Resolution No. 78461 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 WE RESOLUTION NO. 7846 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO EXXON MOBIL CORPORATION FOR THE OPERATION OF A PETROLEUM RELATED USE LOCATED AT 2709 EAST 37TH STREET IN CITY OF VERNON WHEREAS, Exxon Mobil has applied for a conditional use permit to operate a petroleum related use at 2709 East 37th Street; and WHEREAS, the City Council of the City of Vernon held a hearing Ion said application for a conditional use permit on October 17, 2001; and WHEREAS, Exxon Mobil is proposing to expand its use by installing a 50,000-barrel internal floating roof tank for storage of unleaded gasoline and therefore a conditional use permit is required to expand a petroleum related use facility pursuant to Zoning Ordinance Section 26.3.5-3 (d); and WHEREAS, the proposed tank will occupy approximately .034 acres on 'a 34-acre parcel. The size, shape and topography of the parcel is adequate for the proposed operation; and WHEREAS, the proposed site is surrounded by industrial distribution type uses compatible with the proposed use and no adverse effect from traffic, parking, noise, odors, smoke, light or glare, or risk of fire, infection, or effects on wildlife resources are anticipated from the proposed operation; and WHEREAS, the Community Services Department has performed an Initial Study to determine the potential adverse impacts to the environment that the proposed project may cause and has determined that the proposed project will not have a significant effect on the environment in this case because of required mitigating measures. The streets and highways surrounding the proposed use have adequate in width and are improved as necessary to carry the traffic expected by this proposed operation; and WHEREAS, the proposed use as to location, operation, and design is consistent with the General Plan and the Zoning Ordinance of the City of Vernon; and WHEREAS, the City of Vernon has provided notice of its intent to adopt a Mitigated Negative Declaration for the proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, the mitigating measures and the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the project will require an initial study to determine any environmental impacts as required by the California E 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Environmental Quality Act CEQA; and WHEREAS, the City Council has received a Staff Report dated October 10, 2001 upon which it has relied on making the foregoing recitals. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The -City Council of the City of Vernon hereby finds and determines that the recitals contained herein -above are true and correct. SECTION 2: Subject to the mitigation measures and conditions set forth below, the conditional use permit is hereby granted to Exxon Mobil for the operation of a Petroleum Related use located at 2709 East 37th Street in the City of Vernon. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to.conform with all current codes, rules, and regulations and subject to permit fees and taxes adopted by the City of Vernon. b. Any hazardous substances used, handled or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained from the Vernon Health Department if there are reportable quantities of hazardous materials on the site. C. Servicing of vehicles.including washing, steam cleaning and repairing shall not be performed on -site. d. All storage operations shall take place within the proposed site. No equipment or materials shall be 3 1 placed or stored outside. Adequate written plans and 2 materials must be available for cleaning up of leaks or 3 spills of petroleum gasoline or other substances 4 associated with Exxon Mobil Oil operation. 5 e. Broken or cracked sidewalk, curb, gutter or driveway in 6 37th Street adjacent to the site shall be repaired as 7 directed by the Director of Community Services and 8 Water. 9 f. Exxon Mobil shall obtain all required federal, state, 10 local and regulatory agency permits prior to operation. 11 Prior to occupancy a business license and occupancy 12 permit shall be obtained. 13 g. All parking and loading facilities shall remain paved 14 with a hard durable surface material in good repair and 15 shall remain adequately drained, and kept free of dust, 16 mud, trash and weeds. Where parking or maneuvering 17 areas adjoin the public street a barrier wall or 18 landscaping shall be installed and maintained to meet 19 City standards. Adequate on -site parking shall be 20 maintained so that off-street parking will not occur. 21 h. The facility shall be operated in such a manner that 22 noise and vibration shall not be a nuisance to 23 neighborhood properties. At no time shall noise exceed 24 65db or vibration exceeds four hundredths of an inch 25 per second particle velocity when measured at the 26 property line. 27 i. Plans for improvements to the facility and construction 28 1 of structures shall be submitted to both the Department 2 of Community Services and Health Department of the City 3 of Vernon for review and approval. 4 j. The facility's building shall be structurally 5 maintained to exclude rodents and the property shall be 6 maintained rodent free. 7 k. The facility shall be operated in a manner that will 8 prevent unsanitary conditions, odors or other 9 nuisances. 10 1. Exxon Mobil shall perform the mitigating measures set 11 forth herein. 