RESOLUTION NO. 7800
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN AMENDMENT TO THE WORKERS' COMPENSATION SELF-
INSURANCE SERVICE AGREEMENT BY AND BETWEEN THE CITY
OF VERNON AND COLEN AND LEE
WHEREAS, the City of Vernon is self -insured in its workers'
compensation program; and
WHEREAS, on August 21, 1990, the City Council of the City of
Vernon adopted Resolution No. 5791 approving a Workers' Compensation
Self -Insurance Service Agreement with Colen and Lee, Inc., the City's
administrator for the workers' compensation self-insurance program;
and
WHEREAS, since 1991, the City Council of the City of Vernon
has approved increasing the fees for subsequent fiscal years either by
formal amendment or minute order; and
WHEREAS, Colen and Lee, Inc. has requested an increase of
fees from Three Thousand One Hundred Fifty Dollars ($3,150) to Three
Thousand Four Hundred Dollars ($3,400) per month for the coming fiscal
year; and
WHEREAS, on June 25, 2001, the Finance Committee recommended
that the City Council approve the recommendation of Bruce V.
Malkenhorst, the Director of Finance, dated June 21, 2001, that the
fee increase be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
1 and correct.
2 SECTION 2:- The City Council of the City of Vernon hereby
3 approves the Amendment to Workers' Compensation Self -Insurance Service
4 Agreement with Colen and Lee, Inc., a copy of which is attached hereto
5 as Exhibit "A" and made a part hereof.
6 SECTION 3: The City Council of the City of Vernon hereby
7 authorizes the Mayor and the City Clerk to execute said Amendment for,
8 and on behalf of, the City of Vernon.
9 SECTION 4: The City Council of the City of Vernon hereby
10 directs the City Clerk, or his designee, to send one fully executed
11 Amendment to:
12 Colen and Lee, Inc.

15 SECTION 5: The City Clerk of the City of Vernon shall
16 certify to the passage of this resolution, and thereupon and
17 thereafter the same shall be in full force and effect.

AMENDMENT TO
WORKERS' COMPENSATION SELF-INSURANCE
SERVICE AGREEMENT
This AGREEMENT is entered into this day of
Between the CITY OF VERNON, hereinafter referred to as the "City," and
COLEN AND LEE, INC., hereinafter referred to as the "Administrator."

WHEREAS, the City and the Administrator entered into an Agreement,
hereinafter referred to as the "Original Agreement," on September 4, 1986 for
administration of the City's Workers' Compensation Self -Insurance Program;
WHEREAS, the City and the Administrator desire to extend and amend
the Original Agreement;
NOW, THEREFORE, in consideration of the mutual covenants herein
Contained, the City and Administrator do hereby extend and amend the Original
Agreement as follows:
1. CONSIDERATION: Section 12 of the original Agreement is hereby
amended to read: Effective July 1, 2001, the City shall pay the Administrator
$3,400.00 per month for ongoing services rendered under this Agreement. Once
a year thereafter, the Administrator may increase or decrease the service fee by
giving written notice of the change to the City at least sixty (60) days prior to
change.
2. ORIGINAL AGREEMENT: Except as specifically amended herein,
the terms and conditions of the Original Agreement shall remain in full force and
effect.
