FOR THE OPERATION OF A SALVAGE YARD FACILITY AT 3800 EAST 26TH STREET IN CITY OF VERNON WHEREAS, Multi -Link International Corp.("Multi-Link") has applied for a conditional use permit to operate a business at 3800 East 26�h Street; and WHEREAS, the City Council of the City of Vernon held a'', hearing on said application for a conditional use permit on June'. 20, 2001; and WHEREAS, Multi -Link will purchase used plastic, which it will then grind and bail; and WHEREAS, the bailed plastic will be stored then resold and shipped to purchasers who will in turn, process the plastic into raw materials for recycled products; and WHEREAS, Multi -Link will not be processing the plastic materials in order to convert it into a raw product for redistribution; and WHEREAS, given the nature of Multi -Link business operation, it would not be classified as recycled materials processing facility (Vernon City Code Section 26.2.14), but instead falls under the definition of a salvage yard (Vernon City Code Section 26.2.15) for zoning purposes only; WHEREAS, the proposed site is in the (R) Overlay District of the M-2 Zone, Heavy Industrial. Pursuant to Section 26.3.9-3 (c) of the Comprehensive Zoning Ordinance, a salvage yard is allowed in the (R) Overlay District of the M-2 Zone, 1 1 2 3 4 5. 6. 7 8 9. 10 11 12 13 14 15, 16; 17 18 19. 20 21 22 23 24 25, 2 6; 27 28 with approval of a conditional use permit; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, has adequate drainage, and landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has access to 26th Street, a collector roadway with a right-of-way of 60 feet. The streets and highways surrounding the proposed use are adequate in width. And are improved as necessary to carry the traffic expected by This proposed operation; and WHEREAS, the Community Services Department has performed an Initial Study dated May 7, 2001, to determine whether the proposed project will have adverse impacts on the environment and has determined that the proposed project will not have a significant adverse effect on the environment, and the Director of Community Services & Water has recommended that a Negative Declaration be adopted in compliance with the California Environmental Quality Act; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, paring, noise orders, dust smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and 2 1 2 3 4 5 6 7 s 9 10 !, 11 12 13 14 15 16 17 18 19 20 21 22 I!, 23 24 25 26 27 28 WHEREAS, the City of Vernon has provided notice of its intent to adopt a Negative Declaration for the proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon with approval of a conditional use permit; and WHEREAS, the project will require an initial study to determine any environmental impacts as required by the California Environmental Quality Act CEQA; and WHEREAS, the City Council has received a Staff Report dated May 7, 2001 upon which it has relied on making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein - above are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Multi -Link International Corp. for the operation of a salvage yard at 3800 East 26th Street. 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. b. Any hazardous substances used, handled or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. C. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. d. In accordance with National Pollutant Discharge Elimination System permit regulations, Multi -Link shall submit a Notice of Intent to the State Water Resources Control Board and shall prepare a prevention plan and monitoring program within the Board's time limitations. e. All processing and storage operations shall take place within the existing buildings. No equipment or materials shall be stored outside with the exception of pallets or materials stored within tankers or trailers. Adequate written plans and materials must be available for cleaning up leaks or spills of plastic materials or other substances associated with Multi-Link's operation. f. Broken or cracked sidewalk, curb, gutter or driveway in 26TH Street adjacent to the site shall be repaired as directed by the Director of Community Services and Water. 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 g. The entire site shall have a neat and clean appearance and shall be kept free of dust, mud, weeds and trash. The site and surrounding area shall be kept free of all plastic materials associated with Multi-Link's operations including but not limited to raw materials, recycled materials, finished product, pellets and waste material. h. Waste water generated by the plant operations must be contained for proper disposal and shall not be discharged onto the ground surface. i. The facility shall meet the requirements of any regulations adopted pursuant to Public Resources Code, Section 43209 and the requirements of any other applicable sections of the California Integrated Waste Management Act of 1989 (Public Resources Code, Section 40000, et. Seq.). j. Multi -Link shall obtain all required federal, state, local and regulatory agency permits prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. k. Multi -Link shall maintain records that include the amount of waste processed and the name and location of the company that produced it, of all plastics processed at this facility so that it may be determined what plastics are collected within the City of Vernon. 1. The proponent shall submit an annual report to the Environmental Health Department on diversion and disposal tonages. M. All parking and loading facilities shall remain paved with a hard durable surface material in good repair and 5 1 2 _3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 shall remain adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on - site parking shall be maintained so that no on -street parking will occur. n. A system shall be established to drain the site to a clarifier with a rain water diversion valve prior to the discharge to the storm drain. The on -site storm drain shall be protected from unauthorized discharge of wastewater. o. The building shall be repaired so as to prevent the entrance of rodents. SECTION 4: Noncompliance with the conditions set forth in the conditional use permit shall be grounds for voiding the permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning Ordinance. SECTION 5: Multi -Link International Corp. and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the gross negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney°s fees incurred by the City of Vernon on behalf of any party in 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 6: Not later than sixty (60) days from the date of this Resolution, Multi -Link International Corp. shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 5 of the Resolution. SECTION 7: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. CONDITIONAL USE PERMIT TO OPERATE A SALVAGE YARD FACILITY AT 3800 EAST 26TH STREET (NAY 7, 2001) Multi -Link International Corp. has submitted an application for a conditional use permit to operate a salvage yard located at 3800 East 26th Street. The site was previously occupied by Command Packaging LLC., a plastic bag processing facility. The proposed use will be storing and processing scrap plastic materials and operates from 8:00 a.m. to 5:00 p.m. Monday through Friday. 