FROM SECTION 26.4.2-8(c), DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2615 SANTA FE AVENUE IN THE CITY OF VERNON WHEREAS, Vernon Management Company, Inc. (hereinafter referred to as "Vernon Management") owns a parcel of property located at 2615 Santa Fe Avenue in the City of Vernon and is requesting a variance from Section 26.4.2-8 (c), Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, the Property is located in the CM -Zone; and WHEREAS, there is a structure presently situated on the Property that is partially unoccupied due to the occurrence of a fire that resulted in damage to the structure; and WHEREAS, Vernon Management intends to demolish the exiting structure; and WHEREAS, Vernon Management has submitted a site plan which depicts the proposed development of the Property to the City for consideration and approval; and WHEREAS, the physical condition of the Property is unique in that it is a long and narrow parcel, measuring approximately 665 feet in length and 100 feet in width; and WHEREAS, the proposed use for the site will be a 35,318 square foot warehouse; and WHEREAS, the site plan shows a parcel that is rectangular, tapering off at the back of the parcel to a point 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 Um 19 20 21 22 23 24 25 26 27 28 land almost forming a triangle; and WHEREAS, the front of the parcel, according to the site plan, shows a parking area, followed by a four warehouse units, with an equipment area in the back triangular section of the parcel; and WHEREAS, the proposed development will include two loading docks, each measuring 48 feet in width, with eight 40 foot long truck loading and parking spaces and a 40 foot maneuvering area adjacent to the loading docks; WHEREAS, the loading docks will accommodate eight Itrucks; and WHEREAS, Section 26.4.E-4(b) of the Zoning Ordinance provides, in part, that where insufficient space exists on a lot or parcel for compliance with the off-street parking and access requirements for this chapter, compliance shall occur at the time of expansion or structural alteration of the building or buildings or,by August 19, 2009, whichever occurs first; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies that all truck loading and parking spaces shall be a minimum of 65 feet in length and Section 26.4.2-8 (e) requires a 40 foot unobstructed maneuvering area in front of all loading spaces; and WHEREAS, Vernon Management would not be able to fully develop and improve the Property according to its site plan if it were to comply with the Zoning Ordinances off-street parking, loading and maneuvering requirements; and WHEREAS, pursuant to Section 26,4.E-4(d), the City (Council may relieve an occupant of all or part of the provisions K 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 of the off-street parking, access and loading requirements of the Zoning Ordinance upon making certain requisite findings; ands! WHEREAS, there are only about three other parcels of property in the City that measure 100 feet by 665 feet; and WHEREAS, given the irregular shape of the Property, the strict application of the access and loading requirements of Section 26.4 of the Zoning Ordinance would prevent Vernon Management from developing the Property as a warehouse, thus creating an unreasonable hardship; and WHEREAS, the proposed use will not adversely affect the surrounding area because the site has historically been used for truck storage facility; and WHEREAS, proposed use has the requisite number of parking and loading spaces for a 35,000 square foot building; and WHEREAS, the project is categorically exempt from the California Environmental Quality Act as an in -fill project pursuant to Section 15332 of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 1-5062 of the California Environmental Quality Act Guidelines; and WHEREAS, the City Council has received a Staff Report dated May 16, 2001, upon which it has relied in making the foregoing recitals; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on May 23, 2001. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: A variance from Section 26.4.2-8 (c), of the Comprehensive Zoning Ordinance, requiring sixty-five foot long truck loading and parking spaces is hereby granted to Vernon Management Company, Inc. for the property located at 2615 Santa Fe Avenue. SECTION 3: The variance shall be granted subject to the following conditions: (a) The required number of automobile parking and truck loading and parking spaces must be provided. The minimum length of truck loading or parking space provided shall be 40 feet in length and 10 feet in width. The maximum size truck that may access the site shall be 40 feet in length, including the tractor and trailer. (b) All trucks shall enter and exit the site in front forward manner. (c) The property owner shall be subject to a fine not to exceed $500 for every truck that enters the site that violates the size requirement. (d) A sign with a minimum 3" type shall be posted adjacent to Santa Fe Avenue on both sides of the driveway entrance that states "Maximum Length vehicles allowed in this site is 40 feet in length. All violations aresubjectto a fine not to exceed $500". (e) A covenant shall be recorded prior to construction advising all future property owners that all trucks 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 entering the site are limited to a maximum of 40 feet in length and that any violation of this requirement is subject to a maximum $500,fine. (f) The owner of the property shall provide and maintain, for the City of Vernon, utility easements located on the property in a form and manner subject to approval of the Director of Community Services and Water. (g) This variance shall only be valid while Vernon Management owns the property. A new variance will be required upon the change of ownership or use of the Property. (h) All existing and future tenants shall be notified of these restrictions and a condition stating this shall be placed in all future leases. (i) The project shall be constructed substantially in accordance with the site plan submitted as part of the variance application. No changes shall be made in the site development, except with the prior approval of the Director of Community Services. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of Zoning Ordinance Section 26.4.2-8 (c) and the size requirements. They are requesting a variance from the Comprehensive Zoning Ordinance, Section 26.4.2-8 (c), for a proposed building to be constructed at 2615 Santa Fe Avenue. The proposed building is 35,318 square foot in size with 40- foot truck loading and parking spaces. Section 26.4.2-8 (c) of the City Code requires all truck loading and parking spaces to be 65 feet in length. The project is categorically exempt from the California Environmental Quality Act due to it being an in -fill project, as defined in Section 15332 of the guidelines. A Notice of Exemption will be prepared. Submitted herewith are the following documents: 1. Application for variance. 