12 SECTION 4: In order to adequately protect the public 13 health, safety and general welfare the following mitigating measures 14 are required: 15 A. Exxon Mobil shall complete the Health Risk Assessment 16 required by the Vernon Health Department to determine 17 the potential health impacts from any soil 18 contamination on the subject site. The Risk Assessment 19 shall be completed by Exxon Mobil and submitted to the 20 Health Department within two years of the date this 21 conditional use permit is approved. Upon the Health 22 Departments approval of the Health Risk Assessment, any 23 necessary remediation activities as determined by the 24 Health Department, shall be performed by Exxon Mobil in 25 accordance with the time schedule provided by the 26 Health Department. 27 B. Exxon Mobil shall install and maintain devices to 28 detect leaks and spills, shall contract a berm or 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 containment area to retain any spills, shall post signs indicating procedures for spill reporting, and shall maintain an approved spill prevention and response plan. C. Exxon Mobil shall maintain on -site fire -fighting materials used specifically for hydrocarbon fires in a quantity and location specified by the Fire Chief. Exxon Mobil shall design a fire protection system in accordance with the U.F.C. Standard 79-1 and provide and maintain two Mobil fire monitors stored on -site. Exxon Mobil shall provide fire -fighting personnel to perform technical assistance from the Torrance facility when requested by the Vernon Fire Department. D. Exxon Mobil shall have all existing aboveground tanks containing diesel and gasoline fuels inspected according to South Coast Air Quality Management District ("SCAQMD") standards (Rule 463) by certified inspector twice annually, and shall be maintained in accordance with state and federal laws and the latest A.P.I. standards. E. Exxon Mobil shall obtain all permits from the South Coast Air Quality Management District ("SCAQMD") prior to operating the facility. Exxon Mobil shall maintain an NPDES Permit with the State Water Resources Control Board, unless otherwise exempted. SECTION 5: Noncompliance with the conditions set forth in the conditional use permit shall be grounds for voiding the permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning Ordinance. 301 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 6: Exxon Mobil and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the gross negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to Participate in the defense of any such action SECTION 7: Not later than sixty (60) days from the date of this Resolution, Exxon Mobil shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 6 of the Resolution. SECTION 8: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. WITNESS my hand and of cial seal CITY OF VERNON COMMUNITY SERVICES DEPARTMENT STAFF REPORT ON EXXON MOBIL CONDITIONAL USE PERMIT FOR THE OPERATION OF A PETROLEUM RELATED USE AT 2709 EAST 37TH STREET October 10, 2001 Exxon Mobil has submitted an application for a conditional use permit to expand its operation by constructing a new 50,000- barrel (nominal) internal floating roof tank for storage of unleaded gasoline located at 2709 East 37th Street. Currently Exxon Mobil has both blending and storage operations at their site. The proposed expansion will primarily involve Exxon Mobil's storage distribution operations. 1. GENERAL PLAN The proposed use is consistent with the Zoning Ordinance and General Plan. The site is located in the (M) Zone, General Industrial. In accordance with section 26.3.5-3 (d) of the Comprehensive Zoning Ordinance, Exxon Mobil is categorized as a "petroleum -related use and/or uses primarily engaged in the storage of petroleum products". A petroleum storage facility is defined as an establishment including a tank farm for keeping and storing gasoline, kerosene, distillate fuel oils, residual fuel oils, lubricants, and other petroleum products, but not including storage ancillary to an industrial use such as fuel on the premises or storage as part of a hazardous waste treatment facility. A petroleum storage facility use is an allowed use in the (M)-Zone with the approval of a conditional use permit. Exxon 1 Staff Report.wpd f Mobil intends to use the new tank for storage of unleaded gasoline, which will provide alternate storage capacity to allow for themaintenanceand inspection of their existing tanks under the recommended American Petroleum Institute (API) 653 Inspection program. 2. SITE The applicant has not proposed any changes to the size, shape or topography of the existing site. The proposed tank will occupy approximately .034 acres on a 34-acre parcel. The site plans for the proposed use indicates the site is adequate in size, shape, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA) which identifies potentially significant impacts on the environment from the project, but revisions in the project plans or proposals made by or agreed to by the applicant will avoid the effects or mitigate the effects to a point where clearly no significant effect will occur. The Director of Community Services & Water has recommended that a Notice of Intent be filed, and a Negative Declaration be adopted in compliance with the California Environmental Quality Act ("CEQA"). ACCESS The proposed site has sufficient access to streets and highways surrounding the proposed use, and are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. The subject site is served by 37th Street, a collector roadway with a right-of-way of 100 feet. 5. VEHICLE MOVEMENTS On -site and off -site traffic routing is provided by entrance and gates onto Jewel Street. Trucks leaving the facility would travel along East 37TH Street/Bandini Boulevard or Soto Street in order to reach either I-5 (Santa Ana) or I-710 (Long Beach) freeways. Traffic volumes for East 37th Street at. Jewel Street are approximately 8,000 to 10,000 vehicles per day with a level of service (LOS) "A" for both a.m. and p.m. peak hours. The proposed project would add two trips per hour to the existing vehicle movement. Consequently there would be little increase in traffic. Peak hours for this facility are between 7:00 to 9:00 a.m. and 4:00 to 6:00 p.m., which accounts for 700 of daily activity from Monday through Friday. 