Resolution No. 77831 2 3 4 5 6 7 41 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 0 27 No RESOLUTION NO. 7783 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING THE CLOSURE OF 25TH STREET PURSUANT TO VERNON CITY CODE SECTION 22.100 IN CONNECTION WITH THE CONSTRUCTION OF THE ALAMEDA CORRIDOR WHEREAS, on August 5, 1998, the City of Vernon and the Alameda Corridor Transportation Authority ("ACTA") entered into a Memorandum of Understanding ("MOU") for the Design and Construction of the Alameda Corridor Program; and WHEREAS, the Traffic Management Concept ("TMC") attached to and incorporated in the MOU set forth the requirement for the closure of 25th Street; and WHEREAS, the TMC specifies that 25th Street may be closed, but that a bypass lane must be opened during the closure; and WHEREAS, since August of 2000, ACTA has been constructing the Alameda Corridor within the City; and WHEREAS, beginning on or about September of 2000, 25th Street had been closed periodically; and WHEREAS, a temporary bypass roadway was constructed to allow traffic to travel around the construction site; and WHEREAS, ACTA has been and continues to construct a bridge that will allow traffic on 25th Street to travel over the Alameda Corridor just east of Alameda Street; and WHEREAS, ACTA has notified the City that in order to complete the construction of the 25th Street bridge, both 25th Street and the required bypass lane must be closed to through traffic; and WHEREAS, ACTA has estimated the duration of the street 1 closure to be approximately three (3) weeks; and 2 WHEREAS, ACTA will save time and expense if the closure of 3 25th Street and the bypass lane are permitted; and 4 WHEREAS, the City will be more negatively impacted by the 5 closure of 25th Street and believes that ACTA must mitigate any such 6 negative impacts that will occur; and 7 WHEREAS, the City, in the spirit of cooperation and in order 8 to allow the construction of the Alameda Corridor to continue and be 9 completed as quickly as possible, desires to accommodate ACTA; and 10 WHEREAS, the City does not intend to waive any of its rights 11 to additional mitigation; and 12 WHEREAS, Section 22.100 of the Vernon City Code requires 13 authorization from the City Council for temporary street closures of 14 more than forty-eight (48) hours; and 15 WHEREAS, by letter dated May 31, 2001, Bruce V. Malkenhorst, 16 City Administrator/City Clerk, has recommended that authorization be 17 granted for the closure of 25th Street for the completion of the 25th 18 Street bridge over the Corridor. 19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 20 CITY OF VERNON AS FOLLOWS: 21 SECTION 1: The City Council of the City of Vernon hereby 22 finds and determines that the recitals contained hereinabove are true 23 and correct. 24 SECTION 2: The City Council of the City of Vernon hereby 25 authorizes the Director of Community Services and Water, after 26 approval by the City Administrator and after they have determined that 27 any resulting negative impact will be mitigated by ACTA, to close 25th 28 Street for approximately three (3) weeks for the completion of the 25th 1 1 Street bridge over the Corridor. 2 SECTION 3: The City Clerk of the City of Vernon shall 3 certify to the passage of this resolution, and thereupon and 4 thereafter the same shall be in full force and effect. 5 APPROVED AND ADOPTED this 6th day of June, 2001. 6 7 8 LEONIS C. A temporary bypass roadway was constructed to allow traffic to travel around the construction site. The City has been advised that the temporary bypass must be closed for the completion of the construction. It is estimated that 25th Street will be closed for approximately three (3) weeks; however, local traffic will be allowed to utilize 25th Street, all other traffic will be detoured to 37th Street. In accordance with Section 22.100 of the Vernon Municipal Code requires authorization from the Vernon City Council to allow any street to be temporarily closed for more than 48 hours. It is hereby recommended that authorization be granted for the closure of 25th Street for the completion of the 25th Street bridge over the corridor. BVM/ng Very truly yours, Bruce V. Malkenhorst, City Administrator FROM: Samuel Kevin Wilson, Director of Community Services & Water DATE: May 31, 2001 SUBJECT: STREET CLOSURE The Alameda Corridor Transportation Authority (ACTA) is currently constructing a bridge that will allow 25' Street to travel over the corridor just east of Alameda Street. ACTA's contractor has constructed a temporary bypass roadway to allow traffic to travel around the construction site. ACTA has now advised the City that the temporary roadway must be closed in order to allow the contractor to complete the utility relocations and to complete the roadway improvements. They estimate that 25`h Street will be required to be completely closed for approximately 3 weeks. The Vernon-ACTA Memorandum of Understanding does not allow the complete closure of 25t` Street. ACTA's contractor proposes to allow local traffic to utilize 25'' Street. All other traffic will be detoured to 37`h Street. I am of the opinion that 25' Street must be closed in order to complete the construction unless additional private property is taken for construction easements. Section 22.100 of the Vernon Municipal Code requires authorization from the Vernon City Council to allow any street to be temporarily closed for more than 48 hours. It is recommended that the Vernon City Council authorize ACTA's closure of 256' Street for the completion of the 25"' Street bridge over the corridor.
