RESOLUTION NO. 78.15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
LETTER AGREEMENT FOR SEXUAL HARASSMENT AND
DISCRIMINATION PREVENTION SEMINARS BY AND BETWEEN
THE CITY OF VERNON AND LAW FIRM OF ALBRIGHT, YEE &
SCHMIT, LLP
WHEREAS, on August 20, 1974, the City Council of the City of
Vernon adopted Resolution No. 4279 establishing a formal policy .
concerning non-discrimination in employment; and
WHEREAS, on April 6, 1993, the City Council of the City of
Vernon approved Resolution No. 6232, as amended by Resolution No. 7580
on July 26, 2000, adopting a City of Vernon Sexual Harassment Policy;
and
WHEREAS, the law firm of Albright, Yee & Schmit, LLP ("law
firm") specializes in personnel and labor issues; and
WHEREAS, the law firm is willing to provide by June 30,
2002, twelve (12) seminars at the Vernon City Hall for a fee of
Twenty -Two Thousand Dollars and No Cents ($22,000.00); and
WHEREAS, the seminars will benefit City employees and will
be in the public interest; and
WHEREAS, by letter dated August 16, 2001, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that the City
retain the services of the law firm; and
WHEREAS, the City of Vernon desires to enter into a Letter
Agreement with the law firm regarding legal services pertaining to
sexual harassment and discrimination prevention seminars.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
1 SECTION 1: -The City Council of the City of Vernon hereby
2 finds and determines that the recitals contained hereinabove are true
3 and correct.
4 SECTION 2: The City Council of the City of Vernon hereby
5 approves the Letter Agreement with Albright, Yee & Schmit, LLP, a copy
6 of which is attached hereto as Exhibit "A" and made a part hereof.
7 SECTION 3: The City Council of the City of Vernon hereby
8 authorizes the Mayor and the City Clerk to execute said Letter
9 Agreement for, and on behalf of, the City of Vernon.
10 SECTION 4: The City Council of the City of Vernon hereby
11 directs the City Clerk, or his designee, to send one fully executed
12 Letter Agreement to:

16 SECTION 5: The City Clerk of the City of Vernon shall
17 certify to the passage of this resolution, and thereupon and
18 thereafter the same shall be in full force and effect.

Dear Bruce:
This letter follows my August 13, 2001 conversation with Mr. Chris Romero. Albright,
Yee & Schmit, LLP will provide the City of Vernon twelve (12) seminars, each designed to train
approximately 20-25 of your employees. Each seminar will run approximately three hours and
will be presented by a minimum of two persons, including one attorney, from Albright, Yee &
Schmit, LLP. Each seminar will provide appropriate training on the issues relating to
discrimination based on protected categories, including gender, race and sexual orientation, age,
disability and sexual harassment. We will provide the City of Vernon with attendance sheets for
your office's verification purposes.
The twelve (12) seminars will be conducted at the City of Vernon's facility. Precise
scheduling of the seminars will be determined at a later date, but all seminars will be presented by
June 30, 2002. The cost to the City of Vernon for training will be $22,000.00.
Please acknowledge the City of Vernon's acceptance of this Agreement by executing the
enclosed copy where indicated below.