6. OPERATIONS Exxon Mobil proposes to construct a new 50,000-barrel capacity aboveground storage tank for gasoline storage. The tank will be approximately 95 feet in diameter and 48 feet tall; conventional cone roof (fixed steel roof with Staff Report.wpd 3 ventilation at the top and roof eaves) construction, with an internal aluminum pontoon type floating roof for vapor conservation. The tank will be located 50 feet from the nearest property line, and approximately 100 feet from the nearest tank in the facility. The new tank will provide alternate storage capacity to allow for the maintenance and inspection of their existing tanks under the recommended American Petroleum Institute (API) 653 Inspection Program. The tank will be constructed per API-RP650 standards. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. As the attached site plan shows, the site is designed to allow ample room to maneuver trucks. The new tank would be located adjacent to existing tanks and would not interfere with the maneuvering of trucks. Drainage would be routed around the tank area. B) The proposed use will not have an adverse effect upon adjacent or abutting properties in terms of traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion. The new tank would be entirely contained within Mobil's existing terminal. The use is consistent with the terminal, and with the industrial nature of the adjacent development. Mobil Oil Corporation has worked with the Vernon Fire Department to ensure that the facility is designed to meet the latest requirements of the appropriate agencies. The new tank will be monitored with state-of-the-art equipment to provide a clean and safe installation. C) The proposed use will be compatible with the permitted uses of surrounding and adjacent properties. The proposed project setting is located within a regional area of industrial use. The surrounding and adjacent properties are similar in nature to the project property. The facility already maintains a number of tanks, the proposed addition of another tank would not be incompatible with the current land use. With regard to upset and accident situations, the potential impact of the new tank would similar to the potential impact that is currently possible with the largest existing storage tank (Tank #4). Adjacent tanks are of similar size and located in the same general area. The severity of potential fires or explosions due to a failure of either tank would extend out to about the same distance from each tank. Fire suppression measures that currently exist at the facility would be expanded to accommodate the new storage capacity. The new fire suppression systems would include a foam tank with pump that feeds the hydrants for the dike area and also includes a foam feed line to the top of the tank. Foam capacity would be sized to accommodate the area of the dikes and would be regularly maintained. In addition, Vernon Fire Station #3 would be provided with a deck mounted fire monitor for their Fire Engine and a mobile fire monitor would be located at the terminal. Mobil's Torrance Refinery Fire Department and the Vernon Fire Department would initiate interactive training with each other. There are currently eight tanks at the Vernon Terminal: two tanks are used for the storage of premium unleaded gasoline, two tanks are used for diesel, and four tanks are used for regular unleaded gasoline. Trucks leaving the facility would travel along East 37"' Street/Bandini Boulevard or Soto Street in order to reach either 1-5 (Santa Ana) or 1-710 (Long Beach) freeways. Traffic volumes for East 37th Street at Jewel Street are approximately 8,000 to 10,000 vehicles per day with a level of service (LOS) A for both A.M. and P.M. hours. The proposed project would add two trips per hour to the existing vehicle movement. Consequently there would be tittle increase in traffic. Peak hours for this facility are between 7:00 to 9:00 A.M. and 4:00 to 6:00 P.M., which accounts for 70% of daily activity from Monday to Friday. Operations Report The Vernon facility is a wholesale plant facility distributing motor vehicle fuels (gasoline and diesel). Products are received by pipeline and stored in tanks. Tank trucks are loaded through a controlled automated loading rack, operated by a vehicle driver. Access to the loading rack is limited to authorized personnel. Equipment installed in the loading rack and on the tank trucks is designed to shut-off the flow of product should a possible overfill occur. The applicant, Mobil Oil Corporation, proposes to construct a 50,000-barrel floating roof tank for the storage of unleaded gasoline. The tank would be constructed adjacent to existing tanks #11 and #12 (see attached plot plan). The new tank would provide increased capacity to allow for the required maintenance and inspection of their existing tanks under the recommended American Petroleum Institute 650 Inspection Program. The terminal is open 24 hours a day, 7 days a week, 365 days a year. The drivers make up the bulk of the work force. During the week, drivers work either 4 shifts of 10 hours, 5 shifts of 10 hours, or 6 days on and 3 days off depending on which supervisor they work for. The shifts are equally split between day and night. Due to rack restrictions they begin loading from 2 A.M. until 6 A.M. and from 2 P.M. until 6 P.M. The number and distance of their loads determines how often they return to the Vernon Terminal during their shift.
