Resolution No. 78171 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7817 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FINDING THE CITY OF VERNON TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AS ESTABLISHED BY THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY WHEREAS, the Los Angeles County Metropolitan Transportation Authority ("MTA") acting as the Congestion Management Agency for Los Angeles County, adopted the 1997 Congestion Management Program ("CMP") on November 20, 1997; and WHEREAS, the CMP requires that MTA determine that the County and cities within the County conform to all CMP requirements on an annual basis; and WHEREAS, the CMP requires submittal to the MTA of the annual CMP Local Implementation Report by September 1, 2001; and WHEREAS, the City Council of the City of Vernon held a noticed public hearing on August 22, 2001, at which time all interested persons were given an opportunity to be heard; and WHEREAS, the City Council has heard and considered all evidence, both written and oral, presented respecting Vernon's conformance with the criteria in the Congestion Management Program as established by the Los Angeles County Metropolitan Transportation Authority. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. 1 F OCI 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 2: The City Council finds and determines that the City of Vernon has taken all of the following actions, and is in conformance with all applicable statutory requirements of the 1997 CMP. A. The City of Vernon has adopted and continues to implement a transportation demand management ordinance, consistent with the minimum statutory requirements identified in the CMP Chapter on the Transportation Demand Management Element. B. The City of Vernon has adopted and continues to implement a land use analysis program consistent with the minimum statutory requirements identified in the CMP Chapter on the Land Use Analysis Program. C. The City of Vernon has adopted a Local Implementation Report ("LIR"), attached hereto as Exhibit "A" and made a part hereof by reference, consistent with the requirements identified in the CMP. This report balances traffic congestion impacts due to growth within the City with transportation improvements, and demonstrates that the City is meeting its responsibilities under the Countywide Deficiency Plan. D. Since June 1, 1994, the City of Vernon has been tracking new development activity, consistent with the requirements identified in the CMP. This information will be annually tabulated, as the basis for determining mitigation measures, which the City of Vernon may implement if necessary under the Countywide Deficiency Plan. Staff Report The City Attorney's office will prepare the resolution SKW: sc Enclosure xc: City Attorney STAFF REPORT CONGESTION MANAGEMENT PROGRAM 2001 CONFORMANCE REPORT August 13, 2001 The Vernon City Council approved Ordinance No. 1015 adopting a trip reduction and travel demand program in order to implement the Congestion Management Program ("CMP") of the County of Los Angeles. The County Program was designed to alleviate traffic congestion caused by potential increases in growth. As required by the program, each city must self certify that it is in conformance with all elements of the CMP. Failure to comply with the requirements of the program could result in the loss of state funding for transportation projects. The program establishes a points system. In order to be in compliance a municipality must maintain a positive number of points. A City can gain points by implementing congestion relieving strategies. The three strategy categories are: 1. Land Use Strategies; 2. Capital Improvements and Transportation System Management (TSM) ; and 3. Transportation Demand Management and Transit Services. A City is credited points for structures that are demolished. Points from the "Toolbox Strategies" vary depending on the amount of congestion that each project relieves. A City is debited points for each structure constructed. The City of Vernon ("The City") carried over a total of 58,947 points from the previous year. The City was found to be in compliance last year. During this past reporting year, approximately 581,208 square feet of industrial building space was constructed and 646,525 square feet of industrial building space was demolished in the city. These totals are used to calculate the credits/debits the City may have incurred. By adding the total credits calculated in the New Development Activity Worksheet to the debits in the New Development Adjustments Worksheet the City shows a balance of 160 CMP credits. Additional credits are requested through Strategy 321, as defined in the 1997 Congestion Management Program for Los Angeles County. The Strategy allows cities that have adopted CMP Transportation Demand Management requirements through an ordinance, to claim CMP credits for new non-residential development. With this strategy the City is requesting an additional 175 CMP credits. By adding the development credit with the strategy 321 credits the City earned 335 credits during the reporting period.
