RESOLUTION NO. 7755
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 7062 WHICH PROVIDED
FOR THE ESTABLISHMENT OF ELECTRICAL RATES TO BE
CHARGED FOR ELECTRICAL ENERGY DISTRIBUTED AND
SUPPLIED BY SAID CITY WITHIN ITS BOUNDARIES BY
ADDING NEW RATE SCHEDULE NO. CONSERVATION 20/20
WHEREAS, on May 16, 1995, the City Council of the City of
Vernon adopted Ordinance No. 1030 providing that rates to be charged
for electrical energy distributed and supplied by the City within its
boundaries shall be set by resolution; and
WHEREAS, on December 16, 1997, the City Council of the City
of Vernon adopted Resolution No. 7062, providing for the establishment
of electrical rates to be charged for electrical energy distributed
and supplied by the City within its boundaries; and
WHEREAS, Governor Gray Davis recently issued Executive Order
D-30-01 providing for a credit to customers (of the three investor -
owned utilities) of up to twenty percent (200) for reducing
electricity consumption by at least twenty percent (200) during the
period from June 1, 2001 to September 30, 2001; and
WHEREAS, the City of Vernon desires to establish a similar
conservation reward program providing credits in the range of five
percent (5%) to twenty percent (20%) (demand and energy only) for
customers who reduce their energy use by at least ten percent (100)
for the four billing periods commencing May 20, 2001 compared to the
prior year for the same period; and
WHEREAS, by letter dated April 26, 2001, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that the City
approve adding a "Conservation 20/20" tariff to the City's rates for

the distribution of electrical energy supplied by the City; and
WHEREAS, the City Council of the City of Vernon desires to
add a new Schedule No. Conservation 20/20 to the City's rates for the
distribution of electrical energy supplied by the City in order to
establish a limited -term rate reward for conservation efforts.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: The City Council of the City of Vernon hereby
adopts, as the City's rates, terms and conditions for the distribution
of the electrical energy supplied by the City of Vernon, Rate Schedule
No. Conservation 20/20, a copy of which is attached hereto as Exhibit
"A" and made a part hereof, to be effective May 3, 2001.
SECTION 3: Any provisions contained in Resolution No. 7062
snot consistent with or in conflict with this resolution are hereby
repealed. In all other respects, Resolution No. 7062 shall remain in
full force and effect.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

APPLICABILITY
Applicable to all customers taking service under existing rate schedules who have kilowatt-hour
meters and meet the requirements listed below.
1. Customer must reduce its energy usage by at least ten percent from the same period usage
in year 2000.
2. Customer must have been taking service for the last thirteen consecutive months.

will be applied to the customer's bill in the subsequent month.

Schedule Conservation 20/20 (coot.)
1. Customers who participate in the Demand Relief program will not receive credit for energy
reduction associated with the program. In order to determine eligibility for load reduction
credit, the amount of energy reduction associated with the program is added to the
customer's current period energy usage.
2. Customers who have multiple meters will not receive credit for energy reduction at a meter
if such reduction results in an energy increase at another meter(s).
ELIGIBILITY
Load reduction credit eligibility shall be based on a load ratio (LR) determined by dividing the
average daily energy usage in the current period by the average daily energy usage for the same
period in year 2000. Customers who achieve a load ratio of nine -tenth (0.9) or smaller are eligible
to receive energy and demand credit. The following shall determine the load ratio.
LR = (kWh2oo,/Billing Days2w1) / (kWh2000/Billing Days2w)
Where; kWh2001 is the energy usage for the current month, and if applicable,
increased by load reduction associated with the Demand Relief program.
Billing Days2001 is the number of days in the current billing period. Kwh2 w is
the energy usage for the prior year billing period. Billing Days2M is the
number of days for the prior year billing period.
