions set forth
below, the conditional use permit is hereby granted to United-S-
Transfer for the operation of a trucking and freight terminal at
2043 Ross Street.
SECTION 3: In order to adequately protect the
public health and general welfare the following conditions are
required:
a. The facility shall be operated in accordance with,
and made to conform with all current codes, rules, regulations,
and subject to permit fees as adopted by the City of Vernon.
All trucking operations, including truck and trailer parking,
shall be limited to the lot located at 2043 Ross Street in the
City of Vernon.
b. The owner of the property shall provide to the City
of Vernon a utility easement for the overhead power lines which
are located on the property in a form and manner subject to
approval of the Director of Community Services and Water.
c. All parking and loading facilities shall be paved
with a hard durable surface material and shall be adequately
drained, and kept free of dust, mud, trash and weeds. Where
parking or maneuvering areas adjoin the public street a barrier
wall or landscaping shall be installed and maintained to meet
City standards. Adequate on -site parking shall be maintained so

1 that no on -street parking will occur.
2 d. No servicing of vehicles including washing, steam
3 cleaning and repairing shall be performed on the facility unless
4 conducted in compliance with appropriate codes, rules and
5 regulations.
6 e. A National Pollutant Discharge Elimination System
7 Permit shall be obtained from the California State Board of
8 Water Resources, if required.
9 f. No equipment or freight shall be stored on the
10 site, other than in buildings, trailers or on the docks.
11 g. Adequate plans and materials must be available for
12 handling leaks or spills from vehicles during storage or
13 transportation.
14 h. All required federal, state, local and regulatory
15 agency permits shall be obtained prior to operation. Prior to
16 occupancy a business license and occupancy permit shall be
17 obtained.
18 i. A hazardous materials inventory and
19 business/contingency plan shall be submitted and a hazardous
20 materials permit shall be obtained from the City of Vernon
21 Health Department. Hazardous materials/waste shall be handled
22 and managed in compliance with all appropriate federal, state
23 and local laws.
24 j. The facility shall be operated in a manner that
25 will prevent unsanitary conditions, odors or other nuisances.
26 The property shall be provided with adequate refuse containers
27 and refuse disposal service.
28 k. The facility's building shall be structurally

(maintained to exclude rodents and the property shall be
maintained rodent free.
1. The facility shall be operated in a manner which
twill not impede traffic on Ross Street.
m. All existing cracked sidewalk, curb and gutter
adjacent to the site in Ross Street shall be repaired and
maintained to meet City Standards.
n. The site shall not generate more than 50 truck
trips (25 inbound and 25 outbound) and 50 automobile trips (25
inbound and 25 outbound) per day.
o. Any change in ownership or occupancy at 2043 Ross
Street will require a new conditional use permit.
SECTION 4: United-S-Transfer and any successors in
interest shall indemnify, hold harmless, and defend the City of
Vernon, its officers, agents, and employees from and against any
and all claims, complaints, or petitions for: (1) damages,
losses, expanses resulting from bodily injury, sickness,
disease, disability or death arising from the operation of the
facility excluding therefrom any such claim of the City of
Vernon, its officers, agents or employees; (2) a peremptory
writ or other relief by way of injunction, mandamus, or
administrative mandamus; or (3) legal expenses and attorney's
fees incurred by the City of Vernon on behalf of any party in
such actions or proceedings. The City of Vernon does not waive
its right to participate in the defense of any such action.
SECTION 5: Not later than sixty (60) days from the
date of this Resolution United-S-Transfer, shall indicate, in
writing, its acceptance of and agreement with the conditions

1 contained in Section 3 of this Resolution and the
2 indemnification provision contained in Section 4 of the
3 Resolution.
4 SECTION 6: The City Clerk of the City of Vernon
5 shall certify to the passage of this resolution and thereupon
6 and thereafter the same shall be in full force and effect.

United-S-Transfer has applied for a conditional use permit
to operate a truck and freight terminal at 2043 Ross Street in
the City of Vernon.
After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:
1. Staff Report.
2. Request for conditional use permit and information
supporting the application.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
The project is categorically exempt from the California
Environmental Quality Act because it is an existing facility with
no expansion of use as defined in Section 15301. A Notice of
Exemption will be prepared. In my opinion the proposed operation
will pose no adverse effects to the City of Vernon and will have
no significant effects on the environment.