1. GENERAL PLAN The proposed use is consistent with the Zoning Ordinance and General Plan. The site is located in the (R) Overlay District of the M-2 Zone, Heavy Industry. In accordance with section 26.2.9 of the Comprehensive Zoning Ordinance, Multi - Link is categorized as salvage yard facility. A salvage yard facility is defined as a facility receiving solid wastes, temporarily storing or sorting the materials in the solid wastes, transferring the solid wastes directly from smaller to lager vehicles for transport. Any business dealing in selling or buying for resale of recycled materials, such as scrap metals, paper, plastics or comparable matter, but shall not include a yard ancillary to an industrial use. A salvage yard is an allowed use in the (R) Overlay District of the M-2 Zone with approval of a 1 Staff Report.wpd conditional use permit. Multi -Link intends to store baling and sorting of post-industrial and post -commercial plastic scraps, which are later resold to target customers for further processing to create a finished product. Since Multi -Link does not convert the plastic material into a raw product it does not fall within the classification of a recycled processing facility. Pursuant to section 26.2.14 of the Comprehensive Zoning Ordinance, a recycled material processing facility is defined as, a facility which processes recycled materials in order to convert and redistribute them as raw materials for recycled products or in order to convert them and manufacture a product made wholly or partly from recycled materials. However, a recycled material processing facility shall not include a use ancillary to an industrial use. 2. SITE The proposed operation site contains a 169,500 square feet building, which 34,500 square feet will be occupied by the proposed applicant. The applicant has not proposed any changes to the size, shape or topography of the existing site. The site plans for the proposed operation indicates the site is adequate in size, shape, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed use is surrounded by properties with industrial uses that are compatible. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to 2 Staff Report.wpd occur to the adjacent of abutting properties. It is recommended that a Negative Declaration be adopted for the project. The project is exempt from the Standard Urban Storm Water Mitigation Plan Requirements. 4. ACCESS The site has three driveways located on 26th Street, two on the westerly side and one on the easterly side of the property. Multi -Link will primarily use the western driveways. The streets and highways surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. The subject site is served by 26th Street, a collector roadway with a right-of-way of 60 feet. 5. VEHICLE MOVEMENTS The number of truck trips for the purpose of ingress/egress combined, on daily basis (Monday through Friday), will consist of (20) twenty trips. The number of personal vehicle trips will consist of additional 24 ingress/egress Daily trips. Vehicles traveling to the site will generally exit the I-710 and travel westbound to Bonnie Place, then northbound to 26th Street, and then westbound on 26th Street to the site. Vehicles exiting the site will utilize the same streets in the opposite direction. The normal hours of operation of the salvage yard Facility will be from 8:OO a.m. to 5:00 p.m., Monday through Friday. 3 Staff Report.wpd 6. OPERATIONS Multi -Link proposes to operate a business that will purchase used plastic. They intend to store bale, grind and sort post-industrial and post -commercial plastic scraps. The plastic scraps will be sold to target customers for further processing into raw product for recycling. The number of employees on site will consist of 12 persons, and the hours of operation will be from 8:00 a.m. to 5:00 p.m. Monday through Friday. 7. Building standards will, at a minimum, conform to the building requirements of applicable codes and ordinances. The project site is not located near any environmentally sensitive sites. The project is not in conflict with any environmental plans or policies. c) Affect agricultural resources or operations (e.g. impacts to soils or farmlands, or impacts from incompatible land uses)? ❑ ❑ ❑ X c. The City of Vernon is an industrial city with no agricultural land use within its boundaries. The nearest residential unit is approximately 3,100 feet southwest of the project's boundary. The project site is 169,500 square foot building of which Multi -Link International Corporation has occupied, consisting of 34,500 square feet of office and warehousing space. The project has no residential units on it that will be affected by the proposed use. The proposed site will not impact any residents. The site is surrounded by compatible uses and will not disrupt or divide the physical arrangement of any established communities. H. POPULATION AND HOUSING. The population of the City of Vernon is approximately 90, with up to 50,000 people working in the City. The proposed Salvage Yard will consist of approximately 12 employees at the site in an 8 hour period. Upon completion of the proposed Salvage Yard the applicant proposes to keep the same number of employees working at the site in that 8 hour period. Therefore, there will be no impact to population or housing. c) Displace existing housing, especially affordable -3- housing? ❑ 0 0 X e. No housing currently exist on the proposed project site. Thus, the project will not displace housing. M. GEOPHYSICAL. There will not be any significant changes to the geologic substructure or topography. IV. The site for the proposed conditional use is adequate in size and