2. Affidavits of posting and mailing. 3. Notice of public hearing. 4. Staff report. (hereinafter referred to as "Vernon Management") owns a parcel of property located at 2615 Santa Fe Avenue in the City of Vernon (hereinafter referred to as "the Property"). Dynamic Builders, Inc., on behalf of Vernon Management submitted an application to the City seeking a variance from the Comprehensive Zoning Ordinance Section 26.4.2-8 (c), Development Standards. The Property is approximately 1.38 acres and is an irregular shape being approximately 665 feet deep by 100 feet wide. The Property is located in the CM Zone. There are only about three other parcels in the City that have the same dimensions as the Property. Presently, the Property is unproductive property in that an partially occupied structure is situated on it. This structure was damaged in a fire. Vernon Management is proposing to demolish the existing structure and construct a new 35,318 square foot building on the Property. The site plan submitted by Vernon Management shows not only the long and narrow irregular shape of the Property but also the parking areas, buildings and loading areas to be constructed. The parcel is rectangular in shape at the front and tapers off at the back to a point, almost forming a triangle. A parking area will be at the front of the Property, followed by four warehouse units, and operating equipment will be located in the triangular section of the Property. The proposed development will include two loading docks, each measuring 48 feet in width, with eight 40 foot long truck loading and parking spaces and a 40 foot wide maneuvering area. Vernon Management has indicated that due to the odd shape of the lot that it would be unable to develop the subject parcel with an industrial building as it is zoned and that the requirements of Section 26.4.2-8 (c) creates a hardship on the usefulness of the parcel. Vernon Management proposes to acquire a portion of a vacant railroad right-of-way adjoining the Property. The additional 17 foot wide strip will allow additional room for maneuvering. A plot plan of the proposed development is shown on Exhibit "A", a true and correct copy of which is attached hereto and incorporated by reference. According to Section 26.4.E-4(b) of the Zoning Ordinance, where insufficient space exists on a lot or parcel for compliance with the off-street parking and access requirements for this chapter, compliance shall occur at the time of expansion or structural alteration of the building or buildings or by August 19, 2009, whichever occurs first. Zoning Ordinance Section 26.4.2-8 (c) specifies that all truck loading and parking spaces shall be a minimum of 65 feet in length and Section 26.4.2-8 (e) requires a 40 foot unobstructed maneuvering area in front of all loading spaces. However Section 26.4.2-9, Optional Exceptions to Development Standards For Truck Parking and -2- Loading, of the Comprehensive Zoning Ordinance allows a parcel containing a building no larger than 12,000 square feet in size and utilized for warehouse or industrial use to be constructed with 40 foot long truck loading and parking spaces. This Section requires that a covenant be recorded advising all future owners of the truck length limitations and requires a sign be posted. Vernon Management would not be able to fully develop and improve the Property according to its site plan if it were to comply with the Zoning Ordinances off-street parking, loading and maneuvering requirements. Pursuant to Section 26,4.E-4(d), the City Council may relieve an occupant of all or part of the provisions of the off-street parking, access and loading requirements of the Zoning Ordinance upon making certain requisite findings. Those finding are: (1) that the strict application of the off-street parking, access and loading requirements of this Ordinance creates an unreasonable hardship; (2) the existing use. does and will not adversely affect the surrounding are; and (3) the use does not require the number of spaces and/or area specified by this Ordinance. Given the irregular shape of the property, the strict application of the access and loading requirements of Section 26.4 of the Zoning Ordinance would prevent Vernon Management from developing this parcel as a warehouse, thus creating an unreasonable hardship. In addition, the proposed use will not -3- adversely affect the surrounding area because the site has historically been used as a machine sales and storage facility. Furthermore, the proposed use has the requisite number of parking and loading spaces for a 35,318 square foot building. The project is categorically exempt under Section 15332 of the California Environmental Quality Act because it is an in - fill project. A Notice of Exemption will be prepared. The proposed use is in conformance with the Zoning Ordinance and General Plan. Due to the unique shape of the lot, it is recommended that the variance be granted subject to the following conditions: (a) The required number of automobile parking and truck loading and parking spaces must be provided. The minimum length of truck loading or parking space provided shall be 40 feet in length and 10 feet in width. The maximum size truck that may access the site shall be 40 feet in length, including the tractor and trailer. (b) All trucks shall enter and exit the site in front forward manner. (c) The property owner shall be subject to a fine not to exceed $500 for every truck that enters the site that violates the size requirement. (d) A sign with a minimum 3" type shall be posted adjacent to Santa Fe Avenue on both sides of the driveway entrance that states "Maximum Length vehicles allowed in this site is 40 feet in length. All violations are subject to a fine not to exceed $500". (e) A covenant shall be recorded prior to construction advising all future property owners that all trucks entering the site are limited to a maximum of 40 feet in length and that any violation of this requirement is subject to a maximum $500 fine. (f) The owner of the property shall provide and maintain, for the City of Vernon, utility easements located on the property in a form and manner subject to approval of the Director of Community Services and Water. (g) This variance shall only be valid while Vernon Management owns the property. A new variance will be required upon the change of ownership or use of the Property. (h) All existing and future tenants shall be notified of these restrictions and a condition stating this shall be placed in all future leases. (i) The project shall be constructed substantially in accordance with the site plan submitted as part of the variance application.