The project is consistent with the General Plan as adopted
by the City of Vernon.
Therefore, it is recommended that the City Council
determine:
1. That the project is consistent with the General Plan as
adopted by the City of Vernon.
2. That the project will not have a significant effect on

3. That the project will not individually or cumulatively
have an adverse effect on wildlife resources.
Further it is recommended that the conditional use permit be
granted subject to the following conditions:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations, and

trucking operations, including truck and trailer parking, shall
be limited to the lot located at 2043 Ross Street in the City of

TO OPERATE A TRUCK AND FREIGHT TERMINAL
AT 2043 ROSS STREET
(March 14, 2001)
RECOMMENDATION
The Department of Community Services recommends that a
conditional use permit allowing United-S-Transfer to operate a
truck and freight terminal at 2043 Ross Street be approved by the
City Council of the City of Vernon. United-S-Transfer is a
trucking company providing pick-up and delivery services of a
wide range of items. The owner of the property, Los Angeles By -
Products Company has consented to United-S-Transfer's
Application.
BACKGROUND
2043 Ross Street has historically been used as truck
terminal and the site has maintained its legal non -conforming
status. The site was previously occupied by Pacific Arrow
Express who was granted a Conditional Use Permit pursuant to
Resolution 7573 approved July 11, 2000 to relocate its truck and
freight terminal from 2043 Ross Street to 2860 Alameda Street.
GENERAL PLAN
The proposed use is in accordance with the General Plan.
The site is located in the M Zone, General Industry. A truck
terminal is a non -conforming use in the M Zone. However, because
it is a pre-existing terminal, the non -conforming use may be

continued provided that it does not expand as specified in
Section 26.4.6-1. The Comprehensive Zoning Ordinance Section
26.5.2-11, Existing Uses, states that such a use may continue
with approval of a conditional use permit when the occupant is
issued a new occupancy permit.
SITE
The proposed lot is approximately 1.12 acres and contains
one warehouse/office building, one maintenance building and one
storage shack. The size, shape, topography and drainage of the
facility is adequate for the proposed operation. A barrier wall
or landscaping has been installed where the parking and
maneuvering area adjoins a public street.
ADVERSE EFFECT
The proposed site is surrounded by industrial uses
compatible with the proposed use. No potentially significant
impacts on traffic, parking, noise, odors, dust, smoke, light or
glare, or risk of fire, infection or explosion are expected to
result from the project.The project is categorically exempt
under Section 15301 of the California Environmental Quality Act
because it is an existing facility with no expansion of use. A
Notice of Exemption will be prepared.
ACCESS
There are two driveways adjoining the property on Ross
Street that measure 38 and 49 feet in width respectively from
west to east. Trucks may enter and exit from both driveways.
Ross Street is 60 feet wide respectively and is of adequate size

to handle the traffic generated from the proposed operation.
Ross Street is built out to the Master Plan of Street Widths
dated June 16, 1992.
VEHICLE MOVEMENTS
United-S-Transfer will operate 20 trucks out of the facility
consisting of 2 bobtails and 18 vans. Operations will be from
2:00 a.m. to 11:59 p.m. Monday to Friday. The trucks traveling
from the west or north will use the I-10 freeway, exit South on
Alameda Street to Ross Street and to the site. Trucks traveling
from the south and east will use the I-710 freeway, exit East on
Bandini Boulevard and proceed to 37th Street, Ross Street and
then to the site. The trucks will follow the same route when
exiting the site. The site will generate 40 daily truck trips (20
inbound and 20 outbound). The facility has 19 employees that
access the site per day (19 inbound and 19 outbound). The site
has ample room to provide adequate off-street parking and loading
facilities.
The previous occupant Pacific Arrow Express operated 40
trucks out of the site per day. The proposed occupant will
operate 20 trucks out of the site per day. There are no expected
impacts from the proposed move.
To provide for growth the City is proposing to place a
condition limiting the number of truck movements to 50 (25
inbound and 25 outbound) and 50 automobile trips (25 inbound and
25 outbound). This additional traffic will not create any
adverse effects on the environment.

OPERATIONS
United-S-Transfer will use the facility as their operational
head quarters to operate a truck and freight terminal. All
maintenance and washing of vehicles on -site shall be permitted if
in compliance with the Federal, State, and Local government
rules, policies and procedures.
STATE OR FEDERAL CONDITIONS
All Federal, State, and local regulatory permits shall be
obtained as required for the operation.
CONDITIONS

2043 ROSS STREET
United-S-Transfer has submitted an application for
conditional use permit. They propose to operate a truck and
freight terminal at 2043 Ross Street.
The project is subject to the California Environmental
Quality Act (CEQA) but is categorically exempt under CEQA
Guidelines Section 15301, because it is an existing use. A
Notice of Exemption will be filed.
It is recommended that a public hearing for this conditional
use permit be held on March 21, 2001.

The purpose of the hearing is to obtain testimony from