shape including drainage and landscaping to accommodate development features as required by zoning code. An initial study was preformed as part of this project, which studied the affects of water quality impact. Alteration of surface water quality is unlikely. All businesses will be required to obtain a National Pollution Discharge Elimination System (NPDES) permit, if required. There are no surface water bodies within the vicinity of the project. No changes in water currents or water movements will occur. There will be no impacts on the direction or rate of flow of groundwater and no impact on its quality. The City of Vernon is the primary water service provider in Vernon. Therefore, there will be no substantial increase in public water demand and no reduction in the demand for groundwater. -4- V AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ ❑ X ❑ a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District (SCAQMD) at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. b) Expose sensitive receptors to pollutants? ❑ ❑ ❑ X b, The project as proposed will not cause an impact to these sensitive receptors. c) Alter air movement, moisture, or temperature, or cause any change in climate? ❑ ❑ ❑ X c. The proposed project will create no unusual conditions which could alter air movement, moisture, temperature, or climate. d) Create objectionable odors? ❑ ❑ ❑ X d. The proposed project will not create objectionable odors and thus there will be clearly no significant environmental impact. VI. TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? ❑ ❑ ❑ X a. Several freeways serve Vernon. To the north is the Santa Ana (1-5), Santa Monica (1-10) and the Hollywood (1-101) freeways, to the west is the Harbor Freeway (1-110), and to the east is the Long Beach Freeway (1-710). -Vernon has several arterials which bisect the City. The streets surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. The subject site is served by 26's Street, a collector roadway with a right-of-way of 60 feet. Therefore, there will be no impact on transportation during operation due to increased traffic trips. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. No safety hazard resulting from incompatible uses are expected. c) Inadequate emergency access or access to nearby uses? ❑ ❑ ❑ X c. The proposed site will include emergency access and access to nearby uses, as required by the City. -5- d) Insufficient parking capacity on -site or off -site? ❑ ❑ ❑ 1 X d. According to the Comprehensive Zoning Ordinance the proposed Salvage Yard will exceed the parking requirements defined in the zoning code. A total of eleven (11) truck loading spaces, six (6) truck parking spaces and 182 automobile parking spaces are provided for the site. e) Hazards or barriers for pedestrians or bicyclists? ❑ 0 ❑ X f) Conflicts with adopted policies supporting alternative transportation (e.g. bus turnouts, bicycle racks)? ❑ ❑ ❑ X g) Rail, waterborne or air traffic impacts? ❑ ❑ ❑ X e through g. The energy used by this operation will not be substantial. There will be no impact to the City of Vernon Utilities Department. Therefore, the impact will be less than significant. IX. HAZARDS. Would the proposal involve: a) A risk of accidental explosion or release of hazardous substances (including, but not limited to oil, Pesticides, chemicals or radiation)? ❑ ❑ ❑ X b) Possible interference with an emergency response plan or emergency evacuation plan? ❑ ❑ ❑ X c) The creation of any health hazard or potential health hazard? Use and storage of hazardous materials at any facility within the City of Vernon is regulated by the local Certified Unified Program Agency (CUPA) which is the City of Vernon Environmental Health Department. All facilities within the City are regularly inspected by the Vernon Fire and Environmental Health Departments for code violations. The inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully manned hazardous materials unit. All personnel are trained in hazardous material response. The proposed Existing regulations and permitting requirements will be adhered to by the facility and this compliance will reduce potential hazards to less than significant levels. If required, a Hazardous Materials Establishment Permit, as required of all facilities within the City, must be submitted to and approved by the City of Vernon Environmental Health and Fire Departments. A Hazardous Materials Establishment Permit shall include, but not be limited to, instruction and on-the-job training of employees to identify and handle hazardous materials and shall be conducted by an individual knowledgeable in hazardous materials management. These requirements are standard requirements of facilities located within the City of Vernon to regulate the handling and storage of hazardous materials involved in the everyday function of non- hazardous businesses. Therefore, this impact will be less than significant. e) increased fire hazard in areas with flammable brush, grass, or tees? ❑ ❑ ❑ ' X e. The proposed site is located in a completely built -out urbanized area that does not contain flammable grass, brush, or trees. X. NOISE. Would the proposal result in: a) increases in existing noise levels? ❑ ❑ ❑ X b) Exposure of people to severe noise levels? ❑ ❑ ❑ X a and b. The project is within an industrial area and the surrounding manufacturing and warehousing uses are not noise sensitive. Normal operations within the facility include trucks entering the facility, transferring freight and processing of scrap plastic. These operations are not expected to cause any significant noise impacts. XI. PUBLIC SERVICES. Would the proposal have an effect upon, or result in a need for new or altered government services in any of the following areas: a) Fire protection? p ❑ ❑ X b) Police protection? ❑ ❑ ❑ X c) Schools? ❑ ❑ ❑ X a through e. The project will be located in a highly industrialized and developed area. The project shall be required to maintain all materials on -site and prevent any off -site migration of trash or materials, unless hauled off by a refuse company. During operation, the site shall be maintained to prevent any impacts to the maintenance of public facilities. The proposed site is located in an area that is fully urbanized and served by an existing extensive electricity and gas infrastructure. The proposed site will be served by existing communication systems. The telephone, cable, and other communication systems are adequate and available to serve the proposed site